I am looking forward to hearing from the noble Baroness; I think I know what she is going to say.

I will respond to the noble Lords, Lord Coaker and Lord Paddick. On the impact—the question of what the problem is—I think most people would agree that illegal drugs inflict some devastating effects on a quite horrifying scale. The cost to society is colossal, running to about £20 billion a year. There were almost 3,000 deaths relating to drug misuse in 2020. This represents two-thirds of registered drug poisoning deaths and accounts for 52.3 deaths per million people. Heroin-related deaths in England have more than doubled since 2012 and make up the largest proportion of drug misuse deaths at 45%.

In 2020 alone, referrals of children suspected to be victims of county lines—I will get on to that shortly—increased by 31%. Drugs drive nearly half of all homicides and a similar proportion of acquisitive crimes such as robbery, burglary and theft. More than 3 million adults reported using drugs in England and Wales in the last year, and more than one in three 15 year-olds report having ever taken drugs.

The noble Lord, Lord Paddick, asked whether we had done an assessment on the impact of a regulated market for cannabis. I do not think we have. Our position on cannabis remains the same as the last time I spoke about this, but if I have anything new to add I will let him know.

On the additional three-year investment from April next year, the total is £900 million. There is a £300 million three-year Home Office investment, and we commit to making up to £145 million of funding available for county lines—as I said, I will get on to that in a second. There is £533 million—more than half a billion pounds—for DHSC to increase and improve treatment services, £120 million for MoJ for drug treatment and probation services, £68 million for DLUHC for treatment and support in England for those with a housing need, and £21 million for DWP to roll out individual employment support across all local authorities in England. As noble Lords can see, it is a cross-Whitehall effort—across six departments, in fact. The noble Lord, Lord Coaker, talked about co-ordinated programmes. He is absolutely right: if we are operating across six departments, we must certainly have a co-ordinated approach.

The noble Lord asked whether the statistic of 1,500 county lines being shut down means we have caught 1,500 criminals or just that 1,500 phone numbers have been taken out of circulation. In the last two years, our county lines programme has delivered more than 1,500 lines closed, more than 7,400 arrests, £4.3 million in cash and significant quantities of drugs seized, and more than 4,000 vulnerable people safeguarded. It means that 1,500 active county deal lines have been closed and found to remain out of use, which is good news. Through our programme we will continue to focus on arresting and charging the line holder and securing criminal justice outcomes to ensure that we put offenders behind bars. The National County Lines Coordination Centre determines that a line is closed when there is evidence that the controlling gang is no longer capable of distributing drugs using that telephone number, with check-backs to ensure that the telephone number remains out of use.

The noble Lord also asked me how we would measure ourselves and what progress looks like. By 2024 we expect the whole-of-government mission to have prevented nearly 1,000 deaths, reversing the upward trend in drug deaths for the first time in a decade. We expect it to have delivered a phased expansion of treatment capacity, with at least 54,500 new high-quality treatment places, which would be an increase of 20%, including 21,000 places for opiate and crack users, delivering 53% of opiate and crack users into treatment. We expect at least 7,500 more treatment places for people either sleeping rough or at immediate risk of sleeping rough, which would be a 33% increase on current numbers. We expect to provide a treatment place for every offender with an addiction, because the two are so often linked.

We also expect that this strategy will have contributed to the prevention of 750,000 crimes, including 140,000 neighbourhood crimes, through increases in drug treatment. We expect it to have closed over 2,000 more county lines through our relentless and robust action to break the model and bring down the gangs running these illegal lines, and to have delivered 6,400 major and moderate disruptions—that would be a 20% increase —against the activities of organised criminals, including arresting influential suppliers, targeting their finances and dismantling their supply chains. These are the ambitions on which we should be judged.

On the noble Lord’s point that we are simply reversing the cuts made since 2010, the strategy is underpinned by a record investment of nearly £900 million of additional funding over the three years, as I said, taking the total investment in combating drugs to £3 billion over the next three years. It sets out our landmark whole-of-government approach to tackling drug misuse, with more leading departments than ever before.

The noble Lord, Lord Paddick, asked about county lines, on which we are already delivering real impact. In the past two years, our county lines programme has delivered more than 1,500 lines closed, as I told the noble Lord, Lord Coaker, with 7,400 arrests and £4.3 million in cash. The latest national co-ordination centre assessment of county lines shows a reduction in the total number of potentially active lines, an important point, with numbers reported to have fallen from between 800 and 1,000 in 2019-20 to 600 in 2021. There is more to be done on county lines programmes through this strategy. We will be investing up to £145 million to tackle the most violent and exploitative distribution model seen yet. We will continue funding the National County Lines Coordination Centre to provide that vital national strategic oversight. We will also focus on the largest exporter areas, alongside dedicated surge funding for local police forces to tackle county lines and grip the transport network through the dedicated British Transport Police’s county lines taskforce, invest in new technology including ANPR, and fund provision of specialist support for vulnerable children, young people and families involved in county lines activity.

We do not have plans for decriminalisation of drug possession generally. Our approach to drugs remains clear. We must prevent drug misuse in our communities and support people through treatment and recovery, which is one of the main planks of the strategy.

My Lords, in the absence of any evidence-based drug policies in this country, which would include heroin treatment centres linked to staffed consumption rooms to tackle very effectively polydrug use and heroin use, and in the absence of readily available medical cannabis to about 1 million people who need it—I could go on—can the Minister confirm that the small increase in funding for treatment envisaged in this strategy will not, even in the third year, fully compensate for the cuts in spending on treatment? Taking into account, as the Government tend not to do, the cuts to Home Office and probation service funding of treatment, as well as the funding from local authorities, can the Minister confirm that even in year 3, when the largest increase will come into play, we will not even get back to all those years ago, before the cuts began? As the Minister knows, Carol Black was prohibited from looking at any change in the law, and it is only with change in the law that one will achieve good evidence-based policies on drugs.

I think that the noble Baroness knows, even before asking the question, that we do not intend to change the law. However, I thought that she might be quite pleased by the focus of one of the pillars, which is treatment and support for drug users. She will also not be surprised to know that we do not have any plans to introduce drug consumption rooms. Anyone running them would be committing a range of offences including possession of a controlled drug and being concerned in the supply of a controlled drug. We support a range of evidence-based approaches to reduce the health-related harms of drug misuse, such as maintaining—oh, I cannot find the page in my notes, so I will get back to her on this in a second.

