We have stated that the review of the legislation on redundancy protection will consider that issue and report within a year. I recognise that this is a serious matter and I am trying to turbocharge the process to ensure that we report sooner. I reassure the hon. Lady that we take the recommendations of the Committee very seriously, and all options are open.

The Minister knows that pregnant women deserve better—I know he is about to become a dad, so this is a very personal issue for him. It is estimated that about 54,000 women a year are dismissed or made redundant, or feel that they have no choice but to leave their jobs, and that is not good enough. Much of this is cloaked in secrecy because of the use of non-disclosure agreements to withhold information about potentially unlawful acts of dismissing women when they are pregnant. I hope that the Minister will put NDAs on his list of things to consider when he reviews the legislation, as he has generously promised to do.

My right hon. Friend is right: the Griffiths household is waiting with bated breath—it is days before the next Griffiths generation appears on the planet.

I thank my right hon. Friend for the advice that the Committee has given me since I have had ministerial responsibility for this issue. Discriminating against women in the workplace because they are pregnant or new mothers is unlawful, and the Government are determined to stamp it out. She raises the issue of NDAs, and that topical and serious matter is at the top of my agenda.

I am most concerned to hear about those incidents of harassment, and the hon. Lady should be reassured that they are covered already by the Equality Act. The reason those provisions in section 40 were repealed was that, as she has identified, they required not one but three occasions of harassment, and we know that, in the three years those provisions were in place, they were used only once. We have tried to improve the law, and I would encourage her to encourage people to use it.

It is really encouraging to hear my hon. Friend’s response, but does she not agree that it is not just about getting the law right? We have to get the remedies within the law right. We have to encourage anonymised reporting in the workplace. We must also make sure that the unethical use of non-disclosure agreements does not work to stop people bringing forward claims of sexual harassment in the first place.

I thank my right hon. Friend for her question. With her expertise on the Women and Equalities Committee, she knows only too well the challenge we have in advertising the rights that people have in the workplace. I am particularly concerned with non-disclosure agreements. We know that they can be used for lawful reasons—for example, to protect client confidentiality—but they cannot be used to shield employers from claims of harassment or discrimination, and any work that her Committee can do to help the Government in advertising that, I would very much welcome.

I think I can honestly say to the hon. Lady that I was as shocked as she no doubt was to hear about that. I will be discussing it with the Equality and Human Rights Commission and finding out what further communication to employers is needed to ensure that that does not take place, because it is clearly not allowed.

Businesses have just two weeks to file their gender pay gap reports. It is clear from some excellent investigative journalism by the Financial Times that some businesses have filed incorrect data. If this is done deliberately, what will my right hon. Friend do?

I thank my right hon. Friend for raising that issue. This is incredibly important to get right. The reporting on the gender pay gap will be a vital tool in ensuring that we close it. I will be discussing it with the EHRC, which is the group that will follow up with enforcement. It is sufficiently funded to do exactly that, and I will be turning to it to ensure that this is handled properly.

We have to make sure the message is clear to employers that this sort of discrimination is wholly unacceptable, and give new mothers and pregnant women the courage to put forward a claim if it is appropriate. But the message from the Government is clear: this is not acceptable.

In response to the Women and Equalities Committee report, the Government have already agreed to act on this issue. Will my hon. Friend update the House on whether the president of the employment tribunal will be issuing guidance in this area on the extension powers she has already mentioned? My hon. Friend the Member for Esher and Walton (Dominic Raab) has also agreed to start collecting data on applications for time extensions on maternity-related cases. Will the Minister undertake to update the House in future on the progress on that?

In late 2016, the Select Committee, which my right hon. Friend chairs, published a report on this. The recommendations were considered and the research we commissioned with the EHRC did not suggest that the three-month time limit for bringing a claim to the employment tribunal is a barrier. I will of course look into it and write to her.

There is a growing concern about the use of non-disclosure agreements in connection with employment. Will my right hon. Friend join me in condemning the use of non-disclosure agreements to conceal wrongdoing of any kind, and to encourage legal regulators to consider whether they are, in fact, ethical?

It is not just the civil service; we are looking at allied health professionals, civil servants and social workers. The social work programmes are in London, the west midlands, and the east of England. The hon. Gentleman makes an important point: encouraging women to get back into the workplace is critical, and employers should be aware that there are very clear laws about what they can and cannot do when their employees take time off work for maternity leave.

As the hon. Member for Ogmore (Chris Elmore) said, despite some of the best laws in the world, women in this country who are in work face more discrimination when they are pregnant than they did 10 years ago, and that can also stop them getting back into work. Will the Government consider making it clearer that employment tribunals have discretion in allowing individuals to bring discrimination cases in special circumstances outside the general three-month limit? Surely pregnancy must be a very special circumstance indeed.

