Commons ChamberI thank my hon. Friend for her comments. To give her reassurance, all our trade negotiating teams have Department for Environment, Food and Rural Affairs teams within them. They are the experts from the UK Government, and they are absolutely at the heart of our negotiating teams not only for these deals, but for those we are working on now.
Part of the challenge—I understand the anxiety that has appeared, about which I hope the safeguards for these two deals have provided reassurance—is that these are of course the first two of a large number of trade deals. We are looking to accede to the comprehensive and progressive agreement for trans-Pacific partnership, under which we will have enormous opportunities for our agriculture producers to export to something like a £9 trillion marketplace. The Australian and New Zealand trade deals are the first two of many that will afford great opportunities for some of the finest products in the world. I think we are all concerned in standing up for our constituents and ensuring the opportunity to find new export markets for those goods.
My concern is not for the enormous farming conglomerates that we see across swathes of the countryside, but for the small tenant farmers in my constituency. They are a critical part not just of my constituency—which, incidentally, helps feed the country—but of our farming heritage. I think it is those smaller farmers that colleagues across the House are so concerned to understand, support and, if necessary, protect.
My hon. Friend is absolutely right, and that is why we have built into these first two of our trade deals these very clear and robust safeguards, so that there cannot in the early years be the sort of surges that could risk the success of our important tenant farmers. That is also why the work that the National Farmers Union and the National Farmers Union of Scotland do is so important in helping our farming communities.
I too have many small tenanted farms in my constituency, and this is the opportunity for them to work together and to work in the new markets that will be appearing thanks to the continuing new trade deals we will strike. This is about how we can get the maximum benefit not only as they produce for our own domestic markets, but, if they choose to do so, as they export some of the finest meat in the world to new and growing markets across the world.
These two trade deals are very much the first two anchor points, as it were, of a broad and wide set of trade deals that will afford such opportunities to all our farmers, from the large farmers that are very good at fighting their own corner through to—exactly as my hon. Friend points out—our small but incredibly important farmers across our rural communities. Their importance is not only in the food they produce, but in land management and, indeed, in the wider community, so that is at the heart of the plan.
As I say, the negotiating teams that the Department for International Trade take to these negotiations have at their heart teams of experts from the Department for Environment, Food and Rural Affairs, as well as from other Departments as required for each of the chapters in the trade deals.

Commons ChamberEncouraging women to return to work after a career break is key to our prosperity and to levelling up opportunities for all. The Government funds 25 programmes to support people to return to work after a career break, including careers in health, policing and legal services, and I am delighted to announce today the launch of the return to social work programme to support previously certified social workers to return to this vital profession.
Mr Speaker, you may think I am young, but as someone who was elected to this place just a few months before my 50th birthday, may I say how fantastic it is to start a new career and be given a second chance? I often meet women in their 50s and 60s who have so much to offer but do not want to go back to the careers they had before. What more can we do to help those women get the skills and opportunities that they deserve?
My hon. Friend is an exemplar of the fantastic contribution that women in their 50s can make to a workplace. We know that there are 4.5 million women aged 50 to 64 in employment, and we are committed to supporting older workers to remain in the labour market through our work on the Fuller Working Lives strategy and through the appointment of a business champion for older workers to spearhead our work to support employers to retain, retrain and recruit older workers.
Can the Minister clarify whether the Government’s commitment to investing in infrastructure will include support to improve social infrastructure, such as childcare?
I am so glad that the hon. Lady has raised that subject. Childcare is, of course, a vital part of this Government’s programme to level up opportunities across the country. I suspect we shall be hearing a little bit more on childcare from relevant Ministers in questions in due course, but we are clear that we want the workplace to be welcoming to everyone. We want to harness their talents and unleash their potential, and helping parents with childcare is vital to that.
Evidence to the Women and Equalities Committee showed that some women experience unwanted career breaks, particularly when they are pregnant or they are new mums, and sometimes those are covered up by non-disclosure agreements. What action is my hon. Friend taking to ensure that non-disclosure agreements are not used to cover up unlawful behaviour, particularly pregnancy discrimination?
My right hon. Friend has been an incredibly ardent campaigner on that important issue and I thank her for all her work on it. As I hope she knows, the Government have consulted on the use of non-disclosure agreements and my hon. Friend the Under-Secretary of State for Work and Pensions, my hon. Friend the Member for Mid Sussex (Mims Davies), is committed to legislating in due course in that vital area.
We are proud to be hosting our international conference on global LGBT rights in May, a key theme of which will be the safety of LGBT people around the world. Hate crime is completely unacceptable and has no place in British society. We are committed to tackling homophobic, biphobic and transphobic hate crime, and we are working with the Law Commission on a review of current hate crime legislation, which is due to report early next year.
The Minister will no doubt be aware of the serious rise in hate crimes against the LGBT+ community, and particularly the trans community. Hate crimes are up by 25% against the LGBT+ community and up by 37% against the trans community in the past year. Those are shocking rises, and it is not just due to the fivefold increase in reporting. They are shocking statistics. Does she agree that sex and relationships education in schools is crucial, as is responsible reporting, particularly on issues facing the trans community?
I do agree with the hon. Gentleman, and I am grateful to him for his question. Sadly, he is right about the increase in hate crime against LGBT people, and he is right that educating children at school so that we change the culture that may exist among some people is one of the many ways we can tackle this.
This is my first time at the Dispatch Box this year, so may I congratulate you on your re-election, Mr Speaker, and say happy new year to all the staff in the House?
I thank the Minister for her response. Now that the general election is over, there seems to be no need to prolong the decision making any further. She should have had plenty of time to study carefully the consultation on the Gender Recognition Act 2004 and consider the Government’s response. Will she take this opportunity to update the House?
I am grateful to the hon. Lady for that. She knows how complex this area is. We are working carefully and methodically through the results of the consultation. We are clear that we want to protect trans adults’ rights and protect single-sex spaces for women. We do not want to rush into this; we want to get it right.
There are more than 2 million adult victims of domestic abuse in England and Wales, and last year in Leicestershire—my hon. Friend’s county—there were 21,000 domestic abuse-related incidents and crimes. The Government are determined to bring forward the landmark domestic abuse Bill and to enact that legislation as quickly as possible to protect and support the victims of domestic abuse and bring perpetrators to justice.
As a GP, I find that domestic violence cases are one of the hardest types of cases: they are difficult both to identify and to deal with, and that is sad. What are the Minister and her Department doing to help to educate those who work in primary care not only on how to identify people who suffer with domestic violent but on how to signpost them to the correct services?
I thank my hon. Friend for that question and welcome all the experience and expertise that he brings to the House. All staff who work in the NHS must undertake at least level 1 safeguarding training, which includes domestic abuse. We have published an online resource for health professionals, to improve awareness of domestic violence and abuse. NHS England is developing a four-year action plan specifically on domestic abuse to raise awareness among NHS staff to ensure that they have the skills to identify and refer patients, where appropriate, and also, of course, to address the issue of NHS staff who are themselves victims.
County lines exploitation has a devasting impact on our communities, and we of course recognise the risks to girls and young women who are exploited by these ruthless gangs—including, often, for sexual exploitation. The National Crime Agency threat assessment published last year sets out the scale of the issue and the level of exploitation faced by women and girls, which is why we are investing £25 million to disrupt county lines gangs and put an end to this exploitation.
We think that at least one in 10 people involved in county lines are girls, and the number is probably a lot higher than that. Her Majesty’s inspectorate of constabulary has just published a report on how the police and the NCA are dealing with county lines, and it has a number of really excellent recommendations, many of them about different agencies working together. One recommendation is that by the end of the year there should be a legal definition of child criminal exploitation, so that everybody understands what it is and what they should do about it. Does the Minister agree and will she be working to that goal?
As the chair of the all-party group on knife crime, the hon. Lady will know that the Government are working on a public health approach to tackling serious violence. We are very much looking at the workings of agencies, including the police. The hon. Lady will welcome the fact that the National County Lines Coordination Centre has conducted more than 2,500 arrests and safeguarded more than 3,000 people. Of course, that work continues. One of the many ways in which we support those who are exploited is to fund young people’s advocates in London, Manchester and the west midlands to work directly with gang-affected women and girls, particularly if they have been victims or are at risk of sexual violence.
I feel as though I am earning my salary this morning, Mr Speaker, which is why I am so pleased that I about to talk about the gender pay gap.
We have conducted analysis of where women face disadvantages in the workplace and are finalising sector-specific action plans. I can announce that Government Departments are leading the way by publishing their data and action plans today. We want employers to go beyond reporting data on the gender pay gap and create genuinely inclusive workplaces for everyone.
Samira Ahmed’s successful pay discrimination claim against the BBC will have far-reaching implications for other women working at the BBC who will now see their gender pay gap addressed. Samira Ahmed was only able to bring her claim because she knew what male colleagues were earning. What are the Government going to do to assist women employees of the 1.3 million small and medium-sized enterprises who are currently reliant on chance to discover whether they are subject to pay discrimination, because there is no gender pay reporting requirement?
