My hon. Friend is right. The nature of that solemn and binding treaty will be to lock us in, for 21 or 45 months, to every feature of the European Union without representation, vote or voice, and it might mean that we end up in large sections of it—the customs union and single market alignment—in perpetuity, thanks to the Irish backstop.

It is a massive delay, and I say to my hon. and right hon. Friends on the Front Bench that, if they are offering the public either a guaranteed delay under the withdrawal agreement or a shorter delay that they wish to negotiate, a lot of leave voters would rather have the shorter delay but, of course, all of us leave voters do not want any delay at all. That is why people will be scandalised by what this House is rushing through again this evening.

The shortage of time is completely scandalous. This is a massive issue that has gripped the nation for many months. It dominates the news media, it sucks the life out of this House on every other issue and now, when we come to this big crunch event and when leave had been led to believe that we would be leaving the European Union without an agreement if necessary, they are told at the last minute, for the second time, that all their hopes for their democratic outcome will be dashed again. This Parliament does that with grave danger to its reputation.

I urge all those who wish to get this lightning legislation through again to ask themselves what they are going to say to all their leave voters, and what they are going to say to their remain voters who are also democrats and who join leave voters in saying, “Get on with it. Get it over with. Why do we have to sit through month after month of the same people making the same points that they put to a referendum and lost?”

This Parliament needs to wake up and get real. It needs to move on, it needs to rise to the nation’s requirements and deal with the nation’s other business, and it needs to accept that this was decided by the public. It is our duty to implement it. Leaving without this agreement is going to be just fine. We are prepared for it. Business is ready for it. Business has spent money. Business has done whatever it needed to do and, in many cases, feels very let down that it is not able to use all its contingencies, on which it has spent good money.

I would say this to all Labour MPs, particularly those with a majority of leave voters in their constituency: understand the damage you are doing, understand the damage you are doing to this institution, understand the damage you are doing to our democracy and vote for us to leave the European Union.

It really is no good Government Members complaining about the lack of time—the lack of time to debate this Bill or the fact that we are days away from crashing out of the European Union with no deal. In fact, we would have done that already, were it not for the interventions of people from all parts of this House and in the other place.

Why are we in this position? There is some serious revisionist history going on tonight. It is because after the referendum, a Parliament in which a majority of Members voted to remain none the less said, “We accept that people have voted to leave the European Union.” When the Prime Minister—after she had been dragged through the courts, incidentally—was eventually forced to ask for permission to trigger article 50 and begin the process of negotiations, as has been said, the vast majority of MPs, myself included, voted to give the Prime Minister that permission. That was Parliament’s sole role in the matter: being asked for permission and giving the Prime Minister permission.

When Parliament voted for article 50 to be activated, surely Members knew that we would leave after an agreement had been reached or after two years—or did they not bother reading article 50?

The hon. Gentleman will be aware from our time together on the Treasury Committee that we knew what the timeline was for the negotiations. What we could not have foreseen was that the Prime Minister would be so irresponsible, when given the authority to trigger article 50, to send that letter without first having agreement within her Cabinet, within her party and across the House. We also could not have foreseen—not least because she promised repeatedly that she would not do it—that she would have wasted a significant proportion of that two years on a general election.

In the election, the Prime Minister asked the country in explicit and personal terms to give her the mandate that she needed for a hard Brexit of the kind that many Government Members now demand. What did the public say? They said no. They did not give the Prime Minister the majority she asked for. The Conservative party lost seats and the country decided that no one party could be trusted with a majority to govern. That should bring humility on all of us. It also required a degree of contrition and compromise, but we have not seen any of that from the Prime Minister until the 11th hour.

I absolutely do. Let me also say, as a Member of Parliament whose constituency split virtually down the middle, that there is a range of reasons why people voted in the way they did in the general election, because general elections are not single-issue democratic events. However, I can say that people in Ilford North were very worried about what a Conservative Government would bring to the country, not least because of the position that the Prime Minister staked out on Europe.

