My Lords, I welcome Her Majesty’s gracious Speech and, on day 3, I am pleased to have the opportunity of addressing the Chamber, but first I thank the right reverend Prelate the Bishop of Bristol and the noble Baroness, Lady Bennett, for their excellent maiden speeches.

In the time allotted, I wish to focus on responding to the measures to improve agriculture, business and the environment, which I welcome. Supporting a successful rural economy is vital to maintain a vibrant living and working countryside, not only for farmers and land managers but for taxpayers and businesses large and small, who are all, in their own way, pioneering an environment in which all can prosper. I too welcome people visiting the countryside. It will be a better place than we inherited if we can make that countryside the best we can.

As Brexit comes even closer, minute by minute, my next comments regard the CAP. I am no defender of the CAP, which has created perverse incentives and reduced opportunities, and cutting out the layers upon layers of bureaucracy has to be the way forward. It will create a more dynamic and responsive culture, given the ever-changing demands from customers for more healthy foods. By releasing farmers from the rigidity and bureaucracy of the CAP, based now on public money for public goods, the new support system will reward farmers for environmental stewardship and help them become more productive, more sustainable and, of course, more successful.

Increasing investment in nature-based solutions to climate change is an immediate way of putting nature on the path to recovery. We must roll out large-scale native tree planting in appropriate locations that can deliver multiple benefits for carbon, wildlife, the environment and people, while the protection and enhancement of areas of ancient and semi-natural woodland must be prioritised. The burning of blanket bog must be banned, as well as the use of peat in horticulture. Funding for wetland and rewetting restoration must also be drastically increased. Landscapes such as wetlands, coastal habitats, salt-marshes and permanent grasslands must all be protected and restored. They sequester huge amounts of carbon while providing a home for numerous vulnerable species. I hope that the Environment Bill will encapsulate much of what I have said, and go a long way to ensure that we protect and preserve this planet for generations to come.

The Environment Bill also gives the Secretary of State the power to amend two pieces of legislation regarding the use of chemicals in the UK, under REACH 2008. This will allow us to take further steps, where necessary, to ensure a smooth transition to a UK chemicals regime following the UK’s exit from the EU. It will also make it possible to keep the legislation up to date and respond to emerging needs or ambitions for the effective management of chemicals—again, a positive step for the environment.

Secondly, here and now I speak for many who have waited so long for the introduction of measures to promote and protect animal welfare, and for the opportunity to increase maximum penalties from six months to five years. The reintroduction of the Animal Welfare (Sentencing) Bill, to increase those maximum sentences for animal cruelty, improve the welfare of animals transported for slaughter and ban the import and export of trophies made from endangered animals, is to be welcomed. We are proud to already have some of the highest animal welfare standards in the world, and aim to raise those standards even further. Again, post Brexit we must have in place strict import and export measures to maintain those high standards. We have to drive them up even further as the hallmark of a civilised society.

Thirdly, I will speak about businesses and business opportunities, particularly for the rural SMEs which, with support, can create those much-needed local jobs. With apprenticeships figuring highly as more businesses invest in their workforce, the number of people starting apprenticeships in agriculture has risen by 30% over the past five years. That is good news, as is more people being employed than ever before. Amid rural communities, there are many thriving businesses. For them, resilient digital connectivity is vital and they must not be forgotten as we continue to improve our digital infrastructure. It is also important to point out that, in supporting businesses, the Government have previously announced that the main rate of corporation tax will reduce from 19% to 17% on 1 April next year. I am sure that will be warmly received by all businesses.

I welcome the unveiling in the gracious Speech of the national infrastructure strategy, which promises to help us deliver world-class digital connectivity. High-speed broadband and mobile connectivity are essential services but they are nowhere near as available in rural areas as in urban areas, so I welcome the fund of £5 billion to roll them out to the hardest-to-reach 20% of the country so that no community is left behind. Full-fibre broadband will play a unique role in post-Brexit Britain, underpinning incredible advances in technology to unlock huge economic growth and transform our way of life, but we should not forget another important aspect of the internet: continuing to develop proposals to improve internet safety, making the UK the safest place to be online.

Finally, all the areas addressed in the debate are intertwined; they are the glue that binds together. Together, they give the impetus of the two Os: optimism and opportunity. This is about putting the needs of all our rural communities at the heart of government and in the 25-year environment plan. Those giant steps will help to deliver our goal to be the first generation to leave the natural environment in a better state than how we found it—and a more prosperous one.

