My Lords, I start by apologising to noble Lords who have their names against amendments and clause stand part notices in this group. The rules for remote contributions mean that I am always called after the mover of the first amendment in the group; I would have wanted to hear other expert contributions before speaking.

Amendments 39A and 39B in the name of the noble Lord, Lord Knight, make it absolutely plain that the Secretary of State’s powers should be used only when an Ofsted inspection has made it clear that there are issues. Amendment 39C in the name of the noble Lord, Lord Mendelsohn, asks for further qualification to inform a Secretary of State’s intervention decision on the replacement of directors or trustees, which include those who pose

“a risk to the duty of the institution”.

I hope that this would also include those who do not respond to safeguarding concerns. The detail of this comes to the nub of the issue that we have faced in our day and a half of Committee so far: exactly how the Bill will work in practice.

Turning to the 14 clause stand part notices in this group for Clauses 5 to 18, I hope that, after our debates so far in Committee, the Minister is in no doubt about the concern right across the House, including from all the former Education Ministers present, about the first part of the Bill on academies. The noble Lords, Lord Baker, Lord Nash and Lord Agnew, have made it absolutely plain in our debates today and last week that this Bill, especially this part of it, is not fit for purpose and that it would be sensible to delay until more detail can be provided to Parliament, the education sector and parents.

Normally, when a major change in the structure of our entire education system occurs, there has been broad consultation with the public, schools and the bodies that deliver educational services to education directly. That just has not happened here. It is evident that your Lordships’ House remains concerned that this part has not been thought through in the detail needed. All schools that are funded through the public purse becoming academies, bringing virtually all schools under the direction of the Secretary of State, is one such major change.

That brings us to the other conflicting issue to which noble Lords have referred in almost every debate on each grouping: the Henry VIII powers that the Secretary of State will take on in the Bill; again, without wider consultation or understanding of the implications. I want to focus on the latter point for a second. Page 55 of the White Paper, Opportunity for All: Strong Schools with Great Teachers for Your Child, sets out the standards, regulation and intervention from the department’s perspective. Given the debates we have had, the White Paper is remarkably coy about the powers of the Secretary of State. In fact, according to the schedule on page 55 of the White Paper, the Secretary of State’s only role is to sign new funding agreements and amend them “for material changes”. Intervening in schools is listed as happening by the regions group, on sufficiency, admissions, safeguarding, attendance and ensuring quality; whereas the Bill appears to give decisions over these powers directly to the Secretary of State. So, what is on the face of the Bill sets out neither a strategic framework nor the detail of how it will work in practice; it also contradicts the White Paper.

This reflects the difficult debate that we are having at the moment. My noble friend Lady Garden of Frognal said during our debate on the first group of amendments that there should be delays in the progress of the Bill until some of these matters are clarified and put out for consultation. Other noble Lords have said the same; they are right. As more and more issues and concerns emerge, grouping by grouping, it is not right to proceed until they are discussed and then consulted on with the wider public.

As the noble Lords, Lord Agnew and Lord Nash, made clear in our debate last Wednesday, the Academies Minister has already had to take a large number of decisions in relation to schools that are not maintained. Some of us argue that this results in a closed and untransparent system that is particularly opaque for parents, their children and their communities when key and serious decisions need to be made about their local school. It now appears that these powers, given to the Secretary of State but with a recommendation presumably to be made by the relevant Academies Minister, will apply to all 20,000 publicly funded schools once the Bill has gone through. How on earth will this work in practice? Also, how will it be publicly accountable to the parents and communities that these academies will serve? Can a junior Minister manage this workload or will the practicalities of it mean that it will be made by invisible and unaccountable civil servants?

In the Clause 3 stand part debate earlier, the Minister said that the Government will always consult the sector, but I did not hear anything about consulting parents and communities on changes to their local schools. I hope that the Minister can provide some answers or a timetable for your Lordships’ House as to when our many questions can be answered in detail and then debated properly; otherwise, we must delay the next stage of the Bill until we know and understand more about what the Government are trying to achieve through it.

My Lords, I declare my interests as a vice-president of the Local Government Association, as vice-chair of the All-Party Parliamentary Group on Fire Safety and Rescue and as a disabled person. The noble Baroness, Lady Grey-Thompson, is unable to be in her place this morning as she is attending the memorial service for the Duke of Edinburgh in her role as chair of the Duke of Edinburgh’s Award scheme.

In Committee, the noble Baroness, Lady Grey-Thompson, and I both spoke of our experience of the use of personal emergency evacuation plans, or PEEPs—good practice, and less good practice. I will not repeat that today but one thing is clear: the responsibility for getting safely out of a building should not be on the shoulders of a disabled resident alone. That is why I have laid Amendments 13, 20 and 35, and I thank the noble Baronesses, Lady Grey-Thompson and Lady Hayman of Ullock, for signing them. The amendments set out a clear link between the duties under the Equality Act 2010 for those providing services for disabled people—in this case, housing and safety in buildings.

