I have had regular discussions with the Secretary of State at the Department for International Trade and, indeed, other Cabinet colleagues on the issue of food standards in the context of our negotiations with Australia. The UK has a prohibition on the sale of beef treated with hormones, and the agreement recognises our right to regulate in this way.

The Secretary of State will be aware that environmental, animal welfare and farming groups have all expressed their concern about both the small print in the deal and the precedent that it sets. The Minister knows that trust is in very short supply, and that deals have a habit of unravelling, as we have seen very clearly in recent months.

Can the Minister give us a date by which the Trade and Agriculture Commission will be fully operational, and the date on which the analysis of this deal will be published?

The Secretary of State for International Trade will, I think, be giving a statement later. The Government have now published the key components of the agreement in principle, and some analysis of the impacts of this agreement has already been cited. Australia is a very important partner of ours, and it is important that we get a trade agreement with it. It is, of course, a smaller economy and the opportunities are therefore not as large as they would be with a larger economy, but nevertheless, Australia is an important ally and this is a good agreement between us.

I hardly need to explain to the Secretary of State the level of disbelief and anger that there is as the betrayal of British farming unfolds this week. The level of detail is unclear, but The Daily Telegraph helpfully reports a major win for the Secretary of State for International Trade—doubtless briefed by her. The key losers in this situation are British farmers. Given that we now know that there is going to be a huge increase in the amount of beef and lamb coming in from Australia—produced to lower standards at lower cost, disadvantaging our farmers—will the Secretary of State tell the House what he is going to do to help our farmers meet that challenge?

We secured some important mitigations to help the farming industry, including the fact that a tariff rate quota will stay in place for the first 10 years on both beef and sheep, and for the subsequent five years there will be a special agricultural safeguard that means that if volumes go above a certain trigger, tariffs immediately snap back in. We have put in place mitigations through the quota for the first 10 years and through that safeguard.

Farm incomes are heavily influenced by exchange rates, and in the aftermath of the 2016 referendum there was an immediate boost to farm profitability and that has remained the case since. For the first time in 50 years, we are also free to create an independent agriculture policy that works for our own farmers. Our future agriculture policy will support farmers to farm sustainably, to make space for nature in the farmed landscape, and to improve their profitability.

I thank the most excellent Secretary of State for that response. Is he as fed up as I am with doom and gloom from those on the Opposition Benches when our farmers do such a good job? Coming out of the EU allows them to turbocharge their exports. Get rid of that lot and concentrate on the good stuff that we are doing.

We will be announcing plans to increase the support that we offer to exporters, and there are important opportunities for our goods in some of the Asian markets.

As part of the agreement with Australia, we secured a special agricultural safeguard, which has a strict automatic volume trigger. It means that for the first 10 years, Australian beef and lamb will be subject to a tariff rate quota, and for the subsequent five years it will be subject to a special agricultural safeguard with a volume trigger.

This particular Opposition Member has no doubt about the world-class nature of our crofting and farming sector and our food production throughout the UK. However, I am aware of the concerns expressed by those sectors about the lack of consultation with the trade bodies and with Parliament before this deal was announced. What can the Secretary of State do to reassure these industries that a dangerous precedent is not being set and we are not going to see a lack of consultation repeated with trade deals, however important they might be, in future?

The Department for International Trade has a number of groups, including one covering agri-food, that discuss the approach to trade deals and help the Department to identify priorities. Necessarily, when in the final stages of a negotiation, the mandate the Government have is kept confidential, otherwise it would undermine our negotiating position, but we do share as much as we are able to with stakeholders, including the National Farmers Union.

Will the Secretary of State confirm that there is tariff-free access for Australian farmers from day one up to a meaningless cap 60 times current levels of imported beef, and the same applies to lamb up to a cap three times current import levels? Does that not render promises of a 15-year protection period absolutely redundant, and can we expect the same so-called protections in future trade deals?

We have to look at this in the context of the fact that at the moment Australia does not sell us any of these goods because, in the case of beef, it has a minuscule tariff rate quota of only about 1,400 tonnes. We also have to look at it in the context of the fact that we already have a TRQ with New Zealand that is over 100,000 tonnes, and New Zealand does not fill that quota.

Today is Clean Air Day. The recent coroner’s inquest into the tragic death of Ella Kissi-Debrah highlighted the importance of making progress on delivering clean air. The Government are working on a new targets framework for air quality and a range of policies to improve air quality, and in particular to reduce particulate matter. We will also do more to raise awareness of the risks of air quality in our urban areas.

In 2007 there were major floods in Sheffield, which not only affected homes but destroyed large parts of industrial areas, including Meadowhall shopping centre, Forgemasters and other industries. A great deal of work has been done on flood defences, with the council and the private sector working together, with some Government support. However, one thing that would really help is the preservation of the peat bogs in the moorlands above Sheffield, which act as a massive sponge to stop the run-off and the cascading of water down into Sheffield. Will the Minister take action now to stop heather burning on the peat bogs and to make sure that peat does not end up in unnecessary products, such as compost for gardens?

The hon. Gentleman makes an important point. The Government are clear that we will consult on a ban on horticultural peat, and we will shortly bring forward the legislation that will implement a new ban on the burning of heather on blanket bog. It is our intention to treble the rate of peatland restoration, for all the reasons he said.[Official Report, 21 June 2021, Vol. 697, c. 8MC.]

My right hon. Friend makes an important point. The Government set out proposals in our recent England tree strategy. There will be a new urban tree challenge fund and a new treescapes fund for local authorities, and of course our policy of biodiversity net gain absolutely intends to make space for nature in new developments, which will including tree planting.

I hope that today is not the Secretary of State’s last Question Time, given the recent rumours from Downing Street that he is due for the chop. If those rumours are true, how will he spend his next few weeks ensuring that he is not remembered as the Secretary of State who betrayed our fishing industry and who rolled over and betrayed our farmers over an Australian trade deal?

Ministers never comment on reshuffle speculation, particularly when it is about oneself. In the context of fishing, we recently got an agreement with the EU on how to approach shared stocks for the remainder of this year. We of course got an increase in quota of around 25%, with 15% of that coming this year, and we have deployed that to almost double the fishing opportunities for our inshore fleet in this year.

The moors of the Dark Peak are staggeringly beautiful, but unfortunately they remain some of the most depleted in Europe. The case for restoring our peat moorlands makes sense on so many levels. It enhances biodiversity and improves water quality, helping keep water bills down. It reduces the risk of flooding and of wildfire, and it helps tackle climate change. I am proud that the Government are investing huge sums of money in restoration already, but we do need to go further and faster. Can I invite the Secretary of State to come up on the moors of the High Peak with me, so he can see the excellent work being done first-hand and so we can make the case for continued investment in this vital restoration?

My hon. Friend makes a very important point. Our peat habitats are vital for our biodiversity, can be a vitally important carbon store and can also help with both drought and flood risk mitigation. We will be dramatically increasing the funds available for peatland restoration. I or one of my ministerial colleagues would of course be delighted to visit his constituency in the High Peak and see some of the work being done there.

Further to the previous question, the Climate Change Committee warned this week that the area of land suitable for peat-forming vegetation in the uplands could decline by 50% to 65% by the 2050s through the effects of climate change alone, potentially dramatically increasing UK carbon emissions. How is the Secretary of State planning to amend the “England Peat Action Plan” to bring forward plans for peat protection and restoration in light of the Committee’s damning report?

We are dramatically increasing the rate of peatland restoration to get to 35,000 hectares by the end of this Parliament. It will be a big feature of the landscape recovery component of our future agriculture policy. We have great ambitions to see the natural hydrology of our deep peat habitats restored.

Fly-tipping is a blight on rural areas. Central Bedfordshire alone issued 400 penalty notices last year, but with the fine only being £400—frequently discounted—it is treated really as just a cost of doing business if someone gets caught, does my right hon. Friend agree that the fine is too low? What other efforts can he take to improve deterrence?

I know that fly-tipping is a challenge. My hon. Friend says that £400 is too low. That is an immediate on-the-spot penalty fine, which was introduced just a couple of years ago. Prior to that, local authorities had to try to bring a prosecution, but we are doing more to try to improve the traceability of waste, to strengthen the waste carrier transfer system and to digitise the notes to improve the traceability and track down the criminals behind this fly-tipping.

Today marks Clean Air Day, which aims to improve public awareness and understanding of the damage caused by air pollution and to promote campaigning on this critically important issue. I am proud to say that the Welsh Government’s “Programme for Government” published this week included a commitment to introduce a clean air Act for Wales consistent with World Health Organisation guidance and to extend the provision of air quality monitoring. Will the Minister commit to following the Welsh Government’s lead at a UK level?

This issue is very much the subject of debate in the Environment Bill, which is currently going through both Houses of Parliament. We will be setting targets for clean air, and we will also be looking at a population exposure target, since it is not just about the absolute levels of particulate matter—we want to continue to reduce those—but about looking at the issue of population exposure, too.

The Secretary of State is fully aware that we have an issue at the moment with customs. West Somerset Garden Centre in Minehead, which is at the far end of most supply chains, is getting a lot of these articulated lorries from across Europe, and they start their drop in Minehead, which means that customs forms are done in Minehead for the whole load, regardless of whether only a third of it is coming off there. The other problem is that when these plant trays come off—the Secretary of State knows what I am talking about—even if only three of those plants are coming off in Minehead, the rest still have to go through the customs rigmarole there. The customs officers either do not get to Minehead or do not know where it is, and there is a huge problem with this, as the Secretary of State is aware. We need an answer to this fairly quickly, because the paperwork is swamping a small garden centre in Somerset.

The reason why Cumbria’s farmers feel betrayed is that the Australian trade deal gives Australian farmers an unfair advantage over British farmers, because their production costs are lower due to significantly worse animal welfare and environmental standards in Australia compared with those in our country. Given that this sets an appalling precedent for all future deals, will the Secretary of State ensure that farmers’ representatives in this House get the final say and a veto before this deal is signed off.

