Question to the Department for Education:

To ask the Secretary of State for Education, whether she has made an assessment of the potential impact of trends in the number of local authority section 114 notices on the (a) availability and (b) quality of provision for children with SEND in (i) affected local authority areas and (ii) more broadly.

Councils are responsible for their own finances and the decision to issue a Section 114 notice is one taken locally.

Whilst the department has not made a formal assessment of the impact of Section 114 notices on the availability and quality of provision for children and young people with Special Educational Needs and Disabilities (SEND), it is important to note that where a notice is issued, the performance of statutory functions, including statutory functions relating to SEND provision must continue, and that local services can be improved by the intervention and support that follows.
