It has always been the case in respect of inquiries set up by the Government, when it comes to Ministers and former Ministers, that the Government have undertaken that role, although it was not a process governed by the Inquiries Act 2005. That was, I believe, the case with the Chilcot inquiry, and that is what the Government do: they help to put the information together and to ensure that all relevant information is presented. I do not believe there is a precedent for an invitation to provide information on quite such a wide basis—all information over a two-year period, involving a certain means of communication—so this is a new situation, but what the Government are doing is consistent with what Governments have, I believe, always done in these circumstances.

Can I urge the Minister to build not on the legal aspects of this statement but on the discussions with the inquiry? How can the Government build trust with the inquiry—it has a strong position; the Government have a different view—whether through mediation, legal teams meeting or reading rooms? What are the ways through to move this topic on?

My right hon. Friend asks an excellent question, but I hope he will forgive me if I do not get into potential ways through. That would be a matter for the Government to discuss directly with the inquiry, but I very much hope that a way can be found that avoids the court’s time on 30 June. If there is a way through, that would be warmly welcomed.

I am happy to give the right hon. Gentleman the assurance that we will continue to engage with all parties and communities in Northern Ireland—that is the right way to proceed—particularly with regard to the operation of the brake. That is set out in the Command Paper, and we look forward to discussing it, and how to codify it, with the Executive, the Assembly and the political parties as we move forward. That is something we are very happy to do.

Just so the right hon. Gentleman is clear, the Stormont brake is based on an existing Good Friday agreement mechanism. The petition of concern mechanism is well established in Northern Ireland as a cross-community safeguard, which is why we have chosen it as the appropriate mechanism for this particular purpose. As I say, we will continue to engage with all parties to make sure we get it absolutely right.

I join the tributes to John Caldwell, who was shot in front of his son while loading footballs into his car after training kids at a football match in Omagh last week.

I welcome the Windsor agreement and the Windsor framework, and I believe today marks a critical moment in ending three years of instability that has affected communities throughout this most fragile part of our country. I pay tribute to my right hon. Friend and his team for all they have done to secure this. Does he agree that we now need to give the right hon. Member for Lagan Valley (Sir Jeffrey M. Donaldson) and all the other Northern Ireland parties the time, space and encouragement to restore power sharing and to ensure that political decision-making in Northern Ireland can start as soon as possible?

The Chairman of the Select Committee asks about an incredibly important point. Getting a restored devolved Government in Northern Ireland will help enormously in delivering for the people of Northern Ireland. We absolutely acknowledge that the protocol—its interpretation and application—is the impediment to the Democratic Unionist party going back into government, and we will fix that.

My hon. Friend is correct that I have spent a very busy period over the summer engaging with the Irish and elsewhere. I would like to place on record in the House today my thanks to the former Taoiseach, Bertie Ahern, and the former Prime Minister, Sir Tony Blair, for their assistance in the work that I have done over the summer. This weekend at the British-Irish Association in Oxford, I had constructive and prolonged talks with Vice-President Šefčovič, and I am convinced that if the appetite exists, we can find a way to a negotiated solution to the Northern Ireland protocol in the interests of all the people of Northern Ireland and all the people of the United Kingdom—and in the interest of finding a new way of working in partnership with the European Union post Brexit.

I welcome the new Secretary of State. I hope he has had time to savour those moments of ecstatic relief upon realising, as a former Chief Whip, that he no longer has responsibility for the Tory parliamentary party.

Northern Ireland has unique energy needs: a reliance on heating oil, different regulation, a preponderance of small businesses and very low disposable incomes. Will the Minister confirm that in tomorrow’s energy announcement, Northern Ireland will hear not only what will happen to it but when payments will start to be made?

I thank my right hon. Friend for that question and I say to him that he is held in deep affection across Northern Ireland. He is right to identify Northern Ireland’s unique energy challenges, which I have seen and heard about myself on visits in recent weeks. I know that the new Prime Minister will be hearing those messages too and will want to update the House as soon as possible.

