My Lords, our expectation is that the trade and co-operation agreement will be ratified by the end of April. We have agreed to that in the partnership council by written process. We look to the European Union to uphold that obligation. The unilateral measures were lawful as part of a progressive and proportionate implementation of the protocol.

My Lords, the Irish Foreign Minister, Simon Coveney, said that a road map to the full implementation of the Northern Ireland protocol was needed. Since the noble Lord has taken office, has he had the chance to meet Mr Coveney? If not, does he have plans to do so at an early date? There are many of us who think that, on the basis of the noble Lord’s distinguished diplomatic record, he might do a better job spending more time on diplomacy and less time issuing ideological declarations.

I have of course had a conversation with the Irish Foreign Minister, as I have with many Ministers around Europe. Our intention is to pursue the issues arising from the protocol through dialogue, both with the Commission and with our European friends.

My Lords, the Trade and Cooperation Agreement provides for 100% tariff-free and quota-free access to each other’s market for the UK and the EU. It is first trade agreement in the world to do so. A unique combination of facts has made it inevitable that we would see a reduction in trade with the EU in January, and we should use caution in drawing any conclusions from the initial figures released on 12 March.

My Lords, I thank the Minister for that Answer. We are, of course, where we are, but I am sure he would agree we have a particular problem at the moment with the export of animals, meat and shellfish, where exports are down by between 56% and 83%. Will the Minister agree to meet me and other noble Lords from across the House who are acutely concerned about this issue and wish to see it sorted, including the possibility of the Government negotiating a sanitary and phytosanitary agreement similar to that which Switzerland currently enjoys with the European Union?

I thank my noble friend for his words of support for the decisions taken by the Government last week. Our overriding aim is to protect the Belfast/Good Friday agreement in all its dimensions—all the strands, north-south and east-west. The protocol was designed to achieve this. All sides need to be sensitive to the social and political realities, and the fact that the operation of the protocol rests on the confidence of both communities in Northern Ireland. I reassure my noble friend that we will consider any legal process launched by the EU very carefully; we will defend our position vigorously. The protocol is explicit in respecting the territorial integrity of the UK and we will ensure that is sustained.

My Lords, I join in very warmly welcoming the noble Lord to the House. Does he accept that behind this trade crisis in Northern Ireland is his own hostility to the European Union? He has taken Britain out of the customs union and single market and therefore necessitated these trade controls. Is he aware that Margaret Thatcher, who largely created the single market, said:

“How we meet the challenge of the Single Market will be a major factor, possibly the major factor, in our competitive position in European and world markets into the twenty-first century. Getting it right needs a partnership between government and business”?


Does the noble Lord agree with Lady Thatcher?

I thank the noble Lord for his question. We developed a model of Brexit and implemented it on the back of the election victory in December 2019, which is about leaving the customs union and single market. We believe that the United Kingdom will benefit from control of its own laws, trade policy and money. That situation will give us benefits. We would like a constructive relationship with the European Union and I will be working to ensure that happens.

My Lords, it is good that we have the noble Lord, Lord Frost, with us to be accountable for Brexit, because he has a lot to be accountable for. His UK-EU Trade and Cooperation Agreement is the most damaging treaty negotiated by a British Government for more than 50 years. It reduces our trade and undermines our co-operation, and nowhere is the damage of Brexit greater than to our space industry. Some £1.2 billion has been needlessly squandered in our expulsion from the Galileo project, and £500 million has been speculatively invested in OneWeb. Dr Bleddyn Bowen, a space policy expert at Leicester University, says that the OneWeb investment is a “tech and business gamble”, and OneWeb satellites have been described as unsuitable for navigational purposes by our own space agency. Space is turning into another Brexit catastrophe, and no one is being held accountable.

I am sure it is much better to say exactly what we think about public affairs and this is certainly not a time when it is worth anyone’s while to court political popularity. I will therefore begin by saying what everybody would like to ignore or forget, but which must be stated, that

Those were Winston Churchill’s words in the House of Commons on the Munich agreement 82 years ago. Alas, they apply word for word to the Brexit agreement we are being asked to rubber-stamp today.

My Lords, when you have been sitting for seven hours in the same place, you begin to learn how old you are. I thank the noble Lord opposite for his kind remarks at the start and I appreciate his engagement. I also appreciated the preamble to his speech about looking to the future. Unfortunately, most of the rest of his speech seemed a lament that we still do not have more Europe than the public have voted for. As for the Liberal Democrats, I must say that, at a time of national gloom, their unremitting pessimism throughout the debate represents a clear and present danger to the national weal.

In opening, I declare my interest, as ever, as a long-term resident of Italy. As a European, I affirm the abiding genius of the diverse nations and cultures of Europe, inside the EU and out: Proust and Dostoevsky, Goethe and Ibsen, Dante and Shakespeare—all part of a glorious common European culture that we must cherish and never allow, in this age of political correctness, to be washed out of our minds. There was good news this morning, and we celebrate the achievements and genius of scientists born in Hungary, Britain and Germany —again, part of our great European scientific tradition.

