That this House takes note of the detention of Nazanin Zaghari-Ratcliffe and the case for further action by Her Majesty’s Government to secure her release.

My Lords, for five and a half years, Nazanin Zaghari-Ratcliffe has been held in Iran, often in isolation and separated from her baby daughter, robbing her of motherhood and Gabriella of her childhood. Like many noble Lords, I visited Richard Ratcliffe, her husband, outside the Foreign, Commonwealth & Development Office during his recent hunger strike. No one can fail to admire his determination and incredible resolve in his campaign to seek the release of his wife.

Just a couple of weeks ago, I had the opportunity to be at the Magnitsky awards in Westminster Central Hall when I saw that same resolve in a young person. All those present witnessed the deeply moving part of the ceremony when Nazanin’s daughter Gabriella accepted the award for Courage Under Fire on behalf of her mother. Gabriella was just 22 months old when her mother, a project co-ordinator for the Thomson Reuters Foundation was arrested in April 2016 at Tehran Airport, just as they were travelling back to the UK. Iran claimed that she was a spy and, in September 2016, she was sentenced to five years’ imprisonment.

In March 2019, the then Foreign Secretary, Jeremy Hunt, announced that the UK Government were giving Nazanin diplomatic protection. At the time, the Government said that this

“represents formal recognition by the British Government that her treatment fails to meet Iran’s obligations under international law and elevates it to a formal State to State issue.”

Nazanin is the first British national to be granted diplomatic protection since 1951, so can the Minister tell us how the Government have treated her case differently from other consular cases? Under Theresa May’s premiership, at least six trips were undertaken by five different Ministers to solve Nazanin’s case. Why has no Minister been sent to Iran for this purpose under Boris Johnson’s premiership, despite the assertion of diplomatic protection? Nazanin’s status of diplomatic protection means that her ongoing torture is an injury to the United Kingdom itself. What are the Government doing to exercise diplomatic protection for Nazanin and to challenge the fact that she has been tortured?

On 17 March 2020, Nazanin was released from prison under house arrest and allowed to stay at her parents’ home in Tehran. This was partly because of coronavirus. The conditions of her house arrest included wearing an ankle tag and remaining within 300 metres of her parents’ home. In September 2020, it was announced that Nazanin was facing a new charge. A new trial commenced in November 2020, but it was adjourned. Nazanin’s original sentence ended in March 2021. She had her ankle tag removed. However, a week later, she had to attend court for a hearing on a new charge against her, relating to her attendance at a demonstration outside the Iranian embassy in London 12 years ago. She was sentenced to a further year in prison, to be followed by a one-year travel ban. In October 2021, she lost her appeal against this sentence. She now faces the prospect of being returned to prison at any time and of not seeing her husband and daughter until 2023.

It is now well over 2,000 days since Nazanin was first detained. This is an unimaginable ordeal for her and her family. Recent talks between the Government and the Iranian Deputy Foreign Minister did not result in any progress. Nor has there been progress in the cases of other British nationals, including Anoosheh Ashoori and Morad Tahbaz. Both men are not in good health. Like Nazanin, they are being arbitrarily detained on spurious, fabricated charges. Anoosheh Ashoori has not been allowed out of prison. His family applied for diplomatic protection for him in April 2021. What consideration has been given to this request? What was the outcome? Morad Tahbaz was one of eight conservationists held by the Iranian authorities. Amnesty International has said that there was evidence that those eight had been tortured to obtain false confessions.

During the last debate on the detention of British nationals, noble Lords across the House raised the debt of £400 million which Britain owes Iran. The money was paid by Iran to the United Kingdom more than 40 years ago for 1,500 Chieftain tanks, which were never delivered. The Government have said that bank transfer transactions are not possible because of restrictions but, as we all know, if the Government had the will to settle the debt, one way or another, the payment would be made.

No one is suggesting that our Government should pay any sort of ransom. If the money is owed—and there is no question but that that is the case—the debt should be settled. When the Prime Minister was Foreign Secretary, he made a promise to Richard Ratcliffe that the debt would be paid. Significantly, in 2014, the current Defence Secretary described the unpaid debt as “a sorry story”. He said that the whole issue had been,

“marred by double dealing and obfuscation.”—[Official Report, Commons, 11/3/14; col. 103WH.]