I hope the hon. Member will understand that I cannot comment on individual cases, but I met BBC executives this week to discuss their overall approach to equal pay and the gender pay gap. I take the point about smaller businesses. We have been very clear that we need to gather data over several years to see how the approach is working—whether we are asking the right questions and whether there are other questions to be asked. We very much hope and expect that the approach to larger businesses will trickle down to smaller businesses, particularly with regard to action plans.
I am grateful to the hon. Lady for her question. She will know that the report was part of the Government’s review of rape and how the criminal justice system is dealing with it. The review is ongoing and we are looking at other aspects, including the conduct of the police in rape investigations and how the criminal justice system is treating victims, given the rates of attrition. Regarding discussions with the Ministry of Justice, the Lord Chancellor is as committed to the review as the Home Secretary and I are. We expect at the end of the review to come up with meaty proposals to ensure that victims of rape and sexual assault get the justice they deserve.

Commons ChamberThis is the third year of gender pay gap reporting. We are focusing on the three sectors that employ the most women, and also on those with large gender pay gaps, such as financial services. Work is already under way on, for instance, the independent review of the gender pay gap in medicine, the recommendations of which will be published shortly. I am delighted that experts on the Women’s Business Council are helping us with our work in the retail and financial sectors in particular.
The Scottish Government have lowered the threshold for listed public authorities to report their gender pay gaps and publish equal pay statements from more than 150 employees to more than 20. Will the UK Government consider lowering their threshold as well to increase equal-pay transparency?
I am delighted to hear what the Scottish Government are doing. We keep that and other measures under review. As I have said, this is the third year of reporting, and we are delighted that thus far there has been 100% compliance. We must look at the data carefully, but everything is open to review. What is brilliant about this legislation is that for the first time, 10,500 employers in the country are talking about how they treat their female workers.
Last year in Motherwell and Wishaw, women working full-time earned an average of 10% less than their male counterparts. For women who are already struggling with Tory austerity—for example, the capping of universal credit at two children—a 10% increase in pay would make a huge difference. What are the Government doing to help those women, and women across the country?
The hon. Lady will be delighted by the Chancellor’s announcement that we are increasing the national living wage. As she will know, 60% of people who are paid the living wage are women, so that increase will have a huge impact on many women. The hon. Lady and I can agree on at least this: we want women to be treated properly and fairly in the workplace, and I am sure that we all want to close that gap.
Flexible working gives many parents with young children an equal chance to work, and they would therefore support the narrowing of the gender pay gap. Does my hon. Friend agree that all job advertisements should specify whether the jobs are flexible, and that employees should have the right to request that flexibility?
Very much so. My hon. Friend is right to mention flexible working and childcare. The message for employers is that flexible working not only improves diversity in their business models, but helps the bottom line. It is good for business, it is good for our country, and I think that, in particular, it is good for women to have the ability to earn their own incomes and to have the independence that we all cherish in this place.
Does the Minister agree that the Conservatives have actually done more than any other Government to tackle the issue of pay inequality at work? What more is she doing to help women in the boardroom who do not earn as much as their male counterparts?
I am extremely grateful to my hon. Friend, who has done so much work on women and equalities and also on menopause. [Interruption.] I note that Opposition Members are laughing and guffawing, but these issues have a real impact on women who are the lowest paid. I am delighted if it means that the Labour party is supporting gender pay gap regulations, because it was a Conservative coalition Government who introduced the regulations and a Conservative Government who brought them into force two years ago. We need to ensure that employers are treating female employees correctly and properly, and that we are tackling that in the lowest paid sectors. That is why we have the three priority sectors of retail, healthcare and education that are working to bring action plans forward to ensure that we help the lowest paid.
May I take this opportunity, Mr Speaker, to congratulate you on your PinkNews award, and your inspirational and outstanding speech? Trans rights are human rights.
In the previous Queen’s Speech, the right hon. Member for Maidenhead (Mrs May) pledged to make further progress to tackle the gender pay gap, but that was noticeably absent from this week’s Queen’s Speech. Does that mean that the current Prime Minister does not want to reduce the gender pay gap?

Mr Speaker, forgive me for not congratulating you on your award. My right hon. Friend the Member for Portsmouth North (Penny Mordaunt) also received an award last night at the PinkNews celebrations.
On the question, that most certainly does not mean that this Prime Minister is in any way not committed to improving the gender pay gap. The fact that we have a strong ministerial team on the Front Bench today is a very clear indication of how seriously the Government take this issue. Having got the regulations in place, we are now working with industries to ensure that we are helping them achieve those action plans so that they can make the change. This has to be led with business; we have to bring business and employers with us to make this real cultural change.
As we begin to understand the gender pay gap, does the Minister agree that, because the race pay gap is bigger than the gender pay gap, we should start to compel companies to publish their figures on that?
That is a very good question, and I would expect no less from the hon. Lady. We are looking closely at ethnicity pay gaps. My hon. Friend the Member for Rochester and Strood (Kelly Tolhurst) from the Department for Business, Energy and Industrial Strategy, who is present on the Front Bench, is leading on that work, and it is really important. We have been talking to industry leads and stakeholders in the third sector, and the hon. Lady will appreciate that quite how it is defined is not as easy as it is for the gender pay gap, but there is a great deal of work going on in Government to look at it.
In the summer, we ran a consultation to understand people’s experiences of workplace sexual harassment and to assess whether the law in this space needs changing. Our consultation also included wider harassment protections, which cover many bullying behaviours. We are now considering the responses that we received, and we will publish proposals in due course.
Last week, a partner at Freshfields solicitors was ordered by a professional tribunal to pay more than a quarter of a million pounds for sexual misconduct with a junior colleague. Should not every regulator treat actions of sexual misconduct as a breach of professional standards? If the regulators do not act, will the Government?
I thank my right hon. Friend, who as Chair of the Women and Equalities Committee has done so much work on ensuring that employers’ and regulators’ responsibilities in the area are met. I welcome—indeed, I encourage—strong action from regulators to stamp out sexual harassment. We are working with relevant enforcement bodies and inviting them to join our public sector equality duty network to share and promote best practice. We are particularly focusing on regulators of specific relevance, to explore how they can support compliance with equality law.
The #MeToo movement was inspired—if that is the right word—by the activities of Harvey Weinstein in the film industry. Despite all their celebrity, many of the women affected did not feel able to turn to anyone when they encountered bullying and harassment in the workplace. That is all the more true for women today, particularly in small businesses. What is the Minister doing to ensure that women have legal and present support? Does she agree that the fact that Harvey Weinstein remains honoured by the British state with a CBE is a terrible indictment of our honours system?
Of course, the #MeToo movement met with a great deal of attention and support across the world. In terms of sexual harassment, the consultation that closed on 2 October looked at all sorts of workplaces across the United Kingdom, and we are looking at responses to it very, very carefully. The hon. Lady will appreciate that it is only just over two weeks since the consultation closed and I do not want to pre-empt anything. In terms of Mr Weinstein, I cannot comment on individual cases; his case will be dealt with in the US.
Again, I thank my right hon. Friend, who has brought a laser-like focus on bullying and harassment in all places of work. The Government and I strongly support this convention, which seeks to ensure that women and men around the world are properly protected at work. Our law makes it clear that violence and harassment at work are unacceptable and unlawful, and our next steps will be to consider how we will ratify this and bring this new treaty to the attention of Parliament.
I thank the hon. Lady and all Members of this House who contributed so positively and, on occasion, movingly to the Second Reading debate on this important piece of legislation. She knows that the Government are conducting a review of the treatment of migrant women, because we have very much borne in mind the findings of the Joint Committee, chaired so ably by my right hon. Friend the Member for Basingstoke (Mrs Miller). That review is ongoing and as soon as I have more news I promise that the hon. Lady will be among the parliamentarians I speak to.
In Cheadle, Northern Rail has responded positively to my campaign for lift accessibility for people with disabilities by giving 24-hour access, but not every disability is visible—some are invisible. Does the Minister agree that we should support people and help to promote the need for accessible toilet signage?
Sexual harassment online is a major issue for many women. Will the Minister examine the issues of cyber-flashing and revenge porn to make sure that victims are given the proper legal protections from those as sexual offences?
My hon. Friend raises a point that concerns many in the House and outside. I am currently doing a piece of work on online offences and look forward to the development of the online harms White Paper, because I suspect that many of the answers we all seek will be in that documentation.
When she was Minister for Women and Equalities, my right hon. Friend the Member for Portsmouth North (Penny Mordaunt) committed to the House to introduce legislation to remove caste as a protected characteristic from the Equality Act 2010. When will the current Minister for Women and Equalities and her team bring forward legislation so that we can end this bizarre and divisive situation?
