My Lords, it is a great pleasure to introduce this report to the House before the Recess. The report makes it clear that the UK faces a crisis in child vulnerability. In England alone, over a million children are growing up with reduced life chances, and children paid a very heavy price during the pandemic. The national lockdowns, while necessary, had a severe impact on their education and their mental health. However, things were bad long before the outbreak of Covid-19. The last decade has seen our most disadvantaged children and young people being let down. We have seen cuts to early years and early intervention support, despite the raft of research which shows how important it is to a child’s long-term educational success and life chances, with rising child poverty, criminal exploitation and gang violence, while the gap in attainment at school between the richest and poorest children has continued to grow. Our children deserve better.

Spending on early help for families, such as Sure Start and children’s centres, family support and youth services, was cut by 48% between 2010-11 and 2019-20. Our report found that this had a devastating impact on communities across the country. In 2019, before the pandemic, the Office of the Children’s Commissioner for England estimated that 1.6 million children were living in homes with serious parental mental illness, addiction, domestic violence or other concerns, but found that support for these children was either patchy or non-existent. It also found that 829,000 of these children were completely invisible to services. This got worse over lockdown. This decimation of family support services has not only damaged the life chances of disadvantaged children but makes very little economic sense. If children and families are unable to access the support that they need when they need it, small problems can escalate into full-blown crises such as joining a gang, being expelled from school or ending up in care. As a result, councils have been forced to spend almost £2 billion a year more since 2010 on crisis management services such as youth justice services, safeguarding and looking after children in the social care system. Ironically, the decision by successive Governments to slash family support services has therefore resulted in an unprecedented increase in the role of the state in family life. In 2015, 69,000 children in England were in care, but by March 2020 the figure was 80,080.

Josh MacAlister, who gave evidence to our inquiry, warned in his recent Independent Review of Childrens Social Care that a failure to radically reset services for vulnerable children and families would lead to record numbers of children going into care. Research commissioned by the County Councils Network found that the number of looked-after children in England is likely to reach almost 100,000 before 2025 unless action is taken.

This growing crisis demands bold action. Therefore, I confess to being rather disappointed to receive such an uninspiring government response to our report. In fairness, the response did point to the Department for Education’s family hub programme, and additional funding for the early years and Supporting Families programme. We agree that these are steps in the right direction. Our report found that family hubs are an effective model for providing early help and supporting parents to meet their children’s needs. In the small number of areas where they have already been established, we saw how family hubs played an important role in improving early intervention support, in facilitating integration and data sharing among public services, and enabling voluntary sector partnerships.

Also, while most Sure Start centres offered services for children up to the age of only five, family hubs help parents with children up to the age of 19. That is undoubtedly the right approach. However, the money announced for the early years and family hubs to date nowhere near compensates for the £1.7 billion cut from Sure Start and other support since 2010. There are currently only 150 family hubs in England, and this falls far short of the vision put forward by Andrea Leadsom, the author of the Government’s early years review, that all families should be able to access a local hub in their community from pregnancy.

Our children and our country simply cannot afford for the Government to continue to underinvest in family support. This failed approach has undermined families’ resilience and made them more reliant on late, very costly intervention by the state, which is bad for children and, ultimately, bad for the taxpayer. That is why we need a radical new approach to early intervention. We need it for vulnerable families, not only to boost outcomes for children but to support families to be independent and to reduce costs in the criminal justice and social care system. We also need support for the estimated one in six children with unaddressed mental health needs, to ease pressure on the NHS.

During our inquiry, we were presented with a wealth of evidence from the Early Intervention Foundation and other organisations, as well as academics and researchers, about the impressive real-world impact that existing early intervention programmes already have on the lives of children. The Incredible Years programme has an impressive track record in improving cognitive outcomes for children. The Preparing for Life programme was found to narrow the disadvantage gap in school readiness. The recent evaluation of the Family Nurse Partnership programme demonstrates a significant impact on children’s health and education outcomes.

If the Government are serious about levelling up, this is where they should start. A national rollout of some of these programmes, delivered through a comprehensive family hub network, would unlock the full economic potential of our country. For too long, vulnerable children in our most disadvantaged areas have not been given that fair start, and research carried out by Pro Bono Economics on behalf of the committee found that cuts to early intervention have fallen most heavily on our poorest areas. Spending on early intervention in areas of England with the highest levels of child poverty was cut by £766 million between 2010 and 2019. It does not need to be like that. The London School of Economics estimated that the economic cost in a single year of failing to invest in the early years is over £16 billion. We must get our priorities right.