My understanding is that the police are able to require information to be given and Clause 17 gives the Secretary of State the power to reinforce that. As the Minister suggested this morning, the matter would then have to be determined in the courts. This is really the nub of it. We want professionals to feel able to undertake their work to prevent serious violence, with children and young people who really are pretty problematic, without feeling that, in the end, it will go to court to decide whether they are allowed to exercise their professional judgment.

If the noble Baroness will be patient, I will get on to Clauses 16 and 17 in just a second.

Going back to Clause 15, this will permit, but not mandate, authorities to disclose information to each other. It simply ensures that there is a legislative basis in place to enable information to be shared between all authorities exercising functions under Chapter 1 of Part 2 of the Bill. The clause also ensures that any disclosures must only be made in compliance with data protection legislation and cannot be made if certain prohibitions on disclosure set out in the Investigatory Powers Act 2016 apply.

Clause 16 provides a power for a local policing body—a PCC or equivalent—to request information from a specified authority, educational authority, prison or youth custody authority for the purposes of enabling or assisting the local policing body to exercise its role to assist duty holders and monitor its functions to prevent and reduce serious violence. While Clause 16 places a statutory requirement on the specified authority, education authority, prison or youth custody authority to comply with such a request, a disclosure is not required if it would contravene data protection legislation or prohibitions in specified parts of the IPA 2016. The provision does not place any mandatory requirements directly on individual professionals to disclose information they hold under the duty, be that confidential information or otherwise.

There are also a number of safeguards in relation to the information that can be required. As proposed by government Amendment 20, local policing bodies must request only information already held by that authority. Requests must be related to the organisation or function to whom the request is made, except when functions are contracted out. Additionally, the information supplied under Clause 16 must be used by only the local policing body that receives it to enable or assist that body to assist the relevant authorities or monitor the activity it undertakes under the duty. The information received is not therefore to be used or disclosed onwards to any other bodies for other purposes, such as law enforcement.

It is against that backdrop that we need to consider the provisions in each of Clauses 9, 15 and 16 which Amendments 11, 22 and 30 seek to strike out. These provisions state that, in determining whether a disclosure would contravene the data protection legislation,

“the power conferred by this section is to be taken into account”.

This allows the power or duty to disclose to be taken into account when determining the impact of the data protection legislation. This is to preserve the effect of the data protection legislation, dealing with the logical difficulties that can arise where an information-sharing gateway, such as that proposed by these provisions, prevents disclosure in breach of the data protection legislation, but the data protection legislation allows a disclosure which is required or permitted by the enactment. This is to ensure that these provisions can be taken into account when authorities are determining the legal basis for processing data under Article 6 of the UK GDPR.

This Bill is by no means unique in including this drafting. The provisions have been used for a number of other information-sharing clauses, including most recently the Environment Act 2021 and the Forensic Science Regulator Act 2021. I know that I am not allowed props in your Lordships’ House, but if I hold up the list to myself, there are a huge number of Bills to which this pertains. This is a standard provision. I also reiterate that both Clause 15 and regulations made under Clause 9 provide for permissive gateways, meaning that they do not impose any obligation to share information. That is a crucial point.

On Amendment 25, I totally agree that any decision to disclose an individual’s personal data should not be taken lightly. The rationale for not excluding all personal data sharing under the duty is clear. Private and confidential health data has a unique status and needs special protection or trust between patients and doctors. That could be undermined, with individuals actually going as far as to avoid treatment for fear of their data being shared. However, in order for the duty to be effective, we really must still support sharing of case-specific information on individuals at risk to both safeguard them and support vital interventions; I know that the noble Baroness, Lady Meacher, agrees with that point. Decisions about whether disclosures of personal data can lawfully be made under these provisions would always need to be made on a case-by-case basis, and always in line with data protection legislation.

As I said in previous debates, we are not seeking to replace existing data-sharing agreements or protocols, including those under the Crime and Disorder Act 1998. All authorities subject to the duty should have clear processes and principles in place for sharing information and data. Any and all exchanges of data and information under Clauses 15 and 16 or regulations made under Clause 9 must not contravene existing data protection legislation or provisions of the IPA 2016.

I turn to the amendments tabled by the noble Lord, Lord Paddick. Amendment 18 seeks to ensure that relevant authorities are obliged to comply with the serious violence duty only to the extent that it does not conflict with its other statutory duties. We do not support this amendment, as it is essential that all relevant authorities are legally required to collaborate with the specified authorities or with other education, prison or youth custody authorities in their work to prevent and reduce serious violence when requested to do so, and to carry out any actions placed on them in the strategy. There are already sufficient safeguards in place, including considering whether the request is deemed to be disproportionate to the local serious violence threat level, whether it would be incompatible with an existing statutory duty or, indeed, whether it would have an adverse effect on the exercise of the authority’s functions, or would mean that the authority incurred unreasonable cost. In determining whether any of those conditions apply, the cumulative effect of complying with duties under Clause 14 must be taken into account.

We think that this approach strikes the right balance in ensuring that institutions which are affected by serious violence, or may have a valuable contribution to make to local partnership efforts, will be drawn into the work of the local partnership without placing unnecessary burdens on those which may not. This approach is also consistent with the structures and processes in place for existing safeguarding legislation and would allow for an effective and targeted approach within both the education and prison sectors.

Amendments 24, 32 and 33 require that any information disclosed under Clauses 15 or 16 or under regulations made under Clause 9 must comply with any duty of confidence owed by the person making the disclosure, where disclosure would amount to a breach of that duty, the Human Rights Act 1998, the Equality Act 2010, the data protection legislation, the Investigatory Powers Act 2016, and any other restriction on the disclosure of information, however imposed. In addition, Amendment 33 also specifies that no regulations may be published under Clause 9(2) prior to the Secretary of State publishing an equality impact assessment, a data protection impact assessment and a description of any guidance or codes of practice.

My Lords, as I understand it, they must be read with Article 6 of the GDPR, so it is a read-across. Yes, I am tired—my brain is not working very fast today.

Clauses 9, 15 and 16 also already ensure that data can be disclosed only in compliance with the data protection legislation; I mentioned that that requires a case-by-case consideration of the necessity and proportionality of a disclosure.

Obligations of confidence and other restrictions on disclosure are not breached by a disclosure under Clauses 15 or 16, or regulations made under Clause 9, but patient information and personal information held by a health or social care authority should not be shared in line with our proposed amendments, as it is vital that authorities are able to share their data when necessary to determine what is causing serious violence in local areas. Our draft statutory guidance provides some additional steers on this, and the guidance will be subject to formal consultation following Royal Assent and can be revised if it needs further clarification.

