Question to the Home Office:

To ask the Secretary of State for the Home Department, whether existing family members of UK nationals resident in the EU will be entitled to residency in the UK after December 2020.

Although not covered by the draft Withdrawal Agreement on citizens’ rights, as a matter of domestic policy, where family members of UK nationals who have exercised their Treaty rights in another EU Member State are lawfully resident in the UK under regulation 9 of the 2016 Regulations by 31 December 2020, it is our intention that they will be eligible to apply for status under the EU Settlement Scheme.

Those who arrive in the UK after 31 December 2020 will be subject to the future immigration arrangements which are yet to be decided.