My Lords, I declare my farming interest as set out in the register. The advantages of precision farming and technological innovation go beyond reducing carbon emissions. They also provide a range of improvements to the environment and farm productivity. The Government committed £160 million to the five-year agritech strategy in 2013. We continue to support British food and agricultural innovation through the £90 million “Transforming food production” initiative to make food production more efficient while lightening our environmental footprint.

With agricultural management using those technologies in practice while increasing agricultural productivity and income, can the Minister confirm that, with the five-year agritech strategy in its final year, the data and results will feed into the 25-year environmental plan?

My Lords, I should say that precision farming is widely used and has been very successful in raising productivity and reducing the amount of input, but certainly on the results of the five-year plan there are some very interesting schemes that are clearly going to take some time to move from laboratory to farm. As far as I can see, all of them confirm that precision farming is going to be of enormous benefit, and those results will come out into the farmland situation as soon as possible.

My Lords, I declare my farming interests as set out in the register. England’s river ecosystems are the healthiest they have been since the Industrial Revolution. More than 5,900 miles of rivers have been improved since 2010. Where our catchment-sensitive farming programme operates, pesticides in our rivers have fallen by 50% since 2006. Serious sewage pollution incidents have fallen by 89% in the past 25 years. More than 40 billion litres per year of unsustainable abstraction has been prevented since 2008. We intend to go further.

I thank my noble friend the Minister for his encouraging words, but farmland birds have declined by more than half since 1970. More urgent action is needed to tackle sewage effluent chemicals and damaging abstraction of water from rivers and groundwater, which is preventing 15% of rivers meeting good ecological status. On the announcement for abstraction reform to review existing licences and introduce more controls to protect water resources, will this review feed into the 25-year environmental plan, and will targets be set?

My Lords, the whole 25-year environmental plan—and, indeed, all our plans, including in the Agriculture Bill and the environmental land management schemes—is predicated on the need to enhance our environment. Water quality and water supply is clearly one of our priorities. On abstraction reform, we will certainly be looking at increasing supply, reducing demand and reducing leakages. We are already bringing back targets in many of those areas into our law.

My Lords, my experience of water retention on this scale is that I was involved in the transformation of Loch Lomond into a reservoir capable of supplying 450 million litres of water a day.

On the volume of water held back by a dam being increased from 10 million to 30 million cubic litres, perhaps the Minister can say whether the noble Lord, Lord Campbell-Savours, can take some comfort from the fact that the smaller reservoirs would still be subject to all the regulations in the 1975 Act. I have just come from a meeting where we were addressed by an executive from Anglian Water. He said that it was under severe pressure this summer and that, if it has to extract any more water from ground sources, it feels that it will be moving into an area where damage might be caused. This must be quite a worry.

My Lords, I too welcome the SI and agree with many of the comments of my noble friend Lady Byford. We have droughts in the eastern part of the UK, so I welcome looking at our reservoirs and desalination plants.

I have a query about the impact on costs to local authorities. In paragraph 12.3 of the Explanatory Memorandum, it says that,

“there will be a slight increase in costs to Local Authorities … as more resource will be required in order to advise on applications”.

Is that for central government or for local authorities? Budgets are tight and I should like some clarification, particularly on that explanatory note.

My Lords, I declare my interest as a district councillor. I thank the Minister for his opening remarks and for setting the scene so clearly.

Water is a natural resource which is not finite. Our lives and livelihoods depend on it, and the well-being of all living creatures, trees and plants relies on there being a ready and plentiful supply of fresh water.

As the Minister has said, the change to the Planning Act 2008 for nationally significant infrastructure projects was out to consultation for six weeks during November 2017 and then for a shorter, three-week period in April this year. The first consultation resulted in a significant number of responses but no definitive consensus. The second consultation received 20 responses from those bodies directly affected by the change to the law. There was broad agreement with the proposed amendments. I find this encouraging, as it is quite a significant alteration to the capacity currently covered by the 2008 Act.

The change from 10 million to 30 million cubic metres represents a trebling of dam or reservoir capacity. This is likely to have some impact on the surrounding area and, no doubt, the people affected will have views that they wish to express.

To avoid drought conditions in parts of the country—such as we have heard about—it is imperative for major projects which both conserve and move water to be streamlined to ensure they proceed on time.