Under the provisions that we have to ratify treaties, of course this House will have the ability to decline to ratify any treaty, including this particular one. On the issue of animal welfare, it is the case that we have a chapter on animal welfare co-operation. Of course, we will be seeking to address some of the welfare deficiencies in Australia and, for instance, to get it to follow New Zealand’s lead on the issue of mulesing. It is also important to recognise that this agreement does not cover pork and poultry, on which its standards also have problematic approaches.

In 2019 the Government commissioned Richard Benyon to conduct a review of the potential role for highly protected marine areas (HPMAs). HPMAs are similar to the marine conservation zones already established. However, there is strict protection with a presumption against any activity involving extraction, destruction or deposition being permitted in those areas and strict protections on other damaging activities. The review reported last year in June 2020.

The Benyon review concluded that HPMAs would have an important role in helping the marine ecosystem recover. It concluded that there could be spill-over benefits for marine life in adjacent areas to highly protected areas. The review recommended that the Government pilot around five HPMAs to test the proposition further and test delivery. It also recommended that some or all of the pilot sites could be co-located with existing marine protected areas such as marine conservation zones, in effect to upgrade the status of some of those sites.

Today is World Ocean Day when, across the globe, people are taking action to protect and recover our global ocean. This Government are committed to ocean conservation and leaving our environment in a better state than we found it, including the marine environment. I would like to thank Lord Benyon and the panel for their work on the review, and the broad range of stakeholders who contributed to it. The Government welcome the report and accept the central recommendation that we should take forward some pilot sites.

DEFRA will begin introducing HPMAs by identifying a number of locations within English waters to pilot our approach. These may be inside or outside the existing marine protected area network, and in inshore or offshore areas, recognising that HPMAs must be in the locations best able to deliver protection and recovery.

However, the Government recognise that the strict protections implied by HPMAs will cause some concerns with other sea users. In particular, the fishing industry will be concerned about further displacement from fishing grounds when they are already being excluded from some areas ear-marked for offshore wind energy development.

We recognise that there is a balance in supporting sustainable industries in the marine environment while increasing marine protection to ensure a healthy, resilient and diverse marine ecosystem. In developing our response to the review we have engaged with a broad range of stakeholders. We will develop criteria for HPMA identification and create a list of potential sites this year, followed by designations of a number of sites in 2022. We will also set out how we will work with stakeholders, the governance and management of sites and how we will monitor and evaluate sites.

The Benyon review did not cover Scottish and Welsh waters but did include Northern Ireland’s offshore waters. We understand that DAERA wishes to have executive competence transferred to it in relation to certain marine functions, including designation and management of MPAs, in Northern Ireland offshore waters. Amendments to the Marine and Coastal Access Act 2009 made by the Fisheries Act 2020 allow DAERA to make orders to protect the marine environment from fishing activities in the offshore region. We therefore do not propose identifying any of the initial HPMAs in offshore Northern Ireland waters.

I am updating the House on today’s publication of the Government’s response to a consultation and call for views on a range of proposals to help eradicate bovine tuberculosis (bTB) in England by 2038. This is a step towards some of the key priorities that this Government set out in response to Charles Godfrey’s independent review of our bTB eradication strategy in March 2020.

BTB is one of the most difficult and intractable animal health challenges that England faces today. In the last year, over 27,000 cattle in England were compulsorily slaughtered to tackle the disease. This causes devastation and distress for hard-working farmers and rural communities and is damaging our reputation as world leaders in high standards of animal health and welfare. Tackling bTB in England is costing taxpayers over £100 million each year.

The bTB eradication strategy, published in 2014, is making progress, with sustained reductions in the number of new cases and proportion of cattle affected by the disease in the highest incidence areas. However, to achieve bTB-free status for England by 2038, we need to build on this momentum.

The consultation focused on proposals to transition away from the current badger control policy and improve diagnostic testing to root out bTB more effectively. Badger culling is one of the most contentious and divisive policies within our bTB eradication strategy and our latest consultation has continued to attract scrutiny.

We should continue to proceed with the transition to non-lethal wildlife controls as set out in the consultation and striking a timely balance for this transition will be crucial. Current policy enables four years of intensive culling in defined areas, with scope for a further five years of supplementary culling. I intend to stop issuing intensive cull licences for new areas post 2022 and enable any new licences issued from 2021 to be cut short if the chief veterinary officer considers this acceptable based on the evidence available at the time. Supplementary cull licences will be limited to two years and no further such licences will be issued in any areas in which supplementary culling has previously been licensed. We will develop a monitoring system to track the badger population and disease in badgers in former culling areas to monitor any trends. This data will be published, thus supporting any future decision making.

The consultation also put forward proposals for targeted changes to our cattle testing policy to ensure we root out the disease in herds with sustained problems, while further helping to protect low risk bTB areas. I am committed to introducing these policy changes as soon as is practicable. The parallel call for views included longer term options for further changes and improvements to bTB testing, supporting responsible cattle movements and rewarding low-risk cattle purchasing behaviour. It also discussed ways we can continue to adapt how we pay compensation or indeed, reward farmers for “best practice”. We are considering the evidence submitted through consultation responses to determine next steps.

I am committed to accelerating work to deliver a deployable cattle vaccine by 2025. This will be a powerful additional tool in the fight against bTB and will support the staged transition away from culling in ways which will help to protect gains made and ensure incremental progress continues to be made towards disease eradication. Field trials are expected to commence in June.

There is no single solution to the scourge of bTB and we must continue to deploy a range of policy interventions. New industry initiatives, such as the CHECS TB entry- level membership, have launched. The successor to the TB advisory service will also provide the practical help many herd owners need.

Working together, I have full confidence that we can continue to turn the tide on this terrible disease and achieve our long-term objective of eradicating it in England by 2038.

Environment Bill

I beg to move, That the Bill be now read the Third time.

Of course, for this Bill, it is the third time in more ways than one. Hon. Members will recall that a similar Bill was introduced in the last Parliament, and this Bill itself started in the last Session. I thank right hon. and hon. Members across the House, particularly the members of the Public Bill Committee for their scrutiny and all those involved in the previous iteration of the Bill during the last Parliament. I pay special tribute to the Under-Secretary of State for Environment, Food and Rural Affairs, my hon. Friend the Member for Taunton Deane (Rebecca Pow), for her tireless work on the Bill, and to all the DEFRA officials for all the work they put in to get such a significant piece of legislation to this point. It is a large and complex piece of legislation, and a huge amount of work has gone into getting its provisions right.

Members in all parts of the House agree that the decline of our natural environment has persisted for too long. As we emerge from the covid-19 pandemic, we must turn our attention to recovery. We must build back greener. The pandemic has reminded us all of the difference that nature makes to our lives. 

After G7 nations gather in Cornwall next month, the wider international community will attend the convention on biological diversity in Kunming in October, before the UK, as co-president, hosts the world at COP26 on climate change in November. This is a very important year for the environment internationally, and this landmark Environment Bill will deliver on our manifesto commitment to create the most ambitious environmental programme of any country on earth.

As I announced last week, the Government intend to amend the Bill in the other place to include a new, historic, legally binding target on species abundance for 2030, aiming to halt the decline of nature. This is a pioneering measure that will be the net zero equivalent for nature, spurring action on the scale required to address the biodiversity crisis. Our forthcoming Green Paper will also explore how we might deliver our world-leading domestic ambitions for nature, including how we improve the status of native species, such as the water vole and the red squirrel, and protect 30% of our land by 2030.

My right hon. Friend the Member for Epsom and Ewell (Chris Grayling) has ensured that the plight of the hedgehog has been greatly debated during the passage of the Bill, and the Green Paper that we plan later this year will also explore how we might better protect other species currently not protected under the habitats regulations, including the hedgehog. In a similar vein, I have asked my noble Friend Lord Benyon to chair a small working group, together with Tony Juniper, Christopher Katkowski, QC, and the Under-Secretary of State, my hon. Friend the Member for Taunton Deane. The group will explore how our approach to conservation and habitat assessment might be improved so that we can deliver nature’s recovery and hit the ambitious targets that we are setting.

Our world-leading targets will be supported by provisions in the Bill and our new England trees and peat action plans to protect existing trees and expand woodland coverage. Our aim is to treble woodland creation rates by the end of this Parliament and to restore 35,000 hectares of peatland by 2025. Although we treasure our many species and ecosystems for their own sake and their intrinsic value, we must remember that they also provide vital services from which people benefit, such as carbon storage and pollination. As shown in the Dasgupta review, protecting and enhancing our natural assets and the biodiversity that underpins them is crucial to achieving a sustainable, resilient economy.

The Bill takes important strides in tackling air, water and waste pollution. Cleaner air from new, legally binding targets will drive action to tackle harmful air pollution across the country. Better management of our water for new drainage and sewage management plans will improve water quality in our rivers and lakes. The Bill will also give us powers to tackle storm overflows, and I thank my right hon. Friend the Member for Ludlow (Philip Dunne) for his efforts on that particular area of policy. We therefore intend to table an amendment in the other place requiring Government to publish plans to reduce sewage discharges from storm overflows by September 2022, and for water companies and the Environment Agency to publish storm overflow operations data on an annual basis.

We are already consulting on measures to prevent waste and tackle the scourge of plastic ending up in our oceans. The extended producer responsibility scheme, which will make producers of packaging responsible for the cost of disposal, will incentivise better product design from the outset. New powers will allow us to place charges on single-use plastics, reducing their persistence in our natural environment. All of this, of course, will be underpinned by our new system of environmental governance. The Bill creates the new, independent Office for Environmental Protection to hold all public authorities to account on reaching these important goals. Work to establish the OEP is already well under way under the chairmanship of Dame Glenys Stacey and I commend the work that she has done to date.



In conclusion, I am pleased to see this Bill reach its Third Reading after a couple of attempts in previous Sessions and during the last Parliament. I am grateful for the many contributions from Members of all parties today. I believe that these provisions will ensure that this generation leaves our environment in a better state than we found it, and I therefore commend the Bill to the House.

The events of the last 12 months have led people to appreciate the difference that nature makes to our lives more than ever before. Restoring nature will be crucial as we seek to build back greener from this pandemic, and in what is a huge year for the environment we will use our COP26 and G7 presidencies to take a leading role on driving a global green recovery on the world stage.

