European Union (Withdrawal Agreement) Bill

"My Lords, I thank the noble Lord, Lord Whitty, for his dogged persistence in pursuing this matter. There is no doubt that, as we move beyond the end of this year, we will start to lose out on all the joint research on the issues around novel foods, scientific research …..."

Written Question
Brexit
Monday 7th January 2019

Asked by: Baroness Miller of Chilthorne Domer (Liberal Democrat - Life peer)

Question to the Department for Exiting the European Union :

To ask Her Majesty's Government, in the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, as endorsed by leaders at a special meeting of the European Council on 25 November 2018, what is the definition of "dependent" when applied to parents; and what assessment they have made of whether that definition covers physically, mentally and financially dependent parents and grandparents.

Answered by Lord Callanan - Shadow Minister (Foreign, Commonwealth and Development Office)

There is no definition of “dependent” when applied to parents in the draft Withdrawal Agreement, and there is no definition in the Free Movement Directive. However, the UK considers that physical, mental and financial factors can all be relevant.

Under the EU Settlement Scheme the dependence of a parent of the relevant EU citizen or of their spouse or civil partner will be assumed.

"I shall speak to my Amendment 67A, which sets food production within the context of Amendment 66. I heard what the noble Baroness, Lady Jones, said at the beginning and I completely appreciate that Amendment 66 is predicated, or modelled, on the original frameworks. But I want to draw out …..."
