Yes, take control of our laws. [Laughter.] That is what we are arguing about today. I am explaining the extreme irony that this Parliament, which claims to believe in democracy, is deliberately trying to thwart our democracy by denying the result of the democratic decision that was made by the people, and that we said was theirs to make; and that this Parliament is trying to overturn the promises that many candidates—on the Labour side, in particular—made in the general election of 2017, and that they seem to have forgotten now that they are Members of Parliament.

I noticed the laughter from the Scots Nats at what my right hon. Friend said. In view of the very good sense that he was speaking, I invite the House to consider this. Is it not the case that under the withdrawal agreement, during the transition period, decisions will be taken by the Council of Ministers to impose obligations and laws on the United Kingdom without our even being there, without any transcript, without any Hansard and almost invariably by consensus? Is not the whole thing a massive racket, the object of which is to put us in a state of subjugation—

They certainly are, and there are also freehold properties. People who own property, as I have just described, are being put under the most intense anxiety, so I understand the reasons that lie behind the principle of new clause 2.

On new clause 4, I made my point in my intervention on the shadow Minister. I simply cannot understand it. Notwithstanding the intention that appears to be behind the first part the new clause—I am grateful to my hon. Friend the Member for Lichfield (Michael Fabricant) for backing me up on this—it is inconceivable that the report should only come into effect within 12 months of the Act receiving Royal Assent. It is nonsense. I ask the hon. Member for York Central (Rachael Maskell) to note that although I shall vote for the principle of an independent peer review, it will be on the strict understanding that that is without prejudice to my concern that the Act will need to be repealed.

I make this point now and may do so again on Third Reading: we are about to experience a new Government, effectively, with a new Prime Minister, depending on the outcome of the leadership election. The two contenders for the leadership have differing views on HS2: one is in favour and the other says that he wants to put it under review. Although rumours are like bats that fly in the night, the fact is that there are very strong feelings in favour of abandoning this entire project. We understand that it has already cost about £5 billion or £6 billion. That is enough money in itself, but to subject this country to unbelievable havoc as the project goes through constituencies such as mine, with all the attendant problems and anxieties that I have described, and to say, at the same time, that the proposal will go through and that the Labour party, by all accounts, will vote for it seems to be completely at variance with all the evidence and reports—I referred to them in the Westminster Hall debate and on many other occasions—which indicate that this is not a viable project. It was dreamt up by a Labour peer. I am never quite sure what the noble Lord Adonis’s allegiance is these days, but he was certainly a Labour member of the Government when this was proposed, and he deserves to be thoroughly condemned for it.

Did my hon. Friend notice that while Labour says that it wants a 12-month review of fairly fundamental things, it made it very clear that it does not want any material changes to the project that might delay it? I do not really see what the point of the review is.

The hon. Member for York Central is smiling as she looks across the Chamber—[Interruption.] She says that it is unbelievable, but it is anything but unbelievable—it is entirely true and entirely credible. My hon. Friend the Member for Lichfield backed me up on this. What is the point in having a first-class, independent review of the kind that is being advocated and saying that it will come into effect only after this has been made into the law of the land? [Interruption.] I see the Opposition Front Bencher, the hon. Member for Middlesbrough (Andy McDonald), chuntering, but perhaps he would like to come to the Dispatch Box and explain the nonsense that lies behind that reasoning.

My hon. Friend is completely right. That is part of the disgraceful way in which all of this has been done. The speed was certainly breathtaking. The suggestion that the deal had been agreed is itself a breathtaking statement; really, it was imposed on us by abject surrender.

The regulations that moved exit day to 31 October were rammed through at 3.15 pm on Thursday 11 April by the Minister and laid before the House at 4.15 pm on the same day. Let us remember that section 1 of the European Union (Withdrawal) Act 2018 is inextricably bound with exit day, with the repeal of the European Communities Act 1972 in lockstep. The section, says, quite clearly and expressly:

“The European Communities Act 1972 is repealed on exit day.”