Let me use this occasion to pay tribute to the wonderful visits team in Northern Ireland, whom my right hon. Friend will remember—Nadine, Kathryn, Nicola, Helena and George. They have supported me so brilliantly on the 277 visits that I have carried out over the last 12 months as Minister of State, 107 of them to businesses.

My right hon. Friend is conflating two issues. I will come to necessity in due course.

My hon. Friend the Member for Bromley and Chislehurst also mentioned article 16, and the reality is that it does not solve the problem at hand. It would only treat the symptoms without fixing the root cause of the problems. We need a comprehensive and durable solution to this urgent problem and certainty for the businesses and people of Northern Ireland.

On durable solutions, does my right hon. Friend agree that the only durable solution is for the EU to listen to what my right hon. Friend the Member for Lagan Valley (Sir Jeffrey M. Donaldson) articulated about the needs of Unionism and for a British Prime Minister, in place from September, not to go moaning to their counterparts, as has happened over the past two years, but to grip the issue and solve it politically?

Of course, it takes two sides to discuss such matters and come to a solution. I think it has been accepted by all who have spoken so far that there has been some intransigence on the European Union’s side. That is the clear reality. For example, there have been more than 300 hours of discussions between the parties, over 26 meetings involving my right hon. Friend the Foreign Secretary or her predecessor Lord Frost, and 17 non-papers. I am not sure how much more could be done in terms of negotiation; it does need two sides.

I will move on, as I have several amendments to address and I do not want to interfere with Members’ right to speak in due course.

On amendment 26 and new clause 8, tabled by the hon. Member for Oxford West and Abingdon (Layla Moran), she is right to raise the important issue of this Bill’s relationship with the UK’s international legal obligations. However, the amendment is not necessary. The Government have already published a statement setting out their legal position that the Bill is consistent with the UK’s international obligations. In line with the practice of successive Governments over several years, it summarises our position but does not set out the full detail of our legal advice. That is not something that any Government of any shade can do, and it is quite rare to give such a memorandum.

The statement makes it clear that the strain that the arrangements under the protocol are placing on institutions in Northern Ireland, and more generally on socio-political conditions, means there is no other way of safeguarding the essential interests at stake other than the Bill we propose. There is clear evidence of a state of necessity to which the Government must respond. As in other areas, it would not be prudent for the Government to publish evidence or analysis underpinning every point of legal detail—the lawyers in this House will know that that would be extremely inappropriate—particularly in advance of specific cases arising in potential future litigation. I therefore urge the hon. Lady not to move her amendment.

It has long been the position that the Northern Ireland protocol and negotiations regarding it are, like any other treaty, a matter for the Government, operating under the foreign affairs prerogative. The Executive must retain that prerogative for very good reasons. Because of the protocol, there is anyway no Northern Ireland Assembly currently sitting to provide the consent that this amendment would require. This Bill aims specifically to restore stability in Northern Ireland and a working Assembly—that is the very essence of it—so there is an essential flaw in the amendment’s logic in requiring the Assembly to approve the operation of the Bill. That is why I ask the hon. Member for Foyle (Colum Eastwood) not to press the amendment. Of course, the Government will continue to update Parliament and the Northern Ireland Executive, when they return, on the status of talks with the EU regarding the protocol, and to consult stakeholders in Northern Ireland on the operation of the Bill.

Just on a point of clarification for the Committee, if the Northern Ireland Assembly is not up and running, the provisions in the Bill state that when the consent vote comes, the Assembly will be recalled and there will be a vote on that consent. I say that just so there is no lack of clarity for the Committee about the current provisions within the consent mechanism.