I agree with those who say that we will always be European, but the genius of Europe and the United Kingdom did not spring from any international institution. However sad some are at leaving that institution—we heard a lot about it today—will that genius be dimmed after we leave the EU? I believe a great future lies before this country, as some noble Lords who spoke today told us with confidence and pride.

I thank all noble Lords who have taken part in the debate today—125 of them. I counted them all in and counted them all out with, I regret, the exception of the noble Lord, Lord Alderdice, to whom I apologise. It is quite difficult to bolt down a plate of fish and chips in 10 minutes, but I am sorry I missed his speech. There were exceptions. The noble Lord, Lord Hannay of Chiswick, was scarcely rapturous in his reaction, but I welcomed the overall tone set at the start by the noble and learned Lord, Lord Judge. The noble Lord, Lord Butler of Brockwell, the noble Earl, Lord Kinnoull, and many other noble Lords said, as did the noble and learned Lord, Lord Falconer, at the end, that it was time to move on. Many of those who had set themselves against Brexit recognised that but, none the less, there was clear opposition and anger from the Liberal Democrat Benches and a deep undertone of hostility from Labour.

As we close the book on our membership of the EU, 57 years after de Gaulle’s first veto—which I remember watching on black and white television—we can truly say that this was a historic debate. I know that more wish to have taken part, to have spoken for longer or to have had more time to scrutinise the agreement. I recognise that abiding theme of the debate. On a night like this, the House should have been full and the air ringing with challenge and counterchallenge, with conflict across the House, which forges common parliamentary wisdom. We all long for that day to return.

That the Lords of Magna Carta look down on a House so empty is not the Government’s choice, nor is the timing of this debate and Bill on the day before the end of the transition. It was not the United Kingdom’s choice that the negotiations ran so long and late, but who is to say that my right honourable friend the Prime Minister was wrong to go so long and aim so high, when the prize is so great: a historic Canada-style deal with the EU, worth over £650 billion to the United Kingdom, containing zero tariffs and quotas—the first such trade deal that the EU has ever entered into with an independent country?

I pay tribute to my noble friend Lord Frost and his team for their brilliance in the negotiation. As almost all said—with the notable exception of the noble Lord, Lord Kerr of Kinlochard—they were outstanding in ways that many said were impossible. They broke through barriers in the talks with a sonic boom that scattered the naysayers and doubters. There are some, including the Front Bench opposite, who say that it was not necessary to act today. We could have dithered and dallied; we could have acted provisionally. “Never now” and “not yet”, they say, but who is to say that my right honourable friend the Prime Minister was wrong to act so decisively, when the prize that he has won is ending the transition period with a deal implementing our future relationship, providing that much-needed certainty to citizens and businesses across the United Kingdom, for which your Lordships have rightly asked for so long? The deal agreed with the EU means that we have achieved what the British people twice demanded.

This deal is based on friendly co-operation between sovereign equals, centred on free trade and shared values: a new partnership that builds on our common bonds of friendship and co-operation—but, as I say, as sovereign equals, with a clear, independent voice for Britain to speak and act in the world on the things that matter to us. I say to my noble friend Lady McIntosh that we are not entering a deal to terminate it; termination clauses are standard in trade agreements. The Bill ensures that our goods and services can continue to flow to the European Union, but also that our businesses can prosper mightily outside the EU by enabling them to trade freely, widely and ever more widely across the world and in the fastest-growing corners of the world.

Many questions have quite properly been raised in the debate. As your Lordships’ Constitution Committee has said, the pace of passage will no doubt call for considerable ongoing scrutiny—as, frankly, what EU treaty ever signed might not have? The Government will co-operate with that and we are carefully considering what scrutiny processes should be put in place to assist it. I give an assurance to the noble Earl, Lord Kinnoull, that the Government will work with his committee. I share the tribute paid by the Leader of the House to the work of the noble Earl and the European committees of this House.

The noble and learned Lord, Lord Falconer, said that it was not necessary to act. But the UK and the EU need to exchange notification of completion of procedures for provisional application early on 31 December. This exchange cannot be done until the Bill has received Royal Assent, as the passing of legislation is a necessary procedure for provisional application.

I was asked about security. The EU was never ready to allow us access to SIS II. That was not a matter of ECJ jurisdiction. However, as the noble Lord, Lord Hogan-Howe, reminded us, we have reached a far-reaching agreement to protect the British public in areas including evidence, extradition and the sharing of passenger and criminal records data. Control of our borders will enhance our security, allowing the UK to remain safe and secure. The Bill gives us the tools to achieve this.

I was asked about Northern Ireland. I acknowledge that the terms of the Northern Ireland protocol mean that the position of Northern Ireland is not as the rest of our kingdom. But we will guarantee unfettered access for Northern Ireland goods. This deal means that there will be no tariffs on UK goods destined for Northern Ireland. Ulster and its businesses will be able to benefit from the free trade deals that we strike across the world, and the long-term future of the protocol rests on the democratic consent of the people of Northern Ireland.

