This has been quite a consensual debate. It has not been as noisy and pacey as the debate about Europe that we had on Monday, but there has been a great deal of quality and quite a lot of unity, not only on the importance of the Council of Europe, but on the need to reform some of its institutions, such as the European Court. I welcome the Minister’s remarks and those of the Labour representative, the hon. Member for Wolverhampton North East (Emma Reynolds), although I think she might have made a slight slip of the tongue when she suggested that the landmass covered by the Council of Europe stretched from Vladivostok to Reykjavik. The term “landmass” might come as something of a surprise to the Icelanders.

I pay tribute to all the members of the British delegation. I am sure that my hon. Friend the Member for Portsmouth South (Mr Hancock) will be sorry that he is unable to contribute to today’s debate as he is feeling rather unwell. He is a committed member of the delegation, and I am sure that hon. Members will regret not hearing one of his robust contributions. I also pay tribute to the hon. Member for North Dorset (Mr Walter). He burnished his European credentials earlier this week, but he has received so many accolades today as the leader of the British delegation that that fact is worth mentioning too.

It is an enormous honour for Britain to take on the chairmanship of the Council of Europe. As the Minister highlighted, Britain was involved right at the beginning in establishing the institution, which was forged from the embers of wartime Europe and has promoted human rights, freedom and democracy, the rule of law and cultural co-operation ever since. It is sad that we are now so complacent that in some circles the phrase “human rights” has become something of a dirty word. Indeed, on occasion even the rule of law and the right of judges to interpret human rights have been questioned.

The Council of Europe shows that this is an important area that needs to be defended. Obviously the Council of Europe has a much lighter touch than the European Union and its institutions, but that gives it a much wider and more comprehensive remit. It has not just touched on human rights: we also have conventions on cybercrime, pharmaceuticals, the prevention of terrorism and the prevention of torture, and—as the hon. Member for Linlithgow and East Falkirk (Michael Connarty) pointed out—on trafficking human beings and on racism and intolerance, including intolerance based on religious belief or non-belief.

The complacent and sometimes rather lazy criticism of human rights and institutions at the European level can easily drift into a reversal of the progress that we have seen in all these enormously important areas. The hon. Member for North Thanet (Mr Gale), who is no longer in his place, pointed out how important it is not just to accept that the conventions exist and that a piece of paper has been signed, but to ensure that cases are considered in detail and measures are enforced in member states. However, that does not mean that there is no need for reform. The Liberal Democrats welcome the Government’s initiative to look into reforming Council of Europe institutions. The European convention on human rights is something that we should stoutly defend. We were the first state to ratify it, and we should certainly welcome the European Union’s accession to it and the application of those disciplines to its institutions.

During the lifetime of this Government, will the Liberal part of the coalition veto any attempt to repeal the Human Rights Act 1998?

I do not think that there is any suggestion that we will repeal the Human Rights Act, which actually allows this country to exercise its sovereignty by bringing the European convention on human rights into British law and giving British judges the right to enforce it. That is a re-enforcement of British sovereignty, so I would be surprised if any such suggestion were made.

However, the European Court of Human Rights clearly has a lot of problems. Mention has been made of the 155,000-case backlog. Obviously it is right that the British chairmanship should work to ensure that the Court’s judgments are implemented across the rest of Europe as well as they are in the UK, that its membership is of sufficiently high quality and, most importantly, that it does not act as a substitute for domestic courts.

One good initiative by the coalition has been the establishment of the commission on a Bill of Rights, which has already made interim recommendations on reforming the Court. The commission said in July:

“It is essential for the Court to be able to address cases involving serious questions affecting the interpretation or application of the Convention, and serious issues of general importance, where the Court’s intervention is justified. The Court should be a court of last resort, and not a first port of call for all human rights issues. It should be adjudicating hundreds of cases a year, not thousands, and certainly not tens of thousands, and ensuring that the principle of subsidiarity is observed by national institutions with the primary responsibility for the protection of human rights”.

The British chairmanship should build on that report, and seize the opportunity to take forward reform of the Court. I also hope, however, that the UK chairmanship will not be entirely distracted by the mechanics of human rights, and that it will champion those rights where they need to be championed.

In that respect, the UK chairmanship can build on the excellent work of the Foreign Secretary in his extensive report on human rights and democracy produced last year. It contains a list of countries causing concern to the British Government because of their human rights record. That list includes several European countries and one member state of the Council of Europe. Outside the Council of Europe it highlights Belarus, which is currently barred from membership because of its human rights record. The Foreign Secretary’s report describes “successive waves of repression” in that country. The Deputy Prime Minister has referred to it as “Europe’s shameful secret”. The Liberal Democrats’ own youth organisation has highlighted the struggle of its Belarusian sister organisation, Civil Forum, stating that its members

“continue to protest against the regime despite the potential violence they often face. Their struggle for human rights and political freedom is an inspiration to the global Liberal Youth movement.”

Sadly, I am sure that similar things could well be happening in such organisations in other political traditions as well. If the UK chairmanship can advance the cause of human rights in Belarus, that would be extremely welcome.

Russia also gets an unfavourable mention in the Foreign Secretary’s list. The report talks about

“restrictions on freedom of assembly, harassment and obstruction of NGOs and journalists”.

It also states:

“Human rights defenders in Russia remained at high risk in 2010.”

It highlights the cases of Oleg Orlov, of the human rights organisation Memorial, and of Sapiyat Magomedova, a human rights lawyer. It also mentions the trials of Mikhail Khodorkovsky and Platon Lebedev, and talks about the circumstances surrounding the murder of Anna Politkovskaya, about which many questions remain unanswered. This is all very sad, because Russia has for centuries been a pillar of European culture and civilisation, and it needs to understand that showing respect for freedom, democracy and the rule of law is absolutely essential if it is to become a full member of the European family of nations.

As well as mentioning Belarus and Russia, the report also refers to examples even closer to the heart of Europe. Hungary’s new constitution gives cause for concern, and Amnesty International has highlighted issues in it relating to the rights of women, as well as to

“the provision allowing for life imprisonment without the possibility of parole…and the exclusion of sexual orientation from the protected grounds of discrimination”.

Hungary was in many ways at the starting point of Europe’s democratic revolution in 1989. It is a free democracy, and a full member of the Council of Europe and of the European Union, and it would be a great shame if it were to acquire a poor reputation in the area of human rights. I hope that under the UK chairmanship of the Council of Europe we shall see proactive debate and promotion of human rights, democracy and the rule of law.

I welcome the Minister’s remarks on the forthcoming London conference on cyberspace. It is important for it to tackle the threats from cybercrime and even co-ordinated cyber-attack. I also hope, however, that, in line with our role in the Council of Europe, it will emphasise the values of freedom on the internet and in cyberspace. Throughout the whole episode of the Arab spring so far, we have seen how important that freedom can be to championing democracy and human rights.

On the question of the budget, the Council of Europe is a relatively small institution in the great continental scheme of things, but it has had a staggeringly large impact for its size, and I believe that it provides very good value for money. The United Kingdom should pursue an active and successful chairmanship of the Council, as that would be in our national interest, as well as in the interest of our citizens and citizens across the whole continent of Europe.

The hon. Member for Bassetlaw (John Mann) is my next-door neighbour across the Trent, so I hope that there will be a sort of symmetry to our speeches; I will balance his speech for the purposes of the Gainsborough Standard. He is, of course, an ornament of Parliament, not least because he succeeds in irritating his own side as much as us, which is very good.

You, too, are an ornament of Parliament, Mr Deputy Speaker. You are also a former member of the Council of Europe. We all recall you often flying the flag for Britain on a Friday when everybody else had gone home. We are very grateful for all the work you did in the delegation. I am not sure that anyone has yet thanked you, so I wanted to put that on the record. In the Council of Europe we are restricted to three-minute contributions. I cannot promise that I will take as little as that, but I shall try to be as quick as possible because I know that others want to speak.