As a core part of our commitment to leave the environment in a better state than we found it, and acting on the recommendations of the Dasgupta review, we are announcing today that we will be amending the Environment Bill to require a historic, new legally binding target on species abundance for 2030, aiming to halt the decline of nature in England. We hope that this world-leading measure will be the net zero equivalent for nature, spurring action of the scale required to address the biodiversity crisis.

We will develop this target alongside the longer-term legally binding targets we are already developing in the Environment Bill, and set the final target in secondary legislation following the agreement of global targets at the UN nature conference, the convention on biological diversity COP15 in autumn 2021. This amendment will be tabled at Lords Committee stage.

We should not underestimate the scale of the challenge ahead in halting the decline of nature. Over the last 50 years, much of the UK’s wildlife-rich habitat has been lost or degraded, and many of our once common species are in long-term decline. We have also come to better understand the link between our own health, and economic prosperity, and that of the planet. The independent, global Dasgupta review on the economics of biodiversity, led by Professor Sir Partha Dasgupta, has shown us that a healthy natural world, measured in its diversity of life, underpins so much of our economic prosperity and resilience.

To achieve our new target, alongside others in the Bill, we will also need measures that go beyond what is in the Bill.

We are also announcing today:

An England peat action plan to restore, sustainably manage and protect our peatlands. We will restore at least 35,000 hectares of peatland by 2025, investing £50 million through the nature for climate fund and phasing out the most damaging practices to our peatland.

An England trees action plan to better protect our existing trees and expand woodland coverage, aiming for 12% woodland cover by the middle of the century. Over £500 million of the £640 million nature for climate fund is dedicated to trees. Tree planting rates in England will treble by the end of this Parliament to benefit our local communities, nature and climate.

Species reintroduction measures to recover threatened species and continue to provide opportunities for successful reintroductions. We want to see a more nature rich Britain, with further action to bend the curve of species loss in this country.

If we are to deliver this ambitious new target and reverse the downward trend we have seen in recent decades, we need to change our approach. We must move the emphasis away from processes that simply moderated the pace of nature’s decline, and instead put in place the governance regime that can deliver nature’s recovery. We need to create space for the creative public policy thinking that can deliver results, rather than relying on change being set by litigation and case law.

I am therefore also announcing today that I will be tabling an amendment to the Environment Bill to provide for a power to refocus the habitats regulations to our domestic priorities. We want to ensure our legislation adequately supports our ambitions for nature, including our new world-leading targets, rather than remaining tied to legacy EU legislation. We have already set out some important measures in the Environment Bill to switch the focus to nature recovery. We have the requirement for environmental targets on wider areas, for example water quality; a requirement for an environment improvement plan; local nature recovery strategies to steer habitats delivered through biodiversity net gain; and Natural England are making progress with a more strategic approach to nature recovery through their support for delivering the nature recovery network.

We will take a measured approach to reform. We will also consult with the new Office for Environmental Protection, and work with conservation groups on any proposals we develop before any regulatory changes are made. In addition, later this year, I intend to bring forward a Green Paper setting out how we plan to deliver a regulatory framework that is fit for purpose in driving forward our domestic ambitions now that we have left the EU, including our objective of protecting 30 percent of terrestrial land by 2030. We need a revised approach to deliver this new species abundance target and better support iconic and much-loved native species like the hedgehog.

As announced in the Queen’s Speech on 11 May, we will also be bringing forward amendments in the Lords to reduce the harm from storm overflows to our rivers, waterways and coastlines.

New duties will require Government to publish a plan to reduce sewage discharges from storm overflows by September 2022 and report to Parliament on the progress towards implementing the plan. Water companies and the Environment Agency will be required to publish data on storm overflow operations annually.

These new measures will complement the existing provisions in the Environment Bill which will tackle air, water and waste pollution, which are critical to meeting our goals of net zero emissions, stemming and reversing biodiversity loss and improving public health.

Work on implementing measures in the Environment Bill has continued since it was last in the Commons. We have appointed the first chair of the Office for Environmental Protection, Dame Glenys Stacey. We have published a draft principles policy statement, started work on developing legally binding environmental targets, launched consultations on the deposit return schemes for drinks containers, and extended producer responsibility for packaging and consistent recycling collections.

The Environment Bill will have its final day of report and Third Reading in the Commons on 26 May, before moving to the Lords. We are aiming for Royal Assent in the autumn. In the year of COP26, the Environment Bill is at the core of delivering the Government manifesto commitment to deliver the most ambitious environmental programme of any country on earth and leave our environment in a better state than we found it.

This Government were elected on a manifesto that committed to setting up a new independent Office for Environmental Protection (OEP) and to have the

“most ambitious environmental programme of any country on earth”.

DEFRA is seeking a further repayable cash advance from the Contingencies Fund (CFA) of £6,713,000 to proceed with setting up the OEP in advance of Royal Assent of the Environment Bill (the Bill). This new CFA is in addition to the advances of £215,000 and £536,000 notified to Parliament on 21 July and 23 October 2020 which covered essential set-up expenditure up to 31 March 2021.

Under “Managing Public Money” rules, providing a Bill has successfully passed Second Reading, then expenditure to make preparation for the delivery of a new service prior to Royal Assent requires an advance from the Contingencies Fund.

The requirement for this third CFA has arisen because the Environment Bill has been carried over and is still completing its parliamentary passage. The CFA is for the period from 1 April 2021 to 31 March 2022 to provide sufficient contingency cover until the end of the financial year. This CFA covers essential set-up costs which include estates, recruitment and HR, and all interim OEP operational costs from 1 July 2021 until the end of this financial year, or until the OEP is legally established if earlier.

Regulations are required to commence the Bill provisions relating to the OEP, and we expect those regulations to be made shortly after the Bill receives Royal Assent.

Ministers have agreed on the need to set up an interim OEP from 1 July 2021. The interim OEP will be set up, in non-statutory form, within DEFRA and will ease the introduction of the full OEP. The interim OEP will be led by the chair-designate, Dame Glenys Stacey, and the interim chief executive-designate.

The interim Office for Environmental Protection will be able to:

produce and publish an independent assessment of progress in relation to the implementation of the Government’s 25-year environment plan

develop the Office for Environmental Protection strategy including its enforcement policy

receive, but not investigate, complaints from members of the public about failures of public authorities to comply with environmental law

take decisions on operational matters such as staff recruitment, accommodation and facilities

determine approaches for how the Office for Environment Protection will form and operate, establishing its character, ways of working and voice.

The need to spend now in advance of Royal Assent will allow the interim OEP to commence on 1 July 2021, and smooth the transition so that the OEP can begin its statutory functions as soon as practical after Royal Assent.

Parliamentary approval for additional resources of £6,713,000 for this new service will be sought in the main estimate for Department for Environment, Food and Rural Affairs. Pending that approval, urgent expenditure estimated at £6,713,000 will be met by repayable cash advances from the Contingencies Fund.

The combination of falling demand in the EU due to coronavirus restrictions and the introduction of new procedures at the end of the transition period meant that exports fell significantly in the first month of January. Exports of food and drink recovered in February, increasing by 77% on the previous month. While official statistics for March are not yet available, we know that the number of applications for export health certificates has continued to grow.

Since the Government’s precious Brexit, fish exports to the EU have collapsed and the Government said it was teething problems; cheese exports collapsed and the Government blamed exporters for poor paperwork; seafood exports collapsed and the Government said they might reclassify waters to make them cleaner. But nothing substantive has happened on any of it. What will it take to get action from Ministers, or do we have to wait for a text from a crony?

We have indeed taken action right from the moment that there were teething problems in that first week of January as import agents, exporters and border control officials struggled to get used to the paperwork. As I pointed out, it is an improving situation. The hon. Member asked about trends. The trend is a rising one, increasing by 77% in February, and with export health certificates continuing to grow.

Scottish exports make up a quarter of the UK’s food and drink exports. Those exports have been hammered by Brexit, losing out on hundreds of millions of pounds in sales in January and February alone, with some products seeing their market all but collapse, and virtually nothing is being done about it. A new Brexit cliff has arrived before we finished plummeting off the last one: composite food products now need export health certificates. The chaos of the last set of regs is still haunting our exports, and this new chaos will further dent them. Vets say they will not have the capacity to deal with this. What plans do the Government have to address that clear danger?

The European Union has changed some of its export health certificates, particularly for composite goods, from 21 April. We have been working very closely with industry and all those affected over the last few months. We knew that this was going to happen. We have worked with it on getting those replacement health certificates and, in some cases, the need for a private attestation. Yes, it is complicated. It is a change in law that the EU has made and always intended to make, but we worked very closely with industry and all those affected to make sure that they were ready.

I recently met the Home Secretary and the Lord Chancellor in March to discuss the important issue of pet theft. As a result of that meeting, officials from across the three Departments have been tasked with developing solutions that tackle this issue effectively. The work of the pet theft taskforce has already begun, with officials drawing together available data and evidence.

The Secretary of State, I am sure, has a comprehensive understanding of this issue, which causes undue distress to people and affects dogs, cats and all manner of other pets. This week, for example, Cats Protection told me that cat theft is up threefold since 2015. Will the Secretary of State confirm that the Government will back my amendments to the Police, Crime, Sentencing and Courts Bill, which deal with pet theft and introduce tough sentences for those whose actions devastate so many families?

We are aware that there are some reports of a significant increase in the incidence of pet theft. A number of organisations say that reports of it are doubling, and the official figures show a sharp increase, albeit from a relatively low base. We are looking at the issue, and that is why we established the pet theft taskforce. There is already the possibility of a maximum sentence of seven years for aggravated offences, particularly where there is emotional distress, which clearly there is in the case of pets. We are reviewing this particular area of law.

I am sure the Secretary of State recognises that for those committing the theft it may be a financial issue, but for those who have their pets stolen this is really a loss of a valued member of their family. I give credit to The Star newspaper in Sheffield, which has highlighted a growing number of these incidents, and the heartbreak and anguish it causes people to lose their valued pet. Will the Secretary of State accept that this is a different sort of crime to the normal theft of a possession, and that, as such, it needs a different, specific offence with specific and tougher penalties enacted for those who commit it?