It is a pleasure, as always, to respond to my hon. Friend on this important piece of work. I am in the process of discussing this with the Secretary of State, and we hope to have an answer for him shortly.

Commons ChamberMy hon. Friend has asked a deviously difficult question, in that there are many ways to interpret it. I have taken it to reflect the gender split in sectors. The worst sectors in terms of the gender split for women are construction; mining and quarrying; and water supply, sewerage and waste management. All those sectors have workforces that are more than 80% men. The worst sectors in terms of the gender split for men are education, human health and social work. We are working with all those sectors to drive action plans to address the specific problems that men and women face, whether in recruitment, retention, or progression to senior leadership roles, in those sectors.
Brilliant though the Minister is, she cannot be expected, any more than any of us can, to know the inner workings of the sophisticated mind of the hon. Member for Kettering (Mr Hollobone).
There is a highly disproportionately low number of male primary school teachers. What can the Government do to address this?
My hon. Friend asks a good question. There is interesting research on what and how gender stereotypes form at early ages. By the age of seven, girls tend to think that they should be in what we call very loosely the caring industries, and boys tend to think about the mechanical and engineering-type industries. So it starts at the very beginning. We have to work on, and we are working on, ensuring that the gender stereotypes for boys and girls are not allowed to continue. That is precisely why the gender equality road map that we published last week will help with those limiting and limited stereotypes. We must very much encourage boys to grow, and to be great teachers in our schools and colleges.
I am sure the Minister would agree that in the care sector—where my mother has worked for the past 30 years—the focus tends to be purely on women working in that sector, often because it is part-time and low-paid work. What more will the Minister do to make sure that the care sector is seen as a real profession, with good qualifications and a decent salary?
The care sector is such an important sector in our economy—all the more so as we age and live for longer—so through the gender equality road map we are very much looking into how we can help to ensure that the part-time roles are paid properly, and also that there are career opportunities. A tiny step is, of course, the gender pay gap regulation reporting, which helps to set out the disparities between pay, not only within industries and sectors but across the economy. It is through that that we will start to get much better quality.
Only 1% of the tradespeople who work in building maintenance in housing associations are female, so will my hon. Friend endorse the work of the Guinness Partnership and its ambassador tradeswomen who are trying to drive up that figure by going into schools and colleges, encouraging women to pursue a career in construction?
I endorse not only the work of the Guinness Partnership, but the work of my hon. Friend, who is a powerhouse himself for trying to ensure that women and girls see construction as a really good industry and a really good employment opportunity for them.
The Home Secretary commissioned a lessons-learned review to consider the key policy and operational decisions that led to members of the Windrush generation becoming entangled in measures designed for illegal immigrants and appointed Wendy Williams as its independent adviser. We understand that Wendy Williams has been considering a great deal of material during the course of the review and has spoken with a wide range of people. We will publish her report following its receipt.
The Government seem obsessed with pushing through a damaging no-deal Brexit, and Windrush victims feel ignored, as they have to make do with an apology, or perhaps another review, then a report, and then a consultation on the report and the review. Words are cheap; actions count. Can the Minister please explain how the process of compensating Windrush victims is progressing?
I am glad that the hon. Lady has asked this question, because it gives me the opportunity to inform her that more than 6,400 people have been granted some form of documentation by the Windrush taskforce and more than 4,200 people have successfully applied to become British nationals through the Windrush scheme. We have announced that the Windrush compensation scheme is open for claimants. The forms, rules and claimant guidance were published in April and the free phone helpline is available for those wishing to receive printed copies of the forms or for any other queries.
The Government said that it would take two weeks to resolve the Windrush cases; it has been over 64 weeks thus far. I have a live petition, which garnered more than 800 signatures a day, which I plan to present to the Prime Minister next week. Will the Minister join me in fighting for justice and fairness for the Windrush generation, and support the call to get all cases resolved before we break for recess?
I thank the hon. Lady for her question. As she knows from the work she has done, every case is complex. We want to ensure that they are being thoroughly considered. We will continue to update the Select Committee with work and progress on this, but I refer her back to the fact that more than 6,400 people have been given some form of documentation and more than 4,200 people have successfully applied to become British nationals through the scheme.
It is a pleasure to answer this question from the hon. Lady. In September 2018, having considered the evidence of the review, the Home Secretary reached the conclusion that introducing national buffer zones would not be a proportionate response given the experience of the vast majority of hospitals and clinics, and considering that the majority of activities are passive in nature; but we of course watch with great interest the incidents that are happening in her constituency.
Ealing’s buffer zone is pioneering, but it is a local byelaw and its renewal process will have to start next year, notwithstanding its High Court challenge next week. Women up and down the country—clinic users and staff—need the certainties of protection from harassment by national, lasting legislation, and the evidence of the Minister’s review does not bear out what all the pressure groups are saying. So when will the Government have the guts to act?
It is not a question of having the guts or otherwise. We looked at this very carefully. We looked at the range of hospitals and clinics across the country that offer these services, and the overwhelming majority did not report the sorts of activities that the hon. Lady has described taking place outside the clinic in her constituency. However, we of course keep the matter under review, and I am always happy to discuss this with the hon. Lady, because I know she takes such an interest in it.

Commons ChamberThe Government strongly condemn sexual harassment in the workplace and are committed to seeing it end. Employers are already responsible for preventing sexual harassment in their workplace and can be held legally liable if they do not, but we are consulting this summer to gather evidence on whether reinforcing this with a proactive duty would lead to better prevention of this terrible practice in the workplace.
Women who work in the retail and hospitality sectors in the UK have little protection when they face workplace harassment, which is something that happens far too often. As last year’s Presidents Club scandal shows, employers have no duty to protect their staff. May I encourage the Minister, when she carries out that review, to give serious consideration to reinstating section 40 of the Equality Act 2010 to give women the protection at work they have every right to deserve?
I am grateful to the hon. Gentleman for raising this, because it is important; every woman—indeed, every person—should be able to enjoy their place of work without the threat or risk of sexual harassment. I take issue gently with him on section 40. He may know that it was used only twice when it was in force and it had the three strikes approach, which we believe was one reason why it was not used as often as it should have been. We are very open-minded; we have this consultation, and I encourage everyone to participate in it, so that we can find solutions that suit not just employees, but responsible employers.
Has the Minister thought about looking at the system of protected conversations that was introduced by the coalition Government? Given the nature of such conversations, that system could give a licence to employers to engage in harassment in conversations that then, under statute, cannot be quoted at subsequent hearings.
I am happy to look at that. As I say, we will be consulting in the summer. We want also to understand the scale of sexual harassment in the workplace. By definition, it tends to be activity that is hidden and there is stigma to it. We want absolutely to make the point that it is not right for anyone, of any gender, of any sexuality, to suffer this sort of behaviour in the workplace.
Gender pay gap reporting provides transparency for everyone in holding employers to account, and many organisations already recognise that closing the gap makes good business sense. I am writing to public sectors employers who are within scope of the regulations to urge them to develop action plans, and meeting influential business leaders to press them to take action in their sectors to make the best of the potential that their female employees can provide to them.
I am grateful to the Minister for that answer. What early assessment has she made of successful business compliance performance compared with that of last year?
Before I answer that, I feel obliged to wish my hon. Friend good luck in the London marathon this weekend, as I do to all Members of this House who will be running those 26 miles—we hope it will be good weather.
I am sure the whole House joins me in being delighted that we have exceeded last year’s compliance levels, with 95% of all employers believed to be in scope in the regulations having reported their data by the deadlines. We are confident that 100% compliance will be achieved shortly, and we have already seen the reporting rates rise to 98%.
When across 45% of firms the discrepancy in pay increase is in favour of men this year, it is now clear that the Government’ s policy of asking companies simply to report on the gender pay gap is not enough. I welcome the Minister’s response to the question about encouraging people, but will she now heed our advice and make it mandatory for companies also to produce action plans on how they will defeat this inequality against women?
I thank the hon. Lady for her question, and I know she shares my enthusiasm and determination on this point. She will be pleased that already just under 50% of employers within scope are publishing their own action plans—they are doing that because they understand it makes good business sense. We believe that this is the best approach. Interestingly, 56% of employers have reported either reductions in their gender pay gaps or the fact that they are staying the same. There is a great deal of work to do, but we have to bring business with us; businesses have to realise that it makes good business sense to close their gap and to treat their female staff properly. We believe that by encouraging them we will bring about the best result.
I welcome the progress that has been made in closing the gender pay gap and increasing the representation of women on company boards, but what are the Government doing to support low-paid, low-skilled women, who often seem to be left out of the conversation?
My hon. Friend has distilled into his question the important point that the gender pay gap is not just about the heads of companies—directors and so on—important though that aspect is; it is also about helping women at the very lowest ends of the pay scales. We want to encourage them to seek better jobs and have better incomes. That is precisely why my right hon. Friend the Minister for Women and Equalities is setting out a strong strategy on economic empowerment for women, so that they are treated fairly in the workplace, no matter their pay level, and ensuring that employers realise that if they are going to get the best of their workforce, they need to pay their female staff properly.