I am very proud to be a member of the Council of Europe. When we go there we see some marvellous history laid out in the foyer, with pictures of Winston Churchill speaking to one of the first sessions, if not the first. There is something very noble about this concept which, as we know, arose out of the second world war. The Council of Europe was a tremendously powerful mechanism in saying that we were never again going to have the horrors of Nazism and fascism. We should also be very proud of what the immediate past generation of members of the Council of Europe achieved in the whole transition to democracy in eastern Europe, of what the Council of Europe has achieved in eastern Europe and of how we are really defending human rights in eastern Europe, where there have been the most appalling and profound abuses, as there were in western Europe before 1945. To me, that is what the Council of Europe, the European convention on human rights and the Human Rights Act 1998 are all about; it is about the fundamental freedoms that, from Magna Carta onwards, we have built up in this country. We have become a beacon of those freedoms. We all know what they are: freedom of expression and of religion, the right to privacy and a family life—wonderful, basic freedoms. That is what I believe Winston Churchill was talking about, but what we have now seen is judicial creep way beyond anything ever envisaged when the convention was agreed.

There is a misunderstanding about this issue. Nobody on the Government Benches is suggesting that we should leave the convention. I am proud of the convention that we signed in 1949. All we are attacking is the incorporation of the convention into our law under the Human Rights Act 1998, which was passed by the Labour Government. That is our gripe. Nobody is denying that we should be a member of the Council of Europe or that we want to reform it, but this has become a very serious issue. If one looks on the front pages of the newspapers today one will see, just to take one issue, that the population of this country is due to rise within 20 years to 70 million people—a figure that the Labour Government said was quite unacceptable and would never be reached. Two thirds of that increase comes from immigration—that will put a severe strain not only on services but on good relations and human rights. This issue of immigration is therefore important.

If the Minister for Immigration were here and were allowed to speak openly about what is happening in his Department, I am sure that he would have to admit that he is severely constrained in what he can do to deal with this problem of immigration in order to foster good race relations because of the incorporation of the convention into our law. Although he cannot tell us, because he is a Minister, what is going on inside his Department, we have, as I mentioned earlier in a couple of interventions, now heard from a former Minister for Immigration. His diary really is worth revealing because it tells us in great detail what is going on. This is not some right-winger speaking: it is a former Labour Minister—a person who voted for the 1998 Act, was then put in a position of responsibility and was, frankly, driven mad by it.

I am tempted to discuss the issue of immigration and suggest that it is more to do with providing the skills in the right jobs, as that is what is drawing in immigration—that is something that the coalition is tackling.

The hon. Gentleman talks about getting rid of the Human Rights Act, which effectively means taking the ability to interpret the convention out of the hands of British judges and giving it back to European judges. Does he not trust British judges or does he think that by doing that we will somehow not be implementing it as fully as we would be if it were in British law?

I am grateful to the hon. Gentleman because this addresses precisely the point I want to make. I believe that the convention as we understood and implemented it from the late 1940s to the late 1990s was about the protection of fundamental rights. It was understood to be a matter of last resort. If somebody was really dissatisfied with the way that their human rights had been treated in British courts, for example in the immigration process, they could, if they wanted—frankly, after they had been removed—take a case to Strasbourg. What has happened since then—since we have incorporated it—is that we have had a tidal wave of cases coming to our own judges, and they have interpreted the convention in such a way that makes it very difficult for Ministers to do their job. Members of Parliament might not worry about whether it is bad to make it difficult for Ministers to do their job, but Ministers are responsible to this Parliament. This is the democratic forum of the British people. This Parliament should be supreme—not the courts.

If hon. Members do not believe me, they should listen to what Mr Woolas said. I have already mentioned the case. For years we had been working on both sides of the House against forced marriages and we had been trying to raise the age of women coming here. I mentioned in my intervention on the hon. Member for Wolverhampton North East (Emma Reynolds) how that had been overturned by judges. I ask hon. Members to listen to this quote from Phil Woolas, the former Labour Minister for Immigration, which directly mentions the European Court. He said:

“We have four people wanted for genocide in Rwanda (there are 100 but the four are the test case)”—

so we have here four people who are wanted for quite serious crimes, so not very nice people. The quote continues:

“The magistrates had agreed to extradite them but the High Court had disagreed on the grounds that they would not get a fair trial in Rwanda.

I am advised”

“that I should grant six months leave to remain in the UK ‘in the hope that the legal system in Rwanda improves’.

I had asked why we couldn’t try them in The Hague and was told as they were not British, I couldn’t send them there!

So a person accused of committing genocide in an ‘unsafe country’ (which country that has genocide is safe!) simply has to get into an ECHR country and they will get away with it. The ECHR is providing cover for people who commit genocide. Madness.”

That is not me speaking—it is a Labour Minister.

I will refer to another case and then I will stop. There were many others, and I recommend that hon. Members read what is going on inside the Department, because it is our only insight into what is actually happening across Ministers’ desks.

“The French Navy detained some drug smugglers in the middle of the Atlantic. It took 14 days to get back to France because the ship was on patrol. But the…gangster took the French government to court for unlawful detention under the ECHR, saying he should have been dealt with sooner!...The smugglers have been released…I have now asked why we can’t change the law to stop this abuse but the MoD don’t want me to as they are using the same defence to protect six British soldiers, now back in the UK, who are being sued from Iraq after being accused of unlawfully detaining suspect insurgents in Basra…So, we cannot detain suspected gangsters at sea and the Human Rights Act applies in Basra. Unbelievable.”

That is not me speaking; it is a Labour Minister.

That is what we have come to, and it is now affecting national policy in a very profound way. The House may not agree with me about immigration, but I think it is a very serious issue for our country. We have to grapple with it if we are going to ensure good race relations in the future. I believe that a population of 70 million is unsustainable. You may not agree with that, Mr Deputy Speaker, but surely you agree that this House, and Ministers responsible to us, should have the right and the power to deal with it; you do not believe that at all times their hands should be shackled behind their back because of a European convention that has been interpreted in such a way that it goes way beyond what anyone envisaged when it was set up.

The European Court of Human Rights has a proud history of defending the rights of individuals, but there is no doubt that there have been several questionable judgments that raise issues about its competence across the piece. I refer to the membership of the judges’ bench. It has already been said that a number of judges have little judicial experience, and indeed that some of them were political appointees. That does no good for the whole concept of jurisprudence. We ought to be making an effort to ensure that a court of this importance is matched by the quality of the judges who sit on its benches, and the sooner we get down to that, the better it will be. One judge was reported not to understand the concept of legal precedents. When one gets that sort of ignorance in a court of this kind, one begins to wonder what sort of justice it imparts. Indeed, many people in this country have begun to believe that some of its judgments are, to say the least, beyond the pale. Those people are responsible for overturning the decisions of this House and our courts, so we have a right to expect a greater degree of competence and better qualifications. I know that the Minister will take those thoughts on board.

My next point is about languages—a subject touched on by my hon. Friend the Member for North East Hertfordshire (Oliver Heald). The 2005 Woolf report made 26 recommendations on the working methods of the European Court of Human Rights. One was the provision of language training, and yet that has not been implemented. We all know that interpreters can change the nuance of language dramatically when they interpret one language into another. Because the nuance changes, the meaning can be totally different. That is simply unfair to the people who put their trust and faith in the European Court of Human Rights. I urge the Minister to put language training for judges on his little list as an absolute priority.

The 2010 Interlaken conference and declaration stressed the need to preserve the high quality of the European Court of Human Rights. I have already referred to the lack of quality. This matter is consistently asked about, and it is consistently recorded that we need to do things. No wonder the people of this country get a little impatient when nothing happens. I want to send the European Court of Human Rights the message that it must get its act together, because it is undermining the confidence of the people of this country—and, no doubt, that of the people in other countries—which is so necessary for it in doing its work.

