My Lords, does the Minister agree that removing exit checks from our borders in 1998 was a huge mistake? Does she also agree that, Brexit or no Brexit, we now need to bring back immediately exit checks to our borders so that we are on top of things from a security point of view and from the point of view of being in control of immigration, with EU and non-EU citizens being scanned in and scanned out? In fact, I could recommend a whole list of Indian IT companies that could do the job.

I thank the noble Lord. He is right about exit checks. They were reintroduced last year and will provide some very useful information, not least on immigration.

My Lords, I came to the UK as a student from India as a 19 year-old in the early 1980s. Our universities here are the best in the world, along with those of the United States. The university that has won more Nobel Prizes than any other is the University of Cambridge, with nearly 100. I am the third generation of my family to be educated here and now our elder son is at a British university—Cambridge—so that is the fourth generation. I am proud to be chancellor of the University of Birmingham and chair of the advisory board of the Cambridge Judge Business School. I am also president of the UK Council for International Student Affairs, UKCISA, representing the 450,000 international students in this country, along with 160,000 from the EU.

I thank the noble Lord, Lord Lucas, for initiating this debate at this crucial time. Our higher education is, of course, vital to our economy. It is one of our biggest exports. International students contribute directly and indirectly £14 billion to our economy and support 137,000 full-time equivalent jobs. As the noble Baroness, Lady Chakrabarti, said in her excellent maiden speech, they also enrich the experience of our domestic students. Our international students go on to become world leaders. At any time there are 30 world leaders from British universities, including former US presidents. Dr Manmohan Singh, a former Prime Minister of India, went to both Oxford and Cambridge.

What is more, a study carried out in the United States found that of all patents registered at the country’s top 10 patent-generating universities, 76% had a foreign-born inventor. Google, after all, was created by an immigrant. Silicon Valley is littered with foreign student success stories. What chance do we have of emulating that here? Higher education has always been a thoroughly international affair. As we have heard, research has never recognised international boundaries and diversity is recognised for contributing to new ideas and a divergent way of thinking. Thirty per cent of academics at our top universities, including Oxford, Cambridge and Birmingham, are foreign. Professor Alice Gast of Imperial College said:

“Foreigners improve the creativity and productivity of home-grown talent, too”.

The number of university students looking to study abroad is growing vastly. It is expected to grow from 4.1 million to 8 million by 2025. The UK has the second-highest number of them after the United States: 10% as against 19%. But the Government’s attitude to international students has seen our rivals steal a march on us. As the noble Baroness, Lady Warwick, said, I was in India when Prime Minister Theresa May was there. She did not mention higher education once in her speech. As the noble Baroness, Lady Royall, said, Prime Minister Narendra Modi, on the other hand, spoke of the importance of education to Indian students. By the way, our Prime Minister did not once meet the 35 university leaders who were on the delegation to India. On the other hand, our Universities Minister Jo Johnson is a true champion of our British universities.

Australia, Canada and the United States all have strategies to increase the number of international students. Canada aims to double their number by 2020, while Australia wants to increase international students to 720,000 by 2025. In fact, the former Australian Education Minister Christopher Pyne went so far as to thank Britain for its immigration policies because they are driving so many students to Australia’s universities.

That applies not only to English-speaking universities. Indian students are now going to Holland, Sweden, Germany and France. France has a target of doubling the number of Indian students by 2020. The UK Government say that they want to increase the number of international students but there is no specific target. The Prime Minister, when she was Home Secretary, said that she wanted international students to leave the day they graduated. The headline in Indian newspapers was:

“Come to the UK: Graduate, and then get the hell out!”.

The Government have spoken of increasing education exports from £18 billion to £30 billion but there is no specific target and no plan to change the visa rules. The post-study work visa route, which I personally championed in this House in 2007 when the noble Lord, Lord Adonis, was Education Minister, was implemented and the numbers went up significantly. It was taken away in 2012 and we have seen the effect on the number of foreign students. At the moment you can stay on and work but, with so much bureaucracy, it is very difficult to get a job after graduating. Can the Minister tell us how many foreign students are now staying on under the postgraduate work visa scheme that currently exists?

On the other hand, in the United States students can stay on for 12 months without a job offer; Canada allows them to remain in the country for the same duration as the length of their study; and Australia allows graduates to remain in the country for between two and four years. In surveys, the British public overwhelmingly say that they do not mind at all if foreign students stay on and work. There is no downside to it. It helps them to pay for their education; it gives them work experience; they contribute taxes; and they build generation-long bridges with this country. With this in mind, it is no wonder that the number of non-EU students has dropped by 2% and that the number from India has halved in the last four years, while in America it has increased by 9%—and the fastest-growing group of foreign students in America is the group from India, whose number is up by almost 25%.