I was asked about impact assessments. The Government’s number one priority must be to pass this implementing legislation before the end of the transition period, to ensure certainty and clarity for businesses and citizens alike. Of course the Government recognise the value of conducting impact assessments in normal circumstances but, in light of the tight turnaround time to introduce and pass the Bill following the agreement on Christmas Eve, we did not consider it feasible to produce an impact assessment this week in advance of the Bill being introduced. The Government will of course continue to produce impact assessments for relevant future secondary legislation in the usual way.

I was asked about financial services. This agreement provides a stable foundation for us to develop our future relationship with the EU and facilitate new arrangements to promote international financial services trade. In addition to the trade negotiations, both sides are carrying out equivalence assessments. Equivalence is an autonomous mechanism by which one jurisdiction can recognise relevant standards in another.

Leaving the EU means that the Government now have full control over the UK’s legal and regulatory regime and, as my noble friend Lord Trenchard noted, it can make the best decisions about what is right for the United Kingdom and for one of its most productive and innovative sectors. We have agreed a joint declaration on regulatory co-operation that sets out our intention to address shared challenges by discussion, information exchange and wider co-operation.

I was asked about Gibraltar and the overseas territories. Although an agreement has not yet been reached on Gibraltar’s future relationship with the EU in line with the conclusion of the UK-EU deal, we are fully committed to continuing to work together with the Governments of Gibraltar and Spain to reach a political agreement as soon as practicable. Continuing to work together with Spain and the EU to mitigate the effects of the end of the transition period on Gibraltar and ensure the well-being and prosperity of people in the region is an absolute priority for the Government. This includes ensuring border fluidity, which is in all parties’ best interests. The UK has always been, and will remain, steadfast in our support for Gibraltar.

I was asked about data adequacy. The UK will regain full autonomy over its data protection rules from 1 January. Regrettably, the EU left too little time to ratify data adequacy decisions by the end of the year. We have therefore agreed a bridging mechanism for no more than six months. It will allow personal data to flow as it does now while EU adequacy decisions are adopted. We are confident of the outcome and do not expect the bridging mechanism to be in place for more than four months.

I was asked about Erasmus. I recognise the attachment of many to this programme, and I can confirm that we will stay in EU programmes such as Horizon Europe and Copernicus. But we consistently said that we would join Erasmus only if it was in line with UK interests and if we could agree fair terms for participation. Ultimately, the EU could not meet those objectives, and we do not consider participation to be in the interests of the United Kingdom. As has been announced, we will therefore proceed with our own UK-wide programme. This will be a scheme that is global in outlook—not limited to the EU—and focuses on UK priorities, such as supporting social mobility. The Turing scheme will be backed by over £100 million, providing funding for around 35,000 students in universities, colleges and schools to go on placements and exchanges overseas, starting in September 2021. Under the withdrawal agreement, the UK will continue to participate fully in the current Erasmus+ and European Solidarity Corps programmes.

I was asked about fishing. As a descendant of fisher folk, I share the attachment of so many to this harsh and often heroic calling. The deal that we have, backed by £100 million of investment to rebuild our industry, might not be as swift as some would wish, although it is much swifter than the EU wanted, but it points the way to growth after years of foreign control and ends the injustice of the CFP. From day one, the UK will again be an independent coastal state and manager of our own waters.

I was asked about the so-called level playing field. There is no dynamic alignment, no role for the ECJ and no block on our divergence from the acquis, although we freely aim for the highest standards on the environment and in the workplace. I, for one, look forward to an end to the cruel export of live animals, which has been protected by Brussels for far too long.

I was asked about the devolved institutions. The UK Government respect the devolution settlements and we are committed to working with the devolved Administrations on implementation of the agreements. I must report that we were disappointed to hear today that the Scottish Parliament voted against granting legislative consent and that the Northern Ireland Assembly carried a Motion amendment that called, among other things, for the Assembly to decline legislative consent. The Welsh Parliament today voted to note the introduction of the Bill, regretting that it is not in a position to determine legislative consent. We regret the results of those votes. However, the timing is challenging and the Bill must proceed so that the UK can meet its international obligations to implement the agreements by 31 December and ensure that all parts of the UK can benefit from their excellent terms.

I was asked about musicians. The UK pushed for a more ambitious agreement with the European Union on the temporary movement of business travellers that would have covered musicians and others, but our proposals were rejected by the European Union. However, I have obviously heard the remarks made by many noble Lords in the debate.

We will have a further full debate next Friday, when I understand that the House of Commons will be somewhere else, to engage again with these and other detailed questions. I have no doubts that there will be many other occasions. I will welcome that scrutiny, as I know my ministerial colleagues will. But I plead with your Lordships in your wisdom not to impede the Bill, which will answer the expectations of the majority of our countrymen and countrywomen, as is our duty.

I was surprised to read in the name of the Official Opposition not the simple word “yes” that the British people voted for in last December’s election, but 151 words of mudge and fudge, grumble and mumble. The noble Baroness opposite, as always, spoke with great grace and from a personal position that I deeply respect and understand, but I am afraid that her Motion is not one of a party that sees opportunity for our country. How ironic it is that a European debate that began in 1975 with a referendum aimed to paper over the cracks in a disunited Labour Party should end with this rambling Motion from a disunited Labour Party that is fearful of the future, lacking, as the noble Lord, Lord Howarth of Newport, said, any confidence in the genius of the British people. You cannot lead a nation forward if you have no faith in the path it has chosen.