It is a different type of offence in that there is emotional stress on the owner of the pet, but there can also be stress and effects on the welfare of the animal. That is why, in the current sentencing guidelines, the courts can take account of an aggravated offence with emotional distress, and the maximum penalty could be as high as seven years. We have asked the pet theft taskforce to look at this issue more closely and assemble the evidence to consider whether anything further is required.

Pet theft is on the rise, partly because of the demand for pets through lockdown. When gangs steal a pet, they cause harm not only to the pet, but to the families who miss it. We still do not have the five-year sentencing for animal cruelty, which my hon. Friend the Member for West Dorset (Chris Loder) has been trying his best to get through. In the next Parliament, can we not only have that five-year sentencing for cruelty but link in dog theft to the legislation?

DEFRA applies the precautionary principle in relation to pesticides. We therefore supported a ban in 2018 on the use of neonicotinoids to treat crops. Given what the current science tells us about these pesticides, they can be authorised for use only on an emergency basis if very specific circumstances are met and with the appropriate environmental safeguards.

Farmers in the east of England very much welcome the Secretary of State’s dispensation for the use of neonics in treating aphids. What I want from the Secretary of State is some reassurance for the farmers in the east of England that, until a suitable alternative to neonics that is evidence based is available, he will continue to use the dispensation so that we can properly support our farmers to grow crops and protect them from aphids.

As I said, these are emergency authorisations that we grant on an annual basis. In the case of this application for the current year, we added additional conditions to those that have been proposed by the applicant—in particular, adding another 10 months to the period before a flowering crop could be sown. Also, in this case, the threshold for pests was not met and was therefore not needed, but, of course, if there is an application in a future year, we will look at that again.

Today is Earth Day, an initiative that has been running now every year since 1970 and promotes engagement, awareness and individual action for our environment. The Government continue their own engagement with countries around the world in the build-up to COP26 in Glasgow later this year. As part of that programme, next Monday, along with the World Bank, I will be hosting the first dialogue on sustainable agriculture, setting out how changes to agriculture policy can incentivise regenerative agriculture and enhance environmental assets in the farmed landscape.

Given that food waste accounts for 19% of the UK’s landfill and that even the proposed targets in the Environment Bill to separate household food waste collections are unlikely to eliminate food waste in landfill by 2030, is it not time that his Department considered a food waste to landfill ban in England for food waste businesses that produce more than 5 kg of food waste per week?

We are obviously looking at this very carefully through our waste resources strategy and through the provisions in the Environment Bill. We will require local authorities to collect food waste through our consistent collections policy; that is an area that we are consulting on at the moment. Obviously, once food waste is collected separately we can treat it separately, and that could involve anaerobic digesters and other ways of dealing with this waste other than landfill.

The year 2020 was the warmest year on record: more habitats were lost; more species were facing extinction; and more raw sewage was pumped into our nation’s rivers, seemingly without consequence for the water companies involved. On Earth Day, will the Secretary of State commit to take fast action against water companies that are pumping raw sewage into our rivers, killing fish, killing habitats and killing birds, and do so while committing to no further roll-back of environmental protections?

I have already acted in this area. The Department has established a taskforce to look at combined sewer overflows, which are one of the key sources of sewage pollution, and we are also putting a real focus on tackling sewage incidents in our future water strategy, which will inform Ofwat’s approach to the pricing reviews that it has with water companies.

According to research compiled by the Local Government Association, the manufacturers of food packaging in the UK contribute only about 10% of the cost of recycling their products. Does my right hon. Friend agree that as part of the efforts that we are undertaking to improve the recycling of waste food packaging, we need to see the manufacturers of that packaging contribute much more towards the costs of recycling their products, in line with the contribution they make in other countries, rather than leaving our council tax payers to foot most of the bill?

I very much agree with my hon. Friend on this matter. As he will be aware, the Environment Bill introduces the concept of extended producer responsibility, and we are consulting on that at the moment. In future, the manufacturers and the users of packaging for products will take responsibility for recycling it.

Waste incinerators emit toxins and pollutants that are harmful to human health and exacerbate climate change. I am pleased to say that local residents in my constituency of Cynon Valley have recently successfully campaigned against a waste incinerator through the Valleys For Tourism Not Trash campaign, and the Welsh Government have recently announced a moratorium on any future large-scale incinerators. Will the Minister commit to reconsidering the Government’s decision to exclude waste incinerators from their post-Brexit carbon emissions trading scheme and follow Wales’s lead by introducing a moratorium on future incinerators?

This is obviously a contentious area. However, energy from waste can be a way of extracting some use from it. It is often preferable to landfill and often has lower carbon implications because some energy can be generated from it. Nevertheless, there are some environmental concerns around this. That is why in England the Environment Agency has to authorise and license any such facility.

Charity shops are currently experiencing both a surge in donations and an increase in fly-tipping on their doorsteps. Many of the goods donated are of poor quality and simply cannot be sold on. This is causing significant extra waste disposal costs for charities, which have already seen their incomes diminish during the pandemic. What support can DEFRA offer through its new waste management plan to support the charitable community in this financial challenge?

My hon. Friend makes an important point. Fly-tipping has become a scourge in recent years. It has become a growing problem, with organised gangs behind some of these waste crime incidents. We have already taken action to improve our surveillance and to improve the traceability of some of these products so that we can trace them back to the source that they came from and bring those responsible to justice.

A shocking report released by the Bakers, Food and Allied Workers Union has revealed that one in every five people working in the British food sector, which stretches from factories and distribution firms to cafés and supermarkets, live in households that have run out of food because of a lack of money. We live in arguably the sixth richest country on this planet and our workers are going hungry because of meagre wages. Does the Secretary of State agree that access to affordable and nutritious food is a basic human right, and will he commit to ensuring that the right to food is included in next month’s Queen’s Speech?

The Government monitor household spending on food very closely, and we agree that we want to raise earnings among the lowest paid. That is why it has been a long-standing policy of this Government to first introduce a national living wage and then increase it incrementally year on year, and we have done that to take the lowest paid out of poverty. As a result of that policy, household spending on food among the poorest households has actually fallen from about 16% to under 15%, which is the lowest on record.

I have been working with local councillors in Stoke Bardolph and Burton Joyce to work with residents and partner organisations to set up a flood action group that will help to take some preventive action and provide reassurance in part of the Gedling constituency that occasionally floods. Will my right hon. Friend join me commending those who are volunteering to join this group and tell me what steps the Government are taking to help to prevent flooding in Nottinghamshire?

I commend the work that my hon. Friend and those local volunteers are doing. We have our flood resilience forums around the country. The Environment Agency works with local government on them and on putting them in place so that communities can improve their resilience. More broadly, we have an ambitious capital programme of more than £5 billion over the next five years to invest in flood defences and to protect communities such as his.

In an earlier exchange about air quality, the Under-Secretary of State for Environment, Food and Rural Affairs, the hon. Member for Taunton Deane (Rebecca Pow), seemed to suggest that because there was no safe level of air pollution in the way it affects in particular our children’s lungs, that is a reason for rejecting a move to make legal the World Health Organisation standards. That is patent nonsense of course, but can Ministers look particularly at the position around our schools? It is where our young children are very vulnerable. Traffic idling can make pollution levels intense, particularly in urban areas. Is it not time now to take proper action and not simply hear fine words? Action now, Minister, please.

I am not sure that is what my hon. Friend said earlier, but she was making the point that since there is no safe limit of particulate matter and PM2.5, what we should be doing is focusing on additional measures such as overall population exposure, and that is indeed something we are looking at through the target-setting process in the Environment Bill.

Under the UK-EU trade and co-operation agreement, the UK has secured tariff-free access for fisheries products and a substantial transfer of quota from the European Union, benefiting fishing communities across the UK, including Scotland. The transfer is equivalent to 25% of the value of the EU’s historic catch in UK waters, worth £146 million delivered over five years. All fisheries Administrations will have regulatory control, giving Scotland powers over the largest part of the UK’s exclusive economic zone.

At the beginning of the year, the Secretary of State stood at the Dispatch Box and told Members that difficulties with the UK-EU fishing trade were just “teething problems”, but two months on those problems are still ongoing, and the Government’s compensation fund is clearly insufficient. On Tuesday, the Environment, Food and Rural Affairs Committee was told that in the medium term, we will see a lot more of the smaller companies stopping trade in Europe, and it may ultimately be their demise. That is terrible news for the East Neuk in North East Fife and their fishing fleet. Does the Secretary of State still agree with the words that he wrote in 2016, when he said:

“From the point of view of the fishing industry, the case for leaving the EU is overwhelming”?

Yes, I do still believe that, and we have a 25% uplift in quota as a result of the trade and co-operation agreement and regulatory freedom that we did not have before. It is worth noting that we are now seeing lorry loads of fish clearing border control posts in France typically in under an hour—sometimes a little longer, but it is an improving situation. Volumes of trade are back up to around 85% of normal volumes.

The Prime Minister said a week ago that he thought the fishing industry could be saved if we only ate more British fish. Two months ago, the Leader of the House said that the fish are “happier” because of Brexit. In January, the DEFRA Secretary said the collapse of exports was a “teething problem”. Can the flippancy end now, and can we get some serious answers for the industry? Some Scottish businesses still face three-day waits to get their fresh fish to EU markets. Does the Government not accept that they have got it wrong and that the taskforces and other sticking plasters are not enough? Will they get back to the negotiating table with the EU, eat some humble pie and accept whatever regulatory alignment and other measures are necessary to save the industry?

As I said, volumes of fish exports are currently running at about 85% of normal volumes. Given coronavirus and the lockdown in the EU, we think that is probably about the right level, given the stress to the markets in the European Union. It is an improving situation. Well over half of all consignments now clear border control posts within an hour, and typically in 45 minutes. Over 90% are clearing them within three hours, so we do not recognise the figure that the hon. Lady gives of three days.

My hon. Friend makes an important point. The interim OEP will be able to produce an independent assessment of the Government’s progress towards their 25-year environment plan and receive complaints about failures of public authorities to comply with environmental law. It will take decisions on operational matters such as recruitment, accommodation and facilities; develop the OEP strategy, including its enforcement policy; and determine approaches to how the OEP will form and operate.