My Lords, I, too, thank the noble Lord, Lord Black, for securing this debate. In agreeing with many speakers, I would like to voice my support for improving measures and raising standards for our domestic animals. These much-needed measures are long awaited and we need to see clear, strong guidelines embedded in a good, clear strategy. It is regrettable that little further has been done apart from the microchipping of dogs and the Welfare of Racing Greyhounds Regulations 2010, although both are welcome.

We need much-improved measures to include the licensing of all sellers, with better enforcement and strict new import rules to stamp out unregulated dealers. Anyone breeding or selling should and must be tightly regulated and licensed, with the local authority holding the register to inspect on a regular basis. People who are in this business, whether on a large or smaller scale, should have the added incentive to support raising animal welfare standards. It is being recommended that anyone breeding two litters or more per year should be licensed but I would like to see anyone breeding just one litter and selling puppies for a profit having to have a licence. A priority must be to see an end to third-party sales, including in pet shops.

Brexit heralds the opportunity, I hope, for stronger enforcement, particularly when puppies are found to have been imported underage and unvaccinated, with some having travelled in appalling conditions to then be sold on the internet with false data on their passports to evade contravening the PETS. We need to see full traceability at customs points.

Finally, the legislation has potential but progress has been limited on the commitment to promote good welfare, and we must stamp out cruelty. I would like to see the Government working with animal welfare organisations to have a public media campaign bringing all this to the fore.

A timetable for secondary legislation was set some 10 years ago in the Animal Welfare Act 2006. We need some real progress. I want particular attention paid to animal cruelty, for which the maximum sentence is just six months—in the UK it is among the lowest in Europe. I hope that the Government will quickly introduce a change to a five-year sentence. Let us hope that 2018 will be the year for real progress on all fronts in stamping out cruelty to animals.

My Lords, I was about to refer to the noble Baroness, Lady Byford, as my noble friend—we have been friends for such a long time, even though I am independent and she is a Conservative. She touched on something that is absent from this statutory instrument, which is the breeding of cats. Just as with the dogs that the noble Lord, Lord Trees, mentioned, you are getting cats with flat faces, because they are attractive to people who think that they look like babies. It is a real menace in the cat world and should not be allowed. Many people acquire cats—we have two farmhouse-bred moggies. Cats living on farms have litter after litter, and I feel that there needs to be some regulation on spaying or castrating them so that we can reduce the overall number of cats and breed nice, healthy animals—like ours.

My Lords, I just want to say a few words. First, I declare that I am a member of a local authority. I welcome the new regulations on minimum welfare standards. I hope that we will have tough customs checks when puppies come into the UK. I also welcome the important provisions on streamlining, enforcement and full costs for local authorities. As previous speakers have said, this is an opportunity to stamp out unscrupulous, back-street puppy farms, which should be banished as soon as possible.

My second declaration is as a dog lover: I have dogs and I love them dearly. I agree with the comments made by the noble Earl, Lord Cathcart, on the breeding of dogs, under Part 5 of Schedule 1. I acknowledge the move from five to three litters, but I think that if something is a business it should be licensed, even if there is only one litter. It is a commercial enterprise and obviously it is going to make a profit. Instead of having it go down to three, it should be one. If it is a commercial enterprise it should breed a litter to sell. It is a business. Could the Minister clarify that for me?

My Lords, I might look sideways slightly as I say this, but the precise distinction is if the owner is in the business. In other words, the point is that if you have three or more litters you must have a licence, but if you are in the business you would have to have a licence even if you had only one litter. That distinction of being in business will be set out in the guidance. The whole purpose is to capture those who are in the business of dog breeding if they have any number of breeding bitches. It is important that we can license those who are in the business, but we have a catch-all that if you breed and sell more than three litters and you are not in the business, you have to be licensed as well. I say to all breeders who are breeding and selling to look at the regulations. Obviously the purpose of this is not to be bureaucratic, but to raise animal welfare standards. I will reflect on what my noble friend has said. If there is a clearer response I will of course write to my noble friend and all noble Lords, but I think that Hansard will report what are the varying elements of requirements for a licence from the local authority. If there are any ambiguities and noble Lords would like to ask me afterwards so I do not confuse myself, I would be very pleased.

My Lords, I welcome the debate of the noble Lord, Lord German, UK inland waterways and the opportunity to take part. I have nothing to declare: I am not an associate and I do not own a longboat, unlike my noble friend, but I enjoy walking along our many waterways with my two friends, Daisy and Ted, who are my dogs. I enjoy them and they enjoy it, too.