More recently, a number of distinguished former Foreign Secretaries—Conservative and Labour—have said that the debt should be paid. That is also the view of many international and legal commentators and it is the view of the Opposition as well. Jeremy Hunt, a former Foreign Secretary, said that it was not about paying a ransom; it was about the UK’s credibility and doing what is right.

In our last debate on this subject on 15 November 2021, the noble Lord, Lord Goldsmith, insisted that

“it is not helpful in any way to connect wider bilateral issues with those arbitrarily detained in Iran.”—[Official Report, 15/11/21; col. 16.]

Does the Minister acknowledge that Nazanin and her family have been told on numerous occasions that payment of the £400 million IMS debt is key to her release? I hope he will respond to this.

On numerous occasions, we have been told by the Government, including the Minister, that they are doing their best, but, for more than five years, British Governments have tried and failed to secure the release of Nazanin and the other British nationals. If there was a government strategy during this time, it has clearly failed. Richard Ratcliffe puts it in a slightly different way, describing the Government’s policy as a “policy of waiting”. Now is surely the time to be vigorous and determined. Nazanin, Anoosheh Ashoori, Morad Tahbaz and all the British nationals—that is what they are—need to be brought back home. The time for discreet pressure and cautious words is long past.

I suspect that the question that is in the minds of most noble Lords today is: how is it that, in recent years, countries such as the United States, Australia, France and Germany have all successfully negotiated the release of their citizens arbitrarily detained in Iran? Perhaps the noble Lord can tell us what those countries have been doing right and what we have been doing wrong. All noble Lords want to hear from the Minister today that the Government have a strategy and a plan of action for bringing our people home.

I conclude with questions on what actions might be part of that plan. How will the Government use the political will behind the Canada-led Declaration Against Arbitrary Detention in State-to-State Relations, which they joined in February this year, to challenge Iran’s systematic hostage-taking? Will the Government acknowledge that Nazanin and other British nationals arbitrarily detained in Iran, including Anoosheh Ashoori, are hostages in accordance with the Taking of Hostages Act 1982? Will the Government commit to finding international solutions to Iran’s systematic hostage-taking at the upcoming democracy summit, initiated by President Biden, on 9 and 10 December?

The Free Nazanin campaign submitted an evidence file identifying 10 perpetrators of Iran’s hostage-taking, requesting that they be subjected to asset freezes and travel bans, using the Magnitsky sanctions. I know how the Minister will reply: he will resist any questions on planned designations. But I hope today he will confirm that Magnitsky sanctions will form part of the plan of action.

I look forward to hearing not only the Minister’s response but the contributions of all noble Lords across the House this afternoon. In particular, I welcome the maiden speech of the right reverend Prelate the Bishop of Chelmsford, and I look forward to hearing her contribution. I beg to move.

My Lords, I thank all noble Lords for their contributions this afternoon. This has been an excellent and incredibly moving debate. I add my appreciation for the excellent maiden speech by the right reverend Prelate.

I do not dispute for one moment the effort that the Minister and other government Ministers have put into the campaign of pressure that he referred to but, as the noble Lord, Lord Purvis, said, we have had five Foreign Secretaries, each pursuing a new initiative, including diplomatic status. The fundamental question which, sadly, the Minister failed to answer is: why has this country failed when others have succeeded? I hope that when he goes back to the department, that will be uppermost in his mind.

Of course, one other point in relation to the five Foreign Secretaries is that there has been a continuity Minister, who is, of course, the noble Lord himself. He has successfully been a Minister of State in the Foreign Office under all those Foreign Secretaries, so I hope he can provide that continuity message to his superiors about the need not only to continue with the campaign of pressure but to understand better what is needed to resolve this issue—the plan of action that is so desperately needed.

The Minister said that it is in Iran’s gift to release the British nationals, including Nazanin, and he is absolutely right. He said that it is in Iran’s gift to do the right thing and that it is their moral obligation. Here, I come back to the right reverend Prelate the Bishop of Chelmsford. In her maiden speech, she said that it is about upholding international law, setting an example of integrity and doing the right thing. I hope the Minister will take that message back clearly in terms of the debt that is recognised as owed by this country to Iran.

