What I am saying is that voting in this House is a test of our democracy. We have already had ample opportunity to consider the ramifications of the block opt-out and we now know the 35 matters in question. Given the importance of those issues to UK citizens, those who represent their individual constituencies in this House should now have the opportunity to vote on them. That is a matter of principle and it is also a matter of democracy. Once the decisions become irrevocable, the reality is that they will be binding, through the European Communities Act 1972, in a way that would not be the case if this were a general debate about home affairs policy. This debate is tied to the role of the European Court of Justice, against which there is no appeal.

Why have the Government set their face against an open, transparent and informed debate and vote on these measures before negotiations are concluded? In the absence of any convincing explanation from the Government—I say with great respect to the Secretaries of State that we have not had one—we are compelled to conclude that the risk of unravelling a carefully crafted coalition deal weighs more heavily than the desire for democratic accountability. Such an approach is inimical to this House’s European scrutiny system, which is based on our Standing Orders and on early analysis and assessment of the legal and policy implications of EU policies and legislation so that Parliament has a genuine opportunity to influence not only the Government’s position in negotiations, but their outcome as well.

In this case, however, the position is reversed. As I said in an intervention, Parliament will simply be asked to rubber stamp the outcome of negotiations that are being held behind closed doors and hidden from the searching gaze of the public and Parliament. Negotiations are being held behind closed doors not only by the Council of Ministers and the European institutions, but by the coalition itself. We do not know the basis on which these decisions have been reached. It is a double whammy.

The hon. Gentleman needs to forget about the Liberals, because there is a big elephant sitting in the room and its name is Nigel. Does the hon. Gentleman think that growing support for the UK Independence party has been a factor in the way in which this process has evolved?

I do not think so. The driving force behind the arguments being made by the Conservative part of the coalition from the Back Benches is based on objective analysis in the interests of democracy, transparency and accountability in Parliament. Mr Farage cannot deliver anything, because he does not have one Member of Parliament. He cannot change one word of legislation—he can do nothing about any of this. I know that the situation is uncomfortable for the Secretaries of State at this moment in time, but I know for a fact that they will agree emphatically that the United Kingdom Independence party can achieve absolutely nothing. They know perfectly well that Conservative Back Benchers can achieve something. As in relation to many other European matters, Conservative Back Benchers can, by doing what we are doing now—working towards, we hope, a listening Government and listening Secretaries of State—achieve the results that we need, in the interests of the country as a whole. I hope that that answers the hon. Gentleman’s very useful question.

Sometimes, I do not know why we bother. We all turn up for these debates. All those who take an interest in home affairs and issues such as human rights are here, and you are here in your finery, Mr Deputy Speaker. We have heard a very confused speech from the Conservative Secretary of State and we have heard from Labour Members, ever compliant on human rights and home affairs. We have not heard from the Liberals; I do not know whether we will, but I would be interested to hear what they have to say. We are all here, but we are all more or less wasting our time. Why not just get on with it and get The Daily Telegraph, along with the Daily Mail, to conduct our immigration policy? That is what we are getting, with immigration rules that are practically out of The Daily Telegraph’s leader column.

What an absolute farce this afternoon has been. What on earth are we debating? I do not have a clue. We have had three different explanations from the Government about what we are being asked to consider. We are asked to consider that article 8 is a qualified right. Yes, that is a restatement of the bleeding obvious, as I said earlier, and we all know that. We are then asked to support the Government’s immigration rules. Does that mean the immigration rules in their totality, as the Home Secretary said when I intervened, or part of them? Or are we just giving a direction to the judges? I have absolutely no clue whatsoever what we are being asked to consider this evening. It is a total waste of time and a farce. As the hon. Member for Hayes and Harlington (John McDonnell) says, we need a proper process to consider this very important subject—and it is important.

The motion simply reads

“those contained in the Immigration Rules.”

It does not state which immigration rules. Indeed, they might change, as we expect that they will, from those proposed on 13 June.

I do not know whether the hon. Gentleman is being helpful, but that seems to be another interpretation. When he sums up, the Minister for Immigration must tell us exactly what we are voting on this evening, because I do not know. I cannot support the immigration rules in their totality, so if the Government are saying that we have to accept them tonight, I unfortunately cannot support them and will press the matter to a Division. We cannot accept the rules as they stand. This is a very important debate condensed to four hours and a lot of nonsense.

I feel strongly that the case that the hon. Gentleman puts is entirely justified. It is incredibly important to remember that according to “Erskine May”, the first duty of the Speaker is to protect minorities. That is absolutely fundamental. There is no reason whatever that I can think of why any Member from a minority party, be they an independent, or a member of Plaid Cymru, the Scottish National party, or the Democratic Unionist party, should ever be excluded from full participation in the House.

I am grateful for the hon. Gentleman’s intervention. He is right. As I said to the hon. Member for Chichester (Mr Tyrie), minorities should be respected. If anything, we should be over-represented to ensure that differing voices are heard. What is wrong with hearing diverse voices in this House? What are people afraid of? Of course we should be on Select Committees and should be part of them. The Government should be listening to this, because our party is not just a minority party, but the party of government in Scotland. Our party is in a minority Government in Scotland, and the party of my hon. Friend the Member for Dwyfor Meirionnydd is in a coalition Government in Wales. Why do the Government not want to hear those diverse voices in all the workings of this House?

I will tell the House how bad things were. It was not just that we did not have a place on the Scottish Affairs Committee and the Welsh Affairs Committee; when we turned up at the House for our customary little chit-chat with the usual channels, we were told that there were no places for us on any Select Committees, because that is what the Wright proposals suggested. Before the hon. Member for Nottingham North (Mr Allen) gets on his high horse, let me say that that was how the usual channels interpreted the Wright proposals—no places for us on Select Committees, and effective exclusion from scrutiny of Government Departments. That is what was offered to us.

Sometimes, it is from minorities that major parties develop. That has to do with what is called freedom of speech. When people hear the minority view, they have the opportunity to get that view across to the public. To be excluded is a complete derogation from freedom of speech.

I am pleased that I gave way again to the hon. Gentleman, because he is spot on. That is what the issue is about. I hope that the House hears tonight that we have a meaningful contribution to make. My modest little amendment (e) is an attempt to address the issue. It aims to make sure that the minority voice is heard, as the hon. Gentleman says. It is about saying, “Let’s see what we can do to get the smaller parties of the House involved and on board.”

As I have said, there is no way that we would ever be considered for a place on the Back-Bench business committee; that is just not going to happen, and I hope that that will be conceded. We do not yet know how its members will be determined. I know that it will be through an election, but there will be some sort of mechanism or procedure to ensure that Labour, Liberal and Conservative Members are on it. That is 100% certain; I bet you any money, Madam Deputy Speaker, that there will be one Member from each of those three parties on the Committee. It is also almost entirely certain—again, I bet you any money—that there will be no Member from the minority parties on it. We have to change that; we have to ensure that that does not come to pass.

My amendment suggests that we increase the number of members of the Back-Bench business committee from eight to 16. Why 16, you ask, Madam Deputy Speaker? It is because that always seems to be the magic number at which we start to come into play.
