Question to the Department of Health and Social Care:

To ask the Secretary of State for Health and Social Care, if he will implement the recommendations on regulatory levers for heated tobacco products set out in the Public Health England report on e-cigarettes and heated tobacco products, published on 6 February 2018.

The basis of the regulatory regime in the United Kingdom in relation of tobacco products and e-cigarettes is the Tobacco Products Directive (2014/40/EU). This includes relevant provisions on heat not burn. The UK will consider any future opportunities to amend the regulatory regime once the outcome of Brexit negotiations is clear. Until exit negotiations are concluded, the UK remains a full member of the European Union and all the rights and obligations of EU membership remain in force.