My hon. Friend makes an important point. Although the timetable for the Environment Bill has slipped by a few months, we are working at pace to implement the policies and measures behind it. We have announced Dame Glenys Stacey as the chair of the OEP and Worcester as its HQ, and it will launch on an interim basis in July. We are also progressing work on developing targets. We have already published a policy paper and set up working groups, and we are developing proposals for a consultation. We will launch further consultations on a raft of measures to be brought forward under the Environment Bill, including relating to packaging and waste collection reforms.

Now that we are no longer a member of the European Union, it is vital that all steps are taken to ensure that the UK has the strongest possible protections for our environment. That is why so many of us are confused that the Tories weakened their own Environment Bill in Committee by voting down cross-party amendments that would have strengthened the OEP and made the Bill fit for purpose. Can the Secretary of State finally confirm that, when the Environment Bill eventually comes back to the House, he will support all steps to make the OEP—which was promised to Bristol and the south-west but is now headed for Worcester—fit for purpose and fit for the 21st century?

I believe it is fit for purpose. We have set up an independent Office for Environmental Protection that has powers to investigate. It will have powers to bring a judicial review, and powers to investigate and follow up on any complaints that the law has been broken. Crucially, as well, it has been given some work to develop those targets, and also to comment on progress towards both the targets and our environmental plan.

We are already conducting some checks on live animals, with full documentary checks and physical checks being conducted at the premises of destination. We plan to introduce some documentary checks on products of animal origin next month and then begin some physical checks from July onwards, and also to introduce similar checks on plant products later this year. Recruitment of staff by the port health authorities is at an advanced stage.

On Tuesday, the Environment, Food and Rural Affairs Committee heard from a series of our fish and meat exporters to the EU who are struggling with the paperwork system imposed by the EU and its border officials. One exporter in Brixham needed over 70 pages of paperwork for one consignment of fish. When we start making checks this summer, we could insist on 140 pages of paperwork for EU imports, if we wanted to. However, could we, in our mutual interest, negotiate with the EU a digital system to make it easier for our businesses both to export and to import?

Unlike the European Union, we have taken a pragmatic approach to phasing in border controls, so that we can protect business supply chains and UK consumers, but when we do start to introduce those export health certificates, they will be certificates that are of a similar form to those of the European Union, since they are derived from retained EU law. I understand the point my hon. Friend is making, but we should also remain conscious that the primary focus of these checks is to protect food standards and animal health. Over time, the European Union may diverge from British law or may suffer variable enforcement between member states, and the UK needs the ability to protect British consumers and to operate food safety surveillance of other EU member states.

Since 2018, we have been working with farmers to build up ideas and gain their insights. So far, more than 3,000 farmers have helped us to develop aspects of our new approach through 72 tests and trials. Our co-design approach includes the sustainable farming incentive pilot, which will open for expressions of interest shortly. We will also be working with farmers on various consultations and on policies, in particular to address the causes of poor profitability.

Last year, I visited a dairy farm near Penistone in my constituency that is using new technologies to increase efficiency and improve yields. That is a great example of innovation in farming that can lead to a bright future for the dairy industry. Can my right hon. Friend tell me how his Department is supporting farmers to remove barriers to adopting new technologies that they need so that they can become more competitive?

My hon. Friend makes a very important point. Dairy businesses such as the one she refers to in her constituency are embracing technology and innovation, and we want to support them to go further. Over the last three years, we have provided around £75 million to farmers to help them purchase new and innovative technology. From autumn this year, the new farming investment fund will help farmers, including those in the dairy sector, to build on the progress already made by offering them grants. We will also be launching a new approach, with research and development syndicates to support individual farm businesses with research and development of technology.

I regularly have discussions with Cabinet colleagues on this issue, in particular through the Cabinet Sub-Committee dealing with EU exit. Import controls on fish products are being introduced in stages. Imports of most fish products have required illegal, unreported and unregulated fishing documentation since January. That includes a catch certificate. We plan to introduce documentary checks for export health on imported fish from April and some physical checks from July.

I thank my right hon. Friend for all the efforts he is making to iron out the wrinkles in the export of fish products from the UK. However, if these problems persist, why do we not serve notice on our friends in the EU that with immediate effect we intend to treat the import of fish products from EU countries in precisely the same way that our fish exports to EU countries, especially France, are currently being treated—regulatory equivalence? Would that not help to bring people to the table to resolve the current disruption being suffered by our fishing industry?

As I said to the Chair of the Select Committee earlier, when we start to introduce those checks they will indeed be equivalent and similar to the types of checks that the European Union is currently requiring on our own fish exports. At that point, I hope there will be an opportunity for some discussion about how we can each ensure that we have the right safeguards for our respective markets in a way that is more user-friendly and more pragmatic. There are countries in the world that have better and more developed systems for doing this documentation than the European Union.

When it comes to pesticides policy, the Government apply the precautionary principle. Emergency authorisations are an integral part of the precautionary principle, because they allow restrictions on a precautionary basis for certain products while allowing their use where there is a risk that cannot be controlled by any other means. At the beginning of the year, applying that principle, the Government granted an emergency authorisation for the use of thiamethoxam on sugar beet. Sugar beet is a non-flowering crop and we applied a strict condition, which is that the pest pressure should be assessed over the winter months and that the product should only be used if it were deemed necessary and the pest pressure passed a certain threshold. I can tell the House that earlier this week that analysis was published. The threshold was not met due to some of the cold weather we have had. Therefore, the terms of the emergency authorisation are not met and the neonicotinoid in question will not be used this year.

The fishing and fish processing industry continues to be affected by the closure of hospitality nationwide and the impact of border friction arising from Brexit, which has also weakened sales in key Asian markets such as Korea. Will the Secretary of State volunteer his Fisheries Ministers to meet further with me and affected employees? Can he also confirm that the replacement for the European fisheries fund will also benefit the fish processing sector, as well as the fishermen themselves?

My hon. Friend makes a very important point. My ministerial colleague, the Under-Secretary of State for Environment, Food and Rural Affairs, my hon. Friend the Member for Banbury (Victoria Prentis), was nodding to give her assent to a meeting. Indeed, I would also be more than happy to meet fish processors in my hon. Friend’s constituency. I can confirm that the new £100 million fund to develop the fishing industry and infrastructure will be open to fish processors. In addition, those fish processors who have had issues during January, due to the new administrative processes, in exporting to the European Union, are eligible for the fisheries disruption fund and many have already applied.

Fishing boats are tied up and fish exporters are tied up with red tape. Fishing was promised a sea of opportunity, but the reality is that many fishing businesses are on the verge of collapse. Much of the so-called extra fish may not even exist or be able to be caught by British boats. The fishing industry feels betrayed. Is it not now time for the Secretary of State to apologise to the fishing industry for the Brexit deal that his Government negotiated?

I have made it clear all along that the Government had hoped to get closer to a zonal attachment sharing arrangement in that first multi-annual agreement, but the EU has been required to forfeit 25% of the fish that it has historically caught in our waters—a significant uplift—as the price for continued access. That additional fishing quota is worth £140 million.

The pollock quota has gone down in the south-west. There is no apology and no sense of reality from the Secretary of State. He cannot wriggle out on this one—the net is closing in on him. The reality is that fishing has lost trust and confidence in the actions of the Department for Environment, Food and Rural Affairs. For all the broken promises, fishing businesses have closed and others will follow. Why will the Secretary of State not apologise? What will he do to fix the mess that this incompetent Government have created for fishing communities nationwide?

As I said, we have seen, through the trade and co-operation agreement, a significant increase in quotas—25%, worth some £146 million. As we have left the single market and the customs union, there are some new administrative processes in place. That was challenging for the fishing sector during January, which is why we opened a fund to support it. Looking to the long term, however, we have regained control of regulations in our waters, which enables us to do conservation measures on places such as the Dogger Bank that were never possible as an EU country. It has also enabled us to ban pulse trawling in our waters. These are all things that could not be done while we were shackled to the common fisheries policy.

I draw attention to my entry in the Register of Members’ Financial Interests stating that I am a trustee of World Horse Welfare. We have heard from my right hon. Friend this morning that lorryloads of fish are clearing the border in less than an hour, but Olympian Richard Davison tells me that horses that are used for dressage are taking between four and 10 hours to clear the border at Calais because of the requirement for equine health certificates. Please will the Minister tell me what the Government are doing to make sure that there is not a looming animal welfare crisis as temperatures increase and grand prix horses are left standing in lorries for hours on end? [R]

A recent report by the Disability Benefits Consortium said that many disabled people faced a choice between heating and eating during the pandemic and stated that unless legacy benefits were uplifted in line with universal credit, it would be “discriminatory”. Does the Secretary of State therefore feel that the Chancellor’s refusal to do this has discriminated against disabled people while undermining his job to tackle food poverty?

I do not accept that. Obviously, the Chancellor has made an announcement in relation to extending the universal credit uplift to help the financially vulnerable through the current situation. We also announced new rounds of funding late last year to support charities such as FareShare in food redistribution and to support other food charities to help those in need.

Over the last year, we have all learned how vital it is to have access to high-speed broadband, whether that is for home schooling, home working, home shopping or keeping in touch with our friends and families. For residents in cities, an internet connection can be taken for granted, but for many residents in the rural or less well-connected villages in Rother Valley—such as Harthill where I live, Netherthorpe, or even Treeton and Wales—connection is temperamental, slow and in some places completely lacking. We have all adapted to new ways of living and working as a result of the pandemic, but what assurances can my right hon. Friend give me that rural communities such as those in Rother Valley will not be left behind?

My hon. Friend makes a good point. All rural areas need good digital connectivity, including his constituency. The Government have delivered superfast broadband to more than 5 million premises, with 96% of UK premises now able to access superfast speeds. We are investing an unprecedented £5 billion to support deployment of gigabit broadband in the hardest-to-reach areas of the country.

I or one of my ministerial colleagues would be more than happy to meet the hon. Gentleman and others to discuss this. I completely agree with him that deep peat in particular can be an important store of carbon. That is why we have recently announced new restrictions on burning on blanket bog. Restoration of the hydrology of some of those deep peats is a fundamental part of our approach to tackling climate change.