I was going to talk about prisoner voting, but we had a big debate on that recently. Suffice it to say that I believe that prisoners are in prison by choice. They are not forced to break the law; they choose to break the law. Therefore, there is no problem with the removal of that human right. They choose to deny themselves that human right. We ought to do some plain talking when this matter comes before the Committee of Ministers.

I also question the judges’ appreciation of our values and legal procedures. This nation is lucky to have a common law based on almost 1,000 years of life experience—a common law that has served this nation well. To my mind, it covered all the necessary protections of the people of this country. Indeed, they seem to think that it covered the necessary protections themselves. The fact that there are so many different codes of law in a 47 nation-strong Europe underlines the need for greater knowledge of the various codes of law in those countries. If necessary, that might require a division of the judges’ bench. We certainly need them to understand our code of law if they are making judgments about our citizens.

I am delighted to say that most senior judges believe in the primacy of Parliament, and I have no concerns about that. A few judges have tried to argue differently. Only recently, I noticed the remarks of a senior judge in the Court of Appeal that underlined the importance of the primacy of this place.

I want other people to be able to speak, and many Members have spoken for a long time, so I will reject the hon. Gentleman’s request on this occasion.

I wish to touch briefly on the 162,000-case backlog in the European Court of Human Rights. We all know that it is farcical, and that something must be done about it. I am glad that the Minister has decided to do something. However, I must ask him something. I was once told by a fortune teller that I would live to beyond 80, which would be another 11 years. Will the measures that he puts in place during our chairmanship be completed, and will the list be eradicated, in that time? It worries me, and I want to go to meet my maker with a clear and untroubled mind.

Finally, I wish to say that I know the Minister cares about these matters and is well placed to represent us in respect of them. I look forward—for the first time in many years—to action on the European Court of Human Rights that will give the British people confidence. If the Minister comes away after the six months of the British chairmanship having achieved that objective, we will all be prepared to say, “Very well done, Minister!”

It is a great pleasure to follow my hon. Friend the Member for Folkestone and Hythe (Damian Collins). I am sure that football supporters throughout the United Kingdom would echo his remarks—as an England supporter, I certainly endorse what he said—and I am sure that everyone shares his concern about how our beloved game is being administered internationally.

I have already paid tribute to my hon. Friend the Member for North Dorset (Mr Walter) for his sterling work in leading the British delegation to the Council of Europe, but I would also like to pay tribute to Opposition Members who have led the delegation while I have been a member of it. I also pay tribute to my hon. Friend the Member for Christchurch (Mr Chope), who is the chairman of the Council of Europe’s migration committee, on which I have the pleasure of serving, for all his hard work in that capacity, and in such an important field. It has been instructive and interesting for me to see how other European Union member states and their representatives view migration. For my part, I am concerned that the questions of who should be permitted to cross borders, who should be permitted to reside in countries, settle in them and become citizens, and who should be removed from them should principally be a matter for member states’ Parliaments and not determined by European law. We must be careful to ensure that the jurisprudence of the European Court of Human Rights does not obtrude unnecessarily in the field of migration.

I want to make three points about what lies ahead for the British chairmanship of the Council of Europe. The first concerns the European Union. I have already made one speech in the Chamber about the European Union this week, and Members might feel that one is enough for a week—I certainly feel it is. However, it is not me who is bringing the European Union into this debate; rather, the European Union is bringing itself in. It seeks to accede to the European convention on human rights and wants Members of the European Parliament to participate in some of the Council of Europe’s activities. I have many reservations of principle about the accession of the European Union to the Council of Europe and the European convention on human rights. I am not clear on what basis the EU seeks to accede to the convention, because every other member of the convention is a nation state and the EU says that it is not one. I am not clear as to whether the change is needed, because the member states of the European Union are already members of the Council of Europe and the European Union already has a charter of fundamental rights, to which the treaty of Lisbon gives legal effect, covering much the same ground as the European convention on human rights. As a result, the prevailing legal position on human rights in Europe could be complicated by the two sets of conventions.

Surely the point is that the European Union institutions should not be beyond the reach of the convention. Is the hon. Gentleman not missing the opportunity to take the European Commission to the European Court?

We continue to make representations on all examples of activities that we believe will damage the economy of the occupied Palestinian territories. The hon. Gentleman’s point about agricultural produce is a good one. Agricultural exports from the Palestinian territories were 10 times greater in 2010 than in 2009, but one tenth of what they were in 2006. That gives a measure of the problem. We do indeed raise the matter, and we ask both sides to continue their efforts towards negotiations on a final settlement that would, of course, ultimately be in the economic interest of both.

The prisoner exchange involving Gilad Shalit has been presented by Hamas in Gaza as a victory. Does the Minister agree that the cause of moderate Palestinian opinion, and perhaps even the Palestinian economy, could receive a boost from a successful bid for recognition of its statehood at the United Nations?

There are two issues there. First, the unconscionable detention of Gilad Shalit by Hamas was no cause for any victory celebration. We certainly welcome the fact that he has been released and hope that it indicates at least some degree of movement between the two parties. Ultimately, of course, what will benefit all is a negotiated settlement that leads to an independent Palestine side by side with a sovereign and recognised Israel. All the work that the United Kingdom does is to ensure that that is the most likely outcome of the various discussions that are taking place through the Quartet and the UN alike.

The hon. Gentleman will know, as I am sure he read the Liberal Democrat manifesto very carefully, that we committed to an in/out referendum at the time of a fundamental shift. That is why we supported an in/out referendum and proposed one in this Chamber at the time of the Lisbon treaty. Perhaps he can explain why every one of his then Conservative colleagues voted against that motion.

The right hon. Gentleman is making an unfortunately partisan speech and misrepresenting the clear Liberal Democrat pledge to support a referendum at the time of a fundamental shift in the relationship between Britain and Europe—I am sure that that will be pointed out many times today. Should we not instead be uniting to counter the threat to the £351 billion of direct investment from other EU states posed by discussion of a referendum at this vital time?

I think that the person who started with a partisan speech was the Foreign Secretary, who was at pains continually to assert the position of the Conservative party—a very different approach from that of speaking on behalf of the Government, which is the conventional approach from Government members. However, if the hon. Member for Cheltenham (Martin Horwood) wants to continue to defend and account for the position of the Liberal Democrats, I wish him the best of luck.

They can explain why, throughout a general election period, they gave out thousands of leaflets promising a real in/out referendum in which they would be prepared to defend their principled stand of wanting to stay in Europe.

I was surprised that the hon. Member for Bolton North East (Mr Crausby) lost the plot by getting hung up on the wording. My hon. Friend the Member for Bury North (Mr Nuttall), who proposed the motion, has got it absolutely right, and I hope the hon. Gentleman reconsiders his position.

The argument tonight is not about the wording; it is about whether or not we give the hundreds of thousands of people who want an opportunity to discuss this issue the chance to do so. Whichever side of the argument people fall on, and whatever the answer may be, we should not be frightened of simply giving them the chance to have that debate. That is what we are voting on. We are not voting on the wording. We are not voting on whether we should be in or out. We are voting on whether we want to give the British people a chance to hear the arguments in a reasoned way, rather than hear them as a result of a knee-jerk referendum called because Europe suddenly decides to do something we do not like. I would much rather that we have the chance, whichever side of the argument we fall on, to go out to make the case in a reasoned way. I would rather the wording be carefully crafted in a Public Bill Committee, not cobbled together because Europe suddenly does something we do not like and we say, “Oops, it’s a treaty change. Oops, we need to have a quick referendum.”

Let us do this at our pace. Let us not be frightened of the answer. I do not know what the answer will be. It might be one that I do not like, but I am prepared to live with it. I, too, have never voted on whether or not we should have joined the Common Market, as my mother would have called it, but I know from talking to people that they feel strongly that it is now time to talk about this matter, because we are dealing with something completely different. I am sick of hearing the word “referendum” touted around when it is popular with the voters and then seeing it kicked into the long grass when it falls into the “too difficult” box. This is not the “too difficult” box.

