Question to the Department for Business, Innovation, Science and Trade:
To ask the Secretary of State for Business, Innovation, Science and Trade, pursuant to the answer of 8 September 2026, to Question 20474, on MHCLG: Annual Reports, and further to the case of Woodhouse Investment Pte Ltd and West Cumbria Mining (Holdings) Limited v. United Kingdom (ICSID Case No. ARB/25/37) before the International Centre for Settlement of Investment Disputes, what are the maximum level of damages that West Cumbria Mining and Woodhouse Investment Pte are seeking to obtain from HM Government as a consequence of the decision of the UK Government not to take forward permission for the Cumbria coal mine.
Investor-State Dispute Settlement (ISDS) provides an independent means for investors to resolve disputes with states where they believe they have experienced arbitrary, discriminatory or unfair treatment, or expropriation without compensation.
The Government maintains that it has acted consistently with its domestic and international law obligations. In view of the ongoing proceedings, it would be inappropriate for the Government to comment further at this stage.
