On a point of order, Mr Deputy Speaker. The Met Office has issued its first ever red warning for the heatwave that the country is likely to experience on Monday and Tuesday next week. Has the Department of Health and Social Care given you any notice of its intention to make a statement to this House about the health consequences for the public, not least given that this red warning means there is likely to be a risk to life?

Of course, our newspapers, television screens and airwaves are full of reports of overwhelmed ambulance services and accident and emergency departments. Given that the Secretary of State for Health and Social Care failed to answer my urgent question on Wednesday, I would have thought that invisible man might make an appearance today to advise and reassure the public that our public services and emergency services will be able to cope in the light of this emergency.

I thank the hon. Gentleman for his point of order, and for giving me forward notice. I have been given no notification that there will be a statement from the Department of Health and Social Care, or any other Department, today. It is timely that the hon. Gentleman makes this point of order, as people should take advice in these unusual circumstances. People should take water with them when they travel, they should make sure there is plenty of ventilation and they should seek attention if they are feeling unwell. When the UK Government seek to strike trade deals with the rest of the world, they need to be able to speak with one voice for the whole United Kingdom, so will the Secretary of State commit in the Bill that he brings forward to making sure that arrangements are in place for proper consultation with all the devolved Administrations and proper scrutiny by this Parliament and the elected representatives of the British people?

Yes, of course. We have been working with 11 new potential, or existing potential, suppliers, but more than 5,000 businesses have been involved, offering to provide services, because, of course, when producing a complex machine such as a ventilator, we need to make sure that we source everything from the appropriate batteries, the appropriate valves and the appropriate other technology. As I say, 5,000 businesses, including Rolls-Royce, have been involved in the manufacture.

Everyone will understand that we have left the European Union and everyone will understand that the impact of covid-19 might have an impact on the timetable for negotiating our future relationship, so why will the Minister not give businesses the reassurance they need that if the Government need more time, they will take more time? Is it dogma; is it vanity; or is it paranoia?

The hon. Gentleman provides a helpful list of conditions, but it is none of those. It is plain prudence. Were we to perpetuate our membership of the European Union-lite through the transition period, we would end up spending more taxpayers’ money, which could be spent on the NHS. We would have to accept new EU rules that might constrain our ability to fight covid-19 and to deal with other crises, and we would, of course, be unfortunately and unfairly trespassing on the EU’s need to concentrate on other vital priorities.

Does my hon. Friend agree that, post Brexit, we want to continue to attract bright students from many countries all over the world? The proposal that we should exempt EU students from paying fees yet impose them on those from other countries is inherently unfair and, in fact, discriminatory. It does not make economic sense or reflect the open Britain that we are striving to create.

I urge my hon. Friend to do so as well. I will not discriminate on either side of the House. It is a great deal, which will provide us with certainty. We have been closely involved with our European partners for many decades. Ensuring that we continue some of those partnerships, which have both social and economic value, is important.

My hon. Friend is right about the international perspective. People voted to leave the European Union to ensure that Britain can be outward-looking, positive, not insular and not nativist. We want to be able to reach out to other countries and meet our responsibilities on the sustainable development goals. We want students from India and ASEAN—Association of Southeast Asian Nations—countries who want to come to the UK to study, but cannot at the present time, to have the opportunity to do so. Why should European students be given a disproportionate opportunity when it comes to fee levels? She has a valid point.

UK higher education is one of our great national and international success stories, yet there can be no doubt that the Prime Minister’s immigration policies have done enormous damage to our international reputation. And here we are again—the cat is out of the bag—looking to charge EU students tuition fees and make as much money out of them as possible before the withdrawal agreement has even been signed. Will that not just use EU students as cash cows, but rob UK students of the opportunity to study abroad? How many more national success stories are we prepared to sacrifice on the altar of Brexit?

There are proposals to welcome in this statement, but it says an awful lot about this Government that they have to stretch back more than 100 years to find good examples of advancing Conservative employment laws. The Secretary of State could have talked about the doubling of the length of time that employees have to wait to enjoy full employment rights, which was introduced in 2012. He could have talked about the employment tribunal fees introduced in 2013 or about the draconian Trade Union Bill introduced in 2015. Under this Conservative Government, even the Prime Minister’s job security is not all that safe either.