I know that the Minister and the Secretary of State are fully aware of the problems faced by mollusc exporters from grade B waters, but are they aware of the scale? If we are to introduce innovative solutions, such as creating our own depuration plants, we need to be aware that these are sizeable operations and that businesses such as Offshore Shellfish, based in Brixham, need all the support they can get. Will the Minister take that into account and also meet that business and other organisations in my patch?

The Prime Minister’s 10-point plan has been condemned by environmentalists as a wish list, DEFRA has been criticised by the Public Accounts Committee for failing to drive Government policy on the environment, and the Secretary of State’s Environment Bill has been delayed yet again. COP26 is approaching and the UK’s credibility on the environment is close to zero, so can I ask what input he has had into the COP26 ambitions, what the Government hope to get out of COP26 and what he would consider to be a success at the conference?

I clearly do not share the hon. Gentleman’s caricature of the situation. This Government are the first in the world to make it clear that 30% of our international climate finance will go on nature-based solutions. In answer to his question, what we hope to get out of COP26 are ambitious targets around the world to continue to tackle carbon emissions, but also, crucially, a big recognition of the role of nature in tackling climate change.

We have a long-standing trade in live bivalve molluscs to the EU from UK waters. This has benefited both our own shellfish industry and EU restaurants and retailers, which rely on these premium products from the UK.

Recently, concerns have emerged for our trade in live bivalve molluscs to the EU coming from UK class B production waters that have not been through purification or have not cleared testing. The European Commission has changed its position in recent weeks. It advised us in writing in September 2019 that the trade could continue. We shared the Commission’s view and worked with the industry on that basis, and that included explaining that for one small part of the industry—wild harvested molluscs from class B waters—there would need to be a pause while we awaited new export health certificates to become available in April, but that, in line with the guidance from the EU, trade in the molluscs from farms could continue uninterrupted.

We continue to believe that our interpretation of the law and the EU’s original interpretation is correct, that the trade should be able to continue for all relevant molluscs from April, and that there is no reason for a gap at all for molluscs from aquaculture. However, last week the Commission gave us sight of instructions that it sent to all member states on 3 February, stating that any imports into the EU from the UK of live bivalve molluscs for purification from class B waters, such as the sea around Wales and the south-west of England, are not permitted. Exports from class A waters, such as we find around parts of Scotland, may continue.

Bringing an end to this traditional and valuable trade is unacceptable, and I recognise that it is a devastating blow to the businesses that are reliant on the trade. While we do not agree at all with the Commission’s interpretation of the law, we have had to advise traders that their consignments may very well not be accepted at EU ports for now. I am seeking urgent resolution to this problem and have written to Commissioner Kyriakides today. I have emphasised our high shellfish health status and our systems of control. I have also said that if it would assist the trade, we could provide reasonable additional assurances to demonstrate shellfish health, but that this must also recognise the existing high standards and history of trade between us. It is in the EU’s interests to restore this trade. Many businesses in the EU had invested in depuration equipment and are configured around managing the export of molluscs from class B waters.

We have met the industry several times, and it is of course extremely concerned. We are working well with the Shellfish Association of Great Britain, which is taking up the issue in meetings with European counterparts. The molluscs affected include mussels, oysters, clams and cockles. In general, the scallop trade is less affected. Scallop exports may instead undergo pre-export testing, as was the case before exit. However, we know some businesses have not traditionally been working in that way, and we are discussing with them how we may help. The issue does not affect molluscs landed in Northern Ireland. It does, however, affect movements from GB to Northern Ireland.

I know that this issue will be of great concern to many exporters around the country. The Department for Environment, Food and Rural Affairs will continue the technical discussions with the European Commission, and I will update the House with any developments in due course.

Whoever is to blame, the fact is that shellfish farmers and fishermen are not able to export their most valuable product to their most important market. The rule banning imports from third-party countries of untreated shellfish from class B waters has been in place for decades. The Secretary of State claimed in front of the House of Lords EU Environment Sub-Committee last week that the EU had changed its position on how the rules would affect the UK. He had originally told the industry that the ban would be lifted in April, but we now hear it will not. On that basis, will he publish and put in the Library all the correspondence between his Department and the EU that demonstrates why he believed a change would occur? Can he explain to the House today what mechanism he expected the EU to use to make that change?

The letter that the Secretary of State has published today is welcome, but it does not answer those questions. It refers to contact in September 2019, when the UK’s future trading agreement still was not clear. Many fleets are unable to sell their catches and exporters unable to ship and trade. What assessment has his Department made of how many businesses and employees are affected by the situation? What provision has his Department made to use some of the £23 million compensation fund that the Government recently announced to support the businesses who are unable to trade and how long will that support last? A multimillion pound industry has ground to a halt overnight. Jobs and communities are at risk. Unless this situation is resolved, the UK shellfish industry will not survive.

It is the case that in September 2019 the European Commission told us that for wild caught molluscs there would be a need for a new health certificate and, when that was discussed more recently, indicated that that could not come on stream until April. The Commission said that the existing trade in farmed molluscs could continue under existing export health certificates, so it has indeed changed its position. The hon. Lady asks whether I would be prepared to put that correspondence in the Library; I am happy to do so, including the letter I have written to the Commission today and that earlier letter from 2019.

The hon. Lady asks what we wanted to have changed. The answer is that we do not really want anything to be changed. We simply want the European Union to abide by its existing laws. The export of molluscs is governed by the animal health regime, and falls under directive 2006/88/EC and regulation 1251/2008. The directive and regulation are clear that the export of bivalved live molluscs is indeed lawful.

The Commission now seems to be pointing to separate public health regulations, namely regulation 853/2004 and regulation 2019/628, and suggests that they are the reason for a prohibition on sale. Again, that is incorrect, because legislation is clear through article 12 of the Commission implementing regulation 2019/628, which makes it clear that it does not apply where the molluscs are exported to a depuration centre. That is because when they are sent to a depuration centre, they are not yet food for sale. Therefore, the reason given by the European Commission for this change in position is not consistent with the EU’s existing law. That is why we will continue to raise these issues with the Commission because under both the aquatic animal health regime and the public health regulations that the EU has cited, there is no legal justification for a bar on this trade.

This is all very disappointing and unfair. Following what the hon. Member for Barnsley East (Stephanie Peacock) has just said, I have many small independent fishermen and wholesalers whose very livelihoods depend on the export of live molluscs to the European Union. I know that my right hon. Friend is working very hard on the issue, but will he redouble his efforts? We just want the law to be upheld. The EU changed its mind on vaccines; perhaps it will change its mind on shellfish.

My hon. Friend makes an important point. We believe that the EU has simply made an error in interpretation of the law in all the regulations it has cited. We are working closely with it to try to resolve this at a technical level. We do not think that the ban it has put in place is at all justified and, indeed, it represents a complete about turn on everything the EU has told us to date. We want the EU market to have access to the fantastic shellfish we produce in constituencies such as my hon. Friend’s.

The past five weeks have been an absolute nightmare for food-exporting businesses. Fishing businesses face bankruptcy, dairies cannot shift their cheeses, and meat was sitting rotting in lorries, stuck in customs. Small businesses ended mail order deliveries to Northern Ireland and European truckers are refusing UK loads bound for Europe for fear that they will end up stuck in a lorry park in Kent. Forty years of building good customer bases in Europe have been swept away in one month by this Government’s incompetence. The Government blamed the companies for not getting the paperwork right, said it was teething problems or blamed the French, the Dutch or any other big boy who might have done it and run away. Will the Government accept that the fault and the blame lie with them, because they made a bollocks of Brexit? Will they go back to the EU to seek a grace period and new negotiations on market access, even if that means accepting some regulatory alignment?

We will not accept regulatory alignment. This country voted to become an independent, self-governing country again, and to make its own laws again. We were elected as a Government on a clear manifesto commitment to deliver what people voted for in the referendum, and that is what we have done.

Of course, there have been teething problems in these early stages, as people familiarise themselves with new paperwork—not just businesses, but border control post inspectors in France and in the Netherlands, who are also on quite a steep learning curve. They are getting better, and we are working with them to iron out difficulties: for instance, the French at one point said that everything needed to be in blue ink, but they now accept that that is not correct and is not what is required in law. We are working to iron out those difficulties, working with authorities in France, the Netherlands and Ireland to try to improve these processes, and of course we would be willing to have a discussion with the European Commission about how we might modernise some of the forms they have to make them more user-friendly.

I did not realise that “bollocks” was parliamentary language, Madam Deputy Speaker, but obviously that is for you to decide.

My right hon. Friend is very familiar with the Filey fishing community, and lobster and crab are important markets for them. Food exporters of all types are currently finding it more difficult in instances to export to the EU than to non-EU countries and, as he said in his opening remarks, this seems to be a consistency problem related to a common understanding of the rules. Will he do whatever he can to build an agreement that deals with food and plant exports and resolves these issues as soon as possible?

My hon. Friend makes a very important point. I have focused my comments so far on bivalve molluscs, where the European Union is now proposing an outright ban, which is a change from its former position. We are aware that there have also been some teething issues in other sections of the shellfish industry, notably crabs and lobsters, particularly when they are exported live. There have been improvements: a lot of consignments are now going through the short straits, clearing border control posts, often in no more than 45 minutes, and reaching their destination on time. However, I agree with my hon. Friend that the paperwork associated with that could be improved. That would require the EU to engage constructively in such a discussion.

On the matter of unparliamentary language, the hon. Member for Thirsk and Malton (Kevin Hollinrake) is quite right to question the matter. The hon. Member for Edinburgh North and Leith (Deidre Brock) uttered a phrase that I would not have allowed had she directed it specifically at any individual Member of this House. I did not interrupt her for the way in which she used it in her question, but I remind all hon. Members that regardless of whether they are participating virtually or physically, they ought to be very careful never to use any language that could be considered offensive. We are honourable Members in this place.

Families in Flookburgh in my constituency have fished on the sands for centuries. In recent generations, they have built a market that means the majority of their catch is sold in France. The Government’s failure to secure export rights for Flookburgh fishermen is a negligent betrayal of my communities. My constituents do not care whose fault it is, and are not impressed with the Secretary of State’s buck passing while their livelihoods are destroyed. Will he be clear about what he will do to compensate my constituents and restore their access to live shellfish markets, as they had been promised?