I turn to Clause 17, and first I shall answer a point made by the noble Baroness, Lady Brinton. A direction under Clause 17 cannot be made to require information requested under Clause 16 to be provided if the information is patient information or if the health or social care authority is requested to provide personal information. I hope that she finds that clarification helpful.

Amendment 35 strikes out Clause 17, which confers a power on the Secretary of State to direct a specified authority, educational, prison or youth custody authority, where it has failed to discharge its duty imposed under the Bill. I assure the House that we expect these powers to be seldom used and utilised only when all other means of securing compliance have been exhausted. However, in order for this duty to be effective, there needs to be a system in place to ensure that specified authorities comply with the legal requirements that we are proposing to help prevent and reduce serious violence.

I hope, in the light of my explanation, that the noble Baroness, Lady Meacher, and the noble Lord, Lord Paddick, will be content not to press their amendments and support the government amendments.

My Lords, first, I thank the right reverend Prelate the Bishop of Manchester and the noble Lord, Lord Paddick, very much for their support for these amendments and their excellent contributions, and I thank all other noble Lords who have contributed today—in particular the noble Lord, Lord Rosser, who has been very helpful behind the scenes, despite a slight issue this evening, as we know.

I thank the Minister for her reply. Her remarks must have left noble Lords completely confused because, of course, if these clauses really were benign, we would not have Amnesty International, Liberty and about a dozen other organisations desperate for these amendments to pass this evening. The fact is that they are not benign, and I congratulate the Minister on the brilliant wording that has somehow left me bemused, along I am sure with everybody else in this Chamber.

I regard the issue of the ability of professionals to exercise their professional judgment in deciding whether to pass information to the police, which could jeopardise the very vulnerable young people they are working with, as a very important issue of principle. It is for that reason that I wish to test the opinion of the House—albeit I know our numbers are severely limited at this very late hour—and call a vote.

I thank the Minister for her response on Clause 17. However, I wish to express a bit of concern. Although she assured the Committee that an individual doctor or youth worker would not be required to provide information, nevertheless an authority might well provide information, without consulting the individual doctor or youth worker, that would identify individuals who were receiving services in that authority. After the Minister’s response, I am not at all clear that we can be completely sure that this will not happen; I believe that there should be some wording in these clauses to specify that information from authorities about individuals would not be accepted if they provided it. This is an incredibly dangerous situation if individuals find that their authority has been divulging information to the police; it could destroy the efficacy of our public services—it is that serious.

I am not trying to be awkward; I just feel that we need some assurances in these clauses that individuals will not need to be concerned about the disclosure of information about them. Various subsections in Clauses 15 and 16 and so on indicate that, in looking at data protection, you must take account of the regulations in this Act. It is quite complex but it is not reassuring, if I may say so.

My Lords, I am keen for this not to be left hanging in uncertainty. Perhaps a bit of further explanation will be helpful to the noble Baronesses, Lady Meacher and Lady Chakrabarti, and the noble Lord, Lord Paddick.

This is a backstop power that will be used rarely. However, if needed, it could be utilised; for example, where one of the specified authorities fails to participate in the preparation of the local strategy. If a direction was issued and the authority still refused to comply—that was the question asked by the noble Lord, Lord Paddick—on the basis that it believed that doing so would breach data protection legislation, the Secretary of State would need to apply for a mandatory order and the court would ultimately decide, but I do not think that there is any question of breaching data protection legislation.

My Lords, as the Minister says, the hour is indeed late. I thank the noble Lords, Lord Paddick and Lord Moylan, in particular for their support, and other noble Lords for their speeches. I was going to make a rather similar point to the noble Lord, Lord Paddick, because the Minister made this provision sound very amenable and voluntary—“Don’t worry about it. There is no problem with trust. It is all just about general information.” That is not my reading of these clauses at all.

The noble Lord, Lord Paddick, made one issue very clear, but there are actually various bits of these clauses that build that general picture of anything but voluntary disclosure. There is a lot about modifying data protection and so on.

I hope that, one way or another, we can have a discussion with the Minister before Report because, otherwise, I fear that we will have to bring these amendments, or something like them, back. We would much prefer to sort this out, if we possibly can. With that, I beg leave to withdraw the amendment.

I repeat the point I just made to the noble Lord, Lord Dubs, about the accommodation being good enough for our Armed Forces. I underline that the accommodation is safe, warm, fit for purpose and of an appropriate standard, with three meals provided a day. To put the current demand for asylum accommodation into context, back in 2019 the accommodation asylum population was broadly static at about 47,000, but, as of December last year, we now accommodate in excess of 61,000 people.

My Lords, I fear that the Minister has been misinformed for her responses, as the information on the ground is very different, but that is not her fault. It seems that the Home Office is planning to use disused Army barracks such as Napier increasingly to house traumatised and, as the noble Lord, Lord Dubs, said, often tortured asylum seekers for whom prison conditions—as conditions in Napier are described—induce untold suffering, mental health crises and, indeed, suicide attempts. Can the Minister tell the House when Napier will be closed, as it needs to be, and assure the House that barracks will not be used as accommodation to house traumatised asylum seekers in the future?

I must say to the noble Baroness that the people at Napier are not being detained. I must underline that point very clearly: they are not being detained. I have been through the standards of the accommodation with noble Lords already. In terms of trauma, the access to healthcare in the barracks is of a very high standard. We have a nurse on call from Monday to Friday, nine to five, and out-of-hours healthcare, dental provision and emergency healthcare are available as well. I would reject some of the statements being made by noble Lords.

My Lords, I can be brief with the government amendments in this group. Clause 73 enables the Secretary of State to issue guidance about the effect of certain provisions in the Bill, but also about

“other matters relating to domestic abuse in England and Wales”.

It is the UK Government’s view that, with the exception of Clause 73, the provisions in the Bill relate to reserved matters in Wales. We acknowledge that the power to issue statutory guidance about any matter relating to domestic abuse encroaches on devolved matters in Wales. It is for that reason that Clause 73 requires the Secretary of State to consult the Welsh Ministers in so far as any guidance relates to a devolved Welsh authority.

Following discussions with the Welsh Government, these amendments narrow the power to issue guidance under Clause 73(1)(b) so that any such guidance does not relate to Welsh devolved matters. Guidance relating to Welsh devolved matters is properly a matter for the Welsh Ministers and not the Secretary of State. As I indicated, these amendments have been discussed and agreed with the Welsh Government. I will respond to the other amendments in this group when winding up but, for now, I beg to move.