This has been an excellent debate. I am not going delay the House any more. I just hope those messages get through.

My Lords, too many of the vaccines gifted to the poorest countries are within 12 weeks of their use-by dates. These short lead times between donation and expiry show why a strengthened G20 and a month-to-month delivery timetable are now urgent. Will the Government follow the Swiss example of expeditious transferring of delivery dates with their recent transfer to COVAX? We can act now and have an effect now.

My Lords, Covid has seen an additional 283,000 children under five predicted to die from malnutrition, yet the FCDO is currently set to cut ODA to nutrition by 70%. Nutrition programmes not only save lives but are central to girls’ education, vaccine efficacy and economic development. Ahead of the Nutrition for Growth summit next month, which this country has led the way on, will this Government commit to making a prominent pledge to ensure that they meet the UK’s commitment to reach over 50 million children, women and adolescent girls by 2025?

My Lords, I cannot make specific commitments now other than to say that the strategy that we are due to publish will take forward our commitments in the integrated review that set out clearly that the UK is one of the world’s leading development actors. We are committed to the global fight against poverty and to achieving the sustainable development goals by 2030. The strategy that is published will absolutely support those aims.

My Lords, I too pay tribute to the noble Lord, Lord Alton, not only for initiating this debate but for his courage in standing up to the bullying and intimidation of the Chinese Government. The sanctioning by Beijing of the noble Lord and my noble friend Lady Kennedy of The Shaws for speaking out is an absolute affront to our democracy.

As we have heard today, the evidence of the appalling treatment of the Uighur population in Xinjiang is clear: the mass surveillance and arbitrary detention; the torture and the brutality; the rape and the abuse; the forced organ harvesting; the forced sterilisation of women; the enforced separation of children from their parents; and the denial of the Uighurs’ right to practise their religion or to speak their own language. The sad fact is that there is no prospect that either the ICC or the ICJ will be able to examine this evidence, as this would require the consent of China. The Chinese Communist Party will also continue to prevent the United Nations conducting a proper investigation in Xinjiang.

Through our amendments to the Trade Bill, we sought to create a route to genocide determination through the UK’s courts, or through a panel of senior Law Lords, but those cross-party efforts were shamefully resisted by the Government. My attempt to include human rights as a matter of course in trade negotiations was also resisted. One thing I am glad about is that the noble Lord also announced yesterday at the event at the FCDO that the human rights report—which was meant to also include reference to trade—will be published more regularly so that it will, we hope, inform those discussions.

What was ultimately included as Section 3 of the Trade Act 2021 was that designated committees in each House would consider whether there was credible evidence of genocide committed by a potential trading partner. As the noble Lord, Lord Alton, has acknowledged, however, that triggers only when there is a prospect of a negotiated trade agreement. The noble Lord, Lord Alton, also referred to the Foreign Affairs Committee’s recent inquiry into Xinjiang detention camps. This concluded that the Government should respect the view of the House that crimes against humanity and genocide were taking place, and must make a much stronger response.

With the international route to legal determination of genocide blocked by China, and the domestic route to legal determination blocked by the Government, it falls to Parliament to act. The noble Lord, Lord Alton, highlighted the opinion by barristers at Essex Court Chambers, concluding that there was a very credible case that the Chinese Government’s actions constituted genocide. In response to that, of course, the chambers were also sanctioned by Chinese Government.

As a signatory to the 1948 genocide convention, the United Kingdom is legally bound to take all reasonable steps to both punish and—most importantly, as noble Lords have said—prevent genocide. It is incumbent on us to take action. Genocide can never be met with indifference or inaction; the question, then, is what should be done. Sadly, the Government’s actions do not match their rhetoric. The noble Lord, Lord Alton, and Labour have been calling on the Government to apply sanctions to the Chinese officials responsible. The Government have sanctioned only four Chinese officials, and not even Chen Quanguo, as the noble Lord, Lord Alton, said.