I ask the hon. Gentleman to join us tonight to say, “This is now what we should be doing.” He may just throw brickbats and not consider what the Liberal Democrats promised the people, but he has a chance to renew that promise tonight. We have a chance tonight to engage with what the people are asking us to engage in. Our leader promised us that we would have a chance to vote on the Lisbon treaty and we voted accordingly, but we did not have it. We have a new chance now.

This motion is not about reliving history, but it is about looking at how we have engaged with the voters over the past few years. My hon. Friend the Member for Gravesham has got it absolutely right: we have to be principled. For those who have maintained a principled plea to be given the chance, tonight is that chance. If the wording is not quite as some people would like, they should not worry because there will be a chance to craft it in Committee. Hon. Members should not feel that unless they can agree with every little word in the motion they cannot go through the Lobby with us. The wording is only suggested; the principal thing we are voting on tonight is whether we are going to listen to the people and say, “Let’s engage in this argument.” Let us not just park it in the “too difficult” grass, with promises of referendums tomorrow, because they may never come; and if they do come, they may come at a very inappropriate time to make the argument with the British people.

I do agree. They could not really treat us much worse.

From my perspective and that of my constituents, whom I have the privilege to represent, the EU is getting its hands on more and more aspects of the British way of life. My hon. Friend the Member for South East Cornwall (Sheryll Murray) spoke about the effect on this country’s fishing industry, which has been destroyed by our membership of the European Union. Our membership fee has more than doubled. Nine out of every 10 jobs in this country go to foreign migrants, most of whom come from the European Union. These issues are not of concern only to right-wing people; they are of concern to every person in this land.

This debate is exposing an increasing disconnect between our constituents—the residents we struggle to represent—and the Front Benchers of Her Majesty’s Government and Her Majesty’s Opposition, who have tried to deny debate on this issue. One of the qualities of the Backbench Business Committee is that it chooses subjects for debate in this House that the Government would not otherwise allow. That is why the Backbench Business Committee chose this subject. We would not be having this debate if we had left it up to Her Majesty’s Government.

I have a confession for the House: I do not believe in ever closer union. I think it is wrong in principle and I think the British people do as well. I have another confession for the House: I believe that Britain would be better off out of the European Union altogether. I do not expect a majority in this House to agree with that, but I am privileged to put that on the record on behalf of my constituents in Kettering. I believe that if we were to have a referendum on in or out, most of my constituents would vote to leave because they have had enough.

This is an important debate. In a sense, I commend the 100,000 people who brought it about for bringing these issues into the open, not least because it has allowed Conservative Members such as the hon. Member for North Dorset (Mr Walter) and the right hon. and learned Member for Kensington (Sir Malcolm Rifkind) to find their eloquent, pro-European voices. Many of us are perhaps guilty of having let the Eurosceptics dominate this area for far too long.

The hon. and learned Gentleman has anticipated my next sentence. There has been a lot of talk about manifestos in this debate, so I will tell the House exactly what the Liberal Democrat manifesto said. It stated:

“Liberal Democrats…remain committed to an in/out referendum the next time a British government signs up for fundamental change in the relationship between the UK and the EU.”

We support that now, we supported it at the general election and we supported it at the time of the Lisbon treaty, when such a fundamental change was actually being discussed. What is more, we put the matter to a vote of the House at that time, and many hon. Members who are now rising in criticism voted against it, including the hon. Member for St Albans (Mrs Main) and, actually, the hon. Member for Broxbourne (Mr Walker), who succinctly asked earlier, “If not now, when?” Well, the answer was then, and I am afraid he missed the chance.

I recall that debate about referendums at the time of the Lisbon treaty. One got the impression that the Liberal Democrats wanted to say they were in favour of a referendum but not vote for the amendment that might actually create one. It was a cynical manoeuvre and just the kind of thing that has brought the House into disrepute with the British people.

May I also remind some Conservative Members of what was promised in their own manifesto? It promised that any proposed future treaty that transferred areas of power or competences would be subject to a referendum lock. Of course, they actually got that in the European Union Act 2011, which we all voted for only a matter of weeks ago.

Let us look at some of the options on offer in the motion. We have the renegotiation option, which, frankly, is a fiction. What kind of negotiation would take place if we actually tried to do that? What price would Monsieur Sarkozy or Frau Merkel extract in those negotiations for the disruption and risk that would be posed to the working of the Union? Why would the renegotiation succeed if the other 26 member states did not support it, and why would they support it if the only issue of debate was Britain’s terms of membership? That is why it is such a nonsense to extract renegotiation from any other fundamental shift in relationships that would be happening at the time.

I am sorry, I have taken my two interventions.

What I believe all factions of Eurosceptics are really calling for in this debate is withdrawal. That is what they really believe in, let us be honest about it. They perhaps want membership of the European economic area, maybe without the complexities of European Councils or the political complexities of the European Parliament, and I assume without complexities such as the border controls of the Schengen agreement. Let me tell them that there is good news for them. There is one very beautiful country that has achieved that exalted status. One country is a beacon for the Eurosceptics. One country is a member of the European economic area but not of the European Union or Schengen. It is Liechtenstein. That is the level of influence that the Eurosceptics are demanding for this country. They would give up our influence on the European market and our influence as a member of the EU on negotiations from climate change to world trade. They would condemn us to the sidelines of Europe and do profound damage to the interests of this country.

I am old enough to remember a Europe where military, communist and fascist dictatorships outnumbered democracies. One of the greatest achievements of the European Union is that we have between us—27 sovereign states and 500 million people—created a peaceful, democratic federation of which we, as Britons and as Europeans, should be profoundly proud. I am very proud of that. I believe that this is the wrong motion at the wrong time, calling for a referendum that would not work and that would do profound damage to Britain’s national interests, and I think we should throw it out tonight.

We know from experience that we cannot rely even on the assurances given to us by our European partners. In 1992, we thought we had opted out of what was then called the social chapter. We thought that would protect us from the working time directive, but by the end of that Parliament the EU had circumvented the opt-out in typical fashion: it used a different treaty base to force the directive on to our statute book, against the wishes of our Parliament, by making it a health and safety programme.

The same thing is happening with the agency workers directive, which the Government have bitterly opposed because they know that it will price more young people out of the labour market. We now have above-average youth unemployment in this country when it used to be below-average.

I hope the hon. Gentleman will forgive me, but I have given way twice.

The same thing is happening in the regulation of the City of London. If there is one thing that we should never have agreed to in principle, it is that the European Union and Michel Barnier should take over the regulation of the City—our biggest single tax generator. That was driven by a misplaced notion that Bonn, Frankfurt, Paris and the City should be given equal status as global financial centres. That would be disastrous for the City.

We should oppose the Tobin tax on principle, because at the end of the day, it is another tax that takes money out of the pockets of ordinary people, but you wait, Mr Deputy Speaker, the financial transactions tax proposed by the EU will be forced through on some spurious treaty basis.

It is amazing how united the Conservative party has been so far today. We had a Eurosceptic statement from the Prime Minister and then a Eurosceptic speech from the Foreign Secretary, so it can only be the Liberal Democrats who are inveigling us down the path of unrighteousness and taking us away from supporting the motion. The Foreign Secretary made six points that must have been written for him by the Liberal Democrats, because he is far too clever a man to have thought of them for himself, because they do not really add up. I shall go through them.

The Foreign Secretary made two points that were essentially trivial—too trivial for a man of his standing. They were, first, that there was no manifesto commitment for a referendum. However, manifestos can deal only with what is known at the time; they cannot deal with things that have not yet arisen. The crisis in the eurozone and the changes that could come from it were not known with clarity at that point, so it is now right to think beyond the manifesto to what the next steps are. That point can therefore be discarded.

The Foreign Secretary then said that we had passed an Act of Parliament to deal with when we could have referendums, and so we did; but again, this House knows many things, but it is not omniscient. It cannot take care of every occasion that may arise when a referendum may be a good idea or every occasion when the British people—whom we should trust—may want one. So, those two points go.

