Question to the Home Office:

To ask the Secretary of State for the Home Department, whether her Department has published guidance on the compatibility of section 59 of the Anti-social Behaviour, Crime and Policing Act 2014 with the Equality Act 2010.

We provided the police, local authorities and other local agencies with a range of flexible tools and powers that they can use to respond quickly and effectively to ASB through the Anti-social Behaviour, Crime and Policing Act 2014 (the ‘2014 Act’).

The statutory guidance makes clear on page 26 that any use of the powers in the 2014 Act must be compliant with the Equality Act 2010. The statutory guidance, under the s.59 Public Spaces Protection Order (PSPO) chapter, also mentions that the Equality Act 2010 is complied with when proposing PSPOs with dog walking restrictions that would affect those who rely on assistance dogs.

No separate guidance has been published on the compatibility of section 59 of the 2014 Act with the Equality Act 2010.