However, funding alone will not solve the child vulnerability crisis. Every relevant part of local and national government, the public and the voluntary sector must be mobilised if we are to tackle this once-in-a-generation challenge. That is why our report called for a national strategy on vulnerable children, with family hubs at its heart. The Government did not agree. They said that things are best done locally and of course I agree. None the less, we heard from several young people where there had not been the collective co-ordinated action from across public services that tackled the family problems, and it left them very vulnerable.

We fear that, without a national vision to bring together the NHS, police, social care, schools and the voluntary sector, or milestones and targets to hold Ministers and local services to account, little progress will be made to improve things for some of the most vulnerable children. I hope that the incoming Prime Minister, whoever that might be, and their Cabinet will take a different approach and make a strategy on child vulnerability a priority.

Any national strategy must also address data sharing. I think other colleagues from the committee will address this a little more than I have time for, but the Government ignored the evidence in their response on the grounds that data sharing is “already supported”—referring to requirements for safeguarding. The problem is that too many children do not quite reach the threshold for safeguarding, but services need to work with them so that they are not all missing out and falling through the gaps. The Information Commissioner acknowledged that there is a problem with existing data-sharing guidance on children, with too much emphasis placed on the risks to a child of sharing information with third parties, which disincentivises well-meaning front-line workers from sharing data that could improve a child’s outcomes. A clear strategy from the centre to ensure that the NHS, social care, schools, the police and other local services do not view each other as third parties is critical.

It is time that I finished. I thank everyone on the committee, which I have been incredibly lucky to chair. It has some great people. We lost some members, and I am delighted that a couple will contribute to the debate none the less. I must say that at least two of our members are not here and had to remove their names because they have Covid. It is a real problem in this House because we cannot have hybrid sittings anymore. We have not had a meeting of the committee in the last two months where somebody has not been missing with Covid.

I also thank the staff. We had Tristan Stubbs and Mark Hudson working with us, and Claire, our admin assistant. Tristan and Mark moved on as we were finishing this inquiry. We have two new people working with us, Sam Kenny and Tom Burke. They have all been really supportive and helpful in getting us this far. We keep coming back to some of the issues that were raised.

I also pay particular tribute to all the parents, children and young people who bravely shared their experiences with us. Vulnerable families still recovering from the impact of Covid on their education, mental health and personal finances now find themselves in the midst of the worst cost of living crisis in decades. All the pressures children face at home, as described in our report, such as witnessing parental domestic violence, addiction or mental ill-health, are likely to intensify in the coming months. If we do not act, the consequences for these children’s education, future employment prospects and life chances will be catastrophic. We cannot allow difficult times to distract us from this task at hand. If now is not the time to address the crisis facing vulnerable children, then when is it? I beg to move.

My Lords, I thank the Minister for her responses. I was very relieved when I saw that she was to respond because I know, and have discussed with her, the work she did before she came to the House. I had an email today from SafeLives to make sure that I was aware of its points; I know that she will be too.

I thank everyone involved. I forgot to mention in my speech one person who helped us enormously through the report and the evidence taking. That was our specialist adviser, Anne Longfield, a previous Children’s Commissioner, so we had a lot of knowledge and a lot of challenge on how we were doing things, which was extremely useful. The House will recognise that I also had amazing people on the committee, and I was very confident that they would cover areas that I did not have time for in my speech. I thank the noble Baroness, Lady Pitkeathley, for emphasising the voluntary sector and the voice of the child and the family. Throughout our inquiries, we have become convinced, if we were not before, that listening to and involving people with lived experience is critical to both design and delivery of services across the board, and children’s services are very much part of that. I am pleased that the Minister recognised that too.

The other issue is mental health, and I am very grateful to the noble Baroness, Lady Wyld, for spending some time on it. We will never be able to train the number of psychologists and psychiatrists in time to deliver what we all want to be delivered. That means that we must use the voluntary sector, which works at an earlier, less intensive level, so that, for those for whom problems can be contained before they reach the crisis level that the noble Baroness discussed, we can do so with many more people. I know from other work I am doing at the moment that many young people are involved in what can only be called psychotic behaviour and need very specialist attention.

I was also grateful to the right reverend Prelate for his contribution—not as a member of the committee, but if he is interested; we are always interested in the Bishops’ Bench. He was able to talk about somewhere that my noble friend Lady Chapman and I both know very well: Grangetown. I visited that Sure Start centre myself. It was always so great to visit, because there was so much energy, commitment and determination to make things better. I thank him for his contribution.