The other two points that do not add up to much were, first, that a three-way referendum is confusing. However, that is not a problem because the motion calls for a Bill in the next Session, which can deal with any confusion. We can, in our wisdom, work out how to phrase a referendum—or series of referendums, if necessary —that will be understandable.

I am grateful to the hon. Gentleman for giving me an extra minute—it is kind of Gloucestershire to give something to Somerset for once. That issue can be dealt with in the legislation. Indeed, we could have two referendums. As it happens, it might make more sense to have the second referendum after the renegotiation is completed.

The fourth point that did not work was that the EU was all or nothing. However, it is already not all or nothing: we already have opt-outs and so forth. There are therefore two remaining points—as those who are good mathematicians will have worked out—that we need to look at. One was that we are dealing with this issue in a crisis and this is therefore the wrong time: “When a man’s house is burning down, you send in the fire brigade.” Quite right. But then, when he wants to hire someone else’s house nearby to find fresh accommodation, they can set the terms of the tenancy. That is the position that we are in with the European Union—a very strong negotiating position, which we should maximise.

We should also note that we cannot solve our financial crisis until we have freed ourselves from the yoke of European regulation. Only this weekend, we have seen that Tesco is going to take on fewer part-time people because of a directive from Brussels. Are we really going to deny our citizens growth because Brussels wants to put a further yoke on them?

I am sure that the constituents of East Surrey will have followed the speech made by my hon. Friend the Member for East Surrey (Mr Gyimah) with great interest this evening.

In the 1975 referendum, the country was assured—by a Conservative Prime Minister, I am afraid—that there was no question of any erosion of national sovereignty. The people were told that we would have a veto over any important issue, yet those same people have now seen that what they were told was a common market has become a political union in which we can be outvoted, whether we like it or not. They see other countries not following the rules when our country does follow them, and they see an institution whose accounts have not been signed off for some 20 years, yet we continue to give it money year after year. In the coming year, we are giving the European Union £10.9 billion. That is the net contribution, taking account of what we get back. Indeed, in every year except one, we have given more money to the EU than we have got back. That one year was 1974, the year before we last had a referendum on this matter. That was the only year in which we received more money from the EU than we gave. Members who have yet to make up their mind might like to reflect, in the light of that £10.9 billion, that when putting pressure on the EU to reduce our budget contribution, nothing would concentrate its mind more than the knowledge that this country might hold a referendum on our membership of the EU.

There now has to be a referendum. The people have heard too many promises, made by too many parties over too many years. They now want to decide for themselves what our future in Europe, or as an independent country, might be. There has been significant movement on this side of the House during today’s debate. My hon. Friend the Member for Keighley (Kris Hopkins) asked why we were having this discussion, 18 months into the Parliament, and why there was so much disagreement. He wondered why the coalition did not agree on this matter. The reason is that the 57 Liberal Democrat coalition Members were given the referendum on the alternative vote that they wanted, yet a far larger number on the Conservative Benches have not been given the referendum that we want on our country’s position in the EU.

We have discussed this already. The Conservative manifesto did not make a commitment to an in/out referendum; it committed to a referendum lock, which we have achieved through the European Union Act 2011.

The Conservative party had offered a referendum on Lisbon. The Liberal Democrats had offered a referendum with a choice between the EU with Lisbon and leaving the EU. However, what the country got, through the coalition agreement, was the Lisbon treaty and no referendum on anything. Three or four days ago, the Liberal Democrats’ website was still campaigning for an in/out referendum, but that has now been removed. Not only have they gone against what they told the electorate on student fees, but they have done the same on Europe.

We think that the recognition of a Palestinian state is something that needs to be achieved within the framework of negotiations. That is certainly the best way in which to go about it. It now looks as if Palestinian action at the United Nations this month is increasingly likely. We are working closely with partners to build consensus on a way forward that recognises the progress Palestinians have made on their state-building efforts, that meets Israel’s legitimate security concerns, and that avoids confrontation at the UN, which would have a damaging effect on the resumption of negotiations. Whatever action is taken in New York, it is important that that increases and does not diminish the prospects for a return to negotiations. We have reserved our position on the question of recognition of a Palestinian state while we continue to urge all parties back to talks. Recognition is a matter for each Government to decide bilaterally and, if needed—no resolution has yet been tabled—we will take a decision nearer the time, in consultation with the European Union and other partners.

It is important to remember that action in the UN is not an end in itself. September is not the closing date for resolution of this conflict. What happens afterwards is vital, which is why our goal remains ensuring that steps are taken now to pave the way for significant and conclusive talks, and why we believe it is vital that any action in the UN does nothing to endanger the prospect of such talks.

As co-chair of the Liberal Democrat international affairs committee, I would welcome a British yes vote in September. Is not the irony of the American and Israeli position in opposition to this that both the United States and Israel themselves declared their own statehood in advance of the final resolution of their negotiated borders and many other issues?

The hon. Gentleman makes his point tellingly and well, but I will not be drawn into 1776 and all that. We want the new generation of Palestinians to grow up in hope, not despair, believing in a peaceful settlement with Israel, and not impoverished and not susceptible to terrorist recruitment. I want to assure the House that this Government will not cease in our efforts to support the parties in finding a long-term sustainable solution to this conflict that will make that vision a reality.

There have been some fascinating contributions to the debate, not least the eloquent and expert contribution by the right hon. and learned Member for Kensington (Sir Malcolm Rifkind).

I start by doing what many others have done in the Chamber many times, but is still worth doing—paying tribute to our armed forces and, in particular, to those who have lost their lives. I would like to make special mention of Colour Serjeant Kevin Fortuna, who went to school in my constituency and who lost his life not that long ago in Afghanistan. I do not think that he died in vain. The presence of Colour Serjeant Fortuna and many others helps to achieve the central aim of our presence in Afghanistan, which is to protect the security of this country, but has also increased the chances of Afghanistan being a more stable and peaceful country at some stage in the future. If it is not a perfect democracy, that was never one of the core aims of our intervention.

That is why I am slightly puzzled by some elements of the Foreign Affairs Committee’s report. It makes a couple of highly controversial claims. It states that the core justification of the UK presence, which was the threat posed to national security by al-Qaeda in particular, was removed some time ago, but somewhat contradictorily, it suggests that the security situation is still precarious. The right hon. and learned Member for Kensington made exactly the right answer to that, which was that even if that was true, and even if al-Qaeda has been massively damaged in its capacity to regain control of Afghanistan, we still have to find a way of extricating ourselves from the position we are in now in a way that maximises the Afghan Government and society’s chances of stability and peace. We cannot simply walk out.

The report also suggests that there were wider secondary aims that have now proved unachievable, one of which was the defeat of the Taliban. Again, I am not sure that that was ever one of the core aims. The idea was to increase the capacity of the Afghan national security forces to contain and manage the security situation themselves. That is still an important aim as we proceed through withdrawal.

Rather paradoxically, the report goes on to query the 2015 deadline for withdrawal, but accepts that it has concentrated minds. That is an important function of deadlines, but in some ways the debate has moved on, especially after the Prime Minister’s announcement earlier today of further troop reductions. Quite a few hon. Members have pointed out the hard-headed realism that is needed, and the fact that we are not in a leadership position in Afghanistan—a role that effectively falls to the Americans, as we have only one 10th the number of forces that they have there. That leadership will inevitably pass at some stage to the Afghan Government and the people themselves. Therefore, the troop reductions that the Prime Minister announced today are not only right but inevitable.

Political reconciliation ought to be part of the process that we encourage as the withdrawal takes place, which is something that liberals and democrats might find difficult to accept. Would we have wanted political reconciliation with our enemies in previous wars? Has political reconciliation worked everywhere else it has been tried—in Zimbabwe, for example? If we support democracy, should we not defend it at all costs and recognise that there are non-Pashtun political leaders in Afghanistan who really do not want reconciliation with the Taliban at this stage?