I am grateful to the hon. Lady for her FBU question. I would suggest that the FBU—[Interruption.] I have said this before, because it concerns me that there are no women on the FBU executive council. If the fire brigades workforce are to be looked after as we want them to be—Her Majesty’s inspectorate of constabulary recently published a report looking at facilities for female firefighters across the country and was concerned to see, for example, two services with no designated shower facilities for female firefighters—then these changes must be made from the very top of our fire brigade community, making sure that women’s voices are heard, because they are absolutely essential as part of our firefighting workforce.
Department of Health guidance in Northern Ireland says that Northern Ireland doctors referring women to GEO-funded free abortions in England could be breaking the criminal law. Will the Minister publish her legal advice to enable the Department of Health to change that guidance, which surely is erroneous? Will she update the House on what she is doing to help women in Northern Ireland, such as Sarah Ewart and others, who are being required by law to continue pregnancies where doctors have already told them that their babies will die before they are born or shortly after?
Order. I am sorry, but I clearly said that Members should be asking single-sentence questions. People have to be able to adjust. It is not difficult.
I am grateful to the hon. Lady, who has done a great deal of work on this issue in her constituency. We are keeping this matter under review. We are keen that local councils are able to use the powers that they have under the antisocial behaviour laws, if appropriate in their areas.
Recent research shows that the HPV vaccine has led to a dramatic decline in cervical cancer. Having a vaccination saves lives, so can we use this opportunity to urge mums and dads across the UK to ensure that their kids have the measles vaccine?
The hon. Lady may have heard my answer to a previous question. We will consult in the summer on sexual harassment in the workplace and I would encourage her and all colleagues across the House to contribute to that consultation.

Commons ChamberAlthough I share concerns on this issue, prices in the UK are set by competition, not by the Government. As intelligent questioning consumers, women should not be afraid to challenge retailers or manufacturers who are trying to rip us off and, where we are not satisfied, to vote with our purchasing decisions. The Government stand ready to back up any woman who wants to do that.
I thank the Minister for her comments. Research shows that women pay more than men for basic products 42% of the time. Manufacturers claim that this is competition or that more is involved in producing women’s products. Scientists tell us that that is nonsense: we all have the same hair and skin types. Given what she has said about women standing up, will the Minister back my Bill on the pink tax, which is currently going through Parliament, or help to encourage manufacturers and retailers to do away with what is a sexist and outdated practice?
I congratulate the hon. Lady on her private Member’s Bill. The Government will not be supporting it, but we welcome the focus she is bringing to this important issue. In the 21st century, things like social media will help to get the message out to manufacturers and businesses that they simply cannot rip women off. The work uncovered on Friday in the Rose review of access to finance, which female entrepreneurs are sadly not getting at the moment, is precisely why the Government are looking to help female entrepreneurs to set up businesses that will not rip women off.
Will the Minister kindly provide an update on the projects being supported by the tampon tax fund?
I regret to say that I do not have that list to hand at the moment, not least because I was preparing answers on the pink charge on female products, but I will endeavour to write to my hon. Friend with a list. I know the work he has done on this vital topic. I am sure that, like me, he was delighted at the Chancellor’s announcement yesterday that we will be providing free sanitary products to secondary schools.
As the Minister’s reply to the hon. Member for Colchester (Will Quince) will be of wider interest, it might be of service to the House if the hon. Lady places a copy of her reply in the Library.
I am delighted to hear the Minister’s commitment to supporting women who wish to take the matter of the pink tax to task. As it happens, we are in the process of establishing an all-party group concerning the beauty industry. I would welcome the Minister joining the group, so she could, alongside me and colleagues, encourage companies to look at the pink tax. It seems an irony, given that women’s earning potential is less than men’s. We really should be looking at this issue far more closely.
I am extremely grateful, as always, to the hon. Lady for her kind invitation. Sadly, I am not sure that, as a Minister, I am allowed to join an all-party group, but I very much look forward to learning from its work. Of course, if it ever wished to invite me to a meeting, I would be happy to accept the invitation.
I recall the visit that I made with my hon. Friend to see how his local community was looking after vulnerable people in Gloucester. We believe that people who want to leave prostitution should be given every opportunity to find routes out, and this is why we are spending more than £2 million across the Government to support prostitutes and sex workers who are at risk of abuse and exploitation. Indeed, we have a piece of work at the moment involving ongoing research conducted by the University of Bristol into what prostitution in the 21st century looks like, precisely so that we can address the issues that that research identifies.
The primary victims of religiously motivated attacks are women, but how can the Government reassure Muslim women that they are serious about tackling Islamophobia when they choose to ignore and shut down the voices of the British Muslims in their own party who are calling for an independent inquiry into institutional Islamophobia? Speaking as a British Muslim, I believe that it is disgraceful and patronising that the Conservative party continues to refuse to act and tells British Muslims in the party that there is not a problem. Will the Minister at least accept that her party has a problem?
I am delighted that my hon. Friend has asked this question, as it gives me an opportunity to thank Alison Rose for her review, which tries to ensure that the business landscape is as fair for women as it is for men. It is a shocking fact that women’s average starting capital is 50% less than that of men. I was at a fantastic reception at No. 10 last week, where there was a room full of female entrepreneurs, some of whom were world-leading entrepreneurs. We have fantastically talented, capable and creative female entrepreneurs in this country, and we absolutely must support them. We must ensure that businesses, banks, venture capitalists and angel investors are all doing their bit to help these women.
What measures could be included in the draft Domestic Abuse Bill to ensure that parental responsibility does not override restraining orders, especially when partners have been convicted of coercive behaviour?
My hon. Friend raised a constituency case during the International Women’s Day debate last week, and we want the draft Domestic Abuse Bill to support both the victims of the many forms that such abuse can take and the children who live in abusive households. I urge my hon. Friend to write to the Joint Committee on Human Rights, which is scrutinising the Bill, to make her point.
As the Minister for Women and Equalities knows, the estimated 18% gender pay gap is likely to grow following Brexit as women in public services and retail are disproportionately affected. Does she accept that the women who voted to leave did not vote to leave themselves worse off and that they deserve a final-say referendum on the exit deal?

Commons ChamberThe Home Office operates an immigration policy that supports women and children with insecure immigration status. Victims of domestic abuse who entered the UK as the partner of a British citizen, settled person or person with refugee status are eligible to apply for settlement in their own right. Those who are destitute can also apply for crisis support under the destitute domestic violence concession. We are funding a project conducted by Southall Black Sisters to pilot support for women and children who are victims in these circumstances.
If the system is so effective, why does the Ubuntu women’s shelter in my constituency have to be the first charity in the UK to provide short-term accommodation for women with no recourse to public funds? Fleeing gender-based and domestic violence, they are denied access to homelessness, social security and housing support. These are non-EEA women with limited leave to remain. Women who have settled status or leave to remain face delays in processing their status. Any situation where women fleeing domestic violence, torture or persecution have no recourse to public funds is unacceptable. Does the Minister agree, and what is she going to do about it?
I would ask the hon. Gentleman to advise those working in the refuge to help the women he describes in seeking the destitute domestic violence concession. The point of that concession is to provide immediate crisis support to women and children who are victims of domestic abuse, giving them three months’ leave to remain so that they can find new homes and reflect on their situation, and also have access to public funds.
As the Home Affairs Committee, we have expressed concern that the police, having helped an individual who is a survivor of domestic abuse, are then sharing their details with the Home Office for the purposes of immigration control. This has a chilling effect on the likelihood of reporting abuse. Will the Minister give an assurance that when the domestic abuse Bill has made its way through this place, the only thing that will matter is a woman’s welfare, not their immigration status?
In those circumstances, the response of the state is always led by the needs of the victim. We must be careful to recognise that the immigration system operates in and of its own right. That is precisely why we have the destitute domestic violence concession to help women in these desperate circumstances by giving them a three-month break period to seek help and build a future for themselves and for their children, if appropriate.
This is where there is a tension between the immigration system and the needs of victims of domestic abuse. That is precisely why we have the destitute domestic violence concession to give those women three months’ leave to remain and recourse to public funds. But we must be clear that people who do not enjoy settled status in the UK must not have recourse to public funds in the same way that a British citizen would expect.
Support for domestic violence victims is devolved to different tiers of government right across the United Kingdom. What is my hon. Friend doing to support different levels of government to make sure that victims get consistent support across our United Kingdom?
My hon. Friend raises an important point that we are seeking to address through the domestic abuse Bill with the appointment of a domestic abuse commissioner. I am very grateful to my colleagues in the Ministry of Housing, Communities and Local Government who are in the process of conducting a review of services nationally. The role of the commissioner will be to hold local and national Government, and stakeholders, to account as to the provision of services in areas across the country so that there is no possibility of a postcode lottery.