My Lords, I speak to Amendment 180. I thank the noble Baroness, Lady Featherstone, and the noble and learned Baroness, Lady Butler-Sloss, for adding their names to it. Most of all, I thank the Ministers for their extraordinary forbearance on this very long day.

A key aim of this amendment is to prevent domestic abuse in the future. How should we do it? First, we should ensure—perhaps surprisingly, you might say—that primary school children who exhibit symptoms of severe psychological disturbance receive the professional psychological help that they urgently need if their mental health is to be restored and if long-term problems, for them, society, their own children and future spouses, are to be avoided. The amendment makes it clear that, wherever possible, parents should be involved in that therapy. Much quicker and more sustained improvements for the child can generally then be achieved. Having been involved in family therapy work many years ago, I know just how powerful and beneficial it can be for all members of the family.

The second part of the amendment would ensure that effective preparation for adult relationships—sex, marriage and, most particularly, awareness of domestic abuse and its consequences—was provided across the country for all senior schoolchildren in the last years of their schooling. I will return to this briefly at the end of my remarks; I want to focus mainly on primary school children.

This amendment is probably not the polished article. If we proceed to Report on these important matters, relevant lawyers and, I hope, the noble and learned Baroness, Lady Butler-Sloss, might help to get it into shape. But why is the amendment so important? It is because domestic abuse is rooted in childhood and is such a big problem. The Children’s Commissioner suggests that 831,000 children in England are living in households that report domestic abuse. The mental health of all those children will be adversely affected, in some cases very seriously. Many will go on to become domestic abuse perpetrators, as we have said before. Action for Children tells us that 692 assessments are carried out every day that highlight domestic abuse as a feature of a child’s or young person’s life.

The problem is very serious, for the children as well as for their future spouses and children. The consequences of domestic abuse on children range from negatively affecting brain development and impacting cognitive and sensory growth to developing personality and behavioural problems, depression and suicidal tendencies. Analysis of data from the Millennium Cohort Study found that children whose parents experienced domestic violence when their children were aged three reported 30% higher than average anti-social behaviours aged 14, for example committing physical assault. Sensible, preventive interventions with children will save taxpayers’ money on police, courts and prisons, quite apart from saving the lives of the individuals involved from the miseries of criminality and becoming perpetrators of domestic abuse, with all that those things involve.

Our view is that elongating the move-on period does not necessarily solve the problem. What has been shown to be very effective is when the refugee is contacted right at the beginning of that period, so that the process of accessing universal credit or housing or other services can begin straightaway. Indeed, for universal credit, advance payments can be made ahead of 35 days.

My Lords, noble Lords will know that most asylum seekers are not permitted to work during the period awaiting the decision on their application. They will have received just £37.70 per week from the Home Office. They are therefore absolutely without money when the decision finally comes through. Homelessness and destitution seem almost unavoidable in that situation. They have no chance of obtaining rented accommodation. Does the Minister accept that there really is a need for urgent steps if we are to eliminate destitution, particularly among this group? Will she take back to the department the need to allow asylum seekers to work during the period of waiting for their decision?

The noble Baroness highlights the complex arguments around permitting asylum seekers to work, which the Government are certainly listening to very carefully. But it is also important to distinguish between those who need protection and those who are actually seeking to work here, who can apply for a work visa under the Immigration Rules.

I thank the noble Baroness, Lady Meacher, for affording us the opportunity to discuss her amendment and to outline the Government’s approach to tackling that combined problem of drug misuse and knives. Noble Lords will have heard the noble Lord, Lord Hogan-Howe, talking about the link between knives and the growth of the drugs market. It is absolutely right that she has tabled this amendment. I pay tribute to all the work that she has done in this area and to the work done by the charity of the noble Baroness, Lady Chisholm, to divert vulnerable women from prison.

Clause 22 prohibits the possession in public and private of flick-knives and gravity knives. A person guilty of this offence is liable on summary conviction to imprisonment for a term not exceeding six months’ imprisonment, a fine or both. However, under this amendment, a person who is dependent on drugs would have charges dropped if the police refer the person to treatment and the person complies with the rehabilitation treatment. It is worth noting that Clause 25 prohibits the possession in private—the possession in public is already a criminal offence—of offensive weapons to which Section 141 of the Criminal Justice Act 1988 applies, for example push daggers and zombie knives.

The aim of this amendment is that a person who is addicted to drugs would have charges for possession of a flick-knife or gravity knife, but not any other prohibited knife, dropped if the police refer such a person to treatment and the person complies with the rehabilitation treatment.

I know the noble Baroness and others are keen, as we all are, to deal with the underlying issue where offenders have a substance misuse problem. We will not break the cycle of offending unless we do just that. She and other noble Lords said that. I assure the noble Baroness that the Government are already taking action to address the links between drug misuse and offending. A key aim of the Government’s Drug Strategy 2017 is to take a much smarter approach to drug-related offending to address the drivers behind the crime and prevent further substance misuse and offending.

The police have a range of powers at their disposal to deal with drug-related offences in a way that is proportionate to the circumstances of the offender and the public interest. This includes the appropriate use of out-of-court disposals. We continue to encourage wider use of drug testing on arrest to support police forces in monitoring new patterns around drugs.

The West Midlands police and crime commissioner made the point that the police do things almost outside the law, if you like, but it is quite uncomfortable. They want a change in the law to make it clear that the right thing for the police to do is to get drug-addicted young people into really good services that will move them on and get them right away from the illegal drug market. I do not think it is okay to say that the police are doing things—even though they are—because they are not really happy about it. They want the Government to lead.

We have to get the balance right between protecting vulnerable people from becoming further involved in drugs or crime generally and criminalising some of the people who caused them to get into that life in the first place, which may involve drug abuse.

I shall outline some of the things the Government are doing, which go right to the heart of what the noble Baroness is talking about—early prevention, intervention and treatment. Noble Lords will have heard me talking about the Home Secretary’s commitment to a public health approach to drugs, taking into account all the resources that different agencies have at their disposal to tackle such problems. The noble Baroness was talking about the work in Scotland, which is very effective and very good in terms of intervention.

NHS England is rolling out liaison and diversion services across the country. They operate at police stations and courts to identify and assess people with vulnerabilities, substance misuse and mental health problems and criminality, which are quite often interlinked. They refer them into appropriate services and, where appropriate, away from the justice system altogether. If we went back 10 years, the noble Baroness could talk about the police operating aside from the law, but there is much more understanding now that early intervention and diversion are the way forward. The schemes that the NHS is currently running cover around 80% of the population in England, and we are looking to full coverage by 2021.

