To ask the Secretary of State for the Home Department, if he will make an assessment of the potential impact of the Policing Productivity review on levels of theft from shops.

The Government recognises the impact shoplifting has on businesses and communities. The Crime Survey for England and Wales shows neighbourhood crime is down 48% compared to findings from 2010; however, Police Recorded Crime figures show shoplifting offences increased by 32% in the 12 months to September 2023. Statistics also show the number of people charged with shoplifting has risen by 34%, showing the police are acting.

We have recently taken significant steps to improve the police response to retail crime, including shoplifting. In October 2023, the National Police Chiefs’ Council (NPCC) published the Retail Crime Action Plan. All forces across England and Wales have committed to prioritise police attendance at the scene where violence has been used towards shop staff, where an offender has been detained by store security, and where evidence needs to be secured and can only be done by police personnel. Additionally, where CCTV or other digital images are secured, police will run this through the Police National Database to aid efforts to identify offenders. This builds on the NPCC commitment that police will follow up on all reasonable lines of enquiry.

The Government published an enhanced Action Plan, "Fighting Retail Crime: More action" on 10 April. This Plan highlights key areas of work to tackle retail crime, including introduction of a new standalone office for assaults on retail workers; additional electronic monitoring for prolific shoplifters; and increasing use of facial recognition technology.

The Policing Productivity Review was published on 20 November 2023, which concludes there is the potential to free up around 38 million hours of police time per year within five years. This equates to over 20,000 police officers. The Government is working with policing to consider its recommendations, freeing up police officers’ time which can be reprioritised to enable officers to spend more time fighting crime on the front line, in line with local priorities set by Police and Crime Commissioners. This additional police time could be used to support delivery of the Retail Crime Action Plan. Evaluation on the impact of the Policing Productivity Review will be part of the remit of the new Centre for Police Productivity which was announced at the Spring Budget 2024.

We are continuing to work closely with the retail sector, security representatives, trade associations and policing through the National Retail Crime Steering Group (NRCSG), which meets on a quarterly basis, to ensure the response to retail crime, including shoplifting, is as robust as it can be.

To ask the Secretary of State for Justice, what assessment his Department has made of the potential impact of section 156 (2) of the Police, Crime Sentencing and Courts Act 2022 on levels of attacks on workers undertaking public-facing roles.

Section 156 (2) of the Police, Crime, Sentencing and Courts Act 2022 introduced a new statutory aggravating factor for certain assault offences where they are committed against a person providing a public service, performing a public duty, or providing services to the public. The Government introduced this to ensure that the public-facing nature of a victim's role would be considered, allowing the court to give a longer sentence within the statutory maximum for the offence.

The Ministry of Justice does not collect or publish data on the use of aggravating factors. Currently, there is no specific offence for an attack against a worker undertaking a public-facing role. As assault of a worker in a public-facing role is not a specific offence, we are unable to assess the trends relating to assaults on public-facing workers specifically.

The Government recognises the seriousness of assaults on workers undertaking public-facing roles and is clear that we must adopt a zero-tolerance approach to assault against those who serve the public. This is why in April 2024, the Government published ‘Fighting Retail Crime: more action’, within which the Government announced plans to introduce a new offence of assault against a shop worker, building on the operational policing commitments in the police-led Retail Crime Action Plan published in October 2023.

To ask the Secretary of State for the Home Department, when he plans to introduce legislation protecting shopworkers from serial or abusive shoplifters.

The Government’s plan – "Fighting retail crime: more action" was launched on 10 April, and includes a new standalone offence for assaults on retail workers and electronic monitoring for prolific shoplifters. This builds on the police-led Retail Crime Action Plan, launched in October 2023.

We will legislate through the Criminal Justice Bill, currently before Parliament, to introduce a presumption towards electronic monitoring as part of a sentence served in the community for those who repeatedly steal from shops.

The new bespoke offence of assaulting a retail worker will also be introduced via the Criminal Justice Bill. The offence will have a maximum penalty of six months in prison, or an unlimited fine – and upon conviction, it is expected that courts will make a Criminal Behaviour Order, which could bar offenders from visiting affected shops or premises. Breaching a Criminal Behaviour Order is a criminal offence and carries a five-year maximum prison sentence.

Those who repeatedly assault retail workers will be electronically monitored after their third offence, to crack down on reoffending and ensure those continuing down a path of violent behaviour will be met with further consequences. For the most serious violent offenders of assault, custodial sentences of up to five years in prison are already available.

October also saw the launch of Pegasus, a unique private-public partnership, which involves retailers providing data, intelligence and evidence to Opal, the national police intelligence unit on organised acquisitive crime, to develop a better strategic picture and help forces crack down on serious offenders.

The Government’s plan – "Fighting retail crime: more action" was launched on 10 April, which highlights five areas of work this Government will drive forward to tackle retail crime:

  • Introducing a standalone offence for assaults on retail workers;
  • Additional electronic monitoring for prolific shoplifters;
  • Working with police and businesses to roll out the latest facial recognition to catch these perpetrators;
  • Championing good practice to design out crime; and
  • Making it easier for retailers to report crime.

The UK Government continues to work closely with retail businesses, security representatives, trade associations and policing through the National Retail Crime Steering Group (NRCSG) to ensure the response to crimes, such as shoplifting, is as robust as it can be.