I made it very clear to my constituents that I believed that any deal should be put back to the people. That has been a consistent democratic principle. I did not know at the general election that we would be in the position we are now in: not just in the last chance saloon but on last orders. It seems that the Prime Minister is literally on last orders, as she is there just before they boot her out.

Does my hon. Friend agree that the one thing the election pointed out was that there was not a majority for a hard Brexit, and that if the Prime Minister had recognised that and reached out at that moment, we would all be in a much better position than we find ourselves in?

The Prime Minister has never sought to compromise. What she has found difficult—and what any Prime Minister would find difficult—is trying to reconcile the broad range of promises that were made to people in 2016 and the inability to deliver them all. That is entirely due to the fact that the leave campaign was never honest about the tension at the heart of its offer, which was that there is a trade-off between national sovereignty and economic trade and partnership, economic security and national security. We have been great beneficiaries of pooled sovereignty, but if we try to unpool sovereignty there are trade-offs and sacrifices. The leave campaign has never been honest about that.

The final thing I want to say is about the European elections. The idea that we would decide our country’s future, not just for the next year or two but for generations, around the inconvenience of organising European elections is nonsensical. There has never been a clamour for European elections. In fact, lots of the country is currently with Brenda from Bristol on the idea of any election: “Not another one!” I find this idea that holding elections or a confirmatory vote is undemocratic to be laughable. How can involving all our country in decisions about our future possibly be anti-democratic? The idea that we would rush to judgment, crash out with no deal and make decisions that will hurt this country for generations to come because we cannot be bothered to go out and knock on a few doors is no basis on which to make a decision. We should vote against the amendment.

The hon. Lady is usually one of the most forensic questioners in the House, but on this issue I am afraid that I fundamentally disagree. First, the Government have made it very clear that we will not revoke article 50, because we are committed to delivering on the referendum result. Secondly, it is again a slightly illogical charge for the hon. Lady to say that the Prime Minister is seeking to crash out on 29 March when she has today sought an extension to the end of June.

One of the reasons why we wanted the Prime Minister here this afternoon is that, whatever her shortcomings, we can at least trust that when she stands at the Dispatch Box she believes every word she says. That cannot be said for the Secretary of State, who can make an argument in one breath and then vote in the other Division Lobby in the next. [Interruption.] He should not be laughing this afternoon—by the way, people are laughing at him, not with him—because we are nine days away from crashing out with no deal, there is no sign of a plan from the Government and even the extension letter the Prime Minister has submitted fails the basic test of explaining why an extension is required. Is not the simple reason that there is no plan, and if there is a plan, what is it, Stan?

I think the hon. Gentleman is wilfully misrepresenting the way the amendable motion played last Thursday—the fact that amendments were defeated—and we have given a further commitment to an amendable motion on 25 March. Perhaps his frustration is displaced from his frustration with his own Front Bench, because what we have not had from the Leader of the Opposition is clarity about when a second referendum will be put.

I know that the hon. Gentleman is an acute observer of debate and language, but let me assure him that the debate on the SI will be a full and ample one, as to the reasons at the time. The Prime Minister has made it clear—[Interruption.] It may just be a quirk of my nature, but I am still optimistic that we may well get a meaningful vote through. If we do, we will apply for a short, technical extension.

We are days away from our planned exit day and the European Council is even sooner. With respect to the Minister, because I do not think this is his fault, let me say that it is completely unacceptable that the Government, at this stage, are not able to say to the House in simple terms the basis on which the Prime Minister will ask for an extension to article 50 later this week. May I help the Minister out of this hole by reminding him of a commitment made by the Chancellor of the Duchy of Lancaster, from the Dispatch Box, that this House would be given, by the Government, an opportunity for a series of indicative votes to see whether a consensus can be built involving a majority of Members? Does that commitment still hold?