Companies such as Uber are subject to licences awarded by public authorities, so may I ask the right hon. Gentleman to look carefully and seriously at whether licensing authorities such as the Mayor of London, Transport for London and others could take into account employment rights and practices before awarding licences, or indeed—I am thinking across Government here—awarding contracts?

I mentioned some recent examples of legislation, to which I might add the national living wage, which has made a huge difference and led to the fastest growth in the rate of pay for the lowest earners in 20 years. When it comes to the examples that the hon. Gentleman gave, my intention is clear: whoever someone works for in the gig economy, their rights should be clear and fair. Whether they are regulated by the Mayor of London or are not subject to regulation, those rights should be unambiguous, clear and enforced.

There is already the review by John Timpson into our high streets, but we need to keep track of this area. My hon. The hon. Gentleman will be aware that the Government are considering the Migration Advisory Committee proposals in full, but there is no cap on international students coming to study in this country. The university sector is one of the most successful sectors in this country and this Government will make sure we continue to support it.

I congratulate my hon. Friend the Member for Barnsley East (Stephanie Peacock) on securing this important debate. The casual- isation of the jobs market is nothing new. For decades now this country has been moving from an industrial, export-led economy to a services-led economy. Over that period we have begun to see—at an increasing pace—a race to the bottom in jobs, pay and terms and conditions for working people. That is why the debate is so important.

In my capacity as chair of the all-party parliamentary group on taxis, I have raised concerns about the taxi and private hire industry, which other hon. Members have referred to. For anyone in any doubt about the agenda of those companies and the way they treat their workers, look at the way that companies such as Uber have had to be dragged kicking and screaming through the courts by trade unions, on behalf of their members—Uber workers—to be made to provide the basic terms and conditions and decent wages that everyone should enjoy.

I am proud of the role that GMB has played, of my party’s relationship with the trade unions and of the support I have enjoyed as a trade union member and supporter, which is reflected in my entry in the Register of Members’ Financial Interests. However, people should not have to rely on trade unions or High Court judges to protect their basic rights and terms and conditions; they should have a Government and a legal framework that is on their side, which they clearly do not.

We have heard nonsense about flexibility—about how flexible the gig economy is and how people really enjoy the choice. How many people would choose that flexibility for themselves?

I am happy to give way, but how many Members would choose to earn less than a real living wage or not to receive holiday pay and maternity or paternity pay? The truth is that, when we are looking at the way our economy will change—the next phase of globalisation, and the next phase of the industrial revolution that will change our country—how we protect the value of labour will be one of the single biggest questions that defines our political generation. It is about skills, but fundamentally it is about shaping the economy in the interests of ordinary working people and not allowing tech companies, top-heavy business models or digital platforms to shape it in their interests.

The Taylor review was a wonderful opportunity to answer and to meet some of these big challenges. Matthew Taylor is a great guy with a big brain, but clearly, because of his working for this Government and within the political framework in which he knew the report would be received, that report was not nearly ambitious enough. If that was not disappointing in and of itself, the fact that we have seen so little action off the back of it tells workers that they cannot rely on this Government to protect their interests. We desperately need a Labour Government that will put their interests and their rights at work front and centre.

I congratulate my hon. Friend the Member for Barnsley East (Stephanie Peacock) on securing this important debate, and on the thoughtful, passionate contributions made by colleagues today—all but one of them from the Opposition. It seems that the Government’s ruthless whipping ended with the last vote to happen in the Chamber.

My hon. Friend eloquently captured the fear and precariousness associated with modern workforce practices in the gig economy. She made the crucial point at the heart of the issue: there is a fundamental power inequality between the employee and the employer, and we cannot reply to that inherent difficulty in the gig economy with consultations. To remedy it, there must be recognition in law that the power imbalance exists. A pattern that has emerged as a feature of the gig economy is the process of outsourcing and of apps as managers. Those who reap inordinate profits from workers’ labour are distant from accountability for them and from their welfare. They have relinquished that responsibility.

Hon. Members have told us about people who have had long, loyal relationships with a company but have been refused employment contracts and have been left languishing with few or no workplace rights. Members are, rightly, deeply disappointed with the Government’s response to the Taylor review. It was a consultation, and for the Government to conduct a consultation on a consultation seems a weak response.