There are so many issues here but there is unanimity around the House that this is a crisis and an issue that we have not got right—although there are examples of where we can get it right. This is not about saying, “We don’t know what to do”. The reality is that we know what to do. There are examples out there showing us that, with the right sort of support at the right time, things can be different in every community. I am sorry that my noble friend the Whip—the noble Baroness, Lady Blake—has left because she was the leader of Leeds City Council when, despite all the cutbacks, it managed to maintain its investment in Sure Start and children’s centres across the city. While everyone else was seeing the number of children going into care rise, Leeds saw a fall. We know what to do. The challenge for the Government is making sure that they pull together that knowledge and implement it. I thank everyone for a really interesting debate.

I am sure that I am not the only person in this House who has been inspired by the noble Lord’s work over decades, and I thank him deeply for that and for the leadership and hope he brings in this area. I will pass on his remarks to my colleagues in the department.

I would say two things in response to his reflections. First, investment in preventive services is absolutely critical and we will be reviewing that in detail. Secondly, we also need to push ourselves to understand the local authorities prioritising those services, how they are making that work and how we can replicate that across the country. The noble Lord will be familiar with the Hertfordshire family safeguarding model; there are other early intervention models in Leeds and other places around the country. We want to understand those too so that we can act on evidence of what actually works in practice. On the commitment from the Secretary of State and the ministerial team, I cannot underline strongly enough how passionately we aim to address this.

My Lords, I too thank Josh MacAlister, his team and all the people from within the system he worked with. Josh came to the Public Services Committee, which I chair, as part of giving evidence in our review of vulnerable children.

There are so many things I want to put to the Minister today. Maybe she can help me get a debate on the Floor of the House on our report, and then I will not feel as if I am short-changing the vulnerable children I want to argue for. I will concentrate on one issue only: how do we prevent children having to go into the system? However good it normally is, children suffer when they go into the care system. Our committee uncovered that, since 2010, £1.7 billion a year has been cut from early intervention and prevention services. That was largely for two reasons. First, the overall money going in, particularly to local authorities—whether for children’s centres, youth work or other prevention programmes—was under pressure. Secondly, because they were not statutory responsibilities, authorities shifted the money to the statutory responsibility for looked-after children. Therefore, children have become older as they enter the system. I can tell noble Lords that difficult adolescents are much more difficult to deal with than very young children. Will the Government introduce a system which will ensure that money can go to early intervention and prevention services for the long term and will not be allowed to be switched into crisis work?

The noble Baroness is absolutely right to focus on how we prevent children needing to go into the care system or, indeed, needing a social worker at an earlier stage. I highlighted the Secretary of State’s three priorities in response to this report, the second being supporting families to raise their children effectively, happily and in a way that enables them to thrive. One of the strengths of the report is its emphasis on relationships and whether the immediate family—or the wider family—can provide those stable relationships, and how we can create them. As the report uses the term “relentlessly focused”, we must ask: how do we have a relentless focus on those relationships?

We will follow up on all those issues, but in the meantime—we were pleased that Josh MacAlister acknowledged the value of the programme—as we announced in April, we will back the supporting families programme with an additional £695 million over the next three years, which will support 300,000 families to provide the safe and loving homes their children need, as well as other investments in family hubs and other early intervention.

I know that this Minister knows of the importance of voluntary organisations in working with the most disadvantaged, and sometimes the most vulnerable, families. Is she aware, and has she made the review aware, that there are too many examples of the voluntary sector being excluded and not involved in plans for the future of the family and the child once the issue has been referred to safeguarding? This cannot continue. It increases danger for the most vulnerable children.

The noble Baroness will be aware that the majority of looked-after children, 74% as at March 2021, were located 20 miles or less from their home, which is a slight increase on 2020. Only 6% of children are placed more than 20 miles away from their home.

My Lords, is it not clear from the questions to the Minister that we are dealing with a broken system that is letting children down? Will the Government think really deeply about this and seek ways to make sure that care is not the only alternative for children who are vulnerable? If more families get the right support at the right time, fewer children will end up at the risk they are at today—we know this from those places where effective early intervention is taking place across the age ranges, where they have been able to hold stable the number of such children or even reduce them. When will the Government switch their perspective and go for early intervention?