With your permission, Dame Eleanor, I will speak to amendment 25 and new clause 7 together, which are in the name of the hon. Member for North Down (Stephen Farry). The Bill is designed, as I have said, to bring swift solutions to the issues that the protocol has created in Northern Ireland. These solutions are underpinned by the designation of elements of the protocol as “excluded provision”. Put simply, it is by excluding some elements of the protocol and withdrawal agreement in domestic law that the Bill is able to introduce, with the necessary certainty, the changes that are needed in Northern Ireland. By requiring the prior approval of the Northern Ireland Assembly, the amendments would undermine the ability to exclude elements of the protocol, and therefore undermine the entire operation of the Bill. That is unworkable. Because of the protocol, no Northern Ireland Assembly is currently sitting to pass the approving resolution that the amendment would require. The Bill as introduced aims specifically to restore stability in Northern Ireland, and a working Executive and Assembly. Therefore, in requiring the Assembly to approve the operation of the Bill, there is an essential flaw in the logic of the amendment.

As the hon. Member for North Down will be aware, the Sewel convention applies to this Bill, as it does to all Bills of this Parliament that intersect with devolved competence. I confirm that in the absence of functioning institutions, senior officials in the Foreign Office have already made contact with the head of the Northern Ireland civil service regarding legislative consent, and we hope to reach a positive solution as soon as the institutions are restored. By contrast, the amendment would allow the Northern Ireland Assembly to constrain the UK Parliament’s power to legislate, even if that legislation related to a reserved matter. That, of course, is wholly inappropriate under devolution arrangements. The Government will consult stakeholders in Northern Ireland, including Members of the Assembly, on the operation of the Bill during its passage and thereafter. I therefore ask the hon. Gentleman to withdraw his amendment.

This country has an unparalleled record—[Interruption.] Just since—[Interruption.] Since I have been Prime Minister, look at the numbers we have taken from Afghanistan and Hong Kong. The right hon. Gentleman lectures the Home Secretary, but this is a Government unlike any other: the Prime Minister, the Deputy Prime Minister and the Home Secretary are directly descended from refugees. We understand how much refugees have to give to this country and we understand how much this country has to gain from welcoming refugees. We will be generous and we are being generous.

What we are doing is making sure that, in those neighbouring countries, the UK is out in front giving humanitarian assistance and we are in every capital. [Interruption.] SNP Members laugh, they mock, they scoff, but this country is leading in every respect. We are also the single biggest donor of humanitarian aid to the Ukraine warzone—the single biggest donor—and the right hon. Gentleman should be proud of that.

Q6. I commend the Prime Minister’s response to the Ukrainian crisis, but people across the country are genuinely concerned by our response on refugees—by the bureaucracy and the tone of our response. He has shown with vaccines that Government change comes from the very top. I urge him to look again at resetting our policy and taking control of a more humane approach to those women and men fleeing from Ukraine.

I thank my right hon. Friend very much, and I thank him for all the work that he does in this area, but I hope he will have heard what I just said in my answer to the leader of the SNP, which is that this Government are I think unlike any other in our understanding of what refugees can give and the benefits to this country. We have done more than any other to resettle vulnerable people since 2015. There is a huge opportunity now for us to do even more. That is why my right hon. Friend the Secretary of State for Levelling Up will be setting out a route by which the British people—not just the family reunion route, which can run into the hundreds of thousands, but a route by which everybody in this country—can offer a home to people fleeing Ukraine. My right hon. Friend will be setting that out in the course of the next few days.

The status quo cannot continue. Nearly six months ago we presented a Command Paper outlining how we thought we could resolve the serious issues within the Northern Ireland protocol. The EU brought forward its own proposals, but these do not have the support of businesses or society and do not remove the need for unnecessary checks on goods that will remain in Northern Ireland and the UK internal market. We want a negotiated solution and we are engaging constructively but the gap between us is still large. We will do what we need to do to deliver for Northern Ireland.