Amendment 13 would put into law that a statement must have been laid by the regulator that they have engaged with their residents in relation to the accountable person’s duty to avoid disability discrimination. Amendment 20 would amend Section 31 of the Equality Act by adding a specific reference to a person exercising functions in relation to public housing. Amendment 35 would create a duty on the accountable person to include developing PEEPs for people with a disability in order to avoid disability discrimination.

I believe that the amendments are necessary because I want to see clarification that Part 3 of the Equality Act 2010 applies to social landlords and that, as a result of Part 3, there is an anticipatory duty on social landlords to prepare PEEPs for disabled residents. There is a limited time for the relevant government body to prepare statutory guidance and a code of practice in relation to this.

I thank the Minister for his amendments, starting with Amendment 3, which talks about the “assistance and encouragement” that must be provided. Unfortunately, that is a long way from the current requirement for the responsible people in offices and other public buildings, including hotels, to make formal arrangements that ensure that a disabled person can leave a building that is dangerous whether due to suspected fire, chemical escape—such as at the Olympic Park swimming pool last week—or anything else that puts people at risk. The other amendments tabled by the Minister, and indeed his letter to signatories of my amendments that arrived at 10 am this morning, for which I thank him, talk about the government consultation, but the Government have been consulting on this specific matter since the early days of the Grenfell inquiry.

Why do we believe that there needs to be stronger reference to the Equality Act and to PEEPs? Week 68 of the Grenfell Tower inquiry took substantial evidence from witnesses in relation to the provision of communication and engagement with disabled residents and how they were—or were not—able to leave Grenfell Tower safely. They were not. Over 40% of disabled residents died in the fire, a far higher percentage than any other category of resident. There were no PEEPs. Not only was there no guidance but, as I will refer to, any arrangements for disabled people were actively discouraged by the government adviser and government officials.

Inside Housing has reported on week 68 of the Grenfell Tower inquiry last week, saying:

“Government-endorsed guidance in use at the time said the provision of such plans was ‘usually unrealistic’, and staff at the Kensington and Chelsea Tenant Management Organisation … which managed the tower, previously cited this guidance in explaining why they did not provide any.”


As I said in Committee, Colin Todd of CS Todd & Associates, the consultants who wrote the guidance document for the Government, said:

“The consensus opinion of the project group was that it should be acknowledged in the guide that PEEPs were impracticable.”


However, the inquiry heard that Louise Upton, the former head of the fire safety policy team at DCLG, thought it was not a

“deliberate decision to exclude representatives”

of the disabled community.

The inquiry notes that the failure to provide escape plans resulted from that guidance being used by the KCTMO, but the Chief Fire Officers Association had raised concerns and warned that to

“ignore and eliminate advice on disabled access and evacuation is a fundamental error of the document”

and it

“is recommended that it must be included”.

Elspeth Grant, a fire safety consultant with TripleAconsult, wrote to Sir Merrick Cockell, then chair of the LGA and leader of the Royal Borough of Kensington and Chelsea Council, when the guidance was published to say that it was unlawful and discriminated against disabled people, calling for it to be withdrawn

“before this guidance leads to an unnecessary tragedy because plans were not in force”.

Just yesterday at the inquiry, Brian Martin, another official, said that the Government ignored the warnings about PEEPs for disabled people as they were “too expensive” to put into practice. The first phase of the inquiry recommended the provision of PEEPs for residents of high-rise blocks, but that is not what we are seeing now. Instead, the Government are still consulting.

I thank the noble Baroness, Lady Bennett, for tabling these amendments, slightly amended from Committee, and in particular for responding to the Minister’s concerns that the first amendment had perhaps been too broad and would catch the day-to-day business of companies. That cannot be said about Amendment 145.

I also want to pick up a point that the noble Earl made in Committee. He said:

“A company’s working capital, by its nature, is money that is used to fund day-to-day operations in general, and one cannot associate a particular pound with a particular business activity.”—[Official Report, 4/2/22; col. 1161.]


Yet the Charity Commission does have the ability to intervene in the event that a charity, or series of charities stretches—shall we say?—those rules. Its Internal Financial Controls for Charities, CC8, provides very specific guidance. Indeed, in recent years, one charity, the Plymouth Brethren Christian Church, was investigated for a circular set of donations. Each donation to each different body was paid tax relief out of the public purse, coming back to serve the schools that the adults at the community church sent their children to. The way that was structured was similar to a financial instrument employed by the few companies that abused the funding they received from the public purse for social care.