A constituent from Larkhall suffers psychological, emotional and financial abuse from her husband, with whom she ran a business for seven years in the UK. She held a spousal visa. Due to the length of time it took to be approved for indefinite leave to remain, she had a choice to remain in that marriage or to leave the UK. This was due to Home Office bureaucracy. Does the Minister accept that the Home Office needs to be sensitive to cases such as that?
I do; I hope the hon. Lady understands that I cannot comment on a particular case at the Dispatch Box, but that is why we have the destitute domestic violence concession—to give immediate crisis support to victims of domestic abuse whose residency status depends on the partner who may well be abusing them.
The Women’s Aid “No Woman Turned Away” project can only find refuge accommodation for fewer than one in 10 women who have no recourse to public funds. The Government’s proposed measures in the draft domestic abuse Bill are not good enough for migrant women. Can the Minister offer assurances that more will be done to ensure that migrant women can have full and equal access to specialist services?
I thank the hon. Lady for her question. Only last week, when I visited a domestic abuse refuge in the area around Preston in Lancashire, I heard for myself the particular needs of women in the area who have no recourse to public funds. The Bill’s purpose is to provide a statutory definition and so on, to help all victims of abuse, regardless of their immigration status, but of course this matter may well be scrutinised by the pre-legislative Joint Committee of both Houses. We very much welcome that.
We all enormously value the work of women and men employed by fire and rescue authorities who work to protect their communities. It is unacceptable that outdated practices exist such as shower facilities being unavailable to female firefighters. My hon. Friend the Minister for Policing and the Fire Service has been clear that we look to the National Fire Chiefs Council and local fire and rescue service leaders to address those concerns.
To quote former firefighter Lucy Masoud:
“I remember my first fire station. There was a tiny cramped dorm with three beds though it was meant for one. There was a massive dorm for the guys, yet we were stuffed in like sardines.”
At other stations, female firefighters had to sleep on the floor. A “solution” is proposed of having gender-neutral dorms, toilets and washing facilities, which is overwhelmingly opposed and could cause women to leave the service. Will the Minister agree to demand audits at fire stations across the country related to facilities for female firefighters?
The hon. Lady knows that 14 fire services were recently inspected by Her Majesty’s inspectorate, and that of the 14, two were found not to have adequate shower facilities for female firefighters—Hampshire and the Isle of Wight. I name them, and I very much expect that they will improve their services. We know that there are issues with sleeping accommodation, too.
I would, however, note that although the Fire Brigades Union does sterling work for its members, it is a very great shame that its executive council has not yet managed to appoint a woman to put forward the views of female firefighters in a national and consistent way. I hope that it will put pressure on fire chiefs and others to ensure that they do better by their female firefighters.
In addition to working with the Home Office to ensure that there are better facilities, what steps is the Minister taking to encourage more women to take up a career in firefighting?
I am so grateful to the hon. Lady for raising this subject, because women are just as capable as men at firefighting. I hope that we at some point see a revised version of Fireman Sam, because we know from social media campaigns that children grow up expecting firefighters to be male, which limits their expectations and perhaps cuts their career opportunities as they go through school and into training. The message from this Government is very clear: we absolutely welcome female firefighters, and we will work with Women in the Fire Service to ensure that we get more women helping to protect our communities.
As a former member of the national fire service management committee of the Local Government Association, it has been a pleasure for me to see how the culture in the fire service has changed over recent years, but there is still a need to tackle the perception that being a firefighter is a job for a man. Will the Minister therefore welcome the efforts being made by fire authorities such as Devon and Somerset and the West Midlands to promote the message strongly that it is a job that anyone can do?
Very much so—I welcome the work of the fire authorities that my hon. Friend mentioned. I note that we have five fire and rescue services headed by women, including, of course, here in London, where Dany Cotton has had to deal with extraordinary events in her tenure as chief. That, I hope, is another piece in the jigsaw of evidence that proves that women can be just as good at fighting fires as men.
I thank my hon. Friend for the answers she has given thus far. Clearly, in order to encourage young women to take up the opportunities of firefighting, there need to be role models. What action is she taking to encourage female firefighters employed right now to act as role models to encourage others to follow?
I am grateful to my hon. Friend. As I say, the organisation Women in the Fire Service does great work at local level in encouraging women to join the fire service. Again, as role models, we have the five women we know are heading fire and rescue services currently—of course, of the 45 fire and rescue services in England and the three fire and rescue services in Wales, that is a tiny fraction, but they are very positive role models. I also hope that the Fire Brigades Union will manage to bring a woman on to its executive council in the future. It is through that sort of positive work that we will get women into these services.
This week I had a phone call with regard to a young man who tried to commit suicide and a mother who felt that she did not want to burden her children any more, all because of the Windrush scandal. They say that to educate a woman is to educate a nation; therefore, to humiliate a woman is to humiliate a nation. Will the Minister assure the House that the Government will provide urgent and necessary help, support and assistance to women and vulnerable people affected by the Windrush scandal?
May I again set out the Government’s apology to those who have suffered through this terrible incident and reflect on the fact that this was not just one Government who got it wrong, but many Governments of all political colours? I welcome the fact that colleagues across the House are bringing individual constituency cases to our attention. We can then feed them into the system that has been set up so that we can provide help and support. The hon. Lady must, of course, let us know of any cases she wishes to raise, but the Government must learn from mistakes, which was why we set up the review. We are pleased that more than 4,000 people have been helped through the scheme—not just Windrush victims, but people from other countries. It is very much a work in progress, but we welcome Members across the House continuing to raise these issues in the Chamber.
I warmly welcome the publication of the draft Domestic Abuse Bill. Will the Minister provide assurance about what the domestic abuse commissioner will do to share best practice across the country?
I thank my hon. Friend, who has done so much work on this issue for his constituents. The Bill will introduce a domestic abuse commissioner, whose sole focus will be on tackling domestic abuse and holding local and national Government to account to ensure that services are provided well and consistently across the country, thereby helping all the 2 million people who we know are victims of these terrible crimes.

Commons ChamberMerry Christmas to one and all! I say that because although Christmas is a time of festivity, it is also, sadly, a time when the number of incidents involving domestic violence increases exponentially. I hope to be able to inform the House of ways in which we can help to spread the message that if anyone is suffering domestic abuse over the festive period they can—and please, must—seek help.
The Home Secretary chairs an interministerial group on violence against women and girls, which aims to ensure that all Departments, including the Department of Health and Social Care, work together to make dealing with crimes such as domestic abuse a priority. We will publish our response, including our draft domestic abuse Bill, shortly.
I welcome last week’s debate on the public health approach to tackling youth violence. Domestic violence can be a key trigger of trauma in young people’s lives, and they need this strategy to be published and properly funded as soon as possible. May I urge the Minister, who is also part of the Home Office team, to do all she can to make sure this strategy is published as soon as possible?
I am extremely grateful to the hon. Lady, who has done so much work on the specific issue of youth violence, including her work on the commission. She knows, following last week’s very good debate, that the Government are absolutely committed to treating serious violence as a public health issue, but we are very much committed also to ensuring that domestic abuse within the serious violence sphere is tackled in hospitals and GP surgeries, because often the NHS is the touchstone that victims of domestic abuse can use to seek help when they find that they are in a place to be able to do so.
Very much so, and we know that domestic abuse has a devastating impact on children and young people. Home should be a place of safety; it should not be a place of fear and violence. We have launched an £8 million fund to support children affected by domestic abuse and services that can help in that. We have also provided money to roll out an amazing project called Operation Encompass, so that there is a person in every school whom the police can contact before the school day starts, to inform the school if a child has witnessed a domestic abuse incident the previous night so that child is treated in a gentle and comforting way during the school day, having witnessed some trauma at home.
Has the Secretary of State also had discussions with the Secretary of State for Health and Social Care on the benefits of sport for women in improving their wellbeing, because women traditionally take part in a lot less sport than men? On that note, will she also congratulate the women’s netball team for its fantastic achievement in being voted team of the year in the BBC sports personality awards, and does she agree that they are a great role model?
I am very grateful to my hon. Friend for promoting me momentarily. She is right: sport can have an enormously positive impact on people’s lives. Obviously in the context of domestic abuse and serious violence, we are very conscious that sport can be a great way to reach out to young people and help them to make positive life choices. I am grateful to my hon. Friend, and I understand, too, that there are plans for a parliamentary netball team, which I will not volunteer for—I am more of a hockey player—but I am sure that is something to look forward to in the new year.
We are very conscious of the additional pressures women in the asylum system face, particularly if they are in the system through family visas, where, sadly, we know there are cases where the perpetrators of the violence are the people on whom they rely for their asylum status. UK Visas and Immigration has set up a safeguarding hub to look at whether urgent intervention is necessary in each asylum case, and that obviously includes domestic abuse. We are concentrating on this in the forthcoming package of domestic abuse measures.