My right hon. Friend is absolutely right—pregnancy is a very special circumstance, and women and employers are not always aware of their legal obligations. Some of the work that we are doing on gender pay gap reporting will be an important part of that, because it will highlight some of those issues and enable us to dig deeper into the reasons behind that pay gap. I have no doubt that some of it will be due to discrimination against women in the workplace.

Parliament and the Leader of the House are tackling the difficult issue of sexual harassment in this place, and that is to be applauded, but 50% of women in the workplace in general suffer sexual harassment. What are the Government going to do to ensure that the strong laws set out in the Equality Act 2010 and beyond are actually abided by, by businesses in this country?

The debate that we have been having in this place is part of how we raise these issues of sexual harassment in the workplace. We need to be clear that it is illegal and unacceptable, and that it needs to be stamped out wherever we see it. There is legal protection, but we are increasingly understanding that attitudes fundamentally need to change. Also, the Department for Education can play a clear role in ensuring that young people at school get the kind of education that they need to understand that these attitudes are unacceptable, and that they get that from an early age.

EU equalities law has already been overwhelmingly transposed into UK law via the Equality Act. As I said, Ministers must also comply with a public sector equality duty. On workers’ rights more broadly, the Prime Minister was clear in her Lancaster House speech, which she made some time ago, that one of our key priorities will be to protect and maintain them.

As the Chair of the Women and Equalities Committee, may I say how heartening it is to see seven Ministers present to respond to Women and Equalities questions, which shows the importance that the Government attach to these issues?

Ministers have been consistent and clear that their policy objective with the European Union (Withdrawal) Bill is for things to stay the same after we leave the EU, with our having time to debate policy changes after that point. It is clear, however, that the removal of the charter of fundamental rights in itself creates a significant change in the underpinning of equality rights. Will my right hon. Friend meet me to discuss how we can avoid that unintended consequence?

Earlier this week, we saw new information that shows that the incidence of sexual harassment and sexual violence against girls in our schools is increasing, and that is a year after the Women and Equalities Committee published its inquiry into the subject. What more will the Government do to make sure that their policies are working to keep girls and children safe in our schools?

As my right hon. Friend points out, we have taken a range of steps already, but the recent report highlights again how significant an issue this is for young people now. As social media become a staple part of young people’s lives to a greater and greater extent, those risks will only grow. She will be aware that we are trying to make sure that the guidance that we provide to schools remains up to date, and that sits alongside other areas of action from the Government such as updating the relationship and sex education guidance. We are clear that if schools see this happening, they should report it to children’s social services or the police—it is vital that they take action.

In response to a 2005 Northern Ireland Department of Justice consultation, the Royal College of Midwives, the Royal College of Nursing and the Northern Ireland committee of the Royal College of Obstetricians and Gynaecologists all backed changes to give more women in Northern Ireland access to terminations. In the absence of a Northern Ireland Assembly, how will the Government deal with this issue?

What we can do is make sure that Northern Ireland women who are presenting here in the UK have the same rights as a woman from England would already have. To my mind, we need to ensure that whether someone’s address is Belfast or Birmingham, if they are here in England seeking abortion services, they have comparable service and comparable rights, and that is what we will seek to do. As my right hon. Friend sets out, though, there is also a debate to be had in the Northern Ireland Assembly. It is of interest that Ireland’s new leader has talked about bringing forward a referendum on abortion in Ireland next year.

Hate crime is entirely unacceptable. As the hon. Gentleman will know, we have developed and are now funding a hate crime action plan. Alongside that, it is important that we work upstream. The work that we are now doing on bullying in schools can play a massive role in the long term. I also draw the House’s attention to the recent social attitudes survey, which really showed that tolerance and inclusiveness of LGBT rights are now widely accepted across the country, but there are clearly still pockets of intolerance, which we absolutely have to combat.

There are record numbers of women in this Parliament, but women are still outnumbered by men two to one. Will the Government consider the recommendation in the report of the Women and Equalities Committee to bring into action section 106 of the Equality Act 2010 to ensure that each political party is transparent about the gender of the candidates they field?

We will be responding to the Committee’s report. These are incredibly important issues for our country. I am concerned to ensure that, although we have now broadly got up to a third of parliamentarians who are female, we do not now plateau. We all have a role in ensuring that we continue to see progress, and I assure my right hon. Friend that I am committed to ensuring that the Government play a leading role in that, and I am proud that we also have a female Prime Minister.