My understanding was that the Chancellor of the Duchy of Lancaster’s commitment related to the period after we had decided to extend the article 50 period—that was when potential votes of the nature the hon. Gentleman describes would take place. I cannot stress more passionately to him that I still believe there is a binary choice: we still have the prospect of a deal or not. I still believe that that is an option. He has ruled it out, as have many others, but I still believe there is an option—[Interruption.] The Speaker did not rule it out.

My hon. Friend is absolutely right. I do not know what Brenda in Bristol would think about all the proposals from the Opposition parties. The vast majority of the people in this country want to see unity of purpose and for us get the best deal. They are fed up with the political opportunism of those on the Opposition Benches.

In reply to my hon. Friend the Member for Leicester West (Liz Kendall), the Secretary of State confirmed what the No. 10 spokesman said: there must be precise guarantees that Britain and the EU will enjoy frictionless trade after Brexit as a condition of the withdrawal agreement. The question is: does he agree with that position?

We made clear in our proposals, first in relation to the question that I answered, that we want to see a well detailed political declaration so that people, when they come to vote on the meaningful vote, have a clear idea of the direction of the economic model and the security model of co-operation. As the hon. Gentleman will know from our White Paper proposals, we are pursuing and aiming for frictionless trade. That is the point of signing up to a common rule book on goods and agri-food, and that is the reason for the facilitated customs arrangement. He should get behind those proposals.

I understand the concerns that my right hon. Friend and others will have about this. We are proposing to sign up to a common rulebook. There will be an opportunity to influence it through consultation. There will be a parliamentary lock. As I said, if this is not in the UK’s interests, there will be an opportunity to revise the arrangements, but the reality is that the common rulebook on manufactured goods, where a risk would be creating friction at the border, has remained relatively stable over recent years, so I do not think that in practice it would lead to the fears that he has understandably outlined.

The leader of the European Research Group, the hon. Member for North East Somerset (Mr Rees-Mogg), described this White Paper as

“the greatest vassalage since King John paid homage to Philip II at Le Goulet in 1200. This White Paper has not needed age to turn yellow”—

presumably he can give us an eyewitness account. The Opposition’s concern, as is clear from the resignations that we have already seen from the Government, is that this White Paper—the Government’s negotiating position—does not command at this stage the support of a majority of the House of Commons. How does the Secretary of State possibly expect the united front of the EU27 Governments, the European Commission and the European Parliament to take this Government at all seriously, because this House clearly does not?

The hon. Gentleman has produced all sorts of quotations, while blithely skating over the divisions in his own party. The fact is that these are complex issues on which views diverge, and people feel very passionate about them. What we have set out is a positive, principled but also flexible approach that is deliverable. We will go and negotiate with the EU, and we will ensure that we get the best deal for the country. Simply sitting on the sidelines and carping and hoping that somehow the Brexit decision will be reversed is, I am afraid, to be on a fool’s errand.

I start by saying to the hon. Gentleman that I respect his point of view. He has the honesty to say that he would like us to stay in the European Union irrespective of the referendum result. Although I disagree with it, it is honest position to take. But what he describes as giving the Government the right to take us out of the European Union under, frankly, any circumstances was article 50, which was passed by this House and the other House by a very large majority, so I am afraid that he is not right in that respect.

It is accepted practice that Governments negotiate treaties, and this was the case for the European Communities Act 1972, the Lisbon treaty, the Nice treaty, the Amsterdam treaty and the Maastricht treaty. I do not remember any argument over Parliament undertaking those treaties from people who today argue that this amendment is appropriate.

The right hon. Gentleman makes a very good point. It is certainly the case that the European Commission reads every newspaper in Britain, particularly the Financial Times and The Times. It reads them all, but, more surprisingly, it believes them. The simple truth is that it looks at any option that it thinks the British political system will throw up, which will allow it to get a negotiating advantage. Let us remember, too, that most, if not all, of the 27 would much rather that we did not leave—full stop. If it sees an opportunity to create that outcome, that is what it will do.

I want to make a little progress, and then I will give way again.