The objectives the Northern Ireland protocol include ensuring that the everyday lives of people and their communities are not disrupted, that the UK internal market is respected and that all three strands of the Good Friday agreement are respected. The EU’s implementation of the protocol is breaching those issues and we will not tolerate that. It is abhorrent to be in a situation in which members of the Jewish community in Northern Ireland cannot practise their religion under the EU’s requirements. That should not be tolerated by anybody in this House.

I welcome the Government’s dialling down of the rhetoric on the protocol, but may I urge them to speed things up? This issue and these negotiations are affecting our international relationships in steel and other matters, and the very fragile ecology in Northern Ireland. May I also urge the Secretary of State to assist my right hon. Friend the Member for Lagan Valley (Sir Jeffrey M. Donaldson) on his need for a negotiated settlement on the Irish sea checks and regulations?

My right hon. Friend is right: we need to see this resolved quickly, but that obviously requires the European Union to recognise the very real issues on the ground in Northern Ireland and the fact that we need to see movement from the EU to get to a resolution that can work for businesses in Great Britain supplying Northern Ireland, and for Northern Ireland’s citizens.

I am aware of the problem, and we are doing what we can to accelerate the number of driving instructors and testers to allow young people such as the gentleman that she mentions to get their driving test done, and enable them to fulfil their ambitions.

I support the Prime Minister’s comments on Jo Cox and, as a former Chief Whip, his comment on Sir Roy Stone. Sir Roy gave amazing service to me when I was Chief Whip during the worst of the Brexit years in dealing with a hung Parliament and with the occasional disruptive Back Bencher.

Northern Ireland faces some challenges over the coming weeks in terms of nominating a First Minister and a Deputy First Minister. Does the Prime Minister agree that it is vital that the parties stick to the agreements that have been made in the “New Decade, New Approach” deal, which he and I negotiated 18 months ago, and that if they fail to do that—I know he does not like this concept—the UK Government ultimately act as a backstop?

It gives me great pleasure to thank my right hon. Friend for all the work that he did on the “New Decade, New Approach” deal. I agree that it would be a good thing for the whole package to be agreed, and I certainly support the approach that he has set out. I think that what the people of Northern Ireland want is a stable, functioning and mature Executive.

We have just announced the quarantine policy, which, as I have said to the House, is among the toughest in the world and certainly tougher than most other European countries. I am delighted that the right hon. and learned Gentleman is now supporting business—not a policy for which he was famous before—in his latest stunt of bandwagoneering. He has moved from one side of the debate to the other throughout this crisis. Some people have said that this is a “good crisis”. Some people have said that this crisis is

“a gift that keeps on giving”.

Those people sit on the Labour Front Bench. It is disgraceful that they should say those things. This is one of the biggest challenges that this country has faced since the second world war and, thanks to one of the fastest vaccine roll-outs anywhere in the world, it is a challenge that this country can meet and is meeting. I believe that this vaccine roll-out programme is something that this House and this country should be very proud of.

I thank the Prime Minister for the decisions he took last year that have meant that the vaccine programme is in such a good position this week. Despite that success, it is vital that the programme keeps pace with the changing variants. Will he update the House on where the UK stands on ensuring that the UK supply chain is in place and that we do not get behind as the virus mutates?

My right hon. Friend asks an extremely important question. We recently announced an agreement for 50 million doses with the manufacturer CureVac because we believe that that may help us to develop vaccines that can respond at scale to new variants of the virus. As the House will have heard from the chief medical officer, the deputy chief medical officer and others, I think we are going to have to get used to the idea of vaccinating and then revaccinating in the autumn as we come to face these new variants.

Again, I offer my sympathy to the hon. Gentleman and his staff who have faced this intimidation and graffiti. Members across the House stand fully in solidarity with him. He is right that it is vital that we work to ensure that the real issues are dealt with and that we say and demonstrate that we are not influenced by intimidation, violence or extra-parliamentary action. What we do is in the interests of the people he represents, and I look forward to working with him, his party colleagues and others to make sure that we resolve these questions.