As we have heard, the Government refuse to remove international students from the net migration figures. Can the Minister assure us that the Government will look into this? It would send a signal that they do not treat international students as immigrants. We desperately need the 160,000 EU students to come and study here in the UK. Can the Government tell us the plans for these students if we leave the European Union?

I think that the Government are being led by a mistaken belief that the British people want to reduce all immigration. There is good immigration and bad immigration, and international students should be encouraged. Almost 80% of the British population want international students to stay on and work in the UK after they finish their studies. The rhetoric surrounding Brexit is just awful. On the other hand, I hear from my colleagues at American universities that Indian graduates go on to earn salaries of $80,000 in Texas and $100,000 in California. Here, it is claimed that 90,000 students overstay. This is based on International Passenger Survey data and it is bogus. We should have visible exit checks at our borders. Can the Minister tell us when we are going to introduce them? The noble Baroness, Lady Royall, mentioned an unpublished report referred to in the Times which shows that only 1.5% of international students stay on.

In conclusion, India was the jewel in the crown of the British Empire. Today, British universities are the jewel in the crown of this country. The Government need to change their attitude towards international students, because the impact of Brexit and the uncertainty it has caused are damaging the higher education sector, and the Government’s attitude is harmful and undermining. I think that the attitude to immigration is economically illiterate and that the Government’s attitude to international students is economically super-illiterate. If the Government change their attitude, we will remain an educational superpower for the foreseeable future, with international students being our strongest element of soft power in the world.

My Lords, the Prime Minister, in her wisdom, has appointed three Brexiteers to take us out of the European Union. Their motto must be, “All for one and none for all”. One of the main roles of this House is as a check and balance on the other place. Surely it is imperative that both Houses must have a say at every stage, whether it is Article 50 or beyond.

With respect, the Government’s position is that there is no legal obligation to consult Parliament on the triggering of Article 50. That is, of course, the subject of challenge in the courts. Indeed, there will be a directions hearing in the Administrative Court tomorrow in respect of one of those claims.

My Lords, the Government have implemented a series of educational programmes, including by the Anne Frank Trust and the Crown Prosecution Service, which have received the support of the National Union of Teachers. It is close by this afternoon, I believe. In the circumstances, we have taken steps to address this issue. In addition, a cross-government hate crime action plan is to be published imminently. This will drive forward our proposals to deal with all forms of hate crime.

My Lords, I came to this country from India as a 19 year-old in the 1980s. At the time of the referendum, I received this tweet: “You are not British-born, so your input into the vote of the true Brits is not required and of no interest to true workers”. Last weekend, a member of our team for 16 years who is from abroad, with an English husband, went to hospital with a broken, bloodied finger and was told by somebody waiting next to her, “You are a burden on this country”. What is going on? Will the Minister and the Government acknowledge that this wretched referendum has caused this? Are the Government really doing enough to address something which I have not witnessed in any way for 30 years, but am now witnessing?

No matter what may divide us, we are united in this country by shared values of democracy, free speech, mutual respect and opportunity. If we maintain these standards, we can drive out the criminals who would perpetrate the sort of crimes that the noble Lord has referred to.

My Lords, I congratulate the noble Baroness, Lady Brown of Cambridge, on her excellent maiden speech. I have known her for almost a decade, since I was the founder of the UK-India Business Council. Now she is the vice-chancellor of Aston University in Birmingham and I am the Chancellor of the University of Birmingham; we are neighbours. She has taken her title as Cambridge because she is a staunch alumna of Murray Edwards College, known in our day as New Hall, which is one of only three women-only colleges remaining in Cambridge. Her career in the field of engineering is outstanding—from working at Rolls-Royce to heading the engineering faculty at Imperial College in London, to her famous King review in 2008 on carbon emissions from road transport. Not content with being a world-renowned expert in the field of engineering and science, with awards too numerous for me to list, she is also married to Dr Colin Brown, the engineering director at the Institution of Mechanical Engineers. We look forward very much to her contributions in the years to come.

Aung San Suu Kyi, Bill Clinton, Desmond Tutu and Mahatma Gandhi all studied at UK universities. They are the finest universities on this planet along with those of the United States of America, and yet the Government continue to classify international students as immigrants when calculating the net immigration figures, as well as having a target to reduce net immigration to fewer than 100,000. Then, hypocritically, the Government say that there are no limits to international students. Logically, there is no way the Government will meet their targets unless they reduce international student numbers. They have done the right thing in closing down bogus colleges and we all agree with that, but now their policies are damaging genuine international students at our world-class universities. I see this every day in my role as president of UKCISA.

At the University of Birmingham, 20% of our student body is made up of international students and 33% of our academic staff are from overseas. BIS itself states that international students bring in more than £13 billion a year in overseas earnings, and yet, in the words of Professor Leszek Borysiewicz, vice-chancellor of the University of Cambridge,

“the potential economic gains for the UK for recruiting more overseas students are being sacrificed at the altar of political expediency”.