My Lords, it is a great honour for me to be able to introduce this debate on the challenges facing young people. I have deliberately made it a wide-ranging debate. There are therefore topics that I will not cover, partly because I know that many of my colleagues intend so to do. I look forward to hearing from them. I want before I continue to thank all those organisations that have briefed me and, I am sure, other Members. It is a topic that has encouraged a lot of organisations to let us know what they are doing and to challenge us on how we are working with young people.

We have all been young, even if some of us have almost forgotten what it was like. Sometimes, this means that we think that we know what it is like for young people growing up in the UK today. The reality is very different. Some stories are good. Far fewer young people today smoke; they spend more money on mobile phones than on drink; they are not using as many drugs as did a previous generation; many more will get qualifications at school and go on to university, and there are fewer teenage pregnancies than we have ever recorded before. I am quite pleased about the latter because I was in charge of that policy when I was a Minister.

However, there are significant challenges for young people today. Social media has opened up incredible opportunities for young people: they can self-publish poems and books; they can stream their own music; they can communicate with friends and family around the world, but they can also be bullied and be subject to grooming, exploitation and to a different form of loneliness laced with insecurity and lack of self-worth.

The Prince’s Trust has produced the Macquarie Youth Index for the past nine years. This year’s reveals that young people’s happiness and confidence are at their lowest since they started to be measured. The number of young people who do not feel in control of their lives has increased by one-third year on year.

We know from a range of evidence that mental health challenges have really increased in recent years. The Royal College of Paediatrics and Child Health reports that in 2017 one in eight five to 19 year-olds had a diagnosed mental health disorder; that one in 20 had more than one; and that half of adults’ mental health problems start before the age of 14 and 75% before the age of 24. These are diagnosed problems. All the organisations contacting us tell stories of the additional problems that young people face—from academic pressure, where exams have become the norm in a way that was never imagined when I was young, but also from social media.

But there are positives. Young people are just as likely as adults to volunteer. Noble Lords who know me well will not wonder that I talk about this. I have had the privilege of being involved with Voluntary Service Overseas in different ways over the last 50 years, twice as a volunteer. My first volunteering experience was in Kenya for two years. VSO has been the lead charity running International Citizen Service, a programme for 18 to 25 year-olds initiated by the coalition Government in 2011. A diverse range of young people go to a developing country in small groups and work for three months with a group of young people from the host country, who are also volunteering, on a project. They are all expected to contribute some volunteering in their own community when they return. I have met lots of ICS volunteers, here and when I have visited the developing world, and it is the most inspirational activity. Many of them will be the leaders of tomorrow, here and abroad. All of them are clear about their learning, what matters and what contribution young people can make. I just hope the Government can sort out the reprocurement quickly and make sure the programme can continue. The uncertainty has been going on for quite a long time.

We have to face the reality that young people today are part of a generation that is deeply divided in its opportunities. We know about intergenerational inequality, with benefits for my generation not having been reduced by the Government when for young people they have been. Layer rising inequality between young people and families on top of that and there is an even bigger problem. It matters more than ever what sort of family you are born into; not just how much money they have—of course, that does matter—but where you live, what value the family puts on education, and the stability within the family in this very unstable world. For young people coming from families where they experience trauma from domestic abuse and so on, the challenges are even greater. We know all too well that the number of children and young people ending up in care has risen to very difficult and challenging levels. We also know the problems that too many young people and children face and experience in the care system. Too many of them end up in the criminal justice system or in exploitive relationships when they try to move on.

The rise in knife crime has also shown us how vulnerable some young people are, particularly in poorer neighbourhoods, to exploitation by gang leaders and drug traffickers, with the perpetrators often also being victims.

The rise in homelessness is having severe consequences for some young people, who are moved with their families miles from where they were living, meaning that they have to move schools, work out a new set of friends and get to know a new area, which all add to their vulnerability. Too many are sofa-surfing, which puts them at risk, and hidden from services. Too many young women end up being asked for sexual favours to get a room for the night. The New Policy Institute found that, in 2015, 30% of 14 to 24 year-olds were living in poverty. A survey this year found that 40% of local authorities had experienced a rise in youth homelessness. The lack of affordable housing is a real problem for young people. There has been a substantial rise in the number living in the private rented sector, with home ownership among 16 to 24 year-olds falling substantially.

Young people from disadvantaged backgrounds are losing out in education and are less likely to have power in their communities or in politics. If you have a degree, you are three times more likely to engage in civic life, although many reject traditional institutions—they may be deeply political in what they think about, but they are certainly not joining political parties. Only 50% of young people believe parliamentary institutions are essential for democracy. I suspect that number is greater at the end of this week. Maybe that is another reason why young people generally support a second vote on Brexit. Young people want to remain in the European Union—another area where my generation is totally out of touch with young people’s ambitions—by seven to one.