Police Recorded Crime figures show shoplifting offences increased by 32% in the 12 months leading to September 2023 in Wales and England. However, the number of people charged with shoplifting offences in the same period rose by 34%, suggesting that we are now seeing a more robust response.

We have also taken other significant steps to improve the police response to retail crime.

October 2023 saw the publication of the National Police Chiefs’ Council’s Retail Crime Action Plan. The plan includes a commitment to prioritise police attendance at the scene where violence has been used towards shop staff, where an offender has been detained by store security, and where evidence needs to be secured and can only be done by police personnel, showing the Government commitment to tackling this issue. Additionally, where CCTV or other digital images are secured, police will run this through the Police National Database as standard using facial recognition technology to further aid efforts to identify prolific offenders or potentially dangerous individuals.

In addition, October 2023 also saw the launch of Pegasus, a unique private-public partnership that will radically improve the way retailers are able to share intelligence with policing to better understand the tactics used by organised retail crime gangs and identify more offenders. This will include development of a new information-sharing platform and training for retailers.

We have recently taken significant steps to improve the police response to acquisitive crime, including car theft and shoplifting. The National Police Chiefs’ Council has made a commitment that police forces across England and Wales will follow up all crimes where there is actionable evidence and the chance of identifying an offender. His Majesty’s Inspectorate of Constabulary and Fire & Rescue Services (HMICFRS) have commenced a thematic inspection on the effectiveness of police investigations which will include an assessment of how police forces are implementing the reasonable lines of enquiry commitment.

The Government is working closely with police and motor manufacturers through the National Vehicle Crime Working Group, chaired by ACC Jennifer Sims, the National Police Chiefs’ Council lead for vehicle crime, to take forward a programme of work to prevent and reduce vehicle crime nationally. A network of vehicle crime leads has been established in every police force in England and Wales, ensuring forces share information about emerging trends in vehicle crime and are better able to tackle regional issues. The Metropolitan Police Service are represented on the Working Group and have an established vehicle crime lead.

We are legislating through the Criminal Justice Bill to create two new offences where a person possesses, makes, adapts, supplies or offers to supply electronic devices where there are reasonable grounds to suspect they will be used in vehicle theft. The legislation will make it easier for police to prosecute criminals making and supplying these devices, as well as vehicle thieves.

The Government recognises the significant impact shoplifting and violence towards shopworkers has on businesses, communities, and consumers, as well as the loss to the economy. The Government has been clear we expect a zero-tolerance approach to retail crime and shoplifting.

It’s difficult to produce reliable estimates of the cost of shoplifting. Many incidents do not come to the attention of the police, so data on the number of shoplifting crimes recorded by them only provide a partial picture. While official statistics from the Commercial Victimisation Survey (CVS) provide reliable estimates of the prevalence and frequency of shoplifting, the CVS no longer collects data the number of shoplifting offences or the overall cost of these crimes. When the CVS has collected this information in the past, retailers found it difficult to recall precise numbers of crimes they experienced, and the associated costs. As a result, these estimates we judged to be insufficiently reliable.

Home Office ministers have not met Retail Against Crime. The National Retail Crime Steering Group (NRCSG), which the Minister for Crime, Policing and Fire, the Rt Hon Chris Philp, co-chairs alongside the British Retail Consortium, ensures the response to retail crime is as robust as it can be. The NRCSG meets quarterly and comprises senior representatives from policing, the retail sector, retail trade associations, security providers and Government departments.

At this forum, the Retail Crime Action Plan is a standing agenda item. At the last NRCSG, policing colleagues updated me on the implementation of the plan. Statistics published by the National Police Chiefs’ Council show early signs of progress. A dip-sample of data from 31 police forces of over 1,500 crimes show police attended 60% of incidents reported by retailers where violence had been used, with 16% of forces sampled reporting 100% attendance to this type of incident.

The Government is supporting Pegasus, a unique private-public partnership, which involves retailers providing data, intelligence and evidence to Opal, the national police intelligence unit on organised acquisitive crime, to develop a better strategic picture and help forces crack down on serious offenders.

The Home Office will continue to work with members of the NRCSG, including policing and retailers to tackle shoplifting, including organised, as well as other crime experienced within retail settings through our wider work.

The publication of the National Police Chiefs’ Council’s Retail Crime Action Plan, published in October 2023, includes a commitment to prioritise police attendance at the scene where violence has been used towards shop staff, where an offender has been detained by store security, and where evidence needs to be secured and can only be done by police personnel.

Additionally, where CCTV or other digital images are secured, police will run this through the Police National Database as standard using facial recognition technology to further aid efforts to identify prolific offenders or potentially dangerous individuals.

The plan also includes guidance for retailers on what response they can expect from their local police, as well as how retailers can assist the police by providing evidence to help ensure cases are followed-up.

The Sentencing Code is a consolidation of existing sentencing procedure law. It brings together over 50 pieces of primary legislation relating to sentencing procedure into one single piece of legislation, in the Sentencing Act 2020. It includes general provisions relating to sentencing procedure, the different types of sentences available to the courts, and certain behaviour orders that can be imposed in addition to a sentence. Since the Sentencing Act came into force, it has been amended following changes to the law relating to sentencing procedure. The Code is not designed, however, to apply to specific offences.
