To ask Her Majesty’s Government when they expect to announce the result of their reconsideration of the application of Mrs Kiran to join her husband in the United Kingdom as directed by Judge Ford of the First-Tier Tribunal in Birmingham on 5 January under Appeal Number OA/05588/2014.

It is not the policy of the Home Office to comment on the detail of individual applications. However I can confirm that the instructions of the court in this case are being implemented.

Question to the Home Office:

To ask Her Majesty’s Government why the Home Office presenting officer at the appeal of Mrs Kiran in the Birmingham First-Tier Tribunal hearing before Judge Ford on 5 January, Appeal Number OA/05588/2014, was unable to access a copy of the entry clearance officer's bundle; and why those documents had not been served on the Tribunal or the Appellant.

The appeal bundle was sent via diplomatic bag by the British High Commission at Islamabad on 16 December 2014; however it was not available to the court in time for the hearing on 5 January 2015. The delay in sending the bundle was due to the need to consider representations from Mrs Kiran, made to the British High Commission, after the initial decision to refuse Mrs Kiran’s application.

Question to the Home Office:

To ask Her Majesty’s Government, further to the Written Answer by Lord Taylor of Holbeach on 9 April (WA 302–3), on what specific date in July 2014 they will make an application to the Lord Chancellor’s Advisory Council to allow the file held on Hilda Murrell to be transferred to the National Archives; and at what location the file is held in the meantime.

I refer the noble Lord to the reply I gave on 9 April 2014, Official Report, columns WA 302-3. Following the cancellation of the July Lord Chancellor's Advisory Council, the one file referred to will be considered in September. Since my previous answer, a further six relevant files have been identified. Of these further files, five were submitted to TNA on 9 May 2014 for agreement of selection for permanent preservation in The National Archives. This series will be the subject of the Lord Chancellor's Committee on 13 November. The remaining file is from 1993 and is not due for review until 2017.
