Commons ChamberI pay tribute to prison officers for the amazing job that they have done—particularly through the pandemic, but also more generally. We often pay tribute to frontline emergency service workers, but prison officers in particular are out of sight, out of mind. That is why it is so important that we followed the recommendations of the pay review body. I can tell the hon. Gentleman that since 2016 the number of full-time prison officers has increased by 3,662.
Despite IPP sentences having been abolished more than 10 years ago, 2,926 IPP prisoners were still in custody as of June 2022, of whom 608 were 10 years over their original tariff. Does my right hon. Friend agree that many of those people are locked in prison as a result of mental health conditions that they have developed while in custody, rather than because of the threat that they pose to the public?
My hon. Friend has raised the issue with me a number of times, and I respect his view. Of course, we have repealed the IPP legislation, but we are dealing retrospectively with the backlog of cases. I can understand some of the issues that he has raised; I think the right way to approach them is to ensure that offenders who can be released safely get the support, training and rehabilitation that they need to convince decision makers that releasing them is safe. That is the approach that we take, but I am very mindful of the issue and am continually looking at what more we can do.

Commons ChamberAlthough I welcome the Secretary of State’s commitment to increasing rape charging rates and the positive news regarding rape convictions, the facts suggest that what is happening is somewhat to the contrary. In the year ending March 2022, the police recorded the highest annual number of rape offences to date—70,330—but charges were brought in only 2,223 cases. With the split in responsibility between the Home Office and the Ministry of Justice, what steps can my right hon. Friend take, working with his Home Office colleagues, to make sure that more people are charged and put before the courts?
I thank and pay tribute to my hon. Friend for all his work on this issue and the considerable experience that he brings to bear. I read out the statistics and there is clearly more work to be done, but, actually, the trajectory of the latest figures is going in a better direction. The decision making on CPS charging is independent, but it is critical that we proceed with the national roll-out of Operation Soteria, because it is proving to be a very effective tool in getting the police and the CPS to work together more collaboratively to bring forward cases that can go to court.

Commons ChamberThere is no silver bullet that can solve that issue and the small boats issue. Even pulling out of the European convention will not provide a silver bullet. However, I can reassure my hon. Friend—I am happy to talk him through this—that, when it comes to deportation of foreign national offenders or public interest in removals more generally, there will be respect and greater deference to primary legislation passed by this House. In addition, our approach to rule 39 interim orders will mean that we can give him and his constituents the assurances they need.
I welcome my right hon. Friend’s statement. It is rather curious that he is being criticised for acting on the democratic mandate given to him by millions of our fellow citizens who voted on our manifesto. Millions voted, in both the Brexit referendum and the general election in 2019, for control of our borders and to prevent illegal immigration. It is the job of courts to interpret the will of Parliament, not to invent law themselves. Therefore, the Bill of Rights will not only protect the fundamental rights that we all enjoy; it will give the democratic voice of the British people a role in the decision-making process.
My hon. Friend is absolutely right. In a democracy, we command, rule and govern by consent. We are at risk of losing public confidence in our immigration controls if we cannot take the common-sense measures that they expect. We are also at risk of losing public confidence in human rights if we do not restore a healthy dose of common sense.