There are lots of other challenges, but all this is happening in a context of diminishing opportunities to find support. Young people are being left on their own, with no one to share ideas with and to help them work out how to shape their future. Since 2010, youth services spending has declined by 64%. Having been a youth and community worker when I was a lot younger, and having trained many youth and community workers, I know the opportunities that good youth work can open up for young people, and the safe spaces it provides for them to work things out and challenge themselves. How short-sighted we are to lose these opportunities.

Young people have ambition: they want a better world, decent homes and decent jobs. But we are building so many barriers for them. We need to listen to them, and to recognise that there need to be new ways of communicating and of enabling them to make a contribution. They need to be safe too. The Government cannot provide the whole answer but they set the context. They can close down opportunities or help to open them up. My problem is that there seems little chance at the moment of the Government recognising this, let alone engaging effectively to do it. Young people have something important and powerful to say about the future—theirs and ours—and we should listen to them.

My Lords, I thank everyone enormously. It was a very rich and wide-ranging debate from which I think we have all learned a little. Challenges can be things that we learn from and learn to move forward from. For too many children and young people they are limiting, and stop them being able to live full and contributing lives in the way they want to. I look forward to working with noble Lords across the Floor on just that.

My Lords, we should all acknowledge the great work that my noble friend Lord Farmer is doing on families and on raising awareness across government. We have announced the Unlocking Talent, Fulfilling Potential fund, which will help local authorities develop strategies to improve outcomes in early years, including through the effective use of children’s centres. Family hubs are part of that. We will be looking to ensure that these innovations are recognised and shared, and we want to spread these successful approaches. We know that a number of local authorities are already moving towards this model of support for children and families, but it is up to them to decide how to organise and commission services.

My Lords, I wonder whether the Minister understands that there is a real crisis in early intervention. Early intervention is the only way that we will deal with those very severe problems that the noble Lord, Lord Laming, talked about and the whole way in which young people are getting into gangs and not being enabled to live the life that we think they ought to live. Early intervention was beginning to work by using evidence-based programmes, such as Sure Start, and evidence-based parenting programmes. This Government have abandoned much of it, I think for ideological reasons as it was started under the previous Labour Government. It is shameful.

I can only respectfully disagree with the noble Baroness. We have made a huge commitment to this phase of children’s education. Since 2013, nearly 750,000 of the country’s most disadvantaged two year-olds have benefited from our 15 hours’ free education, backed by more than £2 billion of public investment.

My Lords, I know the Minister will think that I go on about the issue I am about to raise, and in a sense I am not apologising. I remind the House of my interests as chair of Changing Lives, a charity based in the north-east of England.

Children who are removed and placed in care are overwhelmingly from economically and socially deprived backgrounds. There has been a lot of evidence on this, recently and over many years. The experiences of those who try to parent in a profoundly unequal society are simply not considered sufficiently. That sounds a bit academic—let me explain what I mean. Mental health difficulties, substance misuse and domestic abuse are seen and accepted as central risk indicators for child abuse. However, these are intrinsically linked with living in poverty and disadvantage in a very unequal society. Psychosocial reactions to deprivation and shame, which are the experience I am talking about, are important in understanding self-harm and harm to others.

Currently, our policy has moved—on some occasions I have been part of that movement, and have resisted it on others—to being absolutely focused on the individual child, with very little space to consider the family context. As I have consistently argued in this House, the role of wider family members—of grandparents, siblings and friendship networks in supporting children—is too often neither recognised nor supported effectively.

Perhaps it would help if I reminded the House of an actual case which came from a Family Rights Group assessment—a study that was done on some of its advocacy work. The study says: “Julia cried as she explained that social workers had told her she was unable to have healthy adult relationships as a result of a brief period in care as a young child. Her child had been removed from her because it transpired that her partner had a history of abuse that she had been unaware of. She immediately separated from him and paid privately for counselling as it was not available from the social worker, who was concerned with the child’s welfare only. Despite her actions, the child was placed in care while a risk assessment was carried out. No one seemed to have considered the ironies here. Would such a separation, for example, result in this child being seen, too, as unable to have healthy adult relationships?”. In other words, the whole system was reinforcing the problems, rather than tackling them.