Mr Speaker, may I take this opportunity to wish you, yours and everyone associated with the House Nadolig llawen? For the benefit of Hansard, that means merry Christmas.
Survivors of domestic abuse and their children need more protection. I have heard from too many victims whose children are forced through family court orders to spend time with an abusive and sometime dangerous parent. Rachel Williams and Sammy Woodhouse are two such victims. Their petitions have gathered half a million signatures. Rachel and Sammy are speaking out, so when will the Government listen and strengthen the law to support victims and their children?
I am grateful to the hon. Lady for her question. I had the privilege of meeting Sammy some months ago to discuss the complexities of her case. We clearly do not want the family courts to be used as another forum in which abusers can continue their abuse. The hon. Lady will know that I and my colleagues in the Ministry of Justice are working together on the Bill, but also on educating those who work in the tribunal and court systems to be alert to that possibility.
I am very concerned to hear that. I note the work that is going on through all-party groups to help victims of crimes and their families overseas. I will of course take away what the hon. Lady has said, and if she would like to meet me to discuss the case, I would be happy to. I will also ensure that the Minister from the relevant Department meets her.

Will the Minister welcome the work of Cats Protection, which fosters cats to enable women to flee domestic violence safe in the knowledge that their family pet is well looked after until they find a secure home?
I must declare an interest, because I own the most beautiful cat in the world.
I am delighted to hear of that organisation and the work that it does. It is a fantastic charity, and I think I should visit it as a priority, as part of not only my Home Office role but my ministerial cat responsibilities.

I wonder why I did not know that. I am as near to speechless as I have ever been.
The Government’s new code of practice is a welcome step in tackling sexual harassment in the workplace, but will the Minister listen to the concerns of the Fawcett Society and provide a formal duty on employers to prevent harassment in the workplace, without which the code falls short and women will be left to deal with this problem on their own?
I very much understand the call for a formal duty and we listen to it carefully, as we do to the Women and Equalities Committee report. We have committed to consulting on that, because this is very complex and we need to make sure we understand not only the scale of the problem, but potential answers to it.

Commons ChamberWe are committed to tackling misogyny and gender inequality, and have pledged £100 million over four years to support our strategy to combat violence against women and girls. We will soon publish our plans to tackle sexual harassment, and we have asked the Law Commission to consider whether sex and gender should be included under current hate crime legislation.
Actions may be criminal, but will the Minister ensure that we do not stray any further into the realms of thought crime?
Of course not: hate crimes are crimes that already exist as crimes in themselves, such as assault and criminal damage, but for which the hatred of a protected characteristic is the aggravating feature that enables judges to reflect that in their sentencing, and we have asked the Law Commission to consider whether sex and gender should be added to those protected characteristics. There will be no legislation for thought crime from this Government.
Recent work done in women’s prisons shows that 48% of women prisoners have had a major brain injury before going to prison, the vast majority due to domestic violence. Could we not solve some of the problems of crime if we dealt more robustly with domestic violence?
I am so pleased the hon. Gentleman raises this point. As he knows, the Government are committed to a domestic abuse Bill. The draft Bill will be published by the end of this Session and there will be a whole range of non-legislative measures with that proposed legislation as well. I hope the whole House will join me in fighting this terrible crime, because it has such enormous impacts not just on the immediate victims themselves but on wider society.
I hope the Minister will agree with me when I say that language is extremely important in terms of misogyny and the way that men, in particular, behave in politics at all levels across the United Kingdom. Will she consider formal training not just for MPs but those in devolved institutions and councils across the country, because misogyny is never acceptable?
I think that this is where we, as a society, need to make it very clear that we do not expect women to be shouted at in the street or have very unpleasant things said to them. I know there are Members of this House who suffer such abuse on a daily basis on social media. That is simply unacceptable, so I join the hon. Gentleman in saying to everyone in this House that how we use our language really matters and that we must ensure our young people grow up with that clear message, too.
We keep any uncommenced provisions from the Equality Act under review. Equality is never a one-time fix and it is right that we keep re-examining these issues. However, political parties are responsible for their candidate selection and should lead the way in improving diverse representation.
Gender pay gap reporting has ensured transparency across the board and resulted in companies taking action. Section 106 could have the same effect, so will the Minister consult those parties on its introduction?
I hope that every party is looking at this legislation. Certainly, the Conservative party is looking at how we can gather this information, not just for the national Parliament but for local government, because we believe it is absolutely essential that local government reflects the society it serves as much as this House does.
I know that the Minister has committed to increasing the number of women in Parliament. Does she agree that we have a woman Prime Minister and strong women Secretaries of State, such as the woman beside her at the Dispatch Box, the Secretary of State for International Development, who should be congratulated on the support and the leadership they show to women across the country?
I think it is 2-0 to us. This is a serious point. In the Labour party, there are many, many strong, capable women I have very good working relationships with. It is a great shame that the Labour party has never managed yet to entrust the leadership of its party to a woman—[Interruption.] I see somebody volunteering on the Opposition Front Bench. We have the opportunity to bring more women into this Parliament through an event next week, on 21 November, when every Member of Parliament can bring a woman into the House of Commons and invite them to stand in this House.
I am extremely grateful to the hon. Lady. The only difficulty with her question is that it does not seem altogether aligned with, or even adjacent to, the subject matter on the Order Paper. Her supplementary question would have been entirely pertinent to Question 2, but I am going to imagine that she has a great interest in section 106 of the Equality Act and that there is some sort of link, unknown to me but known to clever people like Ministers.
I am very interested by the hon. Lady’s question—I am so interested that I am going to ask the responsible Minister to write to her in due course. But I make the point that the more female Members of Parliament we have in the House, the more they can scrutinise this legislation.
What justification is there for an eight-year delay in the implementation of section 106?
The Government have kept that under review, but, as I said earlier, it is also for political parties themselves to act on it, so I am pleased that the Conservative party is looking into how we can gather the evidence in order to improve diversity in our candidates list.
Order. There is a certain amount of gesticulation from a sedentary position. I do not know whether the hon. Member for Airdrie and Shotts (Neil Gray) is signalling that the hon. Member for Lanark and Hamilton East (Angela Crawley) wanted to come in on Question 2. I am sorry if she has been inconvenienced, but she needed to bob on Question 2, not Question 3. But never mind; she has made her point with considerable force and alacrity, and it is on the record. I would call her again, but she is entitled to only one. However, she has made her point very clearly, and we are extremely grateful.
The Government are committed to transforming their approach to domestic abuse, and that includes improving the response of employers to this devastating crime. We have therefore awarded £1 million to the charity Hestia for its “Tools for the Job” pilot project, which will help employers to improve their HR policies on domestic abuse and will fund specialist employment domestic violence advocates. We are also working closely with the employers initiative, which does similar work.
Victims of domestic abuse and violence tell us that a short period of leave from work while they manage to sort out the difficulties in their lives would be helpful. Will the Minister agree to meet employers and trade unions to discuss the possibility of introducing paid leave for victims of domestic violence?
Very much so. I keep pointing out to employers that having policies that can help to identify and support victims of domestic abuse in their workforces makes not only good moral sense but good business sense. I should be delighted to meet the hon. Gentleman, and employers and trade unions, to discuss what more we can do to help.
Of course, domestic violence affects not just women but men, too; but what contact has my hon. Friend had with companies such as the John Lewis Partnership, whose chief executive takes a particularly proactive approach to care in her company?
We tend to focus on women as being the victims of domestic abuse because the statistics show us that it is a gendered crime, but I never forget the fact that, of course, men can be the victims of domestic abuse. That is why we are doing a great deal of work, both through the domestic violence and abuse Bill and through non-legislative measures, to support them and ensure that services are there for them.
I am sure that the John Lewis Partnership is part of the employers initiative, a piece of work in which I am very involved and about which I am very enthusiastic. I should be delighted to support John Lewis not just in a spending capacity, but in a legislative capacity as well.
When I recently visited a Leeds Women’s Aid hostel, which does fantastic work throughout my city, it raised the problems experienced by women in low-paid work in accessing emergency accommodation. What support can the Government give to ensure that women feel confident enough to leave violent relationships and seek support?
The hon. Lady has raised an extremely important point. There have been more refuge places since 2010 under this Government, and in the summer we reconfirmed the funding arrangements for refuges. When I visit refuges, which are incredibly important places for women who need to flee very dangerous situations, what I hear from those women is that they would like to have that support at an earlier stage so that they do not have to be the ones who leave—so that he leaves, rather than her—and we are working on that as well.

It is encouraging that the national gender pay gap is at its narrowest ever, but it will take time and action by employers if we are to close it entirely. I am thrilled that more than 10,000 employers reported their gender pay gaps this year, but that is just the first step. We are now working with employers to help them to understand their gender pay gaps and what plans they could make to close them.