He went on to say that it is “ludicrous” to include overseas students in UK immigration targets. Our competitor countries do not categorise international students as immigrants. In the US they are included as non-immigration admissions, while in Australia they are reported as net temporary arrivals. In Canada they are placed in the temporary resident category. I ask the Minister this: why can we not do the same? In fact, the Prime Minister himself has said to me that he would be open to this idea.

The Government are unnecessarily creating a rod for their own back. Furthermore, our competitor countries have ambitious targets to grow international student numbers, accompanied by government action to help them do so. For example, Canada wants to double its number of international students to 450,000 by 2020. In 2014-15 the number of Indian students increased by 32% in the United States, while the number of Indian students coming to the UK has fallen drastically. Does the Minister agree that we should have specific targets to increase the number of international students?

As we have heard, removing our post-study work visa route has also been hugely damaging. An NUS survey found that 51% of students think that the Government are not welcoming towards international students. Universities UK research shows that 22% of the British public considers overseas students not to be immigrants, yet the Government keep relying on International Passenger Survey data, which are completely unreliable. I have repeatedly said that the Government need to reintroduce exit checks at our borders and that all passports, EU and non-EU, need to be scanned in and out of the country. Then, we would have proper control of our borders and we would know the international students coming in and going out.

This year I was appointed chair of the advisory board at Cambridge Judge Business School. Christoph Loch, our director, said that the Government’s current policies,

“not only are ineffective … but outright hostile and unfair toward a population of highly talented people who collectively do have an influence on the reputation of the UK in the world”.

The Government keep talking about the United Nations’ definition of migrants but, as the noble Baroness, Lady Sharp, said—I thank her for the debate—no one is suggesting that the UK should stop reporting to the UN or recording student migrant numbers. There is no reason why the UN definition should be used for the particular domestic policy objective of the net migration target. UUK, the Russell group, London First and the NUS all independently agree with what I have said. International students are not only one of our biggest export earners, but one of the strongest elements of our soft power.

The Government have sent a strong message about their intention to keep out migrants who will bring no value to the UK, but they must be equally clear that the UK still wants to attract economically valuable groups, such as genuine international students. Removing this group from the net migration target would send a clear international message that the UK is open to all the amazing benefits that international students provide to our country and to British universities, which are the jewel in our crown.

That may be so. I would have to look into that point in relation to the north of England, and I am happy to do so. However, the point is that there is no limit on the number of graduate opportunities available. We have special programmes for PhD students and for post-doctoral study. Therefore, we need to get that message out into the wider world much more effectively that Britain welcomes these students and that a range of opportunities exists for students, post-study, to continue to work and gain experience. They can continue on tier 5 with approved internships and training programmes. Twenty-eight thousand organisations have approval to sponsor tier 2 graduate employment opportunities. There is also the PhD entrepreneur route on tier 1. There is a wealth of opportunities for these students.

The noble Lord, Lord Hannay, asked five very pertinent questions and then answered them, albeit not entirely to the Government’s satisfaction. We recognise that our country is experiencing growing pressures from inward migration and its effect on the fabric of society. As a result, we need to take steps to bring net migration down. Of course, you cannot do that simply by changing the figures. It would be very easy to change the figures and, by waving a magic wand, halve net migration. That would be very comfortable but it would not be true. Often people come to this country to study and then stay on. That is why there is a discrepancy between the figure of 117,000 coming in and 40,000 leaving. We need to understand better why we have the 77,000 discrepancy and we need to better understand the data.

The noble Lord, Lord Hodgson, asked for an update on e-borders. Exit checks, which were introduced last year, will give us a better picture of where those people are going. We will publish an update report in May on the progress of e-borders and the exit checks. That will give us greater confidence in this regard.

My Lords, we know that e-borders are not reliable. We have a migration problem with the EU as well. Why do we not institute scanning of all passports—EU and non-EU—at our borders? Then we will have total control. It is easy technology and is available right now.

We will continue to look at these things. The exit checks are the first step to something we hope will help us get a better handle on flows in and out of the country.

I am aware that there is a great deal of expertise in the House, particularly in the higher education sector. We keep debating the numbers, but I urge noble Lords to think that our message should be to sell the incredible opportunities people have when they come to study in some of the greatest universities in the world. As graduates, they will then have the opportunity to work in some of the greatest companies in world. That is a fantastic offer that we can all come together to sell.

I am very happy to look into those two cases for the noble Lord to ensure we get this right. The message has to be clear, and we have to recognise that we have a duty to welcome people coming in to contribute to our economy and to show them the appropriate respect.

