Question to the Home Office:

To ask the Secretary of State for the Home Department, if she will take into account the implications for UK citizens with non-EEA partners of the effect of periods of maternity leave on the ability of those citizens to meet the income threshold in her decisions on immigration cases.

Paragraphs 13(i) and 16 of Appendix FM-SE to the Immigration Rules ensure that a person is not disadvantaged by a period of maternity leave in meeting the minimum income threshold to sponsor a non-EEA partner to come to or remain in the UK.