Sunlight is the best disinfectant. Does my hon. Friend agree that not just 10,000 employers but 100% of all eligible employers have reported their data and that that provides a baseline on which future progress can be measured and recorded?
I am extremely grateful to my hon. Friend, who is a committed feminist on this subject. Interestingly, not only have more than 10,000 businesses had to have this conversation about how they treat women in their workplace, but we know it is having a trickle-down effect on employers who do not necessarily meet the threshold. I know from the conversations that I have had with business leaders that they understand: the will is there for them to change. They want to do so, and they want to do so in partnership with us in government.
Given the early signs of the success of mandatory gender pay reporting for large businesses, has the Minister considered extending pay transparency to tackle wider inequalities, as recommended by the Institute for Public Policy Research, such as requiring companies with 50 or more employees to report not just on gender pay, but ethnicity and disability gaps?
A huge amount of work is going on, and as the hon. Lady rightly says, the focus this year has been on gender inequality, but we are extending it to ethnic diversity and so on. Interestingly, we have just announced that we are consulting on whether businesses should publicise their parental leave policies to help women and carers.
Forgive me if I have had not heard the hon. Gentleman correctly because of the hubbub in the Chamber; it is wonderful that everybody is so excited about women and equalities today.
The gender pay gap for women between the ages of 40 and 49 has fallen since 2010, but we published the “Fuller Working Lives” strategy last year and continue to work with businesses to ensure that everyone can adapt to the changing face of the workplace.
It is disappointing that the Government rejected the Women and Equalities Committee recommendation of a cross-departmental race equality strategy. Can the Minister at least commit to making the reporting of a race pay gap compulsory, in line with the gender pay gap?
As I have said, a great deal of work is going on, and I had a meeting earlier this year on exactly this point and look forward in due course to working with my colleagues in the Department for Business, Energy and Industrial Strategy on how we can close these gaps as well.

Commons ChamberThe Minister for Women and Equalities takes her responsibilities to the House very seriously and regrets that she cannot be present this morning because she is attending an important Cabinet meeting on EU exit. If there are any urgent matters, she will of course be available to discuss them with colleagues this afternoon.
Earlier this year, the Government Equalities Office and the Department for Business, Energy and Industrial Strategy ran an award-winning £1.5 million communications campaign to promote the take-up of shared parental leave. That was supported by revised guidance and case studies, making it easier for parents to understand and access the scheme.
The introduction of shared parental leave was a momentous step forward for families and for parents in work, with families no longer being held back by outdated stereotypes. Unfortunately, however, official figures show that only 2% of eligible parents have so far taken up the scheme. Many fathers say that they are worried about taking leave because of a perceived negative effect on their careers. What are the Government doing to encourage cultural change to help men to feel that they can take leave, to encourage companies to do more to bring men’s leave pay in line with maternity pay, and to make companies publicise parental leave and pay policies that help to reduce discrimination?
The hon. Lady has hit on the point that this is about not just businesses, but cultural change. That is why we are building the evidence base to understand what works best in encouraging a parent to take up shared parental leave. There are 285,000 parents or couples who can access this scheme across the country, and we encourage them to do so. We are also funding a research programme, which I will disclose more about in response to the first topical question, that will deliver evidence-based tools for employers on what works in closing their gender pay gaps and addressing their employees’ parenting responsibilities.
No awareness campaign on shared parental leave, however welcome, can lead to a significant increase in uptake while structural issues—the fact that men still, on the whole, earn more than women, for example—are making it really hard for families to make this choice. What will the Government do to follow international best practice and make parental leave more accessible and affordable?
Again, we are conscious that this is not just a matter for businesses; it is about cultural change as well. That is why our evidence-based programme will, we hope, bring real results. We look constantly at what other countries are doing to encourage parents to share their parenting responsibilities while maintaining their place in work, because we know that work helps women through financial independence. We want to do all that we can to help parents to maintain their careers while, of course, bringing up their children in a loving family environment.
Just as women should have equal opportunities to work, men should have equal opportunities to be active parents, but they face many barriers to doing so. Will my hon. Friend assure me that she and the Government will be keeping a close eye on their shared parental leave policy to make sure that it achieves its ends?
Very much so. I am grateful to my hon. Friend, who does a great deal of work on gender issues. Before making any changes to shared parental leave and pay schemes, it is important to evaluate the situation, and we will be doing that this year. We will look carefully at what the evidence tells us, and also learn from other countries, before committing to a particular course of action.
Take-up of shared parental leave has been reported to be as low as 2%, and the low rate of shared parental pay is often cited as a reason for that low take-up. Does the Minister agree that if we are serious about tackling the gender pay gap and maternity discrimination, we need to introduce properly paid, stand-alone statutory paternity leave?
As I said, we have to look carefully at the repercussions of any changes to shared parental leave. For example, we want to help self-employed mothers in this space. If they qualify for maternity allowance, they are allowed to share parental leave and pay with an employed father or partner. We are not ruling out providing further support for working parents. We very much agree with the principle of equalising benefits for the self-employed. However, as part of our response to the Taylor review of modern employment practices, it is important that we consider making changes to this area only after careful thought and consideration.
Many colleagues have highlighted their concern about take-up being just over 1% and I must push the Government further. Will the Minister spell out what exactly this Government will do to ensure that taking up the scheme is a real option for parents?
First, I welcome the hon. Lady to her role. I am sure that working with her across the Chamber in the coming months will be a pleasure.
As I said, I am going to make an exciting announcement in response to the first topical question about our detailed programme looking not just at shared parental leave, but at other gender equality issues in the workplace. This Government are committed to leading the world in this space. As part of that, we will evaluate how shared parental leave is working, and get the message out that someone who is a working parent should ask their employer whether they are able to take shared parental leave.
May I first thank the hon. Lady for her role in introducing gender pay gap reporting? I have good news because it has emerged that 100% of employers identified as in scope have reported in the first year. I think that may be unprecedented in Government schemes. My thanks, as I say, to the hon. Lady, to everyone in the Government Equalities Office involved in making that happen and of course to the employers. That represents more than 10,000 boards across the country having board-level conversations about closing the gender pay gap, but reporting is just the first step. Employers must also take action to close the gap and we are supporting them in doing that.
I thank the Minister for that response. I congratulate her on the—almost suspicious—100% compliance, but I am sure the House will agree that that is good news. It is simply unfair that people earn less because they happen to be women, have brown skin, have a disability or come from a working-class background, yet there is clear evidence of pay gaps for all those characteristics. The gender pay gap reporting has clearly made employers pay attention to inadvertent and structural biases in their pay arrangements, so will the Government consult on extending pay transparency and reporting to tackle those wider injustices?
That is a very good point. We are committed to looking not just at gender, but BAME and issues such as mental health. This reporting is opening up conversations about gender, as I say, but we hope that, as part of that, it will open up conversations about how employers treat their workforce generally and ensure that fairness is extended to everyone regardless, as the hon. Lady says, of gender, how they look and so on. One thing we are keen to do is to ensure that, as part of the reporting, employers put their action plans out there. About 48% of companies are already doing that. We would like them to do more.
It is good news and should be celebrated that 100% of eligible businesses have reported on the gender pay gap, but may I press the Minister further? What further steps will she take to see that action flows from the reporting of this gender pay gap?
Very much so. We have a packed agenda of meetings with business leaders but also with industry leaders, so that we can trickle down good practice from the largest employers, who obviously have the most resources in terms of HR departments and so on. We want to get the best practice from them and trickle it down so that we help those employers who under the legislation are required to report. My aspiration is also for employers who fall under that threshold to start adopting the same good practice as well.
In July, we launched the Gender Recognition Act 2004 consultation and a 75-point LGBT action plan in response to the findings of the national LGBT survey. The action plan includes a £4.5 million fund to support delivery of these commitments—ranging from bringing forward proposals to end conversion therapy to appointing a national LGBT health adviser. This work marks a culture change to ensure that LGBT people feel respected at every level of our society.
The “Safe to talk to me” initiative pioneered by Dr Mike Farquhar gives badges, such as the one I am wearing, to NHS staff to encourage members of the LGBT community to understand that they can raise such issues in an open and safe environment. Will my hon. Friend welcome that initiative?
Very much so. I thank my hon. Friend for the work that she does in the national health service looking after ill children. I am admiring her badge from afar. It looks very colourful. I hope that it will draw exactly the sort of reaction intended—namely, encouraging people who perhaps need extra reassurance that they are welcome and they are safe in the NHS to talk about their needs.
Does the Minister agree that we need to do more to help our LGBT friends around the world, particularly those who are seeking asylum? Will she therefore condemn the Home Office’s approach at the moment? It is deporting one of my constituents back to Venezuela after he has applied for asylum and married someone here and lived in Britain for three years. The Home Office still says that Venezuela is a safe place for an LGBT person to live. It even recommends that his husband moves back with him.