The UK Government, the hon. Gentleman’s constituents and other bivalve mollusc producers around the country were all promised by the European Commission that this trade could continue. We are all greatly disappointed by the about-turn by the European Union, which made the change just last week. I have written to the Commissioner setting out why that approach is wrong in law. We will be progressing those technical discussions, so that this trade can resume, since there is no justification—neither animal health nor plant health—for such a ban to be put in place.

Does my right hon. It changed its position just last week, having assured us all along that it simply sought a new export health certificate for wild-caught molluscs. May I seek clarity from the Secretary of State in relation to the measures being taken to support the Northern Ireland fleet in making the shipment of shellfish landed in GB and returned to Northern Ireland unfettered? May I also take this opportunity to urge him to ensure that opportunities are maximised for our Northern Ireland fleet by delivering a full Brexit dividend in the allocation of extra quota won from the EU?

As I said in my opening comments, the ban that the EU proposed does not affect bivalve molluscs that are landed into Northern Ireland or that are farmed in Northern Ireland waters. It is a restriction on GB trade, although under the Northern Ireland protocol, it could affect the trade in these molluscs from GB to Northern Ireland. As the hon. Lady points out, we are working on other issues with the Northern Ireland industry, particularly around the allocation of new quota as we depart from relative stability.

With your permission, Madam Deputy Speaker, I would like to offer my sincere condolences to the family of the Cornish fisherman who died while fishing off the coast of the Isles of Scilly at the weekend and remember the fishermen onboard who witnessed this horror.

The Government and the Secretary of State are right to do everything to unblock this. Shellfish is normally purified or processed in the EU before it is distributed to supermarkets, restaurants and bars. Surely a further course of action available to the Government is to urgently fund the setting up of the necessary processing plants in the UK and identify what other infrastructure investment is needed to satisfy and increase our export market. Will the Secretary of State support those investment priorities, including here in Newlyn?

First, I join my hon. Friend in offering our condolences to the family of the fisherman who was tragically killed in an accident off the Isles of Scilly over the weekend. It is a reminder that fishing is a dangerous occupation, and our thoughts are with his family at this very difficult time.

My hon. Friend makes a very important point, which we will consider: if we are unable to unblock the current situation and get access to the EU for our undepurated shellfish, one of the options available to us is to support the industry in procuring the depuration equipment, so that it can be done here. We will be exploring that and other options.

Despite the EU’s well documented position on third country exports, the Government breezily assured our shellfish industry that the ban would be lifted. We now know that that is not the case. Agriculture and fishing are devolved; negotiating trade deals is not. It is this Government’s responsibility that the Welsh shellfish industry is now unable to export to Europe, and further proof—if any were needed—that Wales needs a seat at the table when it comes to negotiating. Will the Government now guarantee to cover the costs of all necessary export facilities for Welsh businesses such as Bangor Mussel Producers in Gwynedd, which are presently unable to trade with their export market?

As I pointed out earlier, it is not the case that we sought assurances or thought we had them and that the EU has not made a change to accommodate this trade. Nor is it the case that the EU had a ban on the trade from third countries for bivalve molluscs. Indeed, its own health certificate—in the notes to guide it—makes it very clear it is within scope, because it states:

“This certificate is to be used for the entry into the Union of consignments of live aquatic animals intended for all other aquaculture establishments including purification centres”.

So the status quo law the EU has does allow this trade to continue. That is the guidance that the EU gave us all along. It has changed its position. In the short term, our objective is to get the EU to abide by its own laws and legal processes here. Obviously, if it refuses to do so, or it decides to change its law to make things more difficult, we will consider what steps are necessary at that point to support industry.

Under the terms of the UK-EU trade deal, two committees are to be set up: a trade-specialised committee on sanitary and phytosanitary measures; and a specialised committee on fisheries. If those are not being set up, which they should be given the urgency of those issues, surely it is right to move towards an arbitration panel to figure out what can be done. The fishermen of Brixham, Salcombe and Dartmouth are incredibly worried about that point and, if they go under, they expect compensation from the EU for changing its mind over this issue.

My hon. Friend makes an important point. Under the trade and co-operation agreement, there is provision for a specialised committee dealing with SPS issues. There are some early discussions on what that would look like—it would probably be a senior level technical group, probably led by our chief veterinary officer. At the moment, the issue is that the EU, because it has not even got around to ratifying the TCA, is not yet in a place to have formal discussions on how we would form those groups. That of course does not prevent us from doing what we are doing, which is working very closely with the EU at a technical level to iron out the difficulties.

The Prime Minister and Conservative Ministers made grand promises about how they would take back control of our fishing waters and how the fishing industry would prosper. The Leader of the House stood there recently, smiling and saying that

“they are now British fish, and they are better and happier fish for it.”—[Official Report, 14 January 2021; Vol. 687, c. 510.]

The reality, however, is that our shellfish industry is on the verge of collapse and that, thanks to this Government, costly new red tape and bureaucracy are holding back British businesses and our economic recovery. Does the Secretary of State accept that no business, consumer or community should have to pay the price for this Government’s incompetence?

The reality of the trade and co-operation agreement is that its fisheries section delivered a 25% uplift in fishing opportunities, a rebalancing of the sharing arrangements and an abandonment of relative stability as the quid pro quo for granting the EU continued access to our waters for five and a half years. We are free to review it after that. We also have the freedom to set our own regulations in this area. But we recognise that there have been teething problems. That is why the Government announced a new £23 million fisheries disruption fund to support those businesses that struggled with the paperwork in the initial weeks.

Fishermen who land scallops into Scarborough and Whitby have been told by their wholesalers that there is no market for their fish, so they are currently tied up, despite approaching peak season, which ends at the end of April. Is the situation with regards to the European Commission—this flies in the face of the advice it gave in September 2019—an example of its vindictiveness, or its incompetence? Will the Secretary of State write to the chair of the European Parliament Fisheries Committee, whose job it is to hold the Commission to account?

My right hon. Friend makes an important and a good suggestion, so I will indeed write to the chair of the fisheries committee to ensure that they are apprised of the discussions that we are also having with the European Commission. I am happy to do that.

My right hon. Friend invites me to comment on why the EU might have done this. I am afraid I am not going to be drawn on that, since I do not know. We very much hope that on reflection the European Union will look at this again and realise that the judgment it has made on the legal position is wrong and that it can adjust it at this late stage.

What compensation do the Government intend to provide to the shellfish industry and other fishing industries, and boats like the Kirkella, which I have mentioned many times and currently remains tied up in Hull unable to fish?

We have announced a £23 million fisheries disruption fund specifically to help those exporters who attempted to send consignments of shellfish, or indeed any other fish, during the month of January and encountered difficulties and delays that led to a verifiable loss. On the issue of access to Norwegian waters to catch cod, which, as the hon. Lady highlights, is what the Kirkella vessel undertakes, it is not unusual, in the absence of a bilateral agreement, for access to one another’s waters to be suspended during the month of January. The normal situation is that once an agreement is in place, that access resumes, and I am sure that the Kirkella would be able to catch anything it might be allocated under that agreement.

Will the Secretary of State work with fish and general food retailers to promote and sell more of our great fish and other food products to domestic consumers? Will that in mind, will he urgently make grants available to expand cleansing facilities for shellfish, because we will need them for the domestic market?

I very much agree with my right hon. Friend. It is important that we build domestic demand. Indeed, many fish processors say that demand in the European Union is flat anyway because of the coronavirus and the lockdown, while UK retail demand remains quite buoyant for some species, although sadly not for all—in particular, the shellfish sector is quite reliant on export trade. He is right that we should do more to promote fish, and we are working on a project with Seafish that the Government will co-fund to help build demand in exactly the way he outlines.

Scotland Food and Drink has said:

“There’s still a huge amount of uncertainty. It feels like we’re scrabbling around in the dark”.

Does the Secretary of State think that suggesting that businesses “give it a go” is alleviating uncertainty for them or perpetuating their feeling of being lost in darkness?

We have been working closely with the industry over the past month to iron out some of the difficulties that have been encountered, helping businesses to understand where they have made some small errors on the paperwork at the beginning, helping to understand from businesses the problems that they are encountering on the French side of border control posts, and helping to understand any errors that fish certifying officers might have made. We are meeting twice a week in a stakeholder group, working very closely with industry to resolve all the problems being encountered.

With your permission, Madam Deputy Speaker, I would like to send my condolences to the family of my constituent who suffered a fatal accident aboard a Newlyn fishing vessel on Saturday. It is almost a decade since Neil was killed, and I know how they feel.

I know that my right hon. Friend has tried his best, but the time has now come to show the EU that we will not surrender to its games over these shellfish exports. I call on him to start the necessary and frequent boardings on EU vessels in our exclusive economic zone to ensure that they comply with UK laws. If we disrupt their fishing activity, so be it, but we must show the fishing industry support and also provide details of the promised financial support without which our industry will not survive.

I thank my hon. Friend for her comments. I appreciate that this was a constituent of hers and that it was therefore close to home. All parts of the House also recognise the personal tragedy she suffered with the loss of her husband, Neil.

On my hon. Friend’s wider point about the approach we are taking to the European Union, in many, many areas we have taken a pragmatic, sensible, phased approach in the initial months, but there is no obligation on us to continue that. Indeed, as she points out, we want to see some reciprocation from the EU on the application of common sense and reasonableness. We reserve our position in all those other areas. Of course, it goes without saying that any EU vessels accessing UK waters will need to abide by UK law.

Our superb west country shellfish sector faces ruin because of the Government’s botched Brexit deal. The Secretary of State has said repeatedly that he does not want to water down UK food standards now that we have left the EU, so why not do what fellow non-EU fishing nation Norway does and agree to European food standards? That would solve these problems in one fell swoop.

I do not think it would solve this issue in one fell swoop, since the regulations that require the depuration of molluscs coming from class B waters are already in EU law. This is really a change that the EU is making to its law. It is not even that the EU would accept it if we had the same approach; indeed, standards in our own waters are higher than in most EU waters. I therefore do not accept that offering to align with the EU would be of any assistance at all in this instance. What we need is for the EU to abide by its own laws.