The Department of Health and Social Care and the Ministry of Justice are working with NHS England and Public Health England to develop the community sentence treatment requirement protocol. The protocol aims to increase the use of community sentences with drug, alcohol and mental health treatment requirements as an alternative to custody, to improve health outcomes and reduce reoffending. It sets out what is expected from all involved agencies to ensure improved access to mental health and substance misuse treatment for offenders who need it. The Department of Health is currently leading an evaluation of the implementation of the protocol across five test-bed sites to inform further development.

The noble Lord, Lord Ramsbotham, also talked about funding. I do not know whether he knows, but a youth endowment fund of £200 million is being introduced—quite a substantial amount of money. It will run for 10 years, so it is not a short-term approach. The fund will open shortly, so I hope that alongside some of the things we are doing, it will help us in our endeavours to tackle some of the root causes with early interventions and diversions from that type of activity. I ask the noble Baroness to withdraw her amendment.

I shall briefly raise a matter I should have raised before. I thank the Minister for her reply, for the tone of what she said and for her recognition of the need to get to the underlying problems. I omitted to develop the concern about children and young people in care and care leavers. As the Minister will know, there is a long-standing concern about the criminalisation of young people in care and care leavers. Very few arrive into care because of criminal activity, but far too many are represented in our prisons, both as children and as adults. My noble friend Lord Laming led an inquiry into reducing the criminalisation of children, and he is concerned to see all agencies working together to keep young people—both those who have left care and those who are in it—out of the criminal justice system. What the Minister and the noble Baroness have said is helpful in this regard. But there is also a new strengthening duty on the corporate parenting responsibilities of all agencies to support young people leaving care. These are important matters to relate to this particular issue, and I thank the noble Baroness for allowing me to make those points.

I am happy to discuss this further with the noble Baroness. She and I have had many discussions on this subject—we have not had one for a while, so perhaps it would be worth having another. Early intervention and prevention, and a multi-agency approach to assist in diverting people away from the criminal justice system, need to be balanced with the fact that there are quite hardened criminals out there involved with drugs and gangs who we need to capture via the legislation. We need to run both in parallel.

My Lords, we have talked a lot in this place about police funding. It is important to note that public investment in policing has grown by over £1 billion from £11.9 billion in 2015-16 to £13 billion in 2018-19, including investment in counterterrorism policing, local policing and funding for national programmes. There are other funding streams, including the £175 million police transformation fund and special grants.

My Lords, in view of the IDPC report published today, which shows huge increases in the use of drugs across the globe despite harsh punishments and criminalisation, will the Minister seriously consider decriminalising the possession and use of drugs, as Portugal did very successfully more than 20 years ago? That would massively reduce youth crime and is probably the quickest and best way of doing that. It would also increase children’s recovery from drug use and enhance their ability to return to education and work.

On whether no more than five people have applied, the noble Lord is absolutely right that not many people have done so. The panel as currently constituted is making those sorts of decisions on the back of some very urgent cases. Over a longer period, the ACMD will report to the Government on whether cannabis should be rescheduled. Of course, Dame Sally Davies has already made her interim pronouncement on 3 July. On the question of parents travelling abroad to get their children medicine, the noble Lord is absolutely right, and that is why the Government are doing exactly what we are doing: we do not want children to have to travel abroad with their parents and we are acting now in the best interests of those children.

My Lords, I congratulate the Government on instituting these reviews, and I congratulate Professor Sally Davies, the Chief Medical Officer, for making very clear in correspondence with me that she believes that cannabis needs urgently to be rescheduled—she did not use those words, but it was very clear what she meant. In view of the clarity now that cannabis has quite remarkable medical qualities for certainly a number of people with epilepsy, severe pain and so on, is any consideration being given to moving medical cannabis from the Home Office to the Department of Health so that there is clinical leadership in the decisions on this matter?

There is not, and that is because of some of the harms associated with drugs. Yes, Dame Sally Davies made her position quite clear, but of course we work closely with our health partners. In the last few weeks, the noble Baroness will have seen the way in which clinicians and medically based evidence were used to arrive at some of the decisions that were made.

My noble friend is absolutely right: the training is crucial. These officers are experts in their field, who have to make split-second decisions in not just challenging but life-threatening situations, with a lot of people being affected should decisions go wrong. Training is absolutely crucial.

I am certainly happy to give the noble Baroness a longer answer in writing. I will just run through some of the things we have done in recent years. The timeliness of investigations has gone down from 205 working days in the year to April 2017 to 186 working days in the year to April 2018. The IOPC has increased the number of investigations nearly sixfold since 2013-14. In addition, we have doubled the IOPC budget.

My Lords, the Government have a huge amount of sympathy for the rare and difficult situation that Alfie and his family are faced with. My right honourable friend the Policing Minister has undertaken to meet Alfie Dingley’s family as quickly as possible. Both he and my right honourable friend the Home Secretary want to explore every option within the current regulatory framework, including issuing a licence.

I express my sincere thanks to the Minister for that very positive reply. I understand from it that Ministers are now united in wanting to find a legal way to support Alfie Dingley so he can receive medical cannabis in order to lead some sort of life.

I want to set out the main reasons why Ministers have to succeed in this case. The Minister knows that Alfie Dingley was suffering from a very unusual epilepsy mutation. This was causing 3,000 epileptic fits a year, 250 a month, under UK-prescribed medication which will probably lead to psychosis, damage to his internal organs and early death. Alfie Dingley and his family spent five months in the Netherlands, where Alfie was treated by a neuro-paediatrician with cannabis drugs. During that period, Alfie Dingley suffered one or possibly two seizures per month, down from 250 per month in this country.

On the legal question, the Minister knows that under Section 30 of the 1971 Act, licences can be provided.

My Lords, the point I am making is that to amend the existing law on marriage to make provision for legally valid humanist ceremonies would involve a huge range of issues.

It is already in law that humanist marriages should be recognised legally—all it needs is a ministerial order. It does not need, in a sense, to be in this Bill. What would be wonderful would be an assurance from the Minister that she will take forward the need—with some urgency, five years on—for a ministerial order and have it done. It does not need any further legislative change.

What the noble Baroness says is quite helpful, and I am very happy to discuss this matter further. The point I am making today is that this is a very narrowly drawn Bill, and to expand on it in any way would risk the Bill in its passage through your Lordships’ House. I am simply pleading with noble Lords to stick to the content of the Bill. We can certainly have discussions about humanist marriages outside the Chamber, but this is the plea I am making. I am not denigrating in any way what noble Lords have said, but the minute we start adding to or amending Bills like this, the more we are in danger of them not securing their way through.