We are told that this is a “thin” deal at 1,250 pages —too heavy for me to lift up. The Labour Motion condemns bureaucracy and regulation. How many more pages of the bureaucracy and regulation that this Bill enables us to escape form would we need before a deal would be thick enough for the Labour Party? A thicker deal must logically be a closer deal; a thicker deal means more institutional ties, not fewer. Are we to hear a promise next election from Sir Keir Starmer, as some have called for today, to renegotiate us back closer to Brussels? “Get Brexit undone”: is this to be the Labour cry?

The noble Lord, Lord Adonis, is ready to lead the charge. He has always been honest on that. I do not normally give advice to my opponents, but I do not think that that particular trumpet call will bring the blue wall tumbling down in some new miracle of Jericho.

I think that the Labour Party finds itself in a strange position, going one way in a couple of minutes to divide against the deal on Second Reading and then sidling the other way a few minutes later to vote for it on Third Reading. They become more like the Liberal Democrats every day, except that my Liberal Democrat friends have always remained honourably committed to their eccentric belief that Britain’s destiny is as a province of a European super state—although having heard the noble Lord, Lord Newby, say that he will vote for no deal later tonight, I confess I remain a little confused.

I agree with those who say that we should close the book, not keep it open as some noble Lords have said today, on 47 tempestuous years in which the European question bedevilled British politics and confined our horizons—years in which the common market those of us who voted for in 1975 thought we were joining morphed into an ever more constricting would-be single state without the British people ever being asked to give their assent. The British people never agreed to that and when asked in 2016 and in 2019 they said “no”.

The noble Lord, Lord Austin of Dudley, in a remarkable maiden speech—how much I look forward to hearing more from him—recalled something that all too many who have spoken in a negative tone today still seem to have forgotten. Many people—17.4 million and more—brought us to this place tonight. In reclaiming our borders, our laws and our destiny, the true movers are the common man and woman—the extraordinary people of these islands. They were told that they must not break with the EU, but they determined, “Yes, we must.” They were told in Project Fear that they could not break with the EU, that house prices would crash, pensions would be slashed and jobs destroyed. But in that quiet, British way, with 17.4 million pieces of paper pushed purposefully into ballot boxes in village, church and school halls across the land, they said, “Yes, we could.” They were even told after they had voted that in fact they had not known what they were doing, they had not understood what they were doing, and even—the memory of this should shame us all—that they were too stupid to understand. But last December they said again, firmly, “Yes, we had.” I ask your Lordships not to doubt or divide against that firmly expressed wish tonight.

I will not list all those who worked for this outcome, as it is time to draw to a close, but they were not always so many in your Lordships’ House. One of them was my noble friend Lord Cavendish of Furness, whose valedictory speech, so typical in its classical clarity and humanity, we sadly heard tonight. Who will ever forget, however, the rolling of so many eyes, the shaking of heads, the audible sniggers and groans when a few in this House ventured to speak over the last four years of the will of the people? Now let the people’s will finally be done. In saying that, I pay particular tribute to my noble friend Lord Callanan, who led so much enabling legislation through this House, for all he bore and forbore.

But above all, the credit for vindicating the will of the people goes to the grit, guile and negotiating skill of one who has so often been unfairly vilified in this House, and who was vilified again tonight—the Prime Minister, my right honourable friend, right on this great issue of our time, honourable in keeping his promise to get Brexit done, and those of us on this side are proud to call him our friend. With tens of millions of our fellow citizens, we say, “Thank you, Boris. You done good.”

The nature of any compromise is that not everyone gets what they wish for. We have heard this from both sides of the debate. My right honourable friend stuck at it, but he also compromised, and I too pay tribute to the President of the European Commission, Ursula von der Leyen, who played a distinguished role in writing the final chapter of the skilled and dedicated Mr Barnier’s seemingly never-ending roman fleuve. This outcome is good for the UK and it is good for Europe, so let this agreement end the jabbing and parrying that have gone on for too long in Parliament and outside. Let us vote now. I urge all noble Lords to vote positively for the future, for a vote against this Bill, as the Liberal Democrats propose, is a vote for no-deal and for nihilism. A vote for the Labour Motion is a vote to prolong uncertainty—a vote for doubt over hope.

Every lesson of history is that freedom and free trade are the greatest engines of human happiness and prosperity. To turn our backs on the opportunity in the wider world before us would be an act of folly. To embrace it will redeem your Lordships and bring prizes yet untold. This is a Bill for freedom and free trade, for opportunity and control of our country’s own great destiny. Those are ideals which should appeal across all parties and unite all of us, after all the old divides. I have no hesitation in commending it, and commending the future, to this House.

My Lords, I thank the Minister for the opportunity to have had discussions with her on two occasions. I am grateful indeed. There are three short reasons why I hope that the House will accept Motion F1 and Amendments 48E and 48F, which I seek to move and the compromise within that is intended. Those reasons can be explained briefly as follows.