The noble Earl also referred to the Treasury guidance Managing Public Money and Accounting Officer Assessments. I have been through that, too. It is very interesting and clear. Under the heading

“expenditure which may rely on a Supply and Appropriation Act”,

Managing Public Money lists

“routine administration costs: employment costs, rent, cleaning etc … lease agreements, eg for photocopiers, lifts”.

It does not say: “Re-charging sister/parent/daughter companies for large amounts of borrowing and the interest thereto”, which is what has been happening.

It is important that we start to debate how public funding is spent by these companies, particularly those overseas, when we cannot see how that money is spent. I also support the other amendments in the group, which ask for a review of financial regulation. It is interesting that the Treasury guidance refers constantly to the Nolan principles, which are absolutely vital in talking about transparency and responsibility when spending public money. These amendments might not be quite right to deliver that, but it would be good if there were a review under way.

The other thing we must have when these companies spend large amounts of public money is publication of their full accounts. They should not be able to hide behind very short, superficial accounts from overseas.

My Lords, I thank all noble Lords who have contributed to this debate, in particular for their brevity given the long day we have ahead of us. In particular I thank the Minister for his helpful response.

My Amendment 60 is very specific and I asked for a specific response. The Minister has confirmed what I wanted to hear: that health data is special category data, and that it requires additional protections due to its sensitivity, which would be applied by any ICB when it has had that request. The other key phrase that stuck out was that nothing in the clause overrides the range of requirements in law to provide those key protections and safeguards regarding individual personal data. I am therefore satisfied on that basis.

Briefly on Amendment 116, which is much broader in scope and very important for the future of data use with the proposals that are coming down stream, I agree with all the comments that were made by noble Lords. One particular thing that stood out for me was the proposal of the noble Lord, Lord Clement-Jones, that the publication of the Goldacre review is vital before any final version of Data Saves Lives is made public.

We will not get to a vote on Amendment 116 today. However, could the Minister assist the House and confirm that guidance will be issued, rather than a looser “may be” issued? With that, I beg leave to withdraw my amendment.

My Lords, I shall speak shortly to Amendment 168, but want briefly to refer to Amendment 80, moved by the noble Baroness, Lady Cumberlege, and so eloquently introduced by her, and supported across the House. Workforce planning is critical. Frankly, it is surprising that Ministers resisted amendments in Committee which called for formal long-term workforce planning for the NHS, social care and public health to be embedded in legislation.

The noble Baroness said that that current arrangements can be a bit like sticking plasters, and she is right, but it is not just about the use of bank and agency staff but about planning healthcare professional education. We all know how long it takes to train a doctor, but most of the other professionals also cannot just be turned on and off at election time. There have been too many times when this Government have said at elections that they would suddenly magic thousands of extra doctors and nurses. We need to build timescales into that workforce planning. The noble Baroness also talked about population demand, but I want to make another point: this is not just about population numbers; it is also about demographics. We will need more GPs and hospital professionals managing our rapidly ageing population. If we do not encourage people to go into those specialisms, we will not be able to look after our population in 10, 15 or 20 years’ time.

I also agree with the noble Baroness, Lady Cumberlege, that if government resistance is because of the funding implications with delivering such a plan, that is very short sighted. Not planning will be even more catastrophic. Amendment 80 is more modest in nature but is a critical minimum to achieve a commitment to plan effectively for the NHS, social care and public health.

I turn now to Amendment 168. Given that there are a number of speakers on this important group, I will be very brief here too. The amendment from the noble Lord, Lord Hunt, echoes the one he laid in Committee, and I am pleased to have signed both. We heard in Committee about this frustrating loophole that meant that it was not possible for certain members of the Royal College of Physicians of Edinburgh, the Royal College of Physicians and Surgeons of Glasgow and the Royal College of Emergency Medicine to be added to the list of colleges which could be involved in the appointment of NHS consultants. This is now slowing down the appointment of NHS consultants. I am very pleased to support the amendment and hope the Minister will be able to give good news to the House on this amendment too.

My Lords, I declare my interests as a vice-chair of the All-Party Parliamentary Fire Safety and Rescue Group and a vice-president of the Local Government Association. I support all the amendments in this group in the names of my noble friends Lady Pinnock and Lord Stunell.

In his response to the previous group and to some groups on the first day of Committee, the Minister rightly said how shocking some of the revelations have been to him, to us and to many others as more systemic failures have been uncovered, and how far too many people were able to refuse to take responsibility for their role in the problems.

Along with other parliamentarians, I heard Dame Judith Hackitt speaking on a number of occasions during and after her review, and I have also read her Independent Review of Building Regulations and Fire Safety—both the interim and the final reports. Her foreword to the final report published in 2018, which she describes as a personal view, is extremely powerful as a summary to the cultural and regulatory structures in the built environment sector and explains exactly why the amendments in this group are so necessary.