We should be supporting UK businesses to ensure that their supply chains do not include workers subject to human rights violations in Xinjiang by working across Whitehall departments. We should push for the UN High Commissioner for Human Rights to be given full and unfettered access to Xinjiang. If that request continues to be rejected, this side of the House will support—and will call on the Government to implement—a political and diplomatic boycott of the Beijing Winter Olympics in 2022.

The UK Government should also have publicly opposed China’s election to the UN Human Rights Council in the recent elections, and to hold firm to this position until such time as Beijing provides the commissioner with access to Xinjiang. Like the noble Baroness, Lady Finlay, I would also like the Minister to give us an update on what we have called for on that forced organ harvesting. The WHO should conduct independent verification of organ transplant systems, and not just rely on self-verification.

Consecutive Conservative Governments has been naive and complacent in their dealings with the Chinese Government. By leaving the British economy over-reliant—as the noble Lord, Lord Purvis, said—on Chinese imports and supply chains, while failing to defend our values and interests on the global stage, we have seen the United Kingdom’s leverage and influence consistently eroded. In 2015, David Cameron and George Osborne, with the enthusiastic support from then London Mayor Boris Johnson, proclaimed a “golden era” of UK-China relations—a strategy designed to open up UK markets and infrastructure to Chinese business and investment, in the expectation that China would fall in line with international norms around trade and human rights. That strategy has been an unmitigated failure. We have seen uncompetitive market behaviour by state-backed Chinese firms, the human rights abuses in Xinjiang and Hong Kong, and—as the noble Baroness, Lady D’Souza, said—China’s increasing military aggression towards Taiwan and in the South China Sea.

The Government compromised the UK’s national and economic security by increasing the UK’s reliance on China and reducing our strategic independence. For instance, 57 of our critical infrastructure supply chains are now reliant on China. The UK’s failure to build alliances with fellow democracies has hampered our ability to stand up to the Chinese Government when required.

Despite all this, no global challenge, from climate change to pandemics, can be solved without China’s co-operation. Constructive engagement with China is essential but that will be achieved only on the basis of mutual respect and a fundamental reset in UK-China relations. Labour has called on the Government to commit to a fundamental strategic reset in Sino-British relations, starting with a complete audit of every aspect of the UK-China relationship across the whole of government.

First, the UK Government must seek to rebuild our strategic independence by reducing our dependence on China. There needs to be a far more joined-up approach across Whitehall on these issues. Secondly, we must build an alliance of democracies to champion co-operation based on shared values, human rights and the rule of law. We must rebuild trust with our European allies and across the globe, particularly in the Indo-Pacific region, in order to stand firm in the face of authoritarian regimes. That approach would allow for engagement with China from a position of unity, strength and consistency—the type of position that the Chinese Communist Party leaders respect and respond positively to.

Labour stands in solidarity with the Chinese people, with whom the British have a deep, long-standing and valued relationship. We have deep respect for China’s history, culture and civilisation, and we fully acknowledge and recognise its great power and status. Our judgment, as is clear from today’s debate, is focused on the actions of the Chinese Government and Chinese Communist Party leaders, whose irresponsible and increasingly hostile behaviour is undermining their own wish to shape global affairs.

My Lords, the simple fact is that the messages from the UK Government are not being heard by the Zimbabwean Government, and certainly not being acted on. Just over a year ago, I raised with the Minister the Government’s strategy for working with civil society groups in Zimbabwe to defend human rights. I specifically asked whether the Foreign Office would

“work with the TUC and its international affiliates to ensure that we support workers who are organised in Zimbabwe to defend their own human rights.”—[Official Report, 27/10/20; col. 125.]

The Minister at the time, the noble Baroness, Lady Sugg, outlined the support we were giving to civil society groups. She also promised to follow through on meeting with the TUC. Has that meeting taken place? What is the outcome? What support are we giving to those sorts of civil society groups in Zimbabwe?

My Lords, I do not believe the specific meeting took place directly with the TUC. We certainly have been meeting in Harare with various unions, including teaching unions, most recently in September 2021 on salaries and the impact of Covid-19. Trade unions form an important part of civil society in any country, and we engage with them at all levels.