Repeal of the 1972 Act is axiomatic to carrying through the democratic referendum vote that took place on 23 June 2016, because that Act is the constitutional and domestic legislative means by which the voters of the United Kingdom were shackled to all treaties and laws imposed on them, without exception—including rulings of the Court of Justice. Those laws are invariably passed behind closed doors by qualified majority vote of the Council of Ministers of the other 27 member states of the European Union

It is about who governs this country and how they do so—general election manifestos and freely exercised democratic votes of the British electorate are the basis of our parliamentary Government, established over centuries—and whether the wishes of the British electorate prevail.

Does my hon. Friend agree that, given the huge constitutional significance, the way in which the proposal stops us governing ourselves for longer, and the huge sums we will have to pay to the EU under the regulations, it is a disgrace that we did not have a proper debate on the Floor of the House?

Many people outside this House are losing confidence and trust in us and our proceedings. Tonight is another plunge in how they see us, because we are behaving collectively so badly. My right hon. and hon. Friends who have complained about the lack of time for debating both the Bill and the amendments are quite right. This is a serious constitutional matter. We have not been given time to construct proper amendments and there is no time in this brief hour to do justice to the complex issues raised by the Lords amendments. We had but a short debate on the original consideration of the Bill, when I was able to set out some of the constitutional difficulties involved in groups of MPs seizing the agenda and taking over money resolution and Crown prerogative matters, and we are not allowed proper time tonight to consider exactly how all that fits with this Bill.

What we do know, however, is that the very slim majority who have got the Bill this far through this House intend to go against the clearly expressed wishes of the British people in the referendum. All those who voted to leave, two years and nine months ago, had every reason to suppose that all Labour and Conservative Members elected on their 2017 manifestos would see through our exit in a timely way. They should also have expected that from the promises made by both the leave and the remain campaigns in the referendum, the legislation put through in granting that referendum, and the clear statement of the Government at the time, who said that we would implement the wishes of the British people. The Opposition did not dissent from that particular view when the Government put out their leaflet. Indeed, during the remain campaign many Labour MPs endorsed the Government. That is why tonight is another sad night. This Parliament is breaking its word, breaking its promises and letting down 17.4 million voters, but it is also letting down quite a lot of remain voters.

A lot of remain voters are good democrats who fully accept the verdict of the British people. Quite a lot of people in our country were only just remain voters or only just leave voters and are prepared to live with the judgment of the majority, and they now, too, are scandalised that this Parliament is insisting on a second needless delay when we have had two years and nine months to prepare for exit and when our Government assure us that they are fully prepared for exiting without signing the withdrawal agreement.

I find it very odd that Members of this House think that the withdrawal agreement is, in itself, Brexit or in any way helps Brexit because, of course, the withdrawal agreement is a massively long delay to our exit, with the added problem, which the Opposition have rightly identified, that it entails signing up to a solemn and binding international treaty to undermine our bargaining position in the second part of the negotiations envisaged by the EU’s process.

My right hon. Friend is making an extremely good speech. Is he aware that, as I have been informed today, the withdrawal agreement and implementation Bill, which is supposed to put this appalling withdrawal agreement into domestic law, is around 120 pages long? That is what we are heading for in the next couple of weeks.

My hon. Friend is right. The nature of that solemn and binding treaty will be to lock us in, for 21 or 45 months, to every feature of the European Union without representation, vote or voice, and it might mean that we end up in large sections of it—the customs union and single market alignment—in perpetuity, thanks to the Irish backstop.

It is a massive delay, and I say to my hon. and right hon. Friends on the Front Bench that, if they are offering the public either a guaranteed delay under the withdrawal agreement or a shorter delay that they wish to negotiate, a lot of leave voters would rather have the shorter delay but, of course, all of us leave voters do not want any delay at all. That is why people will be scandalised by what this House is rushing through again this evening.

The shortage of time is completely scandalous. This is a massive issue that has gripped the nation for many months. It dominates the news media, it sucks the life out of this House on every other issue and now, when we come to this big crunch event and when leave had been led to believe that we would be leaving the European Union without an agreement if necessary, they are told at the last minute, for the second time, that all their hopes for their democratic outcome will be dashed again. This Parliament does that with grave danger to its reputation.