I think that there is a role for political reconciliation if some of the points made in the report and elsewhere are acknowledged, including the importance of recognising the regional context and finding a solution that takes into account not only Pakistan and Iran, but India and Russia, and approaches the region on a wider scale. It should also encourage a political solution that recognises the complexity and diversity of Afghan society, its highly tribal structure and perhaps the need for less control from Kabul and a more decentralised approach. In that situation, such an approach to political reconciliation might be, as the hon. Member for Croydon South (Richard Ottaway) described it, distasteful but worthwhile. It might not be successful, but in a regional context and with an attention to complexity and diversity, it might become more likely.

The UK’s role must be to support development, and preferably not just in militarily volatile areas, to support the institutions of government and society—such support ought to be, if anything, increasing—and to do whatever we can to embed universal human rights in Afghan politics and society, especially the rights of women, while accepting that ultimately that will not be our job, and that those responsibilities will have to pass to the Afghans themselves.

We have to encourage the same thing in the border areas of Pakistan. I commend to the Minister an extraordinary report that recently landed on my desk, produced by an organisation called the Community Appraisal and Motivation Programme, which I am happy to say is funded by the British high commission. That extremely revealing report explores in great detail opinions in the federally administered frontier tribal areas of Pakistan. It shows that there is, unfortunately, a high degree of hostility to British and American policy, but far from universal support for extremist or Salafist militancy. Of the respondents, 42% identified terrorist attacks as the main threat to life, 57% said suicide bombing was never justified, and there was support for military operations by the Pakistani army. The BBC World Service was rated highly as a source of information, and the same kind of attention was given to issues such as education and schools as we would expect to find among people all over the world.

It is a great honour to follow my hon. Friend the Member for New Forest East (Dr Lewis). I agree completely with my hon. Friend the Member for Penrith and The Border (Rory Stewart) in recognising that we need a definite date for withdrawal.

I wish to pay tribute to Rifleman Martin Lamb, who recently died. He was a constituent of mine who was serving his country bravely and correctly, and we remember him appropriately.

The next person whom I wish to mention is my right hon. and learned Friend the Member for Kensington (Sir Malcolm Rifkind), because I agree that it is very important for us to consider the international approach. It is what we do next that matters, and we need to prepare the ground now. I want to talk briefly about the Helsinki accords, the process that they led to and the process of getting to them, and see where the parallels might be with the situation in the region that we are discussing today.

Very bravely, Gerald Ford signed those accords as President of the United States when neither he nor the idea of détente were at their most popular in the US. Nevertheless, off he went to complete the process, which involved 35 states. Many had views that were not consistent with one another, and many had a huge number of reasons to disagree with their neighbours.

Three baskets of themes were captured in those accords, the first of which was security. The idea was to give other member states the confidence that their military position and security issues would be treated fairly and justly. That would be achieved largely by states notifying one another what would happen.

The second basket was politics and the production of good governance—we should remember the governance of some of those states at that time, and certainly, for example, Romania. Good governance was an important part of the Helsinki accords, but it is also an element that we need to deliver in Afghanistan and elsewhere.

The third basket was culture and human rights. Oddly enough, the third basket turned out to be the most influential. Many commentators will now say that the Helsinki accords suggested to repressed people in those 35 states—obviously, I am talking in the main about eastern Europe—that we would give them the comfort and space to develop their interest in having human rights.

If we extend those three baskets, and in particular the third one, to Afghanistan, Pakistan and—critically—their other neighbours, we could engage them in a way that gives shape to their security and traction to better governance, and that starts to equip their people with the idea that they have space to develop their human rights. That model—it cannot be exactly the same as that of 30 or 40 years ago—could be a framework for international co-operation and for involving the various states that we need to involve. That is the kind of thing that would be of interest as we move towards a new phase of politics.

The hon. Gentleman makes an important point, and it may apply in unexpected areas. One of the points made by the Community Appraisal and Motivation Programme report, which I cited earlier, is that the frontier areas of Pakistan have never been fully integrated into Pakistani democratic politics. In effect, they still have the post-British colonial style of military administration. That has isolated people in those areas from mainstream politics, and indeed from the enjoyment of full human rights of the kind that he is describing.

That is exactly right. Another interesting thing about the Helsinki accords is that, oddly enough, they recognised frontiers that had not been properly recognised before. The accords also enabled those frontiers to be changed through peaceful means. Funnily enough, that mechanism was used by the two German states that were unified in 1990. That is a parallel of what the hon. Gentleman says, although the situation is not precisely the same.

We should go down that route and look at the processes that were involved in the accords. We should ask who would participate and how far the region would extend. My belief is that it should be pretty big, and that we should think in terms of 20 or more states in the area. The UK, the US, and Russia and China ought to be involved in the process too.

That is a big project and it will not happen overnight—it will not happen very quickly at all. Most people would recognise that the Helsinki accords took an awful long time to produce anything, but produce something they did. The process worked. It enabled nation states to start understanding one another, to build better governance, and above all, to respect and promote human rights. That is the basis on which we should start, and it would be interesting to see how such a process unfolds if we develop that policy.

The Afghan constitution enshrines those rights. I am not seeking anything more or less than what is already in that constitution. I simply want to ensure that we do not move backwards by involving in the government of Afghanistan parties that might seek to go back rather than forwards.

My hon. Friend is making many important points. In response to the hon. Member for Newport West (Paul Flynn), is it not the case that if the Arab spring, the Arab awakening, has taught us anything, it is that these universal human rights and aspirations are present in every population? It is slightly patronising to regard them as inappropriate for some countries, even in places where we know that a perfect liberal democracy is not going to emerge in the short term.

As always, my hon. Friend makes a perfectly valid point. I have spoken in the House several times about the hope that the Arab spring is delivering to generations of people who have been excluded from the rights that we take for granted.

As the right hon. Member for Rotherham (Mr MacShane) disappeared into Vietnam, you might forgive me for mentioning Iraq briefly, Madam Deputy Speaker. We failed in Iraq; we made fundamental mistakes: de-Ba’athification, disarmament of the local militia and army, and demobilisation of a civic society. They were the wrong choices to take, and it took Iraqi society years to recover from them. To get Afghanistan right we need to learn those lessons. We need to ensure that we do not undermine Afghanistan’s society as it stands.

We have continued to take the action that I set out in the House last year. We have urged Israel greatly to improve access to Gaza. It has taken some steps, but those steps have not been as fruitful as we had hoped when they were set out. Egypt has now opened an important crossing into Gaza, which may also provide some relief. The answer relies on the general lifting of a blockade of Gaza and on a negotiated two-state solution in the middle east. However, embarking on new flotillas is not the way in which to bring that about. We advise against all travel to Gaza by British nationals, which includes people who may be thinking of boarding a flotilla to go there. We hope that Israel will make only a proportionate response to any such flotilla, but it is, none the less, not the way in which to sort out the problems of the middle east. Such problems require negotiations in good faith by the parties concerned.

I strongly welcome the Foreign Secretary’s remarks about Israel and Palestine, especially his encouragement to Israel to be open to negotiations on a united Palestinian Authority, if it is freely elected by the Palestinian people. Does he believe that both parties could learn from our own example in Northern Ireland by dropping other unhelpful preconditions to talks, such as those that relate to Jerusalem on the one side or the extent of variations to the 1967 border on the other?

I will go a long way with my hon. Friend on this. We want a return to negotiations; that is absolutely right. I have set out the conditions under which Israel should resume its negotiations with the Palestinian Authority, which are the same conditions in relation to the PA. We need the negotiations to succeed so we should not be setting new hurdles. Comparisons with negotiations elsewhere, including those in Northern Ireland, are fraught with difficulty. The situations are not exactly the same and have not reached the point at which negotiations really started to bear fruit in Northern Ireland. A lot of painstaking work still has to be done on this, but it would be a good start, after President Obama’s speech and his statement on the 1967 borders, for both the Israelis and the Palestinians to make it clear that they are happy to return to direct negotiations with each other.

