Question to the Home Office:

To ask the Secretary of State for the Home Department, what forecast she has made of the likely proportion of extraditions sought from the UK under a European Arrest Warrant of (a) British nationals and (b) other persons that will be barred under (i) section 12A and (ii) the proportionality test in section 21A of the Extradition Act 2003 as amended, in each of the next three years.

Between the date on which the Government's reforms to the Arrest Warrant came into force (21 July 2014) and 31 October 2014, the National Crime Agency (NCA) refused to certify 21 Arrest Warrants on proportionality grounds. In addition to this, the courts have discharged one case on the basis of the new proportionality test in section 21A of the 2003 Act.

No Arrest Warrants have been discharged by the courts on charge and try grounds in this three-month period, but we expect that position will change as the legislation now provides for a UK judge to refuse extradition where issuing State is not trial-ready.