Bringing our waterways into the big society puts decision-making into the hands of the thousands of people who love the waterways—like me—and have the pleasure of living near them. Therefore I welcome the Government’s commitment to invest and support local communities and volunteers helping to shape the future of our much-loved waterways.

Importantly, the main and overriding issue is that of safeguarding the safety and structural integrity of water infrastructure and the safety of users and neighbours. One of the main issues must be improving water quality and managing flood risks, as well as enhancing and supporting our heritage while respecting the character of our landscape, creating ample space to develop leisure and commercial activities—as previous speakers have alluded to. Of course, there are many challenges but I always think that challenges bring new ideas.

Waterways are our history; demonstrating their individuality and uniqueness is important. We may not be Holland, with many miles of waterways, but our network of 200 year-old canals and rivers is valued and therefore must be preserved. Our landscape, too, is very precious, so both have to be supported for long-term sustainability, highlighting the opportunity to welcome our visitor economy.

An important issue to raise today is our waterways’ connection to our health and well-being. They are integral in encouraging and supporting physical and healthy outdoor activity. They are an opportunity for someone who may feel isolated and lonely; they can be a lever to begin volunteering, resulting in creating long and lasting friendships, particularly as we are all living longer and healthier lives.

It is also the time to value the environment. Almost 50% of the population live within five miles of a waterway and nearly 1 million people live within a 100-metre catchment. Attention must be drawn to improving physical access to canals and to introducing creative signage, with up-to-date public information to keep awareness and interest for people. As I have stressed, securing the long-term future of our managed waterways is a given, as well as resolving the best outcome for the public purse. Lots of work is also needed to rid our canals of the scourge of the many types of microplastics entering the environment via sewage and sewage sludge.

From soft landscape to commercial opportunities, there are huge opportunities for businesses and small and medium-sized enterprises which want to relocate and stimulate a community, bringing work and jobs. It is particularly important to our rural areas which are situated in an idyllic setting.

Finally, it is important just to be able to enjoy the ambience as well as valuing our natural environment; to discover the pleasure of just being there beside our canals, for everyone who wishes to preserve our heritage. They, too, want to make a better place for our future generations.

Once again I thank the noble Lord for tabling this debate and look forward to the Minister’s response in encouraging the improvement of our canals and waterways. I hope there is support, so that canals and waterways will have a future.

My Lords, the clean air strategy we are bringing forward is designed to deal with all elements of air pollution, because we think that is very important. I should have said to the noble Baroness, Lady Smith, that we are not intending to appeal; we want to implement what the judge has said. We are working actively, in different ways, with all the cities involved, helping them to tackle their NO2 exceedances, and that is an issue for the whole United Kingdom. Wales, which was a separate party to the action, has conceded that it needs to do more and will be bringing forward a new plan in July. There are exceedances in Scotland and Northern Ireland—in fact, 22 of the 28 countries of the EU are in exceedance—so this is an issue we all need to grapple with very seriously. I am confident that my honourable friend Minister Coffey is dealing with this with rigour and drive.

My Lords, over the decades the UK’s air quality has improved, thanks to the concerted efforts at all levels, but we all today, listening to other noble Lords, agree that more needs to be done. Poor air quality is the largest environmental risk to public health as well as to the environment, damaging agricultural crops and forests, and people are rightly concerned. Will the Minister say whether more could be done to inform the general public, with more detailed information or a campaign, to enable them to make informed choices to help tackle the sources of, and to avoid exposure to, air pollution?

My Lords, I think that what my noble friend has said is really important. We are working with local authorities and businesses. One thing we all have to wrestle with is how to manage our lives differently in terms of the things we do and air pollution. Whether it is particulate matter with domestic wood and coal burning, there is a range of things we are all going to have to address. I agree with my noble friend that more needs to be done. With the Department of Health, on things like awareness of air pollution events, we need to ensure that vulnerable people are safer. All these are important points, but the work we are doing and that we need to do in collaboration is urgent and we need to get on with it.

My Lords, there obviously need to be alternatives and we are looking at them. Nothing is exported in the way that the noble Lord describes—there are very strong and strict requirements. I agree with him about wanting to recycle more at home but a number of countries—Turkey, Taiwan, Vietnam and India—all have resources and are taking more waste. However, we certainly want to work more on recycling at home.