I am happy, should the noble Baroness, Lady Sharp, think it an offer worth accepting, to convene a meeting of interested peers and colleagues with our people from the Department for Business, Innovation and Skills, who have ownership of the universities sector and the tier 2 and tier 4 issues, along with people from the Home Office and immigration enforcement, to discuss how we can tackle these problems and the reasons we are not getting the right message out. We can work together to ensure that our fantastic offer on the world stage is communicated loud and clear: that people from around the world with genuine qualifications and places at great British universities are very welcome and that we are very grateful to them; that, post-study, they will have immense opportunities in this country; and that we would like them to stay and contribute, if they are qualified to do so.

We have all asked for one thing. We are all great ambassadors for British universities—we are their greatest fans—and we will continue to be, but we are asking for one thing. The Prime Minister has said he is open to the idea, and I am sure the Chancellor would be. We are asking the Government to categorise international students separately, in the way that, as we have shown, the USA, Canada and Australia do. That one move would send out a message. The Minister talked about perception. It would remove that perception once and for all. Why can the Government not do it?

The noble Lord, who knows this area inside out, knows that we looked at that very carefully. It is true that the United States separates that category out, but when it calculates net migration, it adds it back in. The United States behaves differently because it does not have a net migration target. We do, and therefore we have chosen to include students in the numbers.

The Government believe very strongly in the regional airport network. As I am sure the noble Baroness is aware, Manchester announced earlier this year—at the beginning of the summer in June—a £1 billion investment over the next 10 years. Indeed, we have seen further investment in, for example, road surface improvements around Birmingham, Bristol and Doncaster Airports, so various investments are being made which will reinforce the northern powerhouse.

My Lords, Sir Howard Davies and his commission have put a lot of work into coming up with their recommendation, which has been decided as the one to go forward with. Why do the Government now have to appoint another sub-committee and take even more time? There is probably need for expansion of both Heathrow and Gatwick, but let us get on with Heathrow because it is affecting our competitiveness as a nation. Could the Minister assure us that this is going to be taken quickly and it will be established and put in place really fast?

The noble Lord is quite right. I agree with him that this has been a detailed report, which the previous Government, under the current Prime Minister, commissioned in 2012. The report has been received, and I am sure the noble Lord would agree with me that it is time now to give the detailed report considered opinion. It is quite right that there should be a sub-committee of the Cabinet to take this decision forward. I reiterate the point that the Prime Minister has made quite clear: a decision will be made by the end of the year.

My Lords, arriving at his Cardiff primary school at the age of five, the future vice-chancellor of Cambridge University could use just one English phrase. Today, at the age of 63, he still remembers the kindness that people showed him as he learnt to speak English, and of course he now holds one of the world’s most influential academic positions. The gracious Speech talked about the packed programme of a busy and radical Government, but despite that there is no mention of immigration or of higher education. I want to talk about those two topics and I declare my various interests in the higher education field, as well as being an immigrant. Professor Leszek Borysiewicz has made a defence of the value of immigration. He opposes crude numerical limits and praises Britain’s plural society as one of its greatest strengths.

We all know that the target of tens of thousands has become a real issue. The number of students coming here from India fell by 39% between 2011 and 2012. The vice-chancellor has said that a university such as Cambridge is in the global race, a point also made by the Prime Minister. It is competing not just with other British universities, but with Princeton, Harvard and Stanford. Setting an immigration target of this kind is harming Britain, because for the first time in many years the number of international students coming to Britain has fallen overall. What is even more scary is that the numbers have fallen in the STEM subjects, which we so desperately need students to study.

Michael Kitson, a university lecturer in global macroeconomics at the University of Cambridge, has come up with some great insights. He feels that the popular press has been propelling the bandwagon in immigration. He has said that non-EU students contribute over £7 billion to our economy—our GDP and balance of trade—and, while some students may remain after they have finished their studies, the vast majority leave. When we look behind the figures for net immigration, if students are excluded, the net figure in 2013 was 58,000, averaging 49,000 between 2004 and 2013. Voilà, the Government’s target of net immigration to be measured in the tens of thousands has already been met if students are excluded. When we look at people who come here to work we see that, while 214,000 came to work here in the UK, some 186,000 left the country to work overseas.

The main driver of future prosperity in this country can be summed up in one word: innovation. Innovation is driven by diversity. Just look at Silicon Valley, one of the most diverse communities in the world, and what it has achieved in changing our lives. What has happened over here is that the popular press has been stirring up a hatred of immigration based on anecdotes, rumours and slurs, not on figures. I think we need to come to terms with that. The National Union of Students has conducted surveys which show that 51% of non-EU students think that the UK Government are either not welcoming or not at all welcoming towards international students. We had the Government’s £3,000 visa bond, which set off the alarm bells. In a U-turn, the Government withdrew it. They then had the idea of hoardings saying “Illegal immigrants go home” being driven around. Even Nigel Farage of UKIP objected to them, and they were the subject of another government U-turn. Yet here in this House we have the noble Lord, Lord Glendonbrook, who made an excellent maiden speech. He is an immigrant who has made a brilliant contribution to this country. The Government’s attitude to immigration can be summed up in one word: hypocrisy. On the one hand, we have the immigration cap, while on the other hand, for years I have been saying that we should bring in exit controls at our borders: scan every passport that comes in and scan every passport that goes out. You will then know who is in the country and thus who should or should not be here. The Government must do this. The e-border scheme has been a miserable failure and over £500 million has been wasted on it.