The importance of attachment is recognised in study after study of child-rearing. Not to understand and consider that in our child protection policies is, at best, unwise. This amendment seeks to ensure that appropriate counselling and therapeutic support is offered to any parent whose child is permanently removed. The context of the amendment is that child protection inquiries are continuing to increase; the number of new care proceedings is at record levels. As of 31 March 2016, there were over 70,000 looked-after children in England, which is the highest figure since 1985. If this does not tell us that we have to think again about what we are doing, I do not know what will.

The new clause would enable any parent whose child has been permanently removed to get the therapeutic support and counselling to help them deal with their grief, emotional hurt and other difficulties, so they can avoid the appalling cycle of repeat pregnancies that lead to repeat removals of children. Analysis of court data found that one in four mothers subject to care proceedings was subject to repeat care proceedings. That figure rose to one in three for those who became mothers in their teenage years. Provisional results from further analysis show that more than six out of 10 mothers who had children sequentially removed were teenagers when they had their first child. Of these, 40% were in care, or had been looked after in the care system, during their own childhood.

The figures go on. Some 354 mothers were looked at in this study of recurrent care proceedings. It found that approximately 65% had had their mental health issues mentioned in their first set of proceedings; 75% had domestic abuse mentioned in their first set of proceedings; and 90% had experienced some form of neglect or abuse—emotional, physical or sexual—in their childhood.

The President of the Family Division has recognised the importance of the work that programmes such as Pause are doing in trying to make sure that there is not this cycle of repeat pregnancies and repeat admissions to care. But the programmes that are available, including the one we run in Newcastle, are not nationwide or underpinned by any statutory duty. Most vulnerable parents who have lost a child are therefore left unsupported emotionally and not assisted to parent in future. The new duties set out in the amendment would ensure that all parents who have lost a child receive the therapeutic care and counselling that would help them to avoid that cycle.

I move this amendment in the hope that, in thinking about the future of social work and children in care—and I know that the Government are doing that—they look carefully at the evidence on the importance of working effectively with women in vulnerable situations, so that they are better able to handle the trauma in their lives that inevitably adversely affects their relationships and those they can develop, particularly with their children.

The charity that I chair works with many women who are in this position. Among other work, we have a project in Newcastle that works with women recovering from addictions, and with their children, in a residential setting. Many of them have already lost children into care, and we work with them intensively for about six months. The programme has been successful in breaking that cycle, which has meant that the local authorities involved will happily talk to the Government and others about saving money through children not having come into care who otherwise would have. This is a really challenging time for the Government regarding the future of social work and children in care, and this is one way we can help to break a cycle that is not only depressing but destructive to the children and mothers involved. My Lords, I support the noble Baroness’s amendment and what she has said. After witnessing this weekend, at a gathering of child and adolescent psychotherapists, the superb work that a therapist can do in supporting mothers and their infants to make good, strong relationships, I know that what she asks for is absolutely crucial. It was wonderful to see, for instance, the case of a mother who had grown up with a violent father, been taken into care and then gone on from care to become a teenage mother and have several of her children removed. Then she found the help of a child psychotherapist who helped her to understand her relationship with her child and to build a strong attachment with that child, so that eventually she was able to get back her other children. So I agree absolutely with what the noble Baroness is calling for. It is particularly important in the light of the recent view expressed by the President of the Family Division, highlighting the year-on-year increase in the number of children being taken into care, expressing the concern that that may well accelerate. It is much more difficult to give a high quality of care in the care system if the numbers of children arriving increase year on year.

I was grateful to the Minister for offering to meet me yesterday to discuss whether more can be done by central government to minimise the flow of children coming into care. I look forward to that meeting. I am particularly concerned about the new lower benefit cap and how it might impact on families. The noble Baroness, Lady Armstrong, highlighted the background of poverty for most families whose children are taken into care. I am concerned that this may increase that poverty and force more of these families into homelessness. It raises the risk of more children being taken into care—but we will debate that this evening in the dinner break.

My Lords, I thank everyone who has taken part in this short debate. I think it is clear to the Minister that concerns about this matter are felt around the House. I am pleased that he is committed to thinking more about those concerns and to action. I mentioned Pause. That is not the programme we use, partly because women are not entitled to become part of the programme until they have already had two children taken into care. We wanted to be able to intervene if necessary and if possible before then. I would be interested in talking further to the Minister about this, working with him and inviting him to look at some of the work going on that would support what is proposed in the amendment. We tabled the amendment on the basis of wanting the House to think about the matter and to push the Government further. On the basis that I believe that the Government are taking this issue on board—although I am not yet satisfied—I shall withdraw the amendment at this stage in the hope that the Government will demonstrate to me that they are prepared to continue to work on it.