My Lords, embracing the Chinese ban and implementing further restrictions in the coming years could be an opportunity to overhaul our current system and invest at home. What progress is being made in moving towards a joined-up waste and recycling policy that can respond positively?

My Lords, the resources and waste strategy will be very important in that regard, and it is encouraging that industry is picking this up. We have already had announcements from businesses about plastic-free brand products, and it is interesting that we are now recycling 60% of our packaging. Therefore, although we need to seek further increases in recycling rates, we are now going in the right direction.

I thank the noble Lord, Lord Greaves, for bringing this timely debate to the House today following the announcement of the Chinese ban on imports of plastic and other waste. Regrettably, we have relied on China to deal with our waste for far too long—in fact, now for over 20 years. It is therefore important that the Government’s 25-year plan will send a strong message to everyone about the commitment to be the first generation to leave the natural environment in a better state than it inherited.

There is no doubt that public support for recycling is at a real high, as the noble Lord, Lord Greaves, just mentioned, particularly in response to the BBC’s “Blue Planet” series. Britain currently ships around two-thirds—approximately 500,000 tonnes—of its waste to China for recycling each year. With a view to finding new destinations in the short term, UK recycling firms are now having a hard look at other manufacturing countries such as Malaysia and Vietnam. However, we have to begin to manage more of our waste. We are told that the UK uses 13 billion plastic bottles every year, with only 7.5 billion being recycled and the rest going to landfill. That is a massive amount for any country.

We have a real challenge to address not only in the short term but in the longer term, so it is so important that we build a coherent waste strategy with real meat on the bone. There is no doubt that China’s decision will cause some major issues in the short term, as I alluded to earlier, so there will be a need for joined-up working between government, the Environment Agency, local authorities and all other interested parties to carefully manage the situation before us.

People support recycling and want to do all they can to address the problem and help reduce pollution, so it is disappointing to know that recycling rates have plateaued in the last five years. Therefore, consultation with industry is vital on a well-designed deposit return scheme with inbuilt incentives, in particular to stop the accumulation of plastic products in the environment that adversely affect wildlife, wildlife habitat and indeed humans. Industry must take more responsibility for the environmental impact. I know that taxpayers would be willing to pay more for single-use plastics but surely the manufacturers of these cups should bear the brunt. However, I welcome the Waste Infrastructure Delivery Programme, to which the Government will have committed £3 billion by 2042 to support investment in a range of facilities to keep waste out of landfill and increase recycling levels.

The clean growth strategy, published on 12 October last year, sets out an ambition for zero avoidable waste by 2050, cutting the total amount of plastic in circulation, reducing the number of different plastics in use, improving the rate of recycling, supporting comprehensive and frequent rubbish and recycling collections, and making it easier for individuals to know and understand what goes into the recycling bin and what goes into the general rubbish bin. However, that is a long way away, and confusion still reigns in many cases.

The general public are a captive audience. That was borne out when the 5p charge was put on plastic bags, taking 9 billion bags out of circulation and reducing usage by a whopping 83%, and with more than £66 million being given by supermarkets to good causes from the 5p charge. I certainly look forward to seeing and walking down the plastic-free aisles in our supermarkets very soon. The banning of the manufacture of personal care products containing plastic microbeads only two days ago was a great start.

We are all too well aware of how plastic pollution can unfavourably affect the land, waterways and oceans, with marine animals in particular being affected through entanglement or the direct ingestion of plastic waste, or through exposure to chemicals within plastic that cause interruptions in biological function. I personally find it very difficult to see those heart-rending pictures. We are now witnessing an increase in the volume of plastics in the ocean, with decomposition being slowed down. It is estimated that a foam plastic cup will take 50 years, a plastic beverage holder 400 years, a disposable nappy 450 years and a fishing line 600 years to degrade.

Many UK councils are working hard to increase their recycling rates but others have to raise their game significantly and quickly. England is well down the list of countries in the developed world, ranking 18th and with an average recycling rate of just 42.8%. The time has come to act. The environmental legacy that we leave for our future generations has to be better, so we really must take up the challenge. We have to be bold, we have to improve and manage our recycling, and, in particular, we must take a long, hard look at our future infrastructure now that the Chinese have put a ban on imports of plastic and other waste.

Finally, I hope that this will not be an opportunity missed and that we will see bold new measures being taken in the next few weeks. The situation is indeed urgent. We need the detail and we need the bite. Quite simply, we cannot afford to sit back and wait.