I urge all those who wish to get this lightning legislation through again to ask themselves what they are going to say to all their leave voters, and what they are going to say to their remain voters who are also democrats and who join leave voters in saying, “Get on with it. Get it over with. Why do we have to sit through month after month of the same people making the same points that they put to a referendum and lost?”

This Parliament needs to wake up and get real. It needs to move on, it needs to rise to the nation’s requirements and deal with the nation’s other business, and it needs to accept that this was decided by the public. It is our duty to implement it. Leaving without this agreement is going to be just fine. We are prepared for it. Business is ready for it. Business has spent money. Business has done whatever it needed to do and, in many cases, feels very let down that it is not able to use all its contingencies, on which it has spent good money.

I would say this to all Labour MPs, particularly those with a majority of leave voters in their constituency: understand the damage you are doing, understand the damage you are doing to this institution, understand the damage you are doing to our democracy and vote for us to leave the European Union.

The second big issue that is relevant to this business of the House motion is that, traditionally, only a Minister may move a money resolution in support of legislation that requires the expenditure of public funds. Again, there is very good reason for this, because the Government have to be responsible for the Budget, and they normally understand that, if they want to spend more, they have to raise more through taxes or borrowing. The Government are responsible for both sides of the account.

Again, the House can criticise, refuse to agree or try to get the Government to shift their position, but it is the Government who are financially responsible to the markets and for all the other reporting that has to be done. This proposal could have very significant financial consequences indeed, because staying in the European Union is an extremely expensive thing to do, and I think it would need a money resolution, which should be moved by a Minister of the Crown.

I intend to raise a point of order on this question but, as my right hon. Friend is the first person to mention it, he may be interested to know that I have already prepared a comprehensive note on the question of a money resolution. It would cost UK taxpayers some £36 billion if our contributions are extended for up to two years, which is a vast sum of money. I have written a paper for Mr Speaker and others explaining why I believe a money resolution is required, and at least 50 Members have backed my letter to Mr Speaker on this question. That will come up later.

I am grateful to my hon. Friend for that. Again, it is important to have it on the record in this debate for the House’s consideration that we are dealing with things that could have precedents with wide ramifications that go way beyond the next few days and whether we leave in accordance with the views of the British people or not.

The final of my three points is perhaps even more relevant to this particular proposal: it is tradition that the Government have vested in them Crown prerogative, and the Prime Minister and Ministers act on behalf of the Crown in all international negotiations. That is not just our view, important though that is, in this House of Commons; while we still remain subject to the superior law of Brussels, it is also the law of Brussels. The Brussels authorities—the European Union—do not wish to negotiate with groups of MPs. They wish to negotiate with the UK Government, because it is the UK Government who are the signatory to the treaty and the UK Government who have sought the agreement of the EU to our withdrawal—or indeed to our automatic withdrawal under article 50 should no agreement be reached.

It worries me, but I am a freedom-loving young man and I think that people will do what they want to do; I do not want to stop MPs expressing their views and going to talk to people with whom we are trying to negotiate. I also have a right to a view on it and I agree with the hon. Lady that if those MPs went there with the express intention of delaying or sabotaging Brexit—if they went there to weaken the pretty feeble position the Government had already adopted in the negotiations in order to make it more difficult for us to get any kind of agreement that I could agree to—that is a matter of grave regret. That will be judged by the British people in subsequent elections. It is not for me to make the misery of those MPs greater; they will need to answer to their constituents about that.

When I was talking about the money resolution, I ought to have mentioned that it is not just me who has made these submissions; I understand that a Minister has also made representations. I just want to confirm, on the record, that it is not just Back Benchers doing this, but the Government, because a Minister has told me that he has raised them.

I am pleased the Government have made that representation, as it adds force to the case I was making.