The noble Lord raises an extremely good point; I know he is very experienced in this area. Local authorities must notify each other when placing children out of area, and a placing local authority has a duty to visit looked-after children to supervise arrangements and to promote their welfare. Every child should be visited within the first week, and thereafter children must be visited at intervals of no more than six weeks for the first year, and in subsequent years visits must also take place at intervals of not more than six weeks unless it is a permanent placement, in which case it is every three months. The IRO must monitor the performance of the local authority, as does Ofsted. However, I will take back his concerns to make sure that local authorities are completely aware of their duties in this regard.

My Lords, will the Minister acknowledge that, for every child who goes into care, their trauma is added to because they want to know and understand what has gone wrong, and they want help to find the way forward? The more work is done with the family they have come from, the better the outcome will be. Some of the best outcomes come when children are placed in kinship care. Will the Government work hard to open up opportunities for social workers to learn more about who might be considered a kinship carer and make sure that that is the first option for children who come within the local authority sphere?

The noble Baroness makes a very good point. It is of course appropriate that children are placed with families and friends where possible. We have done a great deal of work in this area: the adoption support fund can help in this area and help the special guardians. The Family Rights Group and Grandparents Plus have also been funded in this area and we will continue to push in this regard.

My Lords, those of you who have heard me speak on previous Bills will know that this is something that I keep coming back to. It comes out of working with kinship carers and learning of some of their experiences, but is particularly about the needs of care leavers as young parents. One tragedy is that far too many young women who have been in the care system become young parents themselves. I and other colleagues here tried to do something about that when we were in government. We introduced various programmes that did an enormous amount both to reduce the number of teenage pregnancies and to care for and support young people significantly when that happened.

We know the reality from the social justice commission: that about one in 10 girls leaving care aged between 16 and 21 are either single parents when they leave or very quickly afterwards become single parents. I ended up specialising in adolescent girls when I was working in Newcastle all those moons ago—most of them will now be grandmothers, or great-grandmothers. I remember one young woman in particular, who had been in care all the time since she was a baby. By the time she had a baby herself, I had finished, but she rang me absolutely delighted to tell me that she was now pregnant. She was 16, and everybody knew that she would have enormous difficulty in caring for that child. But she needed something to love—it was as awful and plain as that. Now I work with women with complex needs, many of whom have come through the care system and certainly come through abuse, and so on. Many of them have child after child, who are taken into care. Nobody works with them because they have removed the child, so they go and get pregnant again and that child ends up in care. We simply should not see this.

It goes back to what I talked about the other day in Committee: that we need to do much more work with parents when the child is taken into care. These amendments are essentially about recognising that those leaving care—many of them are still children—and who are pregnant or have a young child demand a specific responsibility on our part, even if they have left care. I remind the Minister that the staying-on provisions do not relate to children who have technically just gone home to their parents or who are in residential care, but they are still children leaving care. As I say, they do not get the additional time or support that we were all so pleased about in the staying-on relationships, which essentially relate to children in foster care.

All these amendments really say is that this is a specific category to which the Government will have to pay attention. It can become a vicious circle if we are not careful. We know that they will need additional support in parenting, although that is not to say that some of them will not in the long term make good parents. As the Minister who introduced the family nurse partnership, I know that even the most vulnerable teenage parents can, with the right sort of support, become good parents. The amendments address the fact that, if you are a child who has spent significant periods in care, you will need extra support. That is sort of self-evident but it is not taken into account in the Bill, and I ask the Minister to take specific account of it.

I have not tabled an amendment on this aspect, but these clauses also deal with adoption support being extended to special guardians who are raising looked-after children. I am really pleased about that but why have the Government not extended that support to special guardians per se? Kinship carers in particular often step in to make sure that the kids do not go into care or become looked-after children. As I have said—too many times, I feel—kinship carers frequently do that not because they have sought to become a carer but because they do not want their daughter’s or sister’s children to go into the system. They end up having quite good outcomes even though they are impoverished, frequently.