The noble Baroness, Lady Donaghy, asked to see draft regulations before Committee. It is our aim to make a draft of the affirmative regulations available before Committee. The noble Baroness also asked for clarification on the definition of parent. The regulations will prescribe who can be included under the headings for both sets of parents of the couple in the marriage entry. This will enable us to keep pace with societal developments as well as family composition changes.

The noble Baroness, Lady Bakewell, asked if there was an intention to reform marriage law. This Bill simply modernises marriage registration, as I have said, and facilitates changes to the register entry to allow the inclusion of both parents’ names. This Bill is not at all intended to include wider marriage reform.

My noble friend Lady Morris of Bolton asked a very valid question about what is put in the entry if you do not know who your parents, particularly your father, might be. There will be provision for both parents to be included in the marriage entry, and the option to leave this blank, as is the case now, I understand.

My noble friend Lady Seccombe asked for assurances that the cost of the marriage certificate will not be raised, as she is concerned that any additional costs and processes will discourage people from marrying. Fees for marriage certificates are set at a cost-recovery basis, using HM Treasury guidance, and are reviewed annually. The provisions of the Bill would not directly lead to an increase in costs.

The noble Baroness, Lady Flather, was, I think, so perfectly content with the Bill that she just thought she would talk about sharia marriages. But I think she knows that the scope of the Bill is narrowly about marriage registration.

My Lords, I thank the Advisory Council on the Misuse of Drugs for its advice, which has formed the basis for the order.

The order relates to methiopropamine, commonly known as MPA. The effect of the order is to permanently control MPA as a class B drug under Part 2 of Schedule 2 to the 1971 Act. This will make it an offence to possess, produce, import, export, supply or offer to supply this drug without a Home Office licence.

MPA is a stimulant psychoactive substance similar in structure to methamphetamine. It has similar effects to other stimulants such as MDMA, amphetamine and cocaine. These effects include stimulation, alertness and an increase of energy and focus. Side-effects reported include abnormally fast heart rates, anxiety, panic attacks, perspiration, headaches, nausea, difficulty breathing, vomiting, difficulty urinating and sexual dysfunction.

The National Programme of Substance Abuse Deaths reported 46 cases where MPA was found in post-mortem toxicology between 2012 and April 2017. In 33 of these, MPA was implicated in the cause of death. In November 2015, the ACMD recommended that MPA be subject to a temporary class drug order. This followed reports that MPA had emerged as a replacement drug for the methylphenidate-based compounds which were subjected to a temporary class drug order at the time. The increasing number in use and the number of associated deaths and harms, together with the potential intravenous use, led to urgent advice from the ACMD to control MPA by way of a temporary class drug order.

In September 2016 the desired effect of the temporary class drug order appeared to have been successful, as the prevalence and problematic use had declined. However, the ACMD recommended that MPA be subject to another temporary class drug order to allow sufficient time to gather further evidence to recommend full control under the Misuse of Drugs Act 1971.

On 16 June this year, the ACMD reported that MPA is a drug which is being, or is likely to be, misused and that misuse is having, or is capable of having, harmful effects. As such, the ACMD recommended that MPA be permanently controlled under the Misuse of Drugs Act 1971 as a class B drug. The ACMD also found no evidence that MPA has any recognised medicinal use beyond potential research.

This order, if approved, will provide enforcement agencies the requisite powers to restrict the supply and use of MPA in this country. It will also provide a clear message to the public that the Government consider these substances to be a danger to society. We expect that the permanent control of MPA will continue to offer the notable impact it has provided following its temporary control under a TCDO. It is for these reasons that my honourable friend the Minister for Crime, Safeguarding and Vulnerability accepted the ACMD’s advice that MPA should be subject to the order.

It is intended to make two further related statutory instruments to come into force at the same time as the order, to add these substances to the appropriate schedule to the Misuse of Drugs Regulations 2001 and to the Misuse of Drugs (Designation) Order 2001. I commend the order to the Committee.

My Lords, I apologise to the Minister—I had not anticipated this debate starting quite so early. I well understand the need to control the supply of methiopropamine, or MPA, and I applaud the Government for seeking the professional opinion of the Advisory Committee on the Misuse of Drugs and for following its recommendations. As we know, Governments have not always consulted the ACMD, nor have they always followed its recommendations, so that is to be commended. It is unfortunate that the ACMD and the Government have decided that the most appropriate instrument for the control of this drug is the outdated Misuse of Drugs Act 1971, rather than the Psychoactive Substances Act. The main consequence of this decision is that the users of MPA will be subject to a criminal record and criminal penalty if found in possession of this drug. Users are likely to be people with severe health problems and in need of help and support.

The Minister will be aware that I and about 100 other MPs and Peers who are members of the APPG for Drug Policy Reform would be grateful for an indication from her, if at all possible, of when the Government will invite the ACMD or another independent body to review the operation of the 1971 Act and, indeed, the Psychoactive Substances Act 2016 and analyse the consequences of these Acts on: the level of addiction to the many banned substances; the substitution of new and perhaps even more dangerous substances for a banned substance immediately following a ban; and the level of use of alcohol and tobacco in response to the bans on these alternative drugs. I would be grateful if the Minister could inform the House whether the Government have any plans to evaluate the efficacy of the 1971 and 2016 drugs laws, particularly in the light of the UN Office on Drugs and Crime proposition at the UNGASS in 2016 that evidence-based public health policies are here to stay.

Does the Minister agree that neither of our drugs laws—neither the 1971 Act nor the 2016 Act—were in any way based on evidence that those legislative propositions would actually achieve the objectives that any Government want? For example, we know that the experience in Ireland of an almost identical law to our Psychoactive Substances Act 2016 was an increase in psychoactive substance misuse and drug deaths—anything but the result that the Government would hope, and that we would all hope, would be achieved by a new drugs law.

The Government refer to monitoring the control measures through the regulatory framework at paragraph 12.1 of the Explanatory Memorandum. I would be grateful if the Minister would indicate whether any analysis of the impact of the ban on this drug, and of the bans on other drugs, will be undertaken. I look forward to the Minister’s comments.

My Lords, I disagree with the noble Lord about the Psychoactive Substances Act not working because we have managed to close down more than 300 retailers across the UK which sold psychoactive substances. In 2016, there were 28 convictions in England and Wales and seven people were jailed under the new powers. Additionally, coming from Manchester, I would have to disagree with him, having seen some of the sights that I have on the streets of Manchester recently.