I really need the toilet right now, probably because I am eight and a half months pregnant, and my lasting memory from the contribution made by my hon. Friend the Member for Mitcham and Morden (Siobhain McDonagh) is of people being too scared to go to the toilet because they are worried about what will happen to their jobs, which is an absolute disgrace. That people are too scared to go to the toilet in this century, never mind any other century, is absolutely terrible.

The Conservatives and the Government boast about the recovery of employment and lower employment figures, but, sadly, for millions of people work means rising insecurity and low pay. Average real pay has still not returned to the level it was before the financial crisis, and the Resolution Foundation predicts that this is likely to be the weakest decade of real pay growth in almost two centuries. We might have high employment, but we also have record poverty among those in work, so a celebration of employment figures alone is completely disingenuous. What are the Government actually celebrating? More than 8 million working people live in poverty. In 2018, that is an absolute disgrace. The Minister celebrates low unemployment but fails to recognise the poor quality of those jobs.

My hon. Friend is making an excellent speech. Does she agree that it is utterly perverse that many of the people in low-paid insecure work are forced to rely on tax credits? In other words, all of us as taxpayers are funding the exploitative business models of their employers who do not pay their staff proper wages.

It is absolutely nonsensical that the state should subsidise inordinate profits on the one hand and very poor pay on the other. The reality of modern work for millions of people, particularly in the north and in places such as North West Durham, is short-termism, insecurity, low pay and fear. Fixed-term contracts, enforced self-employment and agency work signal a move towards a more casualised and fragmented world of work. The use of zero-hours contracts increased rapidly in the wake of the financial crisis, increasing two and a half times between 2012 and 2016. The latest figures available show that that is not abating. We have had an increase from 1.4 million to 1.8 million in just six months.

When Conservative Members celebrate the flexibility—this has been mentioned many times—of zero-hours contracts, they have a romanticised vision of a student who perhaps wants summer work, but the reality is very different. One in three people on a zero-hours contract wants more hours.

As I was outlining, the poorer students today are leaving with the highest levels of debt, and this Government scrapped the maintenance grants that would have helped them. The next Labour Government will reintroduce maintenance grants and scrap tuition fees to make sure that our students can get the education they deserve. I ask the Minister to think again and ensure that everyone, whatever their background, can access education.

This brings us back to a fundamental point. What do the Government believe the role of the new Office for Students should be—an independent regulator, a funding council, a validator of degrees or a body to micromanage universities? How will a university know when it is dealing with the regulator, a funding council or the voice of Government? It is that final point that will be concerning to many universities and students, who worry that, far from acting as a voice for students to the Government—I ask as the Minister chunters away—the Office for Students will be the opposite: the Government demanding a voice on students. For instance, the Minister wants the Office for Students to stop no-platform policies that ban hate groups from student unions. This seems to be a solution in search of a problem. Perhaps he can explain why he believes that he and the board of the Office for Students should use their resources to interfere at this level.

My hon. Friend is making an incredibly powerful speech. One of the groups on the NUS’s no-platform policy was Hizb ut-Tahrir. Presumably, if Hizb ut-Tahrir was not on the NUS’s no-platform policy and student unions were not making efforts to stop it speaking, the Government would be attacking student unions for not doing enough to tackle extremism on campuses. Does this not expose the ideological flaws at the heart of the Government’s obsession with what is frankly a debate best reserved for student union meetings, rather than the House of Commons?

I absolutely agree with my hon. Friend, who makes some excellent points, as he did throughout the Committee stage of the Higher Education and Research Act 2017. It seems ironic that many of the organisations or individuals listed under the NUS’s no-platform policy have been banned by the Government themselves. Is it still the Government’s policy to fine universities for the actions of autonomous student unions? If so, will the Minister explain how high the fines will go?

While the Government are prepared to dictate student union speakers lists, they have shied away from the real issues, such as the soaring pay of vice-chancellors, while staff pay continues to fall in real terms. The Labour party has set out a plan to tackle pay inequality and accountability, but the Minister seems strangely shy about using the sweeping powers of the Office for Students. Instead he has said he is “intensely relaxed” about runaway pay packets.

As the first person in my family to go to university and to have made it from free school meals in an inner-city state school to the University of Cambridge, I am not taking any lectures from the Conservative party about being anti-aspiration. It is because so many of my constituents have high aspirations for their children to go on to high-quality technical education or high-quality higher education that I am so concerned about the direction of Government policy.