Furthermore, the Lords amendment sets deadlines that would simply allow the other side to use time against us, as it has already tried to do. What we have proposed in lieu is an amendment that builds on commitments that I first set out to the House in a statement on 13 December last year. The amendment provides that the withdrawal agreement cannot be ratified unless both the agreement and the future framework have been approved by a motion of this House. It also prevents the agreement from being ratified unless an Act of Parliament has been passed to implement it. This is all before the Constitutional Reform and Governance Act 2010 as well. Therefore, this is in addition to the Government’s commitment to introduce the withdrawal agreement and implementation Bill if Parliament votes in favour of a final deal.

We cannot do that. This constitutional structure has stood for hundreds of years and many thousands of treaties. As I said earlier, nobody suggested for a moment that the House of Commons should negotiate the Maastricht treaty, the Lisbon treaty, or one or two other controversial treaties that came before the House. We cannot change that structure now, on this basis.

I am very grateful to my hon. Friend for giving way, and pay tribute to the work that our Front-Bench Brexit team in this House and in the Lords have done to improve the Bill. The Secretary of State was not courageous enough to take my intervention, so may I ask my hon. Friend what does more to harm the Prime Minister’s hand at the negotiating table—the principle of parliamentary consent; the Foreign Secretary making damaging, unguarded remarks at a private dinner; the Brexit Secretary playing the hokey cokey about whether he is going to stay in the Government; or the spectacle of Ministers resigning because their own Government are too intransigent to listen to the constructive and sensible direction on Brexit that many of us would like them to pursue?

My hon. Friend makes a good point. There is nothing more damaging. As the Secretary of State himself said, the EU monitors with great interest developments in this House and what is said across the country. It sees the open warfare and disagreement in the Cabinet and the Foreign Secretary continually undermining the Prime Minister’s approach.

My hon. Friend is making a powerful speech. Is this not the greatest tragedy of the way in which the Brexit negotiations are unfolding? The people who voted leave were not being given the Brexit for which they voted on the timescale for which they voted, but the biggest losers will be the people throughout the country—especially the young—whose opportunities will become far more limited because of the type of Brexit that is being pursued. Furthermore, every parent and grandparent in the country should reflect on the damage that is being done to the prospects of their children and grandchildren.

That is an excellent point with which I completely agree. Indeed, I am about to speak about just that issue.

Brexit is an injustice that will take away rights without giving people the option to secure those rights in the long term for themselves and their children. The idea of European citizenship is cherished by those who are old enough to remember a time when Europe was going through a healing process. We seem to have forgotten that it was not always the peaceful, prosperous place that it is today: a union of people, not merely nations. It is a pity that there are elected politicians in this House who are unwilling to understand the strong feelings of many British people about their European identity.

I cannot accept the premise of my hon. Friend’s question. We have gone to and fro in the House about the meaning of the term “impact assessments”. What was made available to colleagues were sectoral analyses. I refer my hon. Friend both to the written ministerial statement setting out how meaningful votes will happen at the end of the process and to my previous remarks about the need to protect the integrity of our negotiating position. We will ensure that, when we reach the end of the negotiating period, parliamentarians are able to access appropriate economic analysis when we all take that important decision.

Last week, I asked the Treasury’s permanent secretary whether he could confirm that just a single one of the Government’s scenarios for a deal post brexit would lead to a better economic deal and outcome than what we have as members of the single market and customs union. He did not seem able to answer. Is not the truth that no such model exists? Has it not been confirmed today that, as a result of the Government’s dogmatic determination to pull us out of the single market and the customs union, it will not be my city, London, that is most affected, or indeed the industries in the City of London that are worst affected, but the key sectors of the economy right across the UK, with the impact felt worst in the west midlands, the north-east and Northern Ireland? How on earth could that possibly be in the national interest?