The National Union of Students, which supports the aim of removing international students from the immigration figures, says clearly that such students contribute a great deal to the social and economic fabric of the UK, contributing more than £12.5 billion to the UK economy. Its surveys show that only 1% of all immigrants granted settlement in 2009 progressed directly from a study route to remain in this country. That is because the vast majority of students leave the UK within five years. The excellent post-graduation work visas need to be brought back in by the Government. In any case, we have one of the most expensive visa systems in the world.

I conclude by going back to the vice-chancellor of Cambridge, who has said:

“When I think of how my parents were welcomed to this country, I find that actually quite saddening. I do feel we are an open, democratic country and we should be setting the standards for the rest of the world, not hindering them … One of Britain’s greatest strengths has been in the way it has assimilated so many different communities, and we are a very plural and open society … At a personal level I abhor the idea that we actually have a very strict migration target. There are so many nuances to numbers in this regard that it actually hides the true potential benefit that people coming into Britain can have. We should be looking at the capacity of individuals to contribute to our society here rather than have a political ding-dong over ‘we brought in 10,000 fewer than you did’”.

My Lords, over the past weeks, I have received numerous requests by journalists from around the world because one of the seven schools that I attended was the Hyderabad Public School. The 46-year-old chief executive officer of Microsoft, Satya Nadella, also attended the Hyderabad Public School. He then went to the United States for his education and is now heading one of the world’s largest companies, with a market cap of $340 billion.

Earlier this afternoon, I attended a talk by the Governor-General of Canada, David Johnston. A huge part of his speech was about education and about Canada wanting to attract the best students from around the world. Like me, he came as a foreign student to Cambridge to read law. Is it not sad that, on 16 January, the Times Higher Education Supplement carried the headline “Overseas student total falls ‘for first time’ as Indian numbers collapse”? It went further and stated that,

“the number of non-EU students at UK universities fell by 1 per cent last year, the first such decline ever recorded”.

An NUS survey of more than 3,000 international students conducted in January found that 51% of non-EU students thought the UK Government unwelcoming. Meanwhile, in Canada, the Government aim to double the number of international students in Canadian educational institutions by 2022, raising the total to 450,000 yearly. In Australia, more than 74,000 student visa applications were lodged in the September 2013 quarter, 7.1% higher than the same period in 2012 and the highest for this quarter in the past four years. In France, the Government have moved to simplify the visa application process and to double the number of Indian students studying at French universities. Does the Minister have a target for increasing the number of foreign students in the UK, let alone of Indian students?

The Russell group has reported that the intakes of postgraduate students from India at its institutions dropped by 21% in 2011-12, with a further drop of 18% in 2012-13. Even the growth rate in new students from China has started to taper off. Meanwhile, postgraduate student numbers to the United States increased by 40% in 2013. Visas granted to Indian students across all levels in Australia have risen by 22% in the past year, following the introduction of a more open immigration policy, and visas granted to Indian students in Canada rose by 8% in 2012.

The Prime Minister talks about Britain having to take part in a global race yet the Government’s insistence is on following this madcap immigration cap policy and targeting bringing down the immigration level to the tens of thousands. This is shooting ourselves in the foot. What are the Government thinking of? Why do the Government keep including student numbers in the immigration figures when Canada, Australia and the United States—our immediate competitors—do not? Does the Minister agree that we should exclude foreign student numbers from the immigration figures? The Government might then hit their target but they should not do it for that reason: they should do it because this policy is sending out the wrong messages. The Prime Minister has said that there is no limit to the number of students that we want to come to study in the United Kingdom—I have heard him say that myself—so why are the Government not following the example of our counterparts in Canada and setting a target to double the number of foreign students coming into the United Kingdom?

In contrast, let us look at what is happening over here. The number of Indian students has fallen by 25% and the overall non-EU enrolment of overseas students has dropped from 173,560 to 171,910. The Government are sending out a negative message: that Britain does not want foreign students. The noble Baroness, Lady Hamwee, referred to the perception of reality. The perception has become reality and the Government have been bringing out ridiculous ideas. When the idea of a £3,000 bond for foreign visitors was floated, it did not take long before the Government backtracked. However, it sent shockwaves around the world. I kept getting asked about this on every visit to India. Then the Government had the amazing idea of having vans going around the UK saying “Illegal immigrants go home”. I do not like quoting Nigel Farage but even he—a man perceived to be entirely anti-immigration—said:

“I think the actual tone of the billboards is nasty, unpleasant, Big Brother”.