As much as Conservative Members come here this evening to accuse the Labour party of trying to bring down the OfS by daring to vote against the statutory instrument, they neglect to notice that this SI was not in place yesterday and yet the architecture of the higher education sector has not fallen apart. It is not in place today, yet the higher education sector still seems to manage to function. If they expect us to pass any old rubbish on the basis that we have to pass it or there will be calamity, I have to tell them that, unfortunately for the Conservative party, they did not win a majority at the last election, and they have to get used to winning arguments and to parliamentary scrutiny. Presumably, that is why they bring forward so little legislation; they realise that this House of Commons will not pass any old rubbish.

That brings me to the statutory instrument we are dealing with this evening. The Office for Students is the logical conclusion of a vision of a higher education system in which, as my hon. Friend the shadow Secretary of State said, the market rules supreme and which seeks to reduce higher education to a commodity for students to purchase as consumers and trade in for future success in the workplace. We were promised that the Office for Students would be this great champion of consumers, but we have seen precious little evidence of that so far.

The tragedy is that the Government managed to find a well-respected chair of the Office for Students, who was the architect of the system and who believes in their vision of a consumer-driven higher education system. The problem for the chair of the Office for Students and its very capable poacher-turned-gamekeeper chief executive is that, because of politicisation by the Government and their sheer incompetence, the Office for Students has been left discredited by the political process that led to the composition of its board. How can they come here with a straight face and defend a process that was condemned by the Commissioner for Public Appointments, who found not only that assurances given to this place were incorrect, but that there was direct political interference by special advisers from 10 Downing Street?

The report by the Commissioner for Public Appointments on recruitment to the Office for Students highlighted several concerns about fairness and consistency in the appointment process. Will my hon. Friend comment on how students and universities can be expected to place any trust in that body as a regulator?

I wholeheartedly agree with my hon. Friend. In fact, one of the things about the appointments process that has deeply damaged the standing of the OfS in the eyes of students was the insistence by Government political advisers that there should be no representatives from students unions or the National Union of Students on the board. The Government did not say, “We’re going to cast the net wide, and if we find a student who is more capable than an elected officer of the NUS or a students union, we’ll appoint them,” but instead effectively blacklisted the NUS and students unions. As a former president of the NUS, I think that is an absolute disgrace, not least because students who are elected have the confidence of the student body. They present manifestos about the issues that those they represent care about.

If the Government had listened a bit more to what students were saying, perhaps they would not be in the political mess they are in, not just with students but with their parents and grandparents, who are horrified that tuition fees have been trebled, that student grants for the poorest were abolished and that the education maintenance allowance for students in further education was scrapped. The Government have got themselves into a real mess by failing to listen to people who know best about higher education, which is the people who work in it and the people who learn from it. It is a disgrace that there is no NUS representative on the board of the Office for Students.

It is also a disgrace that there is no staff representative from the University and College Union. Recent events, particularly in the pensions dispute, have shown that the lack of effective dialogue between staff representatives and university leaders leads to students being severely disadvantaged, but we have barely heard a peep from the Government about that crisis. They seem to have their heads in the sand. It is deeply regrettable that the Office for Students has been so deeply damaged by politicisation in the run-up to its creation, and the Government should not be surprised that we wish to oppose this statutory instrument.

Finally, let me gently say, without apology or any humility whatsoever, that many of the issues that have confronted the Government, particularly vice-chancellor pay and scrutiny and accountability, would easily have been dealt with had they accepted more amendments from me and my party’s Front Bench during the Higher Education and Research Bill Committee. I warned them that vice-chancellor pay was soaring out of control, and I proposed a modest amendment that would have put student and staff representatives on remuneration committees to better hold vice-chancellors’ pay to account, but that modest proposal was rejected by the Minister’s predecessor. The Government must be regretting that now. I also tabled an amendment that would have required universities to publish the ratios of the highest-paid to the lowest-paid at their institutions, to allow students, staff and the public to better hold them to account. That modest proposal was rejected as well.

As my hon. Friend the shadow Secretary of State said, the truth is that, when it comes to championing the interests of students and making our higher education sector better, fairer and more equitable, the Government do not listen and do not act. I agree strongly with what the Chair of the Education Committee said about the lack of further education representation. If we are serious about a further and higher education system that is well placed not just to serve the needs of our future economy, but to champion social justice, the Government need to do a damn sight better than they have done with the creation of the Office for Students. They cannot expect an effective Opposition to wade through statutory instruments like this when the work beneath it is so shabby and poor.