On vaccines, on Northern Ireland and now on fishing, is it not the case that the EU says one thing and does the other? Will the Government supercharge their investment in the UK fish processing industry so that coastal communities like mine in Redcar and Cleveland can be supported?

Yes, indeed, as we leave the European Union there is an opportunity to build back those coastal communities and invest in aquaculture, port facilities and fish processing facilities. Did the Secretary of State know, when the Prime Minister dumped his half-empty EU deal on us on Christmas eve, that it might mean export bans for fishermen from south Wales fishing in the Welsh sea for cockles, mussels and oysters? If he did, why did he not make arrangements for those products to be sold for British consumers, and in particular those in food need? Will he make such arrangements so that those fishermen can face a sustainable livelihood and not possible bankruptcy?

We did not know that there would be such a ban since, at that point, the European Commission was telling us that the trade could continue with the exception of wild-caught molluscs, for which it said there would be a short delay while an export health certificate was designed. This is a complete change in position by the European Union that occurred just last week.

Businesses such as Menai Oysters and Mussels in my constituency are struggling to export their molluscs because our Welsh sea waters are grade B and they will not be accepted into EU ports. What can my right hon. Friend the Secretary of State say to reassure local businesses on Ynys Môn that this matter will be resolved?

We are doing everything possible to get the European Union to revisit the decision it appears to have taken and revert to its original interpretation of the law, which we believe to be right. We believe the approach it has taken is not consistent with EU law and is completely unjustified under either animal health or public health reasons. The UK currently has a very basic trading regime with the EU with respect to food, akin to World Trade Organisation rules. Surely these problems with shellfish and other food exports point to the need for a UK-EU veterinary agreement, which could be negotiated through the sanitary and phytosanitary standards specialised committee. Does the Secretary of State recognise that such an agreement would go a long way to defusing many of the current tensions around the Northern Ireland protocol?

I very much agree with the point that the hon. Gentleman raises. Of course, during the negotiations, we made arguments to the European Union around equivalence—the fact that we could recognise each other’s equivalence and have more proportionate regimes. At that point, the EU was simply unwilling to entertain such a discussion, but it has veterinary agreements with countries such as New Zealand, with lower levels of inspection and simpler procedures to enable trade to continue. Of course, we very much hope that, now that the trade and co-operation agreement is in place, the EU will see fit to be much more pragmatic and proportionate in the measures it puts in place.

At the weekend, I got to enjoy some amazing St Austell bay mussels, which I get to watch being harvested by the sea regularly through my window. However, that exceptional produce, along with Cornish scallops and Cornish oysters, currently cannot be enjoyed by people in France or across Europe because of the change in policy by the European Commission. The Secretary of State will know what a devastating impact that is having on the Cornish fishing industry and how urgently action is required. What discussions has he had with the European Commission about its change in policy, and what hope can he give us of progress being made in the coming days?

My hon. Friend does indeed have some fantastic mussels grown at St Austell; I visited one of the mussel farms there myself. We have written to Commissioner Kyriakides today, but my officials and the chief veterinary officer have been in regular dialogue with officials in the Commission over the last couple of weeks on this matter and, as I said, a change in position manifested itself just last week. We are in regular dialogue, and in my letter to the commissioner I requested an urgent discussion on this matter.

Deepdock, a mussel exporting specialist, says that it now requires 41 pieces of paper to ship 10 bags of mussels to the EU where only one was required before. Is this just, as the Secretary of State likes to say, a teething issue, or is it yet another sign that the Tories’ Brexit deal has completely failed the UK’s fishing industry and communities?

It is the case that people seeking to export all fish or products of animal origin will now require an export health certificate. It is also the case that the design of the forms that the EU prescribes in the schedule to its animal health regulation is sometimes a little clunky and not particularly user-friendly. We have had many suggestions from industry about how the form could be improved, particularly from businesses that are experienced in exporting around the world to other developed countries, many of which do this far better than the European Union. We will obviously seek to learn the lessons from that and try to encourage the European Union to change the nature of its forms.

This arbitrary action by the European Commission is causing real concern in fishing communities that have already suffered losses from export disruption, and I urge the Secretary of State to confirm details of the compensation scheme. While I strongly support his efforts to have this ban lifted, will he also put in place contingency arrangements to support fishing firms in King’s Lynn and elsewhere, with grants for purification facilities?

Does the Secretary of State have any idea of the devastating financial impact that the ban is going to have on historic cockling communities such as Penclawdd in Gower? What conversations has he been having with the Welsh Government to ensure that the fisheries disruption fund reaches Penclawdd?

As I said in my opening remarks, we realise that this situation is devastating for many sections of the mollusc industry. We recognise that a large proportion of bivalve molluscs—in some cases up to 80%—are exported, which is why we are working so hard to get the Commission to revisit its decision. We have indeed had conversations about the fisheries disruption fund. It is a UK-wide scheme and will be open to anybody, including those from Wales, who attempted to export and ran into difficulties.

I thank my right hon. Friend for his letter to the EU Commission that addressed these issues, but what is being done to ensure that generations of fishermen, such as those in Ilfracombe in my North Devon constituency, can return their fleets to the waters and do not moor up forever? Will my right hon. Friend assure desperate fishermen who have had no income all year that they can rapidly access the announced £23 million and the £100 million fund, to give them hope for the future?

We will shortly announce further details on and open the fisheries disruption fund for those exporters who encountered difficulties in January. I assure my hon. Friend that we recognise the impact of the European Union’s change of heart on the bivalve-mollusc industry, which is why we are working to unblock the problem. This particular step by the European Union does not affect the wider shellfish industry, including not only most scallop producers in the catching sector but those doing crabs and lobsters, but we recognise that some of those producers nevertheless encountered difficulties in January, and the fisheries disruption fund is there to support them.

I associate myself with the comments of colleagues and send my condolences to the family of the fisherman who was lost this weekend.

I thank my right hon. Friend for his work to resolve this matter. I reiterate that it is vital that the cash assistance reaches not only the affected shellfish exporters but the smallest boats on the Fal estuary, which are currently tied up and facing serious difficulties. What is my right hon. Friend’s assessment of the opinion of some in the industry that its French market was, in fact, intact and profitable, despite restaurants in France having been closed in November and December, but is now non-existent, which adds to the current issues?

My hon. Friend and neighbouring MP has an important heritage oyster fishery in the Fal. I have been on board one of the vessels and seen its work at first hand. The export market will of course be important for some oyster fisheries, including the farmed oyster sector. As I have said, we are working very hard to try to get the position resolved. There will be a good future for our fishing industry once we can resolve these particular issues.

I am updating the House on publication of a consultation on delivery of the next phase of our 25-year strategy to eradicate bovine TB (bTB) in England by 2038.

BTB is one of the most difficult and intractable animal health challenges that England faces today. In the last year, we compulsorily slaughtered over 27,000 cattle in England to tackle the disease. This causes devastation and distress for hard-working farmers and rural communities and is damaging our reputation as world leaders in high standards of animal health and welfare.

The bTB eradication strategy we published in 2014 is making progress. We are now seeing sustained improvements in the high-risk area. We need to build on this momentum to achieve bTB free status for England by 2038.

In 2018, my predecessor commissioned Professor Sir Charles Godfray to conduct an independent review of our strategy (“the Godfray review”). In March 2020, we published a response setting out key priorities for the next phase. Today, I am launching a public consultation and a call for views on a range of proposals and longer-term options in keeping with that response, to take us into this next phase.

I am also pleased to report that work on developing a deployable cattle bTB vaccine continues and is on track to be completed within the next five years. Our goal is to deliver on the significant investment we have made to date in developing a candidate diagnostic test to detect infected animals among vaccinated animals to enable use of the vaccine. Although a cattle bTB vaccine will not be the single solution to the problem of bTB, it will be a strong additional tool at our disposal. The Animal and Plant Health Agency (APHA) has awarded a contract to Eville & Jones to run veterinary field trials aimed at generating the necessary evidence to enable UK marketing authorisations. The trials are scheduled to get under way in the coming months.

Badger culling is one of the most contentious and divisive policies within our bTB eradication strategy. Our current policy enables four-year intensive cull licences in defined areas with scope for a further five years of supplementary culling. The consultation sets out proposals for Natural England (NE) to stop issuing the current intensive cull licences for new areas post 2022 and enable new licences issued to be cut short if the chief veterinary officer considers this acceptable. Furthermore, I am proposing to restrict any new supplementary cull licences to two years and cease re-issuing such licences in any areas in which supplementary culling has previously been licensed.

As proposed in the Government’s response to the Godfray review, APHA recently released a new analysis showing the estimated distribution of TB infection in badgers in England’s bTB edge area. This will be of assistance to NE in assessing applications for badger culling and vaccination licences in the future.

The farming community has invested heavily in badger culling, which the evidence shows has played a critical role in helping to start to turn the tide on this terrible disease. But we were clear that culling badgers indefinitely is not acceptable. My proposed approach will enable us to complete the objective we set out to achieve when we started the culls. It will also support our stated intention of phasing out culling over the next few years. I envisage that in future some form of culling would be an option in exceptional circumstances to address any local disease flare-ups. This transitional period will also give us time to undertake badger vaccination pilots and develop our future badger vaccination policy. The end of widespread culling is also anticipated to coincide with changes in cattle measures, including our timeline for a deployable cattle bTB vaccine. Taken together, it is anticipated that these cattle and badger measures should preserve the benefits from intensive culling.

I am also proposing some targeted changes to our cattle bTB testing policy, to ensure we root out the disease more effectively in herds with recurring problems, and further help protect lower bTB risk areas.

In parallel to the consultation, I am also seeking views to explore other options for further accelerating eradication of disease. These include possible further changes and improvements to bTB testing, supporting responsible cattle movements and rewarding low-risk cattle purchasing behaviour. Our call for views also discusses ways we can continue to adapt how we reward farmers for “best practice”, in line with our wider agricultural transition plan.

There is no single solution to the scourge of bTB, but by deploying a range of policy interventions we can continue to turn the tide on this terrible disease and achieve our long-term objective of eradicating it in England by 2038.