There you have it.

There is no question that a lot needs to be done to reform immigration in this country. Illegal immigration is out of control. The noble Lord, Lord King, asked whether we know the numbers. Have we lost control of our borders? I think we have. The UK Border Agency was not fit for purpose and has been disbanded. Can the Government tell us the number of illegal immigrants in this country? I will let the Government round it up to the nearest 100,000 but I bet that they could not even give a figure. They do not even know whether it is half a million or a million. The coalition Government have given a manifesto commitment to reintroduce exit controls and there is matter in the Bill to address this. However, the Government should bring in mandatory scanning of all passports when people leave this country—whether they are British, EU or non-EU—and scan them when they come in. The technology is there for us to know who has come in, who has left and who has stayed when they should not be staying. We could then control illegal immigration. Why are the Government not doing that? The e-Borders programme is a step towards that but we could get to that step right now.

As the noble Lord, Lord Dholakia, said, the Government are right to crack down on sham marriages, but they are wrong to bring in landlord controls and ask the landlords to do the job of the border authority. Even the Minister responsible for the Bill, Mark Harper, could not find out the status of his own cleaner when he had tried hard to do so. This is impractical and I fear that it will be another government U-turn.

The proposed NHS fees are unwelcoming. As a former foreign student in this country, I know how expensive it is to study here. The average international student will spend something in the region of £75,000 during a three-year degree programme. A PhD student coming in with a spouse and children could pay thousands of pounds in advance for this. These fees will seem like a penalty charge and could be a powerful disincentive. In a survey carried out by the National Union of Students, 74% of the non-EU students surveyed, who would be subject to the charge, said that an additional charge of £150 per year of study would make it more difficult or impossible for them to study in the UK. The Minister said that the figure is only 1%, but the perception, unfortunately, is the reality. More than 82% of those with dependants say that free access to the NHS was important in their choice to study in the UK. The current visa fees are really expensive in any case and the Government have just announced a 40% increase for some additional family members. Why do we need NHS charges? Most students are young and healthy and do not use the NHS much. The Government have been penny wise and pound foolish.

On the matter of the appeals process and the changes proposed in this Bill, Universities UK notes that more than 50% of appeals by students are successful. If these measures are brought in they will be deprived. In the House in 2007 I initiated a debate on the two-year post-study work visa. The noble Lord, Lord Adonis, was the Education Minister answering at the time. He listened, the Government responded, it was brought in and we saw international student numbers go up. Even the Business Secretary disagrees with government policy on this. Vince Cable has said that around £17 billion is generated each year by universities, £10 billion of which comes from overseas students through their fees and expenditure. At last year’s Liberal Democrat party conference he warned that a lot of students who would normally come to Britain would go instead to America and Australia where they thought a “warmer welcome” would be given to them.

If students here want to work after this expensive education it is important for them to be able to pay for it, gain work experience, pay some taxes, and build the generation-long links with this country and their countries—and on the whole they go back to them. Three generations of my family have studied in this country. Moosung Lee, a PhD candidate at the University of Minnesota, notes that 27% of world leaders have been educated in the United States. The Americans are streets ahead of us. We are missing out as a result of this and we need to start thinking long term. Shutting down the bogus colleges was good, but we do not need to create a perception that what was true for them is true for our good universities as well.

My recommendations are as follows. First, student figures should be removed from the immigration figures to send out a clear message that we do not include them in the Government’s madcap immigration cap target. Secondly, a system in which everyone’s passports will be scanned in and out of the country, at all ports of entry, should be introduced as soon as possible. Thirdly, the Government should bring back the post-study work visa. The mechanism at the moment is not fit for purpose. Can the Minister tell me how many graduates have taken up work after they have graduated under the new scheme that the Government have initiated? Fourthly, NHS charges for students should not be brought in. Students are spending huge amounts of money here already. A fee of £150 a year is a classic example of being penny wise and pound foolish. Fifthly, the Government should scrap the ridiculous and impractical idea of landlords having to make checks on foreign nationals and especially students. Landlords are not immigration officials. Finally, the Government should reform the appeals process that is already flawed. They should not be bringing in a system that will make it worse. Already 50% of appeals by students are successful.

As the noble Lord, Lord Dholakia, said, Britain is a most amazingly fair and just country. London is the most cosmopolitan city in the world. Recently, I led a debate to mark the 150th anniversary of the Zoroastrian Trust Funds of Europe to ask Her Majesty’s Government how they have recognised and supported the role and contribution of faith and minority communities in Britain during Her Majesty’s reign. All of us who spoke in that debate were able to give scores of examples of the amazing contribution that immigrants have given to this country. We would not be where we are without the contribution of immigration. On the other hand, we know that people abuse this country’s generosity and the Government must clamp down on those excesses. However, the Government now have a system that creates negative perceptions and unfortunately those perceptions have become reality. The Government must stop going down this path before it is too late and this wonderful country is permanently damaged.

