The House will be disturbed to learn today that since the CPS guidance on rape was amended in 2011 the number of people charged with rape over that period has fallen by 14%. There is concern that cases are being dismissed that could be successfully prosecuted. What will the Secretary of State do to ensure that the CPS has the appropriate resources to ensure that no victim of rape in this country is let down?

I am sure that the hon. Lady heard the answer I gave a few moments ago about the action we are taking with the Director of Public Prosecutions, police and crime commissioners and chief constables to look beneath the detail of that and ensure that all proper cases are referred. I am happy that the facts do not bear out her accusation that this is anything to do with resources, as in nine police areas the number of referrals has gone up over the two years since the new guidelines came in.

As I said to the hon. Member for Liverpool, Walton (Steve Rotheram), in the particular instance of the Hillsborough investigation my right hon. Friend the Home Secretary has already made that commitment on resources. There is clearly a wider point about the IPCC’s resources and how it operates, and a statement on that will be made very shortly.

Short of reading again what I have just said, that is what we are doing. The Select Committee, of which he is a distinguished member, is conducting an investigation. It has not published its final report, but when it does so the Government will look at it and all the matters it raises seriously.

The Minister says that the IPCC has asked for two powers that are contained in the Bill. What conversations has he had with the IPCC since the Bill was published about anything that is missing? He says he has had conversations with chief officers, specifically on sanctions. What conversations has he had with the IPCC about sanctions?

I have had extensive conversations with the IPCC. I have seen its briefing to Members, which led to the all-party group amendment. I have specifically discussed sanctions with the IPCC. As I have said in more general terms, if there is a need to widen the IPCC’s powers the Government will look at it with an open mind and with a view to legislation, but it is sensible to await the Select Committee report before committing ourselves in any detail. It will be for the IPCC to investigate whether individuals involved on the day should face misconduct or criminal proceedings; we must ensure it has the powers it needs. The IPCC has been clear: that fully to investigate the terrible events of 15 April 1989 it needs to hear the testimony of officers involved on the day and in subsequent investigations.

Criminal records checks depend on the quality of information we get from the sending country, and that will differ between different European countries. I am conscious of my hon. Friend’s attitude to the EU, but as we are talking about the immigration laws under the current laws of this country, I think we have said enough on that particular topic for this afternoon.

The queues at Heathrow are unacceptable, but there are also reports of long queues at Gatwick and the channel tunnel. Three weeks ago, I came into Gatwick at about half-past midnight and had to wait for more than half an hour to enter the country. I witnessed families with young children who were struggling badly with the delay. What inquiries has the Minister made into queues faced by travellers outside the capital?

As I have already explained, the service level agreement is that 95% of UK and EU passengers should be processed within 25 minutes and non-EU passengers should be processed within 45 minutes. Those are the targets Border Force has been set. Without knowing the details of the individuals to whom the hon. Lady refers, I cannot say whether or not they were processed in accordance with service standards. The point she makes about Calais and Coquelles is particularly ill-advised in that we have been told that, along with Easter, the February half-term is one of the busiest weeks at Calais and Coquelles because of schools coming back from half-term trips, and we prepared and planned, and there were no problems over that busy weekend.

I imagine that the voters of Oldham East and Saddleworth—who have great knowledge of immigration, owing to the unfortunate activities of my predecessor in this job—will take the view that the Labour party is, as ever, attempting to mislead them completely on immigration, and that that is why it should not be trusted.

Can the Minister please answer the question that my right hon. Friend the shadow Secretary of State asked him earlier? What is the status of those who applied under the illegal cap and were rejected, and will their applications now be granted? I draw to his attention the example of the international scientist who was unable to come to this country to take part in a cancer research project.

I am sorry that the hon. Lady did not listen to the answer that I gave the shadow Home Secretary, but I am quite happy to repeat it. The judgment was given on Friday but we do not have the written judgment yet, and we will not get it until January. It is clearly absurd to ask us to decide what to do about individual applications in advance of deciding whether to appeal against the judgment, and we cannot do that until we have the judgment in writing.

I give that assurance to the House and, beyond that, to business. We held something that has been unusual in recent years: a consultation that genuinely consulted. We listened to business and changed the rules on inter-company transfers. That is also why we got rid of most of tier 1 and left a small remainder for the very exceptional. We now have a system that will not only enable us to get immigration to sustainable levels, but protect businesses and educational institutions that are vital to our future prosperity.

In light of the concerns about immigration that the Minister has articulated, will he share his justification for this week’s news that front-line UK Border Agency staff at Liverpool port and John Lennon airport will be slashed by almost half?

The hon. Lady has heard me say in response to a previous question that there will be a reduction of more than 5,000 in the UKBA work force. We are ensuring that we use new technology and new working practices to make our border more secure than it was under the Government whom she used to support. I commend to her the very good Institute for Public Policy Research publication, “Immigration under Labour”, in which an adviser to one of Labour’s more successful Home Secretaries—