I meet kinship carers in the north-east—because we have a higher proportion of kinship carers than in most regions of the country—who have gone through things that you and I would absolutely not want to do to look after the children. They get no support at all. They are not going to get the mental health support for the children or the other support that the children frequently need because they are special guardians, but their child has not technically been in care or looked after. It tells you how old I am when I keep saying “in care” instead of “looked after”, does it not, but because that is not the case, they are not going to get that additional support. I have not put an amendment down about it at this stage but I will come back to it. I want to make sure that the Government think about these sorts of things a little more. In the Bill, we are in the business—I hope—of trying to make sure that we create less vulnerability and less cost to the public purse. I believe that in the long term, addressing these amendments and my question will assist that objective.

My Lords, I support my noble friend Lady Armstrong, particularly on Amendment 61A, but also in what she said about kinship care. I know that the outcomes of children in kinship care are better, in health and academically, than other forms of care. I also know that there are vicious circles which, unless there is intervention, go on being vicious circles generation after generation. The Family Rights Group report on the young parents project has out significant things about young people who are young parents and care leavers. We know that these young parents have multiple challenges—there is also a figure that one in 10 care leavers aged 16 to 21 have a child taken into care—but they are alienated by negative experience of state services. They are judged by their youth and background and have suffered abuse often,

“being in care, mental health problems, exclusion from school and/or involvement in youth justice”,

and so on. The support given often ignores their roles as parents or helps them to safely raise and keep a child. They often have less developed support networks, as compared to older parents, and fewer established systems in place as they move into adulthood. Despite their vulnerability, the particular needs and circumstances of young parents who are care leavers—whose children are not subject to child protection inquiries—are not sufficiently identified. They need a clear pathway plan, which includes all that a pathway plan should include, and certain sorts of information should be drawn upon in formulating these pathway plans.

My Amendments 98AA and 98AB are long and fairly self-evident. They repeat many concerns already expressed about the importance of pathway plans or assessments of need. One other thing that is important in pathway plans is the co-ordination of plans, and of assessments in relation to them, along with the setting up of advice, assistance and support. Again, I would state that these young people are extremely vulnerable, as my noble friend said, and need all the support that we can give. She also said that giving support early can avoid pain to them and also cost to the state, if we avoid these vicious circles that we all know exist.

My Lords, I will introduce a totally different note into the debate. I want assurances from the Government that corporate parenting will not be used as an excuse for not working with the natural parents while the child is in care. One of the major failures in this country is that while the child is in care, we do not do any work with the natural parents. We send children back from care to their natural parents more than they do in most other European countries. I went to look at this in Denmark and Germany when I was Minister for Social Exclusion. I was looking at why we in this country did so badly with children in care. They cost us more and the outcomes are poorer, which means that we should learn from what goes on elsewhere.

What the social workers in Berlin said to me was, “We don’t pretend that we can be substitute parents. We know that we have to be the bridge between what has gone wrong and where they might go”. That means that they were prepared to take them in earlier, but when I went to breakfast in one children’s home, three mothers were there. I have to say that they were clearly fairly dysfunctional, but as soon as the children went out to school, the key workers did some work with those mothers. They said that the children might never go back home, but anyone in this Room who has worked with children in care—which was my first job in Newcastle—knows that it did not matter how long they had been away from home or how bad things were there: the children wanted to know about their families. I am concerned that we sometimes say, “Right, they are in our care now and we can look after them. We’re not going to spend any time with that dysfunctional natural family”. I believe having that in our system is one of the reasons why we fail.

My Lords, I will speak briefly. I welcome the corporate parenting principles in the Bill, but I hope that we do not end up making them so complex that local authorities find them difficult to implement by adding things that should perhaps belong in other places such as the national offer or in other parts of the Bill. We should keep the principles simple. However, I agree absolutely with the noble Lord, Lord Warner, and in particular with his Amendment 29. The noble Baroness, Lady Howe, referred to it in terms of the other people who should be incorporated into taking responsibility for these young people. We will come to that, but I would rather we dealt with it in another part of the Bill rather than here.

I also agree with the noble Lord, Lord Warner—as one of the other people in this Room who has been a corporate parent—that the phrase “have regard to” would become a major discussion around the table of a local authority in difficulty that had to make savings. It will not be true in places such as Leeds or Kensington and Chelsea, which really have a grip on this.

I will also say that, as the Minister knows perfectly well, the Ofsted report published yesterday showed that many of our care systems are doing much better. Eight out of 10 children’s homes are now rated as being good or doing well. They can improve, so we are not at the bottom. Certainly a lot of local authorities need to improve, but we are on the way up. I hope that anything we do here and anything the Government do in future will encourage the direction of travel that we appear to be on at the moment. But it will certainly not be helped by the phrase, “have regard to”. “Must” is a much better word.