My Lords, this is a draft amendment to the Immigration and Nationality (Fees) Order 2011. The order is an enabling power concerning charging for visa, immigration and nationality services. It enables the Home Office to specify applications, processes and services for which it intends to set a fee. Specific fee levels will be set out in separate legislation to be brought before this House shortly. For applications and services where we charge more than the administrative cost of delivery, the regulations are subject to the affirmative procedure. Noble Lords will have the opportunity to ask searching questions—and I am sure they will—about fee levels in that debate.

In accordance with our legal powers, this amendment to the Immigration and Nationality (Fees) Order 2011 sets out new applications and services for which we intend a fee to be paid in future, and clarifies the powers under which some existing fees are set. First, the order enables us to expand our premium services. These are optional services, offered to customers who want faster processing or more convenience. It will allow premium service fees to be charged for all applications where the Home Office is able to offer such a service. It will also allow us to charge for services offered at locations other than Home Office premium service centres—for example, at business or university premises.

It will also bring fees for certain Border Force premium services within the immigration charging framework. As a result, these services may be charged to generate additional revenue, rather like other optional premium services provided by the Home Office. For example, it will enable fees to be charged for the registered traveller scheme, in operation as a pilot since September 2013, which will speed up the processing of frequent travellers from low-risk countries.

The order will also enable new fees to be introduced for the process of conducting a review of a refusal decision for certain applications. Such reviews are likely to form an increasingly important part of our service as a result of changes to the current appeals process being proposed under the Immigration Bill 2014. The Bill will reduce the range of immigration decisions that attract a right of appeal. However, applicants will be able to request a review of a decision to refuse leave. The order will allow a fee to be charged to those who request such a review. The fee will be refunded if it is decided that the initial decision was incorrect. The order is not seeking to predetermine the outcome of the Bill in any way; that will be resolved in separate debates.

We also wish to take this opportunity to make clarifications to the current fees order. First, we want to clarify the basis on which fees are charged for residence and registration documentation issued to European Economic Area nationals and their families. We also want to make clear that fees charged by our commercial partners overseas are within the scope of the charging regime. We recognise the benefits that managed legal migration can bring to the United Kingdom and seek to ensure that the fees for visa, immigration and nationality services demonstrate that the UK retains its position as an attractive destination to work, study or visit.

As I have said, the order provides the enabling powers to set fees and we will return to Parliament in due course to debate further regulations, under the affirmative procedure, specifying the fee levels that rely on the powers in Section 51 of the Immigration, Asylum and Nationality Act 2006 and additional powers in the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004, as amended by Section 20 of the UK Borders Act 2007.

I believe noble Lords would want to ensure that the immigration system controls migration, commands public confidence, serves our economic interests and is paid for in a fair and sustainable manner. The order will ensure that we can continue to strike the right balance between the contribution made by taxpayers and by those who use and benefit most from the immigration and border services provided by the Home Office. My Lords, I know that we will be debating the Immigration Bill very shortly, but I should like to comment on this matter of fees and the premium services that are being offered—presumably to try to make it easier. Speaking as the founding chairman of the UK India Business Council, if there is one complaint about the United Kingdom and our relationship that I hear when I go back to India, as I do regularly, it is about visas. This is particularly true of students, and of the business community. We have serious problems in that the UK Border Agency, as it was, was not fit for purpose and has now been dismantled. Can the Minister confirm that the levying of fees is a caseworking function and falls within the remit of UK Visa and Immigration and not that of the UK Border Force?

Furthermore, it is quite clear when I come in and out of Heathrow in particular that it is very difficult; the queues are very long. We are not adequately resourced to cater for the passengers arriving in the UK. With this system, I presume that the Government are trying to make it easier for someone, by paying a premium fee first, to get a visa and then, once arrived, to get in quickly and escape the queues. Can the Minister confirm that? It is very off-putting, whether you are a tourist or a business traveller, to be confronted by those queues at Heathrow.

Quite apart from this, the Government—as I have said before—should surely be thinking about joining Schengen, which is much better value for money. It would encourage many more visitors to come. This government measure is a step in the right direction but it is completely avoidable if we join Schengen. That would hugely enhance the number of tourists and increase the number of business visitors. It would be much better value for money.

Next, from the point of view of students from abroad, Britain is a very expensive country to study in. They want to study in Britain—our higher education, along with that of the United States, is the best in the world—but both the fees and the cost of living in the UK are high. This has not helped countries such as India, for example, where the exchange rate has deteriorated rapidly and the rupee is now much weaker, making it even more expensive for Indian students. Having to pay an even higher fee for a premium service makes it that much more expensive for them to come to this country. The number of Indian students has dropped by 25%. Our economy desperately needs the income from foreign students—what they spend on fees and what they spend while they are here—which is estimated at possibly £14 billion a year. This is quite apart from the generation-long links that are built.