On this Crown prerogative point, the EU position and the internationally agreed position is that only the Government can formally represent and negotiate on behalf of the UK. So one of my problems, which I raised directly with my right hon. Friend the Member for West Dorset (Sir Oliver Letwin), is how far can this House go in instructing and controlling the negotiation? He gave me a sensible answer, saying that the House was not going to try to say that there had to be a delay, because he fully understood my point that that is ultimately in the EU’s gift. As I pointed out, it is in this House’s gift to insist on a Minister seeking a delay. He rightly added that it is in this House’s gift to decide whether to accept any delay should the EU grant it, but the central point is that, assuming this House wanted a delay, most of the power rests with the EU. As we saw the last time a needless delay was sought and granted, quite a long delay—to 30 June—was requested, but the effective delay turned out to be only until 12 April.

The point I am making is that we do not want to take time debating something that misleads people. A lot of people outside this House think that today we are debating a Bill that will require and achieve a delay, whereas it cannot possibly guarantee to do that. People must also understand that even if this House reaches an agreement with my right hon. Friend the Prime Minister, she may not end up with anything like that which the House was seeking.

The hon. Member for Bath (Wera Hobhouse), who has disappeared, said that she had discovered that we could do anything. I have to disabuse her of that notion in two ways. First, even this House and all Members of Parliament—sometimes the public do not understand this—have to obey the law. Our advantage is that we can change the law if enough of us wish to do so.

Secondly, the hon. Lady also has to understand that great though this House can be once we are out of the European Union, and powerful though it is even still within the European Union, there are a lot of things for which it cannot sensibly legislate. Let us suppose that all working people would like it to rain on Mondays and Tuesdays, and be sunny on Saturdays and Sundays. That would be very convenient and an extremely popular law to pass, but there is no point in passing such a law, because even this House does not control the weather. I feel the same about the European Union.

There is absolutely no point in this House legislating for how the EU should respond, what its conduct should be or what laws it should pass—although they are a matter of great interest to me and many others—because we have absolutely no power over it. Indeed, that was at heart of the referendum campaign. What the SNP never accepts when it uses our phrase, “take back control”, is that the control that we wish to take back is all those mighty powers granted to the European Union, which the SNP is relaxed about. As soon as the Executive here wants any power to behave as a normal Government, however, the SNP says that that is unacceptable and Parliament needs to take it back.

I hope that the House will consider the business motion carefully, that more will come to my view—this is too little time to discuss such fundamental issues—and that they will agree with me that the big issues are to do with our future procedures and with the balance between the Executive and Parliament. I am one who often criticises the Executive, but I do not want to go too far this afternoon so that all government is in effect impossible. They must retain control of the agenda and of the money.

I heard the Prime Minister repeatedly mention our precious Union. The Northern Ireland backstop drives a coach and horses through the precious Union––that is the problem. As I understand it, that is precisely why the Democratic Unionist party will vote against the withdrawal agreement today—because it puts the Union at risk.

Is it my hon. Friend’s view that we are not being shown today the Bill to implement the withdrawal agreement because it would reveal that we have to remove the repeal of the 1972 Act, or reintroduce all the European Union powers, proving that this is not leaving the European Union?

That is exactly the point. I see the Solicitor General chuntering a little. He is a good friend of mine, but I have to say that he knows this is a serious point––the Attorney General referred to private conversations I have had, and I will now refer to one that I had with both him and the Solicitor General—and he acknowledges that it would need to be sorted out, because there is a serious worry.

What happened can be very simply stated. On 26 June last year, we passed the European Union (Withdrawal) Act 2018, section 1 of which states that the European Communities Act 1972 is to be repealed on exit day. Exit day operates in lockstep with whatever exit day turns out to be. However, the reality is that, because of the saving provisions, and under article 4, on the capacity of the Court to disapply enactments, it is just conceivable—indeed, it is highly possible—that issues of interpretation could arise.

We need to discuss this properly, but we cannot do so until we see the implementation Bill. I know that the Solicitor General agrees. In fact, some Secretaries of State—I will not disclose which—have told me that they think we should see a copy of the Bill, because until we see the drafting, we will be unable to judge its impact on the repeal of the 1972 Act, which itself is the anchor of the referendum. I repeat the point that the referendum was itself endorsed by a sovereign Act of this Parliament that transferred the decision to the British people, and the British people make that decision, in line with the wishes of the electorate.

