My Lords, I support the excellent and tightly drafted amendment from my noble friend Lady Neville-Rolfe. I say that it is tightly drawn because proposed new subsection (2) is about concealing one’s identity, not about wearing the clothes themselves: the scarf or the hat. I speak as a cyclist who frequently cycles in the winter, when of course you need to wear protective clothing to keep you warm. However, this is about allowing a police officer, or another person who is entitled to know your identity, to know your identity, and it is about failing to stop when required to do so by a constable.

I am glad that my noble friend mentioned the issue of live facial recognition. I am just about to finish my four-year term on the British Transport Police Authority. In terms of clear-up rates, one of the issues we have in unfortunately failing to tackle violence against women and girls—which, of course, is a government priority and a priority of the Department for Transport—is that we have way too many persistent, repeat offenders on bail who are travelling on the rail network and who are able to enter stations and get on trains. Live facial recognition, were it to be rolled out for a good reason, with proper checks and balances, would significantly reduce the incidence of those people being able to get on trains and Tubes and assault women and girls, and others. Live facial recognition is important because, if people are going to be wearing face coverings, that will naturally circumscribe the powers used in live facial recognition.

Rates of crime on bikes and scooters have gone up. Many people who are committing those crimes are hiding their identity and I believe that, in most cases, there is a legitimate reason for the police to stop them. In 2024, Sky News received figures from FoI requests that showed that crimes involving e-bikes and e-scooters had risen by more than 730% in the preceding five years. These crimes included theft, robbery, burglary, drug trafficking, stalking, rape, violent crimes and weapons offences. In 2023-24, 11,266 crimes were recorded that mentioned an e-bike or e-scooter—up from just 1,354 in 2019-20. These figures do not include data from the Metropolitan Police and the West Midlands Police—I know that West Midlands Police have been busy doing other things, not always to their great credit —so the actual numbers were likely higher.

On 30 December 2025, the Metropolitan Police reported that it had seized 37 e-bikes and scooters in an attempt to tackle crime and anti-social behaviour. That resulted in 52 arrests and weapons being seized. Between January and December 2025, Merseyside Police seized 1,000 unregistered vehicles, e-bikes, e-scooters and scramblers. It launched Operation Gears in July 2024 to deal with crime and anti-social behaviour linked specifically to bikes and scooters. In its words, two-wheeled vehicles

“are increasingly linked to serious criminal activity, including violence, robberies, and serious organised crime (SOC) offences”.

The Metropolitan Police has also produced reasonably new data—up to the end of 2023. They show that there were 4,985 cases of robbery and theft of a mobile phone in London using a motorcycle or an e-bike in 2023, and a face covering was worn in over 1,000 of those. These statistics demonstrate that it is legitimate to link bikes and scooters to crimes. Therefore, if someone is covering their face specifically to avoid identity while using these vehicles, it does raise suspicion, and it most emphatically gives police a legitimate reason to exercise their due and proper powers. On that basis, I support my noble friend’s amendment.

My Lords, as someone who regularly jumps out of the way on a pavement from e-bikes, electric scooters and so on, I think this amendment is probably very sensible, but we should listen to the noble Lord, Lord Hogan-Howe, because, as far as I can see, it does not go sufficiently far. We need to add to it, perhaps on Report, a provision that the police can require someone to take their face covering off, because without that, I do not think it goes very far.

My noble friend is making a very compelling case. Does she agree with me, in response to the noble and learned Baroness, Lady Butler-Sloss, that the context, to be fair, is that the last Government took an outward-looking, internationalist approach and their safe routes to citizenship for Syrians, Ukrainians and Hong Kong citizens were widely supported across the world? She was careful to praise the existing Government, who have been in power for 16 months, rather than the strong, positive record of the previous Conservative Government.

My Lords, I rise to speak very briefly, before the noble Baroness, Lady Brinton, because I am unhappy about these amendments. I was very relieved when the Government put forward a situation that would not support them.

I was invited by the charity Safe Passage to attend a drop-in session at its drop-in house in London, where I met two young men. Safe Passage was absolutely satisfied that both of them were 16. They were Afghans; one had a beard, and the other had a moustache. The point made by the noble Lord, Lord Jackson of Peterborough, seems to me to be unsafe, because what we are looking at is Europeans. Europeans do not normally get beards and moustaches under the age of 18, but those who come as refugees and asylum seekers come from all over the world, where they grow up and mature much more quickly.

I was extremely relieved to see the approach of this Government and very disturbed to see these amendments, which I hope will not succeed.