My Lords, the UN changed the basis of global drug policy in April last year at its special session. We now know that banning drugs will never create a drug-free world. The UN therefore wants nations to pursue evidence-based policies, as the noble Lord, Lord Howarth, mentioned, and public health policies to reduce addiction and the harms to our young people. The Psychoactive Substances Act runs counter to the evidence. It does nothing to reduce addiction; it increases the risks to young people. Yes, the head shops were closed but they were the last vestige of any kind of protection for young people, pretty inadequate though that was. I therefore reiterate the point: will the Minister give an assurance to this House that she will give the most serious consideration to instigating an independent review of all our drug policies? What are we doing? We are simply making matters worse. Will she come forward with evidence-based policies?

I do not disagree, and on previous occasions I have not disagreed, that evidence-based policies are absolutely the right way forward. In fact, WHO is undertaking some work of its own and it will report next year on the various elements of cannabis. We await with interest the results of that work.

The noble Lord raises an interesting point, because there has actually been a reduction in drug misuse among adults and young people compared with a decade ago. It has gone down from 10.5% in 2005-6 to 8.4% in 2015-16. The number of heroin and crack cocaine users in England has also fallen, to 294,000. Among 11 to 15 year-olds—a particularly vulnerable group—drug use has continued to fall since its peak in 2003. On the point about local authority investment in drug treatment, the amount that local authorities spend on treatment and rehabilitation is entirely up to them, because the budgets are devolved to them. Clearly, there are different needs in different areas and it is up to local authorities to deem how that money is spent.

My Lords, is the Minister aware that in April the United Nations challenged 50 years of prohibitionist global drug policy at the UNGASS when it declared that evidence-based public health policy is here to stay? I know that the Minister is aware of the considerable evidence now available of the importance of medical cannabis to tens, if not hundreds of thousands, of very sick, chronically ill patients. If the MHRA is willing to work with the Home Office to develop ways in which cannabis medicine can be made available to these very sick patients, will the Minister enter into discussions on that issue?

I thank the noble Baroness. She and I have had many discussions both within the Chamber and outside it on this very issue. I recognise the value of Sativex in the treatment of multiple sclerosis and other types of pain relief. The MHRA is open to considering marketing approval applications for other medicinal cannabis products, should a product be developed. As happened in the case of Sativex, the Home Office will consider issuing a licence to enable trials of any new medicine provided that it complies with appropriate ethical approvals.

My Lords, the noble Lord brings up a very important point, but of course London authorities have always done that. The important thing is to make sure that fewer families have to reside in temporary accommodation, and we have made sure that that is the case.

My Lords, will the Minister accept that one of the biggest problems relating to the welfare bill is the huge cost of housing benefit? This country will never get that cost down until we tackle the terrible shortage of land for housebuilding. We have vast areas of green belt. Will the Minister consider allocating 10% of the green belt to housebuilding in order to rack down rents and reduce the housing benefit bill?

My Lords, the Government are very clear that the green belt should be protected. However, as the noble Baroness will know, this Government are very committed to right to buy and to unlocking brownfield sites, with the brownfield register being available from councils, and we will put £1 billion into the brownfield fund. I have talked about starter homes and other affordable homes.

Again, this has been a further excellent debate on the role of the criminal law in helping to put a stop to the practice of FGM in this country. I am grateful for the constructive approach that the noble Baroness, Lady Meacher, and others have adopted in both debates and in the discussions we have had outside and inside the Chamber.

As many noble Lords have said, we are aiming to get to the same end. It is slightly unfortunate that the amendment was tabled quite late and that there is a difference of opinion in terms of what the amendment seeks to achieve. My noble friend Lady Hamwee rightly pointed out, on the point about “other or others”, that the amendment does not seek to achieve what was sought in the original amendment, if that makes sense.

I also thank my noble friend Lady Tonge and the noble Baroness, Lady Meacher, for pointing out quite strongly that this is not a religious matter. There is nothing in any religious text that points to FGM being something that should be carried out on young girls. It is a specific cultural practice that exists in certain communities in the world and has found its way to this country. Legislation alone cannot eradicate a practice that is so deeply ingrained in the culture and traditions of those who practise it and have been doing so for centuries, but I agree that the law is a very important part of our response to the abhorrent practice of female genital mutilation, and it is right that we should change it where necessary.

We believe that the new offence that we have just debated of failing to protect a girl from risk of genital mutilation gets to the heart of the issue. The Government’s new offence focuses on those who allow this dreadful abuse to be perpetrated on their daughters rather than on those who may only encourage them to do so. That is not to suggest that encouraging female genital mutilation, or indeed any crime, is in any way acceptable.

I take the point made by the noble Baroness, Lady Hamwee, that such behaviour also constitutes an offence under the provisions of Part 2 of the Serious Crime Act 2007, which contains inchoate offences of: intentionally encouraging or assisting an offence; encouraging or assisting an offence believing it will be committed; and encouraging or assisting offences believing one or more will be committed. As the noble Baroness observed, the revised wording of the proposed new offence follows closely the wording of the existing inchoate offences. That is both its strength and, dare I say, its weakness. As a result, it would not cover behaviour that is not already covered by the existing 2007 Act offences.

We are not persuaded that creating a specific offence of encouraging FGM is necessary or appropriate. The provisions in Part 2 of the Serious Crime Act 2007 apply to all criminal offences precisely so that it is not necessary to create specific encouraging or assisting offences for every crime. We agree that the behaviours now referred to in the noble Baroness’s revised amendment should be criminalised, but that is already the case. This amendment would not advance the criminal law in this area—I suspect this is where we are going to have a further conversation.

We believe that changing the culture and attitudes that allow female genital mutilation to persist will be better achieved through the awareness raising and community engagement that the Government have already embarked upon, rather than through the creation of another, arguably unnecessary, inchoate offence.

I wholeheartedly commend the aims of the noble Baroness, Lady Meacher, and others in tabling her amendment. As I have said, this House is united in its desire to eradicate FGM, even though we may differ on how best to achieve that end. I hope the noble Baroness will agree that the government amendments that we have just debated represent a substantial package of measures to strengthen the civil and criminal law to tackle FGM. I firmly believe that they offer a better way forward, and on that basis I ask the noble Baroness not to press her amendment.