The two previous motions, one in the name of my hon. Friend the Member for Altrincham and Sale West (Sir Graham Brady) and the other in the name of my right hon. Friend the Member for Meriden (Dame Caroline Spelman), are both incorporated in the Government motion.

With respect to the first motion, there has been no realistic suggestion for a credible replacement to the backstop since the motion was passed and the EU is still saying it will not renegotiate. There is no withdrawal agreement simply because it has not been signed. In that context, the Brady motion was meaningless. Furthermore, as I said to the Prime Minister on Tuesday, article 4 of the current draft withdrawal agreement undermines control over our own laws. That will create uncompetitive havoc for businesses, and for trade unionists and for workers, as the laws are passed by the other 27 member states, as they go through the Council of Ministers, and we will not even be there. The measure also contradicts the repeal of section 1 of the European Union (Withdrawal) Act 2018 and the repeal of the European Communities Act 1972.

Does my hon. Friend agree that, were we to make the mistake of saying that we rule out leaving without signing the withdrawal agreement, we would take away the Government’s main bargaining card for getting improvements to the agreement?

On the amendment tabled by my right hon. Friend the Member for Meriden, in reply to my question on Tuesday, which the Prime Minister agreed with, the Prime Minister said that Members from across the House voted to trigger article 50, which had a two-year timeline, ending on 29 March, and that every Conservative Member had voted for the withdrawal Act. She was right. However, the amendment tabled by my right hon. Friend the Member for Meriden passed only because it was supported by Members from all parties who had already voted for the withdrawal Act, the European Union (Notification of Withdrawal) Act 2017 and the European Union Referendum Act 2015, and were in effect, on the Prime Minister’s own analysis, undermining their previous votes. Furthermore, we were whipped against the amendment tabled by my right hon. Friend the Member for Meriden.

There was no consultation prior to the tabling of the Government motion now before the House. In any case, the Government’s position that a so-called no deal remains on the table is clear, as the Secretary of State confirmed. The motion makes no sense, so why are we faced with it today? We are told that it is to keep traction with the EU, which has been, as I said to the Prime Minister on Tuesday, both undemocratic and totally intransigent. As I have said, the withdrawal agreement itself is inconsistent with the European Communities Act 1972. It is therefore also inconsistent with the referendum itself and our manifesto. The 2018 Act includes the repudiation in UK law of all EU laws and treaties, and article 4 of the withdrawal agreement is completely inconsistent with that. A vast number of voters see through this charade—they see through the smoke and mirrors—and in particular so too does the Conservative party membership—a recent “ConservativeHome” poll showed that 70% of them are against the withdrawal agreement.

The real problem goes back to what I said at the time of the first vote on the withdrawal agreement and my observations about the failure of public trust in respect of the Chequers deal and this withdrawal agreement. Those words stand as much today as they did when I spoke on 15 January. Today’s motion further undermines public trust. We are now truly entering the world of George Orwell’s Ministry of Truth. In his book “1984” Orwell wrote:

“Doublethink means the power of holding two contradictory beliefs in one’s mind simultaneously, and accepting both of them.”

This double motion is doublethink in action, and I cannot possibly vote for it.

I have made the point today—I have made it in previous debates—that it would not be satisfactory at all to accept the Chequers proposals. I shall explain why in relation to the particular arrangements under the White Paper.

First, while the White Paper contemplates saving the European Communities Act 1972 only during the implementation period, there are some very specific instances in which EU law will continue beyond the implementation period. The Government have already conceded in principle that some specific European Court jurisdiction will continue after the end of the implementation period, and that, of course, includes citizens’ rights. The withdrawal agreement, however, also includes other areas for which that would be the case, such as in relation to pending cases in which the facts arose before the end of the implementation period. Furthermore, continuing participation in EU agencies could entail automatic acceptance of the European Court’s decisions.

The Government say that they are going to save the European Communities Act in part. That is all very well but, as I said in my presentation of the arguments last Wednesday during the European Scrutiny Committee’s proceedings with Mr Olly Robbins and the Secretary of State, the reality is that within a mere 14 days of the European Union (Withdrawal) Act 2018 receiving Royal Assent, a White Paper was introduced on saving parts of the 1972 Act even beyond the implementation period in circumstances that I find not just weird but thoroughly unacceptable.