The first is that the assertion of financial privilege is one to which there are two answers: it is not a financial issue, it is a constitutional and devolution issue. The scope of financial privilege is a question that will need to be discussed further in due course as the precedents on financial privilege need to be considered in the light of devolution. However, this is not the occasion. The issues in relation to devolution are addressed in this amendment in a way that simply seeks to clarify the need for consultation, principles and advice, all of which are so essential to the function of a union, but they do not impinge on the power of the other place.

My second reason for the amendment is that the way in which it seeks to proceed is to set out a principal reason for spending in the devolved areas. The UK Government and the devolved Governments should work together to strengthen confidence both in the Governments and in the union. The clause requires, as before, consultation in establishing the publication of principles and—this is new—the consideration of advice from the devolved Governments in the field where powers have been devolved. This goes nowhere beyond the devolved powers and it seeks simply to uphold the devolution settlement. The keys are consultation, principle and advice.

It is of course for the UK Government to decide whether they will follow that advice, but perhaps I may make three short points. If the advice were to be followed, it would stop the UK going back, as the Minister has observed, to “Westminster knows best.” If the UK Government were to follow the advice, it would say that they can work with the Governments that have been elected by the people of Northern Ireland, Scotland and Wales to spend wisely in the devolved fields by accepting the advice of those who know best in the devolved institutions. Secondly, it would also give the spending of those funds a considerable degree of democratic legitimacy by ensuring that the democratic mandate to spend in the devolved fields was heeded. Thirdly, if the advice was followed, spending would be much more efficient, as there should be co-ordination of spending. The real risk of inconsistent and, worse still, competitive spending, would be avoided.

My last main reason is, in short, is that the amendment seeks to lay part of the foundation for the exercise of statecraft, something that is so necessary to ensure the future of our union. The question may therefore be asked: why is it necessary to put this into a Bill? We simply cannot afford the failure of statecraft in relation to the union. Experience has shown that a clear mechanism is the best way of providing for co-operation between the four nations. There can be no more important area in which to do this than in relation to the working together, with a common and unified purpose, to increase the prosperity of each of the four nations, and here I refer in particular to the very deprived areas within those four nations. I beg to move.

I strongly support everything that has just been said by the noble and learned Lord, Lord Thomas, and I hope that my noble friends in the Labour Party will support him in his amendment if he presses it to a vote. The points he has raised are absolutely fundamental to the devolution settlement. The big issue here is what happens in lieu of the big decisions that used to be made about the structural funds. The noble Baroness the Minister said in our last debate that it was the European Union that would decide, which of course was technically true because these were EU funds, but the advice upon which projects are prioritised within the devolved Administrations very clearly flowed from the devolved Administrations themselves. If we do not observe that principle in respect of the Shared Prosperity Fund and whatever may replace it over time—the noble and learned Lord, Lord Thomas, has explained that we are putting in place within statute a regime that could now last for decades—what we will be doing is substantially rolling back the devolution settlement.

The noble and learned Lord used a slightly antiquated term, “statecraft”, but it is coming back into vogue, because we have so little of it. Indeed, as some noble Lords might recall, the Prime Minister told us some while ago that it would be a failure of statecraft if there was not a deal, which he very nearly railroaded the country into over the past weekend. It would be an equal failure of statecraft if the devolution settlement starts to break down because of irreconcilable differences between the devolved Administrations and the UK Government on fundamental issues relating to the allocation of structural and regional funding within the UK.

The position that we are in, which is why I think it is so important that the noble and learned Lord presses his amendment, is this: can we simply take the rather vague assurances that the Minister has given us today as being sufficient? In respect of the operation of the whole devolution settlement, which is something that one would expect to roll over from Government to Government as a part of our constitution, I do not think that the assurances which have been given as set down in Hansard are sufficient. It is important to have them in statute. Thus, I think that the arrangements that the noble and learned Lord has set out in his Amendment F1 are absolutely appropriate to what we are facing in this area.

The other reason is that in my experience, people’s past behaviour is always the best guide to their future behaviour. On the basis of the Government’s past behaviour, I do not believe that we can accept those assurances as being sufficient. This is the Government that introduced the towns fund under which Ministers themselves could decide on a wholly arbitrary basis that was not related to any objective statements of need, how they would allocated hundreds of millions of pounds—I think in the end billions of pounds under the fund; I have just been told £4 billion—based on arbitrary and essentially political criteria. How can we accept a vague assurance about consultation with the devolved Administrations when we know that that is how Ministers of the Crown have behaved?

It seems to me to be absolutely essential, not simply desirable, that we put into statute the requirements of the noble and learned Lord’s Amendment F1. They seek that the Government should make these further investments only after consultation, which is the crucial element of his proposed new wording for Clause 48

“on the principles under which financial assistance may be provided by a Minister of the Crown.”

That would set out in law the requirement that there must be consultation on principles.

If I have a concern about the noble and learned Lord’s amendment, it is that it is too weak. This is the classic problem when one starts to compromise. You end up by giving up too much ground. As I read it, I think that the wording of his amendment is too weak because it requires consultation on principles. On my reading of the amendment, it does not require the consent of the devolved Administrations to disbursements that are made in respect of additional investments like the Shared Prosperity Fund.

