Question to the Ministry of Justice:

To ask the Secretary of State for Justice, what estimate he has made of the number of disabled people living in poverty who are not eligible for legal aid.

It is not possible to answer these questions. This is because eligibility for legal aid is determined by the applicant’s financial means as well as the merits and circumstances of their case.

Legal aid eligibility is a crucial way in which the government protects the legal aid fund for those who need it most while balancing this with cost to the taxpayer. As announced by the Lord Chancellor, we are conducting a review of legal aid reforms and plan to take this opportunity to inform wider consideration on the future of legal support in the justice system.