Well, it cannot be entirely inaccurate because the most powerful student voice in the country is, in fact, the National Union of Students, and it is not entirely happy.

It was, in fact, the case that the president of the National Union of Students sat around the board table of the Higher Education Funding Council for England, so it is not true to say that what we have now is an improvement. We have a token student on the board of the OfS with no representative background whatever, and a talking shop that has no real teeth. That is not the same as having a board member.

I would like to mention one person above all others, if you will indulge me, Mr Deputy Speaker, and that is my magnificent researcher Keith Thomson. He has pulled a shift and a half—a paid shift and a half—to ensure that the Bill made it to the Floor of the House this afternoon.

Right hon. and hon. Members will know that the Bill enjoys support from all the parties in this House, with the exception of the Democratic Unionist party, but I do not wish to dwell on that lowly fact at the moment; unfortunately, my overdraft did not extend to that which Her Majesty’s Treasury enjoys. Right hon. and hon. Members will also know that yesterday the polling company YouGov published a poll showing that 65% of the public believe that unpaid trial work is unfair; a clear majority of people across the UK are looking for this Parliament to do what it has to do in correcting the law as it currently stands. That is the opportunity that sits before us. [Interruption.] Did the hon. Member for Mid Worcestershire (Nigel Huddleston) wish to say something? It is unlike him—

I congratulate the hon. Gentleman on introducing this Bill. Time is short, and we know how Friday shenanigans can sometimes work. Given the high level of public and cross-party support, it is incumbent on the Government and, in particular, Conservative Back Benchers, to make sure that this Bill passes its Second Reading before we adjourn.

The hon. Gentleman knows, as do Conservative Members, that I wish to be a constructive voice in this Parliament while I am here. I think this is a good Bill. Some people may see it as not a perfect one, which is why it should go to Committee, so that we can make good law. If we are not here as legislators to make good law, what on earth is the point of this Parliament? Although my political career rests on that question, while I am here I would like to make some use of the time and so I agree with what he has to say. With support from Members from across the Benches and with great support enjoyed among the public, we should give the Bill a Second Reading.

I wish to adumbrate for Members why I believe, as do so many others, that the law needs to be changed. As I understand it, the Government’s view is that unpaid trial shifts are already unlawful and that such practices are covered by the National Minimum Wage Act 1998. It is 20 years old this year and undoubtedly a fine piece of legislation, but it is insufficient when it comes to dealing with unpaid trial shifts, although I do not think it was meant to be. We have the opportunity to put it right.

In 20 years of the 1998 Act, there has not been a single tribunal or a single fine issued. There has not been a single prosecution, naming and shaming or ticking off of anyone for the use of an unpaid trial shift. That feeds into the fact that the Government, the courts and the trade unions do not hold any statistics on unpaid trial shifts. Nevertheless, we all know that they happen.

I recognise that, as I have said, many of the tweets have been obnoxious and repellent in many ways—obviously, I have not seen all 40,000 of them—but it is also important to recognise that that tweet was probably eight or nine years old, since which time Mr Young has been on something of a developmental journey. It is possible that there is a capacity for reform, and we want to encourage Mr Young to develop the best sides of his personality—those that have led to him setting up good schools and to working with disadvantaged children in London so that they can make the most of their potential. It is for those reasons that he has been appointed to the board.

There is a fault line in politics, with those who want a modern democracy with people appointed on their merit rather than their mates on one side, and I am surprised that the Minister, who is meant to be a serious person, finds himself on the other side.

I ask the Minister specifically about Mr Young’s comments in the past two to three years, which the Select Committee Chairman raised, and in which Mr Young advocated what he called “progressive eugenics”—not in 2009, but in 2015. He repeated that in November 2017. The comments were removed by the Teach First website and he claimed that he had been no-platformed and censored. Does that sound like someone remorseful, who is suitable for public office? Why on earth has the Minister done this, not only to his and the Prime Minister’s credibility, but to that of the Office for Students?

Mr Young’s work on behalf of disadvantaged and disabled students speaks for itself. He has championed inclusion in the educational institutions that he has set up. I cannot speak for the content of specific articles or tweets because, frankly, there are too many, and he has apologised for any offence he has caused, but I think that we should judge him by what he does—more so than we are currently doing.