I thank the Minister for her constructive response and all noble Lords who have spoken very constructively in this debate. I particularly thank my noble and learned friend Lady Butler-Sloss for her very important point that this amendment, unlike any other, would achieve deterrence, and that is what we want to do. We want to deter this dreadful act. We do not want just to prosecute after the event, although it is difficult ever to achieve a prosecution. If we can deter, we have really got to the goal that is now clearly shared across all sides of the House, which is to change the culture on FGM. We therefore need to change the way the leaders operate and the way they encourage people to indulge in this terrible act.

I also thank the noble Baroness, Lady Smith, for her very helpful support. We must try to find a form of words that the government lawyers, our lawyers and all other lawyers agree will achieve this incredibly important objective. On that basis, I beg leave to withdraw the amendment.

My Lords, I commend noble Lords who spoke to the amendments in this group, which show how seriously this House takes the practice of female genital mutilation. These amendments seek, in their different ways, to further our common objective of ending the abhorrent practice of female genital mutilation.

In moving Amendment 40BA, the noble Baroness, Lady Meacher, is, as she explained, seeking to give effect to a recommendation made by the Local Government Association. The association recommended that a specific offence of “inciting and condoning” the practice of female genital mutilation would make it easier to bring cases against those who advocate it, whether they reside in or are visiting the UK. As I hope Clause 64 demonstrates, the Government are open to identifying ways in which the law might be strengthened to help put an end to female genital mutilation and better to protect victims. We are already considering recommendations made by the Director of Public Prosecutions, one of which we will debate shortly, and we are looking carefully at the recent recommendations made by the Home Affairs Select Committee, to which the noble Lord referred. In this instance, however, I hope to persuade the noble Baroness that her proposed amendment is unnecessary as the behaviour that it seeks to criminalise is already covered and can more effectively be punished by existing provisions of the law.

The common-law offence of inciting the commission of another offence was abolished by Section 59 of the Serious Crime Act 2007 with effect from 1 October 2008, and replaced by the provisions in Part 2 of that Act, which I will refer to as the 2007 Act. They are as follows: intentionally encouraging or assisting an offence; encouraging or assisting an offence believing it will be committed; and encouraging or assisting offences believing one or more will be committed. To be convicted of encouraging or assisting an offence, it is not necessary for the anticipated principle offence to take place. In addition to these legislative provisions, if an FGM offence is actually carried out then anyone who aided, abetted, counselled or procured the offence would be liable as an accessory.

We believe that the existing law is sufficient to cover those who encourage or assist the practice of female genital mutilation and those who take part in an offence in a secondary way, whatever their reason for doing so. The offences in Part 2 of the 2007 Act also have extraterritorial application: they can cover those who encourage or assist, wholly or partly from this country, offences of female genital mutilation that they know or believe will be committed abroad.

I am sorry to interrupt the Minister but I wonder whether I have understood this correctly. My understanding is that the current law talks about aiding a particular offence of FGM. What we are concerned about is the general promotion by community leaders and faith leaders of this practice. I am not sure whether this is the case, but my feeling is that perhaps the current law does not fully and effectively cover that point.

I think I will get on to that further on. As the noble Baroness said, we need to go beyond the law and think about other aspects of how we stop this happening in our communities. I hope I will answer her question, but if I do not I am sure she will stand up again.

This possibly comes on to it: a person convicted of encouraging, assisting, aiding or abetting an offence is liable to any penalty for which he would be liable on conviction of the principle offence. So a person convicted of encouraging, assisting, aiding or abetting an offence of female genital mutilation would be liable, on conviction on indictment, to imprisonment for up to 14 years. Amendment 40BA, which provides a maximum penalty of seven years’ imprisonment for encouraging or assisting the promotion of the practice of female genital mutilation, would therefore have the effect of reducing by half the maximum penalty currently available for such behaviour.

The noble Baroness is, of course, right that the long-term and systematic eradication of FGM in the UK will require practising communities to abandon the practice themselves. While the criminal law can play a part in this, the recent Home Affairs Select Committee report quite properly also pointed to the need for more effective engagement with communities to persuade them to abandon the practice. To this end, the Government are spending £100,000 on the FGM community engagement initiative. Charities were invited to bid for up to £10,000 to carry out community work to raise awareness of FGM among women who have already been affected by FGM and young girls at risk, as well as men. We are now funding 12 organisations to deliver community engagement activity, and we will continue to work with civil society organisations to examine how we can support and facilitate their engagement with communities in the UK. It is noteworthy that in its report the Home Affairs Select Committee made no recommendation in favour of a new offence of promoting or encouraging FGM.

I now turn to Amendment 40CA. As the noble Lord, Lord Rosser, has explained, this amendment would extend to the victims of FGM the same anonymity that already applies to the alleged victims of many sexual offences.

Well, the Minister did say that I could stand up again if she did not answer my point. I was listening very carefully to her words, and they still related to a specific offence of FGM, whereas this amendment is about its general promotion—for example, in a faith leader’s sermon—which is a different thing. I only ask the Minister if she could take this back and consider it. I have said enough, and I do not want to interfere with her answer to noble Lords.

I shall certainly go back and think about what the noble Baroness has said. There is no provision in law for condoning something, and that is what she is suggesting. Perhaps I could clarify it with her further. I apologise if I have not quite answered her question.

Can we now move on to Amendment 40CA from the noble Lord, Lord Rosser? He talked about the same anonymity being applied to victims of FGM that already applies to victims of other sexual offences. This follows a recommendation by the Director of Public Prosecutions. FGM is an offence of a particularly personal and sensitive nature, and the DPP believes that it is important that its victims should know that their identity will be protected if a prosecution takes place. The DPP has argued: that this protection needs to be guaranteed, rather than discretionary; that it should apply from the outset, when an allegation is first made, rather than from the point of charge; and that it should last indefinitely. The director believes that such anonymity would go far to encourage the further reporting of this offence.

These are powerful arguments, and we are considering them carefully. In doing so, we will also take account of the fact that, in its recent report on FGM, the Home Affairs Select Committee endorsed the DPP’s proposal. There are some questions that we need to resolve, but I assure your Lordships that the Government see the force of the argument, and I am confident that they shall shortly be in a position to announce their conclusions.

Going back to the noble Baroness, Lady Meacher, I have just been given an additional note. I will read it out: “Where the general encouragement of FGM related to a specific act, constituting an offence would depend on the circumstances of the case, but we believe such conduct could be covered”. If that still does not answer her question I am happy to write to her. But on the basis of everything I have said, and in the knowledge that we can and should return to this issue on Report, I hope that the noble Lord, Lord Rosser, and the noble Baroness, Lady Meacher, will be content at this stage not to press their amendments.