The action taken last week follows the EU’s track record of a lack of understanding of the sensitivities in Northern Ireland. We saw it during the Brexit process, with the EU’s intransigence about not providing the then Prime Minister, my right hon. Friend the Member for Maidenhead (Mrs May), with an exit mechanism to the backstop, and we saw it again in the run-up to the protocol, with the EU ignoring our requests for trusted-trader schemes and other flexibilities.

I urge my right hon. Friend to take this discussion out of the purely technical discussions around the Northern Ireland protocol and transform it into a more strategic discussion with the EU. What does the EU need in return from the UK on other fronts to resolve these issues in the long term, and what does the EU need to do to give confidence, particularly to Unionists across Northern Ireland, that it understands that the Good Friday agreement and the protocol are matters of a joint duty of care for both the EU and the UK?

My right hon. Friend is absolutely spot on and makes the central point. People in Northern Ireland will have heard, during the whole Brexit process, professions of care and concern from EU politicians about Northern Ireland. Some of those were sincere, but the way in which the Commission has behaved in the course of the past week is of deep concern. I should say that I absolutely exempt Vice-President Maroš Šefčovič from this: he completely understands the need to make sure that we have a pragmatic resolution to this problem. But not every European politician understands the situation in Northern Ireland anything like as well as my right hon. Friend does, and we do need to make sure that we have a resolution that recognises Northern Ireland’s integral place in the UK, while also ensuring that we have the best possible relationship with all our neighbours.

I am grateful to the hon. Lady for all the points that she raises; they are all legitimate. It is important, of course, to recognise that some of the problems that were identified in the very first few days of the operation of the protocol have been addressed. As I mentioned, Andrew Opie of the British Retail Consortium explained to the FREU Committee earlier today that the supply of goods to supermarket shelves is now pretty much as normal. It is also important to recall that, as the Prime Minister stated earlier, no trucks have been turned away and that we now have normal traffic for this time of year. But the hon. Lady is right to say that there are and will remain challenges that it is the Government’s responsibility to address.



The hon. Lady asked specifically about engagement with the trader support service. As I mentioned earlier, more than 25,000 businesses have engaged with TSS, but there is more that the Government must do to ensure that all businesses are acquainted with the new procedures that the protocol requires and that our departure from the European Union requires when it comes to trade across the short straits.

The hon. Lady is absolutely right: the protocol should impact as little as possible on the lives of the citizens of Northern Ireland. That is why I will be working not just with businesses and representatives in Northern Ireland, but through the Joint Committee to ensure that we have a pragmatic approach towards grace periods and the operation of the protocol, because we want to make sure that the citizens of Northern Ireland, who are integrally part of the United Kingdom, are valued in the same way as her own constituents and mine are by everyone in this House.

I welcome my right hon. Friend’s remarks. I particularly welcome the confidence that he is planning to give to UK businesses to continue to trade in Northern Ireland—a fantastic base for their products and services. Will he confirm that the protocol is a joint UK-EU responsibility and, in that light, will he look at setting up immediately the joint working group, beneath the Joint Committee, and also use his negotiating talents and the relationships that he built up last year in completing the protocol to make 2021 a grace period for supermarkets in Northern Ireland? I think the EU will be up for that deal, so let us make it happen.

I am grateful to my right hon. Friend. No one has better negotiating skills than him. We remember that it is almost a year to the day since the “New Decade, New Approach” agreement was concluded, which restored democratic government to Northern Ireland. That was secured thanks to his leadership as a superb former Secretary of State for Northern Ireland.

My right hon. Friend is absolutely right that the protocol is a joint responsibility and I will be talking to my colleagues in the Commission as well as to representatives of the Government in Dublin to ensure that we do everything possible to smooth life for citizens of Northern Ireland. He is absolutely right: it is a wonderful place in which to live and to do business, and in this year of all years we must do everything possible to support the citizens of Northern Ireland.