Paragraph 89 in chapter 1 of the future partnership White Paper says:

“The UK will seek reciprocal arrangements on the future rules around some defined elements of social security coordination.”

Does my hon. Friend share my fear that that may also involve jurisdiction over our banking system?

That is part of the same problem. I am afraid that there are some really very difficult questions that Ministers and the Government have to answer. I put all this to the Prime Minister immediately after 6 July, when the Chequers proposals came through. I questioned whether we could in fact reconcile the Chequers proposals with the European Communities Act 1972, and the reality is that we cannot. We may then say that we have an agreed implementation period to give certainty to businesses. However, as I pointed out in an intervention, it does not create certainty for business on product standards, for example, because anyone who knows anything about the workings of the European scrutiny system knows that decisions are quite often taken by officials in such things as working groups and then are effectively rubberstamped by Ministers. Furthermore, under the existing arrangements, decisions are taken behind closed doors without any transcripts of the proceedings.

Businesses need to wake up to this. They are told that they will have greater certainty, but do they really know and understand anything about how the system functions in practice? In practice, decisions are taken by consensus, because everybody knows what the outcome will be before they even walk in the room, but we will not even be there in relation to the common rulebook, so how can the Government provide business with certainty when they do not know what changes might be made to that rulebook? Moreover, people in business will have absolutely no idea why changes are being imposed on them because there is no transcript of proceedings.

Furthermore, a problem exists in relation to the scrutiny that will take place, because the so-called provisions of the joint committee represent no more than consultation. There will be no right for us to refuse to do something—I will come to the parliamentary lock in a moment—as the reality is that consultation means no more than saying, “We will listen to what you say,” but it does not mean that anyone will act. Anyone who is foolish enough to believe the European Union, given its background, its bullying tactics and the way in which it has operated over the past months and even before, needs to realise that the decisions will be taken by the other member states and that we will effectively have no real control over them whatsoever. That is a really serious problem.

Is not it also the case that, far from ending business uncertainty, the Chequers proposals create another 21 months of perpetual renegotiation, thereby maximising uncertainty?

That is completely true. I am very concerned about the suggestion that the Chequers proposals somehow or other end up creating more certainty—it is just not the case.

From conversations, watching opinion polls and listening to the national conversation. I do not know about the hon. Lady, but I take my politics seriously and I regard it as my job to listen, to read, to understand and to consult colleagues. I find that coming into the Chamber is quite a good way of judging the mood because sometimes Members of Parliament, even those on the Labour Benches, know the mood in their constituencies.

Will my right hon. Friend remind the hon. Lady and the House that a pamphlet was put out by the Government during the referendum campaign that explicitly said, “This decision will be yours”? There was no question of its being decided by Members of Parliament. We operate by a system of parliamentary government, not government by Parliament.

Indeed, but let us press on.

My worry is about the Chequers proposal—and it is only a proposal; it is not a deal or an agreement—which was set out in the future relationship White Paper, and the consequent White Paper about how such an agreement, were one to arise, would be handled and implemented by this Parliament. My worry, and I think it is the worry of many leave voters and some remain voters, is that, having voted to get rid of treaty law—to dismiss the European Union treaty because we had not enjoyed living under its tentacles—the Government now suggest we need another two European treaties to replace the one that we are getting rid of. We are mightily suspicious of treaty law. Why are we so suspicious of it? Because the original treaty, the treaty of Rome, masqueraded as a free trade agreement, which is how it was sold to the British people in the long-distant 1975 referendum, but by accretion and development, over which the British people had no control, it changed—through Nice, Amsterdam, Maastricht and Lisbon—into a massive panoply of laws and controls and completely changed our constitutional structure, without the people ever having a proper vote on that process until the most recent referendum.