I will put this to the noble and learned Lord: what would happen if, having consulted, the United Kingdom Government do what they now seem to do routinely—the Prime Minister has told us that he does not believe in devolution—and simply override the view of the devolved Administrations and decide on a political basis to make what are essentially politically motivated investments anyway?

I hope the noble and learned Lord can disabuse me, but my reading of the wording of his new amendment is that the United Kingdom Government would, having consulted, none the less be able to ride roughshod over the devolved Administrations and decide what they want to do for political reasons in London and Westminster. The noble Baroness said—we liked her words—that she was seeking to give backing to the principle that it is not the case that Westminster knows best; my reading of the state of the law, which is what will matter on these things, is that it would be perfectly okay for future Governments to say not only that Westminster knows best but that the Conservative Party knows best and will distribute funding in Scotland, Wales and Northern Ireland in respect of Conservative Party priorities and not any priorities agreed with the devolved Administrations.

I strongly support the noble and learned Lord’s amendment. It goes to the heart of what will happen to devolution after Brexit. My concern is that, in the process of compromising as this Bill has gone through, the amendment is too weak to deliver the objectives which the noble and learned Lord so rightly set out.

I want to ask the Minister a very specific question. She talked about consultation, but will she undertake on behalf of Her Majesty’s Government to commit that they will not make investments under the shared prosperity fund, or any of its successors, in the territories of the devolved Administrations without their consent? This is about not just consultation but consent. Further, does she realise that, if she does not do so, none of the other assurances that she has given is worth the paper they are written on?

I believe that this issue was the subject of the amendments tabled by the noble and learned Lord, Lord Thomas, in the previous round of ping-pong. Those amendments were sent to the Commons and the Commons rejected them, so we are discussing a new set of amendments in this round of ping-pong. This question was dealt with in the previous round and is, as the Speaker of the House of Commons determined for previous amendments, subject to financial privilege.

My Lords, before I address the specific amendments in the names of the noble Baronesses, Lady Finlay and Lady Bowles, I will make an observation on the ruling from the Deputy Speaker on the previous group, when the noble and learned Lord, Lord Thomas, sought to withdraw his amendment. It directly relates to this because, for all I know, the same might happen in this case, too. I put on record for future discussions the question of why, as is the normal practice of the House, amendments are not the property of the House once they have been moved.

I understand that was the case when, on 26 November, the noble Lord, Lord Woolley, moved his amendment in the ping-pong on the Parliamentary Constituencies Bill. He sought to withdraw it, but other noble Lords were not content that he should and the House then voted on it. I do not understand the difference between what happened on 26 November on the Parliamentary Constituencies Bill and what happened today when the noble and learned Lord sought to withdraw his amendment. I think this is quite an important point about the procedure of the House and whether, on significant issues of this kind, the House, rather than an individual noble Lord, has responsibility for amendments that have been moved.

My Lords, I agree with every word that the noble Lord, Lord Lexden, has said, with the noble Lord, Lord Rennard, and with the very eloquent speech by the noble Lord, Lord Woolley. The Minister said that the House of Commons had given a view on this, but it is perfectly reasonable and normal for us to ask it to think a second time on issues where we believe that there is a very strong public interest, particularly constitutional issues, since we are a constitutional safeguard. There are not many others in our system. One is the courts, and we have heard from a former Lord Chief Justice, who also spoke extremely eloquently about the composition of the Boundary Commissions. When a former Lord Chief Justice raises concerns about possible gerrymandering of the Boundary Commissions, we should take note.

For all the reasons that have been given so far, the issue of engagement of young people in our democratic system is fundamental. It is not a peripheral issue for the future of this country, and it is all the more fundamental because of the current evidence of massive underregistration of young people. The noble Lord, Lord Woolley, spoke with great passion about how ethnic minority groups are even more underrepresented than young people at large. The evidence is that in the 2017 election, only 64%—not even two-thirds—of 18 to 24 year-olds were even on the electoral register, so the rest were not even able to participate unless they went through the laborious process of registering themselves during the election. Many would then have missed the deadline, and I had not even thought about the very powerful point made by the noble Lord, Lord Rennard, that if they are not on the electoral register, they are not available for jury service either. All these attributes of citizenship, which are fundamental to the future of our democracy, they are not engaged in.

Only 64% being registered is a huge condemnation of the status quo. The Minister cannot say that the system works and therefore, “if it ain’t broke, don’t fix it”. The system is fundamentally broken, and not because of changes that go back a long time and which are hard to tackle but because of the introduction of individual registration, a reform introduced only six years ago, and which was itself, in respect of young people, unnecessary because, as the second aspect of this amendment which the noble Lord, Lord Lexden, referred to, makes clear, we know who all the 16 year- olds in the country are. It is not a mystery. They all get a national insurance card. The state thinks that it is important for them to be registered for taxation, but not to be registered to vote. These are fundamental issues, and if we have any role in our constitutional development as a country, we should be drawing them further to the attention of the House of Commons, and we should certainly be putting on the record, as emphatically as we can, that the status quo does not work satisfactorily at the moment.