Thank you for calling me, Mr Hollobone. I will try to keep an eye on the time. I commend my hon. Friend the Member for Harrow East (Bob Blackman) for securing the debate, and for resisting the impulse to give a rendition of the Eurovision song contest’s winning song. That is a mercy to all of us.

The debate is very important because although the region is ostensibly stable at the moment, it clearly has potential for a lot of volatility. As well as the conflict over Nagorno-Karabakh, there was the war only a few years ago between Russia and Georgia, there is unresolved conflict over South Ossetia and Abkhazia, and we now have other regional powers, such as Iran, taking an interest, although apparently in the unlikely role of peacemaker at the moment. That all underlines how such a potentially volatile region could deteriorate quite fast. If we have learned anything from events in the middle east and north Africa, it is that one cannot take one’s eye off the ball and expect stable regions to remain stable just because they are at the moment.

Reference has been made to the conflict in Nagorno-Karabakh, and in fact it has been called the occupation of Nagorno-Karabakh. Clearly, one person’s occupation is another person’s liberation, and the origins of the dispute started with a regional soviet voting to attach itself to Armenia in 1988 under the USSR. It is important that while emphasising many other universal values such as human rights, the rule of law and democracy, we remember the important right to self-determination. That will clearly be a live issue in this country for the next couple of years. Should the people of Scotland, however unwisely, decide to vote for independence or a different constitutional arrangement with the United Kingdom, we would of course respect that, just as Czechoslovakia respected the right of Slovakia to separate from the Czech Republic some years ago.

My hon. Friend’s point about self-determination is of course right, but if the indigenous population has been expelled, self-determination and its result will be rather different from what might otherwise be expected.

My hon. Friend makes a valid point. Perhaps the way forward is that suggested by the European Parliament in its 2008 resolution, which recognised the territorial integrity of Azerbaijan but referred specifically to rights to self-determination, whether in the form of home rule, devolution, confederation or whatever. It is crucial that popular consent is part of the process.

I agree that progress towards a peaceful resolution seems to be frustratingly slow, although it is positive that all parties now seem to have committed themselves to peaceful resolution of the dispute. I gather that the South Caucasus security and co-operation conference has now resolved that all outstanding issues in the region should be tackled by 2014, and I would be interested to hear from the Minister—his enormous portfolio now also includes that troublesome region—what pressure Her Majesty’s Government will put on the Governments of Azerbaijan, Armenia and Russia to make that process a success.

I want to mention briefly two wider issues. One is the role of western foreign policy in the post-Soviet space in the world. Clearly, discussions are continuing between NATO and Azerbaijan, which is interesting. It is probably right and wise that those negotiations are concentrating not so much on Azerbaijani membership, but on building stability and ensuring that Azerbaijan is a barrier to the spread of weapons of mass destruction and other things that contribute to the stability of the region and the rest of the world.

The other issue, which other hon. Members have mentioned, is human rights. The Arab spring or awakening has underlined the importance of what President Obama called

“the false promise of stability”

sometimes enforced by repressive tactics. Azerbaijan is not Libya; it is not Syria; it is not Iran. It has many of the characteristics of an increasingly prosperous multi-party democracy, yet there serious concerns. The Organisation for Security and Co-operation in Europe described the 2010 parliamentary elections as “peaceful”, but

“not sufficient to constitute meaningful progress in the democratic development of the country.”

Amnesty International reports:

“Threats, harassment, and acts of violence against journalists, civil society activists and opposition activists continue with impunity, leading to an increase in self-censorship. Criminal and civil defamation laws are used to silence criticism, resulting in prison sentences and heavy fines against journalists.”

If I had more time, I would highlight the cases of Jabbar Savalan, Eynulla Fatullayev, Adnan Hajizade and Emin Abdullayev. I hope that the Minister will be able to take up those cases in particular with the Azerbaijani Government.

If Azerbaijan is to take its place in the democratic family of nations—I agree with hon. Members who have said that it is important to have examples of Muslim countries that are emerging as stable and free democracies—it must recognise the importance of tackling the human rights issues that still exist there. I hope that the good offices of the Minister, the Conservative Friends of Azerbaijan, and the all-party Azerbaijan group will be utilised in that effort. That would be extremely positive for Azerbaijan.

Thank you for calling me so early, Mr Turner.

I thank my right hon. Friend the Member for Bermondsey and Old Southwark (Simon Hughes) for proposing this debate, which is important, timely and supported by what I might call a broad coalition. The contribution of the hon. Member for Hayes and Harlington (John McDonnell) was welcome as well.

My right hon. Friend was right to refer to the BBC Online article, which pointed out the economics of conflict. In addition, the Secretary of State recently quoted Professor Paul Collier from Oxford university, who described conflict as “development in reverse”, and he cited some astonishing statistics:

“a civil war is estimated to cost a low income country an average of about 64 billion US dollars. In other words, the cost of a single conflict is more than half of the value of annual development aid worldwide.”

He also pointed out that

“the higher a country’s GDP per capita, the lower the risk of internal war. A typical post-conflict country with no economic growth has a 42% risk of returning to conflict within ten years. But with 10% growth, the risk declines to 29%.”

The issues of development and conflict are intertwined.

That was also my experience when working for Oxfam for some years. We saw conflict adding to poverty and destroying infrastructure in health, education and transport, often driving the most skilled people in a country into exile or displacement, or getting them killed, and disrupting the education, employment and training of everyone else. Conflict disrupts economies, normal politics and civil society, it wrecks agriculture and it destroys the ability of countries to support themselves. Clearly, we have common ground in that any money spent or effort made by the Government and other Governments internationally to prevent conflict must be well done.

Part of the question concerns how the money is spent. Most obvious is peacekeeping, but in one sense that is intervention at the point of failure. In effect, events have developed so far that we need soldiers on the ground and enormous effort to retrieve a situation. Other things help to fuel a conflict that is potential or just breaking out, and the arms trade is the single most important one. We must also look deeper, at the sources of tension and conflict, which are commonly social, religious, ethnic and political. Increasingly, especially with the impact of climate change, conflict will be over resources. I must echo the comments of my right hon. Friend the Member for Bermondsey and Old Southwark, who talked about our recent trip to Israel and Palestine, where we can see every single one of those different elements of conflict fuelling each other and adding to a toxic mix, making us most concerned for the future of that region.

I therefore very much welcome the Government’s mapping out an increasing amount of spending in what is called the conflict pool budget, which has risen from £229 million last year to £256 million this year, and will reach £309 million by 2014-15. Part of the conflict pool—about £76 million—is devoted to peacekeeping. On top of that, a separate peacekeeping budget now consists of £374 million, so something like two thirds of what is being spent annually by the Government goes on peacekeeping. Yet that, in a sense, is intervention at the point of failure, so perhaps we need to look at how much of the focus ought to be on anticipating and preventing conflict in the first place.

Even if we break down the remaining money in the conflict pool, which is spent on conflict resolution, discretionary peacekeeping—yet more peacekeeping—and stabilisation activities, including the excellent work, which I strongly commend, of the cross-departmental Stabilisation Unit, the countries on which that money is focused are a list of war zones and former war zones: Afghanistan, Yemen, South Sudan, Somalia and, slightly more distant, Lebanon and Cyprus. That is right because, as discussed, the risk of recurrence is high in regions that have already had conflict, but if we are to have a theme of anticipation and prevention, perhaps there is room for exploring where else the strategy needs to go.

My noble friend Lord Ashdown’s recent report on humanitarian aid and assistance emphasised the importance of building anticipation and resilience before emergencies strike. We need the same approach, if possible, in conflict prevention. We need the tools to build resilience to conflict. I would like my right hon. Friend the Member for Bermondsey and Old Southwark to commend Saferworld’s briefing on this debate to Ministers, including its points about emphasising the context of each country, as well as the point made by the hon. Member for Hammersmith (Mr Slaughter) about focusing conflict prevention efforts strongly on people’s experience.