We know from our experience here that this became what I call a puppet Parliament. In dozens and dozens of crucial areas where we might like to legislate, we had no power to legislate independently of the European Union whatsoever. In all those massive areas—not just trade and business, but the environment, social policy, employment policy and even foreign affairs—we had to legislate in the way the European Union laid down. Quite often, many Members of Parliament and many members of the public disagreed with that way. Quite often, it was an area where the Government had either lost a vote or did not bother to hold one because they knew they were going to lose as they were in disagreement with other member states. It was that above all else that the British public rejected in the historic vote in 2016. They said to Members of Parliament, “Collectively, you often make a mess, we don’t always approve of you and we are very critical of you, but you are our MPs” and the joy the public have is that they can fire us if we really annoy them or we get it wrong, whereas the European Union often strongly annoys them and gets it wrong and there is absolutely no one they can, directly or indirectly, have fired because it is a system that the UK cannot control and has to receive. We are, therefore, very suspicious of the idea of more treaty law.

One of the things that makes this debate very difficult for a neutral observer to come to a sensible view on is the abuse of language and the scare stories that seem to characterise most of what passes for debate on these important issues. I do not for one moment believe that there is a cliff edge and I do not for one moment believe that we would leave the European Union with no agreements. There will be lots of agreements. We have always had lots of agreements: there are lots of business-to-business agreements, business-to-individuals agreements, business-to-Government agreements and even Government-to-Government agreements. Once we have left the European Union properly, I am sure that there will be a lot of diplomacy, discussion and joint action, but we want it to be bilateral and based on the merits of the case as we proceed each time. We do not wish it to be multilateral through the EU, where the EU has special legal powers that mean that it has duress over us or can prevent us from having a weighted dialogue with the EU and reaching an agreement if we wish and not if we do not.

The structure of what the Government are now proposing is quite alarming. The EU withdrawal agreement would take the form of an international treaty, which would of course need full ratification by Parliament in the way that has been laid out. However, if it was agreed with the EU and then subsequently ratified by this Parliament, we would be back in the position where European law had more significance and for the whole of the transition period we would of course be completely back under the control of the European Union. As my hon. Friend the Member for Stone (Sir William Cash) has pointed out, we would be even more vulnerable than we are today because the EU could legislate in our absence. At least we can see them annoying us at the moment around the same table, whereas we would be in the position where they could simply do it without consulting us or taking into account our views.

Therefore, that is not a good idea, but even worse is the proposed legal form of the so-called future partnership agreement. The UK Government call it a partnership agreement, but I think what the EU proposes, and would call it, is an EU association agreement. Such agreements are normally very comprehensive, and we can see exactly what they look like when we read the one for Turkey or for Ukraine. They have been designed by the EU to lock in countries that would like to become members but are not yet fully compliant with all its legal requirements, standards and so forth. They are used to drag those countries gradually into compliance—usually willingly, because they want to join.

We want something completely different. We want agreements on how to proceed in various areas, but we are going in the other direction. We do not want an agreement that drags us into closer compliance; we want the freedom and flexibility to have our own trade policy, our own fishing policy and our own business policy as time evolves. I am very worried that an association agreement model, rather than allowing that, would reintroduce the powers of the European Court, over which we will obviously have no control, and we would again be under strict control in a number of wide-ranging areas from which the British people wish us to liberate themselves.

No, that is not true. In their devolved areas, they have genuine power, which they exercise in accordance with their electors’ wishes, but of course this is the sovereign United Kingdom Parliament, and the devolved powers come from the sovereign Parliament, as the hon. Gentleman well understands, which is presumably why he likes being here.

Will my right hon. Friend also bear in mind the manner in which laws are made in Europe? They are made behind closed doors in the Council of Ministers with no proper record of who votes, how and why—we are outvoted more than any other country—and then those laws come here and are imposed upon us in this Parliament.

I quite agree.

We wish to take back control. We will be a very different and much better country when this Parliament can settle how much tax we levy, how we levy it, how we spend money, how we conduct ourselves and what kind of laws we have.

My main remarks for the Minister and his colleagues on the Treasury Bench, however, concern the conduct of the negotiations. Like the Minister, I wish the Government every success. I hope that they get a really good deal—I look forward to seeing where they get to—but the EU is trying to make the process as difficult as possible by insisting on conducting the negotiations in reverse order. It says first that we have to agree to pay it a whole load of money that we do not owe. It then says that we have to agree a long transition period that coincides with its further budget periods, so that it can carry on levying all that money, and that is before we get on to what really matters: the future relationship and the questions of whether there be a comprehensive free trade agreement, what it will cover, and if it will be better than just leaving under WTO terms.