In the previous two elections, since we have had individual registration playing through, there has been a fundamental underrepresentation of young people, particularly in minority and poorer groups. Also, young people are becoming increasingly politicised because of the scale of the issues affecting them—Brexit, Covid-19 and so on—and as soon as elections come, they suddenly and frantically seek to register. The figures from the Electoral Commission are that in the general election in 2019, 1.4 million young people registered after the calling of the election, and apparently most of the new registrations on 10 of the 15 days with the highest number of new registrations were of young people at that general election.

The Minister might say that this shows that the system is, to some extent, working, but I do not think that it shows that at all. It shows a massive crisis in registration. When young people realise that they are not registered, some, but only a proportion, take the active steps necessary to correct that in that very short window between the calling of the election and the final date for being able to register. This is not a system that is working, it is one that is fundamentally broken, and one where the remedies are very straight- forward. Automatic registration is very straightforward to implement. It could be done immediately and should have been done under this Bill, but the Government rejected it. The further amendment on the paper today, which I absolutely believe that we should carry, would simply draw to the attention of young people that they should be registered.

When there is a fundamental problem of this kind, one does not need to look for the motivation behind it because, in the time that I have been in this House, this is the fourth occasion on which we have addressed the issue of individual registration. It looks very straight- forward and clear to me. Not all members of the Conservative Party, but the electoral advisers of the Conservative Party think they have a direct political interest in voter suppression in general and in the underregistration of young people in particular. Looking at the tactics in this populist movement that has been sweeping the United States and Britain, unfortunately the Prime Minister, who is a representative of it—not as bad as Donald Trump but still pretty bad—is perfectly content to resort to such methods so that fewer young people are registered and vote. On all the evidence, that appears to be the case. This makes me, and, I hope, other noble Lords who take these issues to heart, all the more determined that these issues should be aired, not suppressed, and that we should send this issue back to the House of Commons a second time.

My Lords, I just popped in today to see this Bill put safety to bed, having participated extensively in Committee and on Report—speaking on it for far too long, noble Lords may wish to shout. I was therefore surprised to see the amendment in the name of the noble Lord, Lord Woolley, and to hear his speech. I congratulate him on a passionate and thorough speech, but one which should have been made at Second Reading. It was a perfect example of a Second Reading speech, and it would also have gone down perfectly well in Committee.

The noble Lord has apologised to the House for coming to the matter late in the day, as he put it, for which he blamed the pandemic. We have all had to change our modus operandi because of the pandemic, but I cannot imagine why, over the past four months, he was unable to participate in any stage of this Bill, online or in the Chamber. While I participated upstairs in Grand Committee, the noble Lord, Lord Tyler, participated from somewhere in the south-west—Devon, I presume—and many other noble Lords participated online. As a new Member, I made mistakes on the procedures, etiquette and courtesies of this House and had to apologise. I know he has apologised today, but the procedure that he has adopted, coming in with this amendment out of the blue at this late stage, is not the right thing to do in this House. I hope that he has not been used as a Trojan horse by the Liberal Democrats, because this has all the smell of a Liberal Democrat ploy. Someone else moves an amendment, the noble Lord has said that he will not vote on it, but it looks as though the Liberal Democrats will force a vote on ping-pong at this stage.

Irrespective of the merits of the arguments and the passionate speech by the noble Lord, Lord Adonis, we should follow the usual customs and courtesies of this House at ping-pong.

My Lords, I commend the Minister both for the extremely fluent manner in which he introduced this legislation and for its sensible and proportionate content. He invited the House to support it and I doubt that there will be any dissent. It is important that we give the Government credit when they do a good job, because we are always critical when they do not. The way that the consultation on these regulations was conducted, with the devolved authorities, local authorities, electoral administrators and so on, has been almost a model of its kind. The conclusion which the Government drew—to have a short delay in the permissible period for the publication of the register but not to cancel the canvass, which would have potentially led to large numbers of people being disfranchised, as the Minister said—was the right outcome and the response to a well-conducted consultation.

Since the Minister is inviting the House to agree to these arrangements for electoral registration, I will raise a wider issue. One thing that is seriously wrong with our system of electoral registration at the moment, which goes back to the introduction of individual registration, is the way that we deal with people who live in institutions. The two largest groups of those are students in higher education and people who live in care institutions—who have been much in our mind in respect of Covid. Right back to 2015, when individual registration was introduced, electoral administrators and others have been seriously worried about the underregistration of people in institutions, who often move in and out in quite short order. They are often not aware of the fact that they are not registered and there is now no system for automatic registration as there was before. The Minister has introduced these regulations in such a reasonable way. May I invite him to at least agree to look at this further? It is obviously not going to make any change for this year, because it would require legislation, but there would be widespread support for a system allowing EROs automatically to register those in institutions. This could lead to a justifiable improvement in the way that the register works.

It was notable that the report on registrations for last December’s general election by the Office for National Statistics showed a very large increase in registrations in the run-up to the election. Total registration increased by 2.8% between December 2018 and December 2019, to its highest level ever. That is a welcome reflection of engagement in the democratic process, but it is also a commentary on how inaccurate the register was at the start of that period. If it were possible to get an automatically more accurate register, not only through the improvements such as data matching that the Minister rightly noted, but also by means of automatic registration of those in institutions, this would be a welcome advance.