Saferworld made those good points, and I would add that we should look for countries in which there is systematic denial of human rights and democracy, which is often the source of conflict. In his recent address to both Houses of Parliament, President Obama drew an interesting lesson from the experience of the Arab spring, which was exactly right. He pointed out that the west collectively had been supporting some tyrannical regimes that had given the impression of being stable. He said that

“repression offers only the false promise of stability”,

and that it puts a lid on conflict and often suppresses legitimate democratic, ethnic, political and even religious aspirations to the point where there is eventually an explosion. It would be good if the Government looked at a slightly more anticipatory approach with an eye on human rights and democracy.

It is excellent that the Government are developing the so-called BSOS, the building stability overseas strategy, and we must build into it and pay particular attention to institution-building, human rights, and particularly the rights of minorities and marginalised groups who are not part of the mainstream in each society. We need an anticipatory approach.

It is also excellent that in BSOS and many other policy areas that I mentioned we see three Departments—the Ministry of Defence, the Foreign and Commonwealth Office and the Department for International Development —working closely together. Ministers should be commended on the extent to which there is a cross-departmental approach to many of the issues. Clearly, when there is an opportunity to join up, that is more effective and often more cost-effective. The one thing I would add is that the same lesson also applies at European level, and if we can join up and co-ordinate our stabilisation efforts with other European countries and, indeed, the European Union as a whole, we may have an even more effective and cost-effective approach. Nowhere is that more true than in the case of the arms trade, where an international approach is necessary.

It is right that the Government are pressing on towards an arms control treaty, which is vital, but it is also important to look at what environmentalists might call domestic effort. The steps that the Government have already taken are welcome in the wake of the Arab spring, or the Arab awakening as some people are now calling it. They have instituted a review of their arms export licences, and have already revoked 160. The list of licences that had been issued—sadly, that was under the previous Labour Government—is a cautionary tale. Although human rights and repression were supposed to be part of the criteria, we sold arms to almost every regime in the middle east, including the former regime in Egypt, Libya, Syria, Bahrain and Saudi Arabia. We were selling not just small arms, parts or communications technology, but tear gas, and something described as crowd control ammunition. I cannot conceive how that could be used peacefully and democratically.

I strongly welcome the revocations, and I urge the Foreign Office to consider making the current review of the arms control and the arms trade licence regime as robust as possible. It has been done in a hurry, and although it was right to do it quickly in response to events, I would welcome a more inclusive and wider review. Various right hon. and hon. Members have made the point that if we are to prevent conflict, we need an anticipatory approach. Many good suggestions have been made during the debate for enhancing the role and profile of conflict prevention, and there is a real opportunity for the coalition to show great leadership and to gain widespread support.

The right hon. Gentleman is conflating several different subjects. What I said needed fleshing out in more detail was the immediate planning of the national transitional council in Benghazi for the day after Gaddafi—if we can express it like that. It is doing a lot of that work, and we are looking forward to it communicating that. That is taking place, and we are in the lead in terms of looking in detail at the stabilisation response. Our stabilisation response team has been in Benghazi and is now writing its report, but we have been working with Italy and Turkey on that. So the UN will have that responsibility for co-ordination of humanitarian assistance and for the future, but Britain has taken the lead in putting people on the ground and doing the thinking. None of those things is inconsistent with the others.

Will the Foreign Secretary take up with the Bahraini Government the specific case of Ayat al-Qormozi, the young woman who has now been imprisoned for nothing worse than reading out a poem to freedom at the Pearl roundabout, and can he do that as part of a more robust approach to the Bahraini Government and their Saudi guardians?

Yes, of course we take up and express to the Bahraini authorities the need for universal respect for human rights, including for due process, and that is what we look to them to bring about in their judicial process. I have strongly expressed that view to the Crown Prince of Bahrain, and we will continue to make those representations to the Bahraini authorities.

The Liberal Democrats welcome the debate and strongly support the motion. The Select Committee Chairman set out very well the terms of the debate and the contrast between soft and hard power. Hard power in military terms is certainly often appropriate, as in the cases of Libya and Afghanistan, but it is an expression of British power overseas that is often fraught with military, political and financial difficulties. Even in the gentler realm of diplomacy, we are rightly reviewing our diplomatic presence around the world—and, it is to be hoped, expanding it in many cases in light of a changing world—while also having to pay attention to the financial context at home.

Soft power and expressions such as “the BBC World Service” are extraordinarily cost-effective. They reach billions of people and are enormously positive with very few complications, including many of the negative complications of other expressions of British interest around the world. The World Service in particular has attracted extraordinary plaudits from the likes of Kofi Annan and even Nelson Mandela. It has been refreshing in recent months to see placards on the streets of Muslim countries calling not for death to Britain or anything like that but thanking the BBC. They are talking about the BBC World Service, of course. In that context, it is extraordinary that we are facing the prospect of cuts to the Arabic service in particular. So, it is right that Ministers should be reconsidering the matter.

The current funding relationship is somewhat uncomfortable. The Select Committee is cautious about the eventual transfer of World Service funding to the BBC and rightly says that safeguards should be

“put in place to prevent any risk of long-term erosion of the World Service’s funding and of Parliament’s right to oversee its work.”

The intervention by my right hon. and learned Friend the Member for North East Fife (Sir Menzies Campbell) was also well made. Provided that those safeguards can be put in place—the Select Committee suggested a formal concordat with the BBC Trust—there is one advantage to the transfer of funding, which is that it underlines the independence of the BBC World Service from political decisions about both funding and editorial content. That is an important reassurance for World Service listeners worldwide.

In the meantime, we have something of a problem in the period leading up to 2014. I welcome the Committee’s call for funding arrangements to be re-examined. We are happy to support it and I am glad that the Government are accepting the motion. I appreciate, however, that this is not as easy as it first looks. I understand, like others, that Ministers have thought about this very carefully and are aware of the issues involved. I am certainly very grateful for the time that Ministers and their advisers from both DFID and the FCO have spent answering my questions on this subject, as well as those of my right hon. and hon. Friends in this Chamber and in another place.

I particularly welcome the Secretary of State for International Development’s announcement about the prospect of a significant grant to the BBC World Service Trust. Many development issues can be addressed in World Service programming, from gender awareness, to global responsibilities for climate change, adaptation to it and how people can prepare for it, to health awareness, particularly about matters such as the HIV epidemic.

There are limitations, however. It is right that DFID’s funding should be restricted to matters that qualify as official development assistance and not all broadcasting can come within that remit. It would set a bad precedent if DFID was asked to fund areas that did not qualify as ODA under OECD rules and we would not want that precedent to be set. Nor would we want World Service programming to be skewed completely in the direction of development programming. The provision of information and a British perspective on world events is very important in many countries. The Hindi and Mandarin services spring to mind and the priority in those cases is not development but our economic, diplomatic, political and cultural presence, which is vital.

The BBC should have to examine its costs, its overheads and its back-up costs just like any other public spending. It is quite right that it should try to do that and if the hon. Member for Ilford South (Mike Gapes) is correct, there has clearly already been an iterative process between Ministers and the BBC on the exact nature and extent of these cuts and their impact on particular broadcast services. Even if that is true, following that iterative process we are still facing cuts in such vital services as Arabic, Hindi and Mandarin, so it is clear that we must reconsider the transitional arrangements between now and 2014. We should consider how we can protect those key services.

In the great scheme of things, the amounts of money involved are not huge. As has been pointed out by the Select Committee, they are a relatively small proportion of the increases in DFID’s budget. Even within wider Government and FCO spending, we are not talking about large amounts of money. As I said at the outset, the cost-effectiveness of the programming and influence of the World Service and the respect that it earns this country are of almost incalculable value. I urge Ministers enthusiastically to accept the motion and do whatever they can to protect this jewel in the crown of British broadcasting.