The hon. Gentleman said that there is no such model; the truth is that my right hon. Friend the Member for New Forest West (Sir Desmond Swayne) referred to a model earlier. Economists for Free Trade are very clear about their modelling. Other models are available—at the time of the referendum, Open Europe did some modelling and found that the effect could be plus or minus 2%. The truth is that there are profound uncertainties facing not just the United Kingdom in this negotiation but all economies in the world. All face three big issues: the growth of technology; a new phase in globalisation; and, of course, the continuing aftermath of the financial crisis which, as the hon. Gentleman well knows, has left interest rates at levels the Governor of the Bank of England has described as extraordinary if not emergency. Those three issues mean that all economies are on highly uncertain paths. The Government will navigate their way through the future with confidence and boldness.

It is a great pleasure to speak in the last half hour of the 64 hours of the Committee stage of the EU (Withdrawal) Bill. I am absolutely delighted to speak in support of amendment 400. I congratulate my hon. Friends on putting it forward. We now have a position akin to article 50, whereby we leave no later than two years from the trigger date. We know when that date will be, but we retain the flexibility should it be required. That shows a great compromise across the House, demonstrating to us and to the public at large that we are capable of finding a way through where we had some discord previously.

I listened intently to the points made by Opposition Members about requiring the Government to honour their commitment on amendment 7. The Government have done so. I therefore ask all those Members that the rest of the Bill that has not been amended be honoured on that basis as well. I very much hope that they have accepted that reciprocal commitment.

I have sat through eight hours in this Committee, and the key thing that strikes me is the lack of optimism and ambition that I have heard. That in no way reflects the country at large, this being the day when it has been announced that, for the very first time, the UK ranks first in the Forbes annual survey of the best countries for doing business. If Forbes had been tuning into this debate, it may well have been wondering if it had got the right country.

The reality is that the world is changing. We must of course look for trade with our European partners. The Prime Minister has set out quite clearly that we want to continue to trade with mainland Europe and to purchase the goods that we have always purchased from it, and we will continue to do so. However, let us take Africa, for example. Germany and Spain have declining populations. Africa has 1.2 billion people at present; by 2050, that will have doubled to 2.4 billion. There are trade opportunities for us to take advantage of. Remaining inside the customs union, as new clause 13 would have it, would not allow us to take advantage of those opportunities.

This also misses the point that we trade as part of the EU under WTO rules with a number of countries, such as the US, China, Hong Kong, Australia, Russia, and Saudi Arabia. To say that we cannot continue to trade with those countries under WTO rules when we already do so as part of the European Union misses the point.

I now come to the real point that I wish to make. During the referendum campaign, unlike many Members in this place I did not take a view. I chaired debates but I did not take any view. Instead, I listened to the arguments going on from both sides. I dare say that right hon. and hon. Members who took a view were not listening to both sides because they were so passionate about their own. I cannot remember any individual who wanted to leave the European Union arguing, “I fancy a bit of what Norway has got. I would like to leave the European Union and remain within the single market.” The customs union has also been mentioned in that context, but of course Norway is not part of the customs union. It is quite clear to most members of the public—it was certainly made clear by those on both sides of the argument—that the EU is effectively a brand. The substance of the EU is the single market and the customs union. If more people voted to leave the European Union than to remain, which was indeed the case, there is a very fair chance that those people knew what they were voting for, and certainly did not want to leave and then return through the back door, as many hon. Members have suggested.

This is the key part for me. I really believe—I put this respectfully—that many in this Chamber are seeking to re-engineer the arguments to get them on their side because they do not want to leave. Even though most of them voted to trigger article 50, so they have chosen to leave, they now want to redesign the terms. They are seeking to have the public on their side by asking, as the hon. Member for Bath (Wera Hobhouse) mentioned, that the public are asked what they think—as if we have a spreadsheet big enough for that. The reality is that the majority of the public have voted to leave. They now look to the Executive to lead the negotiations, and they look to Parliament to support the negotiations and provide scrutiny, as it is doing. Ultimately, they want us to get on with the job and to be optimistic and ambitious about the future of this country, rather than sitting on our hands.