In order to have a successful negotiating position, the Government have rightly sketched out a couple of important propositions. The first is that nothing is agreed until everything is agreed. That is fundamental, and I urge Ministers to understand that they must not sign any withdrawal agreement unless and until there is a comprehensive agreement that is credible and that can be legally upstanding, because there is no point paying money for nothing. There would only be any point in giving the EU all that money if there was a comprehensive agreement that the Government and the country at large could be proud of, and which enough leave voters could agree with as well as remain voters.

The second thing that the Government have rightly said is that no deal is better than a bad deal. That, again, is fundamental to the negotiations. I have never made any bones about this, because I said before the referendum that no deal was quite a likely outcome, and a fine outcome. For me, no deal is a lot better than staying in the EU: it would give us complete control over our money, meaning we could start spending it on our priorities; it would give us complete control over our laws, meaning we could pass the laws and levy the taxes that we wanted; it would give us complete control over our borders, meaning we could have the migration policy of our choosing; and it would give us the complete right and freedom to negotiate a trade policy with the EU and anybody else. That would depend, of course, on the good will of the other side as well, but I would far rather be in that position than part of a customs union in which I had little influence and that was extremely restrictive against others. There is therefore an awful lot going for no deal.

The Minister and his colleagues must stick to the proposition that they will recommend a deal to the House only if it is manifestly better than no deal. They need to keep reminding the EU negotiators that no deal offers Britain most of what it wanted when it voted to take back control.

The answer to the hon. Gentleman’s question is that no two democracies have ever gone to war with one another. I declare a personal interest in this issue because my father was killed in Normandy, fighting for this country, and I am proud that he got the Military Cross for that reason. This is something that many people in this country really understand and believe. It is not easy to explain, but it is to do with the fact that people understand the real reasons that self-government is so important.

The proposal in the European Communities Act 1972, which we are now repealing, was the greatest power grab since Oliver Cromwell. It was done in 1972 with good intentions. I voted yes in 1975 and I did it for the reason the hon. Gentleman mentions: I believed it would create stability in Europe. The problem is that it has done exactly the opposite. Look, throughout the countries of the European Union, at the grassroots movements and the rise of the far right, which I deeply abhor and have opposed ever since I set about the Maastricht rebellion in 1990. I set out then why I was so opposed to the Maastricht treaty: it was creating European Government and making this country ever more subservient to the rulemaking of the European Union. As I said in response to my right hon. and learned Friend the Member for Rushcliffe (Mr Clarke), that has been conducted behind closed doors. We have been shackled by European laws. He asked at one point if we could give one example. The ports regulation is a very good example. We fought that in the European Scrutiny Committee and in the House of Commons, but we were not allowed to make any difference to it. It was opposed by the Government, it was opposed by the Opposition, it was opposed by all the port employers and it was opposed by the trade unions. What could we do about it? Absolutely nothing!

Does my hon. Friend agree that once Parliament has passed the repeal of the 1972 Act, Ministers will only be able to do things that this Parliament permits them to do? Today, Ministers have to do many things that the European Union insists on, which this Parliament cannot discuss or overturn.

There are at least 12,000 regulations, every one of which would have required a whole Act of Parliament, with amendments and stages in both Houses. A transcript would have been available. People would have known who voted which way and why, and known the outcome of what was a democratic process. Instead, as I said to my right hon. and learned Friend the Member for Rushcliffe—even he conceded that I was right on this—the process is conducted, over bibulous lunches and in the Council of Ministers, in a manner completely lacking in democratic legitimacy, yet, because of consensus arrangements behind closed doors, it becomes part of our law through section 2 of the 1972 Act. It is imposed on us by our voluntary consent. It is therefore up to us and the people of this country to decide, by their voluntary consent and their freedom of choice, to get out of this, just as it was brought in by an Act of Parliament, without a referendum, in 1972.