Moreover, while we are focusing on the fees, the Government are completely ignoring—again, we will address this in the Immigration Bill—the introduction of exit checks when people leave the country. It is very simple, with today’s technology, to scan every passport as people leave the country, whether they are EU or non-EU. Then we would know who has left the country and who has come into the country, which would also help to address the huge problem with illegal immigrants.

My Lords, I am grateful to the Minister for his explanation, which certainly addressed a couple of the points I wanted to ask him. I found it extremely helpful. I appreciate that this is not the order that sets the level of fees, which will come before us again. However, there are a number of questions on this.

First, I entirely agree with the point made in paragraph 7.1 of the Explanatory Memorandum, which states:

“The Home Office believes that it is right that those who benefit directly from the border and immigration system should bear a higher share of the cost of running the system and therefore reduce the contribution made by the UK tax payer”.

Noble Lords will recall that I addressed that principle in the anti-social behaviour Bill on the issue of firearms licences. The Government did not agree with me in that case and the taxpayer is shouldering a huge burden of millions of pounds every year for firearms licences. Given that it establishes a principle here, I hope it will apply to other areas of government policy, such as those I have raised previously, when appropriate.

The new provisions here talk about the new services that can be provided at a cost. The Minister said something about this but it seems to me that there is still an area of flexibility. He talked about the new optional premium service and where it could be provided. Can he can say anything more about that, or am I wrong and there is no flexibility? However, from what is here and what he was saying, it is implied that there is some flexibility in the services that can be charged for. I am interested to see whether there is a definitive list of those services that are not being charged for now but would be charged for in the future. That would be a useful list to have.

I was looking at the debate yesterday in the other place and one of the areas that struck me, and is something that I have been looking at, was the consultation. I did not think there was a consultation on these proposals. It has closed but it has never been published. As a matter of principle, it is always helpful if information on consultations is published prior to the debates on the issue because presumably the consultation was to inform policy and this debate is to help form policy. I would have greatly appreciated having the responses, or a summary of them, and the details of that consultation prior to today’s debate. Given that the discussion on fees will continue, it would be helpful if the noble Lord could circulate, at least to those interested in today’s debate, or place in the Library, details of that consultation and the Government’s response to it. We will not oppose the order today or pray against it because of that, but I do not think it is a good principle.

As I understand it, part of the proposal is that what the Government call “commercial partners”—and most people call contractors—would be able to charge for services they provide, particularly visa applications. They would also be providing new services and new fees. I hope that, when we discuss fees at a later date, more information can be given to your Lordships’ House on the method of calculation if we are talking about three new variables: new services, new fees and contractors.

I am curious about what appears to be an extended role for contractors in visa applications. Can the noble Lord can say something more about what work contractors will be undertaking that the Home Office is currently undertaking? Will there be a transfer of responsibilities or of work? I am not clear exactly what the contractors will be doing under the terms of this order. Does the Minister know which contractors will be used? Will there be new contracts to bid for? Who are the contractors, if that information is available? What will the process be and what will the work be? How long will any contracts be given for? The key point is that presumably there has to be careful monitoring and high expectations of the standards to be reached by contractors. There have been issues with some big contracts, such as security for the Olympics, which the Minister and I and debated on the Floor of the House. Recently, we have seen security concerns raised over one of the private prisons and problems with electronic tagging. I think there are multimillion-pound paybacks from some companies that the Home Office has employed to undertake work on its behalf. If this is an extension of contractors, we need some very clear assurances on what the monitoring arrangements will be and how they will be enforced to ensure high standards, especially if new fees are coming in to pay for those services.

That sums up the standards that we expect in the work being done by contractors. We also want to know a little more about the fees and what services will be covered by them. I hope that the Minister can answer those questions. If he cannot, I shall be happy for him to write to me. I have asked for a fair bit of detail, particularly on the contractors. If he could give me an overview now and then write to me, I would be equally happy with that.

We have two principal contractors at the moment, VFS Global and CSC. These were retendered in 2013. From 2014, there will be two new contractors. VFS Global is reinstated but Teleperformance UK has been re-engaged. These were open-tender contracting arrangements. However, if the noble Baroness would like more information on them, I am prepared to write to her about the services they supply. I will make sure that that is done. I have some of the information here.

I thank the Minister for giving way. I wish to make two points. He said that the number of overseas students has increased. However, if I may correct him, according to the Times Higher Education Supplement of 16 January, the number of non-EU students at UK universities fell by 1% last year—the first such decline ever recorded. In the Government’s defence, the noble Baroness, Lady Smith, asked if there had been consultation. My understanding is that targeted consultation took place.