Before the noble and learned Baroness sits down, if I may, for the avoidance of doubt, I was not arguing that it would be merely a subjective assessment or value judgment of appearance: it would be complementary to a robust scientific method, which would be tested both in this House and by other scientists in the course of the work. It would not just be a border officer saying, “You look like a 21 year-old”. The amendments make reference to scientific assessment, which would be an important complementary safeguard that might address the particular concerns of the noble and learned Baroness.

I am very interested in what the noble Lord, Lord Jackson of Peterborough, says, because he did talk about common sense and looking at a person. That is what encouraged me to speak. When I met those two young men, I absolutely took the view that they were over 18, but I was disabused, not only by their age, which was identified, but by the fact that I had been thinking in European terms. That is the danger of what is being said by the Opposition.

I understand the point that the noble Lord makes, but I am reading the amendment that he has tabled. The third word is “promotes”. What does that mean in terms of an objective criterion for how an individual would promote human rights, and for how he or she would protect the human rights of those involved in football and the club that they were involved with? The amendment is an example of potential regulatory overreach. Seeking to enforce it would be a straightforward prima facie case of ultra vires actions, because it would be unenforceable.

Having said that, I have great sympathy with the noble Lord’s Amendment 200 on state ownership of football clubs. We will have a good debate on that. However, on Amendment 178, the noble Lord is gilding the lily. Although he has good intentions, it is not a workable amendment. It would damage the interests of football clubs and be difficult for the regulator properly to enforce.

My Lords, I support Amendment 178. Indeed, I have come in specifically to speak on the issue of modern slavery and I declare an interest as a co-chair of the modern slavery parliamentary group and vice-chair of the Human Trafficking Foundation.

I profoundly disagree with what the previous noble Lord said about individual ownership fitness criteria in relation to modern slavery. Under the Modern Slavery Act 2015—Section 56, I think—it is wrong to have a supply chain that operates on the exploitation of those who provide the goods for a company. So, if you have an individual owning a company who makes his money on the exploitation of people in the supply chain, it should not be all that difficult to discover it. That is absolutely where the regulator should be promoting modern slavery issues when he looks at the individual fitness of a person who wants to take over a club.

I see the point on human rights, although we have the Human Rights Act and it is fairly clear under that Act what the rights are of various people that might be impinged by an individual who did not have appropriate fitness criteria. I can see—

I thank the noble and learned Baroness for most generously giving way. If we have statutory sanctions already in place to deal with this behaviour, whether it is the Human Rights Act or the Modern Slavery Act, surely she is proving my case that this is regulatory overreach. My point is that we do not need further legislation when it is already covered by the existing legislation.

I do not want to deal with human rights. I have come here to deal with modern slavery. I disagree with the noble Lord. The problem is that Section 56 is voluntary and not mandatory. Consequently, companies are not obliged to follow what happens. In a 2019 review led by Lord Field of Birkenhead, of which I was a part, we picked up the fact that it was not mandatory. Consequently, if the regulator does not have to think about modern slavery, he would not have to look to see whether or not an individual taking over a club is making his money in a wholly inappropriate and extremely wicked way. Because it is not mandatory, it is important that someone else looks at it. If it were mandatory, I would entirely agree with the noble Lord.

My Lords, I rise to support the amendment in the name of my noble friend Lady Lawlor. I will speak generally about the Bill very briefly, and the amendment, and also say why I strongly oppose the amendments in the names of my noble friend Lord Hailsham and the noble Baroness, Lady Chakrabarti, which are pernicious and dangerous. I cannot believe that, when my noble friend Lord Hailsham sought election in the county constituency of Sleaford and North Hykeham in 2010, he would have told his constituents that he would seek to disregard the rights and privileges of Parliament in favour of supranational legal entities and international treaties, because I suspect that that would not have been a very popular point of view to take. But that seems to be the logical implication of the amendment he has put forward today.

The Bill does contain some important statements of principle, in that it reasserts the sovereignty of Parliament and its right to legislate to cut through the morass of alleged international norms which currently frustrate the ability of the United Kingdom to control its own borders, in Clause 1(4). The partial disapplication of aspects of the Human Rights Act—

Does the noble Lord realise that the Government, and previous Governments, have signed and ratified the international agreements and treaties about which we are talking?

Well, I will develop my argument about the tension between domestic legislation, parliamentary sovereignty and the rights and privileges of Parliament, and the international obligations and a universalist human rights regime which many noble Lords seem very content to support in preference to the former.