My Lords, I have great respect for the noble Lords, Lord Hayward and Lord Tyler, but I had difficulty following some of their points.

On the point from the noble Lord, Lord Hayward, about the size of the House of Commons, it has historically always had about 650 Members. A century ago, it was larger at 707 Members; it has come down in size over that period. I do not think it excessively large for exactly the reasons my noble friend gave: we have an unusually large Executive in this country, partly because we are a unitary state. We do not have devolved government in England. Maybe we should have a smaller Government than 100-odd members, but as long as such a large proportion of the governing party are members of the Executive—about a third of the Members of the governing party in the House of Commons are members of the Executive—I see no alternative to a House of Commons about the same size we have at the moment.

As for the House of Lords, I think the noble Lord’s memory is somewhat short. It was the last Labour Government who dramatically decreased the size of the House of Lords by removing most of the hereditary Peers. The House of Lords is now much smaller than it has been for most of recent history.

As for what the noble Lord, Lord Tyler, said, I am a supporter of electoral reform. I support the mixed member system that Britain introduced into Germany after 1945 to get the best balance between directly elected constituency MPs and a proportional top-up—but we have had a referendum on that. We had a referendum in 2011, and whereas I was very open to exploring the results of the 2016 referendum, which was close and not on a precise proposition, the 2011 referendum on the alternative vote was on a very precise proposition and has been enacted by Parliament—and it was decisive; 69% voted against it.

My strong advice to my friends on the Lib Dem Benches is: do not go there. The way the progressive parties in this country will come to power in future is not by chimera ideas of electoral reform but by winning an election under the existing system. That is what we should devote our attention to doing.

My noble friend’s points were all well made and I agreed with them all. I amplify her final point about votes at 16. It is not clear to me what the Government’s policy is in respect of allowing the House of Commons a free vote; perhaps he could elucidate that for us in his reply. It looks as if on a free vote there probably is a majority now in the House of Commons for a voting age of 16.

Not only has the time clearly come for votes at 16— the group that wants representation and has a democratic right to it that is most unrepresented in our institutions at the moment is young people, particularly 16 and 17 year-olds—but it should go hand in hand with two other reforms. First, young people should be automatically registered at their place of study, which used to happen when I was a student. Then, all universities would automatically register all their students. The move towards individual registration has served to keep a lot of young people off the electoral roll. If we are to reduce the voting age to 16, the other change I would make is to have a polling station in every place of study—every school with a sixth form, every college and every university. The combination of those three reforms—votes at 16, automatic registration and a polling booth in every place of study—would transform the representation of young people and we would be a healthier society for it.

My Lords, I completely agree with the noble Lord, Lord Lilley, that we need a more efficient state. We need to pay attention to that in this crisis.

In his speech this morning, the Prime Minister predicted that there will be a return to normality by Christmas. I tend to be with George Eliot on these matters: of all mistakes in life, prophesy is the most unnecessary. I do not think it at all likely that we will be back to normal by Christmas, but who knows? Anyone who tries to prophesise is almost certainly making a mistake. However, we must have public policy in the midst of a crisis where, as the Japanese famously say of politics, “An inch ahead is darkness.” The question is: what should that policy be?

Among those who are more reputable economists than me, there are three different models: the post-crisis situation could be L-shaped, V-shaped or U-shaped. The truth is that no one knows whether it will be L-shaped, V-shaped or U-shaped. The right stance for the Government, who hold our destinies in their hands, is to observe the precautionary principle. Since there is a distinct possibility of mass unemployment after this crisis on a scale that we have not seen in recent history—my noble friend Lord Livermore said that the economy has contracted more this year than in any year since, I think, 1706—surely the right precautionary principle for the Government is to work on the assumption that the post-crisis situation will be L-shaped; that is, with a big shock in demand and supply, which will continue. Significant efforts by the Government to boost both supply and demand will therefore be required.

That broadly seems to be the Government’s policy, except that they make announcements then put time limits on them. At the moment, they have to do that because they can only see a certain period ahead, but I look to the Minister to assure us that, if we are in an L-shaped post-crisis situation with a massive contraction of both supply and demand, the Government will continue to provide the economic support that they have done.

On the actual measures, let me be frank: I agree with some and I disagree with others. I agree strongly with the measures taken in respect of youth employment, such as the kick-start scheme. I am sceptical about the stamp duty cut. I am not a great fan of giving people £10 to eat out when many cannot even afford to eat in. We need ceaseless activity on the Rooseveltian principle in this crisis. I will not criticise the Chancellor or the Minister for taking initiatives that involve action to try to tackle the roots of a supply and demand crisis just because I may happen to disagree with particular measures. Inaction is the great crisis that we potentially face, not too much action, particularly in respect of youth unemployment, where the kick-start scheme is vital.

I do not have time to continue. Will the Minister give a commitment that the Government will do all that they can to maintain the kick-start scheme and, if necessary, give a direct and explicit commitment to employing young people who face unemployment after this crisis? If I can break my own rule and engage in some prophesy, the big thing I fear is mass youth unemployment after this crisis, which would be unconscionable.