Of course I am concerned to hear about LGBT people in Venezuela being treated as despicably as the hon. Gentleman has described. If I may, I will take the opportunity to invite him to write to the relevant Minister. I would certainly hope that we can look into the matter in more detail.
Very recently, the Government reduced the waiting time for gay people who want to give blood from 12 months of celibacy to three months, which was welcomed by the LGBT community. Will my hon. Friend update the House on how that progress is going?
I thank my hon. Friend for his work. I know that he campaigned strongly on this issue, and he adds colour to the House, as I am sure he added colour to that campaign. I regret that I do not have the precise figures to hand, but if I may, I will take the opportunity to write to him, and I would, of course, be happy to discuss the matter with him after this session.
As you know, Mr Speaker, I entered a civil partnership eight years ago, yet the Government are still consulting on what to do about civil partnerships—there is a threat that you are going to abolish us! [Interruption.] Well not you, Mr Speaker, but the Government are threatening that they might abolish civil partnerships. There is joy, there is passion, and not so much celibacy in civil partnerships, so would it not make far more sense to extend them to straight people as well?
I enjoyed the hon. Gentleman’s civil partnership ceremony which, if memory serves me correctly, took place on 27 March 2010.
There are so many ways I could go with this. I congratulate the hon. Member for Rhondda (Chris Bryant) on his civil partnership. He will know that my hon. Friend the Member for East Worthing and Shoreham (Tim Loughton) is promoting his Civil Partnerships, Marriages and Deaths (Registration Etc.) Bill, and I will have the pleasure of responding to that as the Minister responsible. We are conducting a consultation and carefully considering the Supreme Court judgment because, all joking aside, we know that these issues matter to people and we want to ensure that our country continues to be a place of equality.

Since June 2017, women from Northern Ireland have been able to access abortion services in England free of charge. We have also introduced a central booking system to simplify the process and there is support for travel costs where appropriate. The numbers of women from Northern Ireland accessing abortion services in England and Wales has increased as a result: up 25%, to 919 in 2017, which is the highest level since 2011.
Recently, the Government announced that they will echo Scotland in giving women the right to take early medical abortion pills at home. In Scotland, however, there is a residency test for this healthcare, which, if copied in England, will deny the 28 women a week who are now coming from Northern Ireland for an abortion in the UK, that choice of procedure. Will the Minister pledge to work with the Department of Health and Social Care to prevent that happening, or will she now listen to the Supreme Court, which said that this was a human rights abuse in the first place? Let us get on and give our Northern Irish sisters the right to access healthcare and abortion at home, just as our sisters around the rest of the UK have.
Department of Health and Social Care Ministers only have the power to approve English homes as a class of place for medical abortion. The definition of what “home” means in this context is not straightforward and will be determined as we take this work forward. DHSC officials are working with the Royal College of Obstetricians and Gynaecologists to develop a protocol that will set out criteria for which places should be covered by the term “home”, as well as contradictions for use at home and other relevant issues. We will look at how the schemes are working in Scotland and Wales and learn from their experience. The hon. Lady knows, on the wider point of abortion, that we call upon representatives in Northern Ireland to get their act together and get the Assembly working again, so that Northern Irish people can make their decision on this very important topic.
The Government are committed to ensuring that the UK is an international leader on gender equality research, so that employers have the tools and knowledge to act on their gender pay gaps. We are investing £3.1 million in research on gender equality in the workplace over the next two years. That includes £2 million in the gender and behavioural insights programme, to help us to understand what works to change employers’ behaviour and improve gender equality in the workplace. In June, we launched the workplace and gender equality research programme—a two-year programme that will invest more than £1 million in new research and deliver evidence-based tools for employers on what works to close their gender pay gaps. That reflects the Government’s strong commitment to ensuring that evidence supports employers and employees.
Research from Wales TUC showed that as many as 85% of women who took part in its survey felt that the menopause had adversely affected their working life. Will the Minister press colleagues to consider workplace policies on the menopause, so that women get more support and employers cannot ignore the welfare of women with menopausal symptoms?
One of the advances of this Parliament is that we are beginning to talk about the menopause and its effects more than we did three, four or five years ago, and I think that that is a good thing. I very much take the hon. Lady’s point about encouraging employers to recognise the effects of the menopause as part of their treatment of employees. That goes to the point that we have been talking about, whether it is the gender pay gap or the treatment of black and ethnic minority employees and others. It is about employers treating their workforce fairly in a way that gets the most out of people’s potential and makes them feel valued.
The Government have responded today, in a written ministerial statement, to the inquiry that I requested—as the then Minister for Women and Equalities—into whether we needed a national buffer zone system for abortion clinics. They have concluded that we do not. May I ask the Minister what arrangements individual councils or areas will have in the absence of such a system?
Let me add that I welcome the conclusion reached in the written ministerial statement. Now that I am able to travel slightly less conspicuously, I took the opportunity to visit the abortion clinic in the constituency of Ealing Central and Acton to take a look for myself. I observed that there was no longer any harassment taking place, which I believe continues to reflect the conclusion in the statement.
I am grateful to my right hon. Friend for her question, and, obviously, for her work on this issue.
I asked for the written ministerial statement to be issued in advance so that Members would have an opportunity to question me about it today. Having looked at the evidence, we have discovered that 363 hospitals and clinics in the country offer abortion services, and that in 36 of those locations there have been demonstrations, or protests—however people wish to phrase it. On the basis of that evidence, we have concluded for the moment that we should continue the current scheme of enabling councils to apply for public space protection orders which target their localities, but we will of course keep this matter very much under review, because we want to ensure that people who need to access such services can do so safely.
The arrival of Blake Bridgen on 8 September means that my hon. Friend the Member for North West Leicestershire (Andrew Bridgen) will have the opportunity to engage in shared parental responsibility. Can the Minister assure me that we will continue to promote the “share the joy” campaign, so that other men can benefit from shared parental leave?
Very much so, and I am delighted to hear about my hon. Friend the Member for North West Leicestershire (Andrew Bridgen). That was news to me, and I am sure that we all share his joy. I look forward to his taking some shared parental leave—if that is permitted under house rules.
The hon. Lady will, I hope, understand that I cannot comment on cases on the Floor of the House, but if I can extend an offer to meet her—or arrange for the relevant Minister to meet her—I will of course do so.
May I take up a point that was made earlier? During the summer recess, I visited Corby jobcentre and met the very dedicated staff there. They told me unequivocally that universal credit was working locally. Is it not the case that more women are in work, and that universal credit is helping that?
Forced marriage is outlawed in this country, but it still happens, and schools do not do enough about it. It does not help either that children can get married at 16 in this country. Will the Minister meet me and Jasvinder Sanghera from Karma Nirvana to discuss this issue?
It was a pleasure to sit in for my hon. Friend’s 10-minute rule motion on exactly this point last week, and I would be happy to meet her to discuss the marriage age. Forced marriage is illegal, of course, and the Home Office is doing a great deal of work to spread the message around communities particularly affected by it that it is simply not acceptable in the 21st century.
It does not show that at all. The Government have a record of trying to push people into work, because we see work as the best way of tackling hunger and poverty. That is why we are trying to make universal credit taper more easily—so that when people get into work, they keep more of their own money. It is also why we raised the threshold at which people start paying income tax—again so that the lowest paid keep their money rather than paying it to the state. It is also about extending educational opportunities to children so that when children leave our schools they have had a good or outstanding education.
What progress has my hon. Friend made in developing the legislation required to remove caste as a protected characteristic from the Equality Act 2010?
I always look forward to the six-weekly question from my hon. Friend on this matter. The Government completely oppose any discrimination on the basis of a person’s origins, including any perceptions of their caste, which is why we issued a public consultation on caste and the Equality Act. It ran for six months and closed in 2017. We responded in July and now propose to ensure there is appropriate legal protection against caste discrimination through reliance on existing case law. In our view, this shows that a statutory remedy against caste discrimination is already available. As for a date, I am afraid he will have to keep pressing me, because, as he will appreciate, machinations are in place.
I am pleased that today the previous Home Secretary’s review of abortion clinic protests has seen the light of day—and that the right hon. Member for Hastings and Rye (Amber Rudd) is in her place given the last episode of “Bodyguard”. However, the conclusions are a bit disappointing as the word “women” does not occur in there once; the review talks about pregnant persons. It seems to say that a disproportionate number of women must be affected before any action takes place. May I suggest that the Minister has a meeting with her boss, the Home Secretary, me and the Chair of the Select Committee on Home Affairs, because there are other ways of proceeding than the blanket ban that the Government have rejected?
I commend the hon. Lady for all the campaigning and other work she has done to stand up for her constituents and those visiting her constituency for the services provided by the clinic there. I am of course happy to meet her and the Chair of the Home Affairs Committee to discuss this issue further. We will keep it under review. We are particularly interested to see how the public spaces protection order in Ealing is working. We understand from Marie Stopes that it considers it to be working well, but of course we will keep it under review.