My Lords, we have consistently called on all parties, not just the Government of Ethiopia, to end fighting and protect civilians. On 5 November, the Foreign Secretary spoke to the Ethiopian Deputy Prime Minister, Demeke Mekonnen Hassen. She raised our strong concerns about the impact of continued fighting in Ethiopia and the appalling suffering of the civilian population. She set out the need for negotiations to avoid further bloodshed and deliver peace. All sides must agree a ceasefire and allow aid to reach starving people.

My Lords, last week Liz Truss committed to prioritising and funding combating sexual violence in conflict, with the noble Lord, Lord Ahmad, leading. Tigray must rank as the worst example of the use of sexual violence in conflict, yet there has been no public word about the results of the scoping mission to Ethiopia by the UK preventing sexual violence team. There is a desperate need for services for survivors and to secure legal evidence, much of which is in camps in Sudan. Will the UK back the call from Helen Clark and others on the UN Security Council to set up a tribunal to investigate allegations of sexual violence?

The noble Lord makes an extremely important point and he is right that sexual violence has been a grim feature of this conflict. The deployment by the Preventing Sexual Violence Initiative UK team of experts resulted in a review of the needs and gaps in the response, which we are taking forward, including through a specialist role based in the Embassy. We expect that that work to support accountability will begin in January. We are not planning at this stage, I am told, to make the review public, but I am assured, following our encounter just a few minutes ago, that there will be briefings specifically for parliamentarians.

The Government strongly support the noble Baroness’s appeal for full access and full transparency, in relation both to cultural heritage and the allegations that have been made, and to the International Committee of the Red Cross, which does not currently have full access to all prisoners of war. That is something that we are pushing hard for.

My Lords, six months ago, I raised with the noble Lord, Lord Ahmad, the fact that Russia had taken significant control over the administration of Nagorno-Karabakh. Last week, a Russian news agency suggested that the Armenian President wanted the Russian army to remain for good. What assessment has his department made of this move, and what impact will it have on security in the region?

As I said, the UK has not yet made a full assessment of the deployment of the Russian peacekeepers, but deployment of peacekeepers clearly has to have the support of both parties to the conflict, or the aims become almost impossible to achieve.

My Lords, as I said in answer to the previous two questions, we are reviewing the funding decisions. We are reviewing country allocations and we will come back with figures when we can. No one disputes the importance of this work to people’s lives and to the stability of countries. Yes, I would be very happy to meet the noble Lord.

I think it is worth repeating this really important point so that the Minister hears: there has been a 75% cut in our landmine clearance work. That will result in deaths. While the Minister is waiting for another nine months, many children and women will be killed as a consequence of this action. It is no good talking about the past; it is the future we are concerned about. Will he, therefore, go back to his department and say, “Restore these cuts now”?

My Lords, the department is currently—not in nine months—reviewing funding decisions in relation to demining. As I said, none of my ministerial colleagues and no one in the foreign office disputes the importance of this work. Every penny that we put into this programme is a penny that will contribute to saving lives and we are very aware of that.

My Lords, no one disputes that there is a historic debt, one which was owed to pre-revolutionary Iran. There is no dispute or debate about that. However, here I am answering a Question about Nazanin, yet the majority of questions relate to that money. The combination of that issue with the issue that we are dealing with—an appallingly tragic human case—is exactly what we should be avoiding. Otherwise, this does become a hostage situation and any payment of any money becomes payment for a hostage. That is not in our international current, medium or long-term interests.

Let us put it a different way. When I met Richard outside the FCDO, he described the policy of the Government as a “policy of waiting”. The Minister has said that they are doing things; well, this House wants to hear precisely what they are doing. One thing this Government should be doing is ensuring that we improve relationships with the Government in Iran—to ensure that all the outstanding issues, including of those who remain in prison, are properly resolved. So what are the Government doing?

The Government certainly want to improve our relationship with Iran. In direct answer to the noble Lord’s questions, we have raised this case at the highest levels of government at every opportunity. The Prime Minister raised it with President Rouhani on 10 March this year. The previous Foreign Secretary engaged regularly with Foreign Minister Zarif. The current Foreign Secretary, who has been in post for only a few weeks, has spoken twice now with her counterpart, most recently just a week and a half ago. Our ambassador and the wider team continue to lobby Iranian interlocutors at every opportunity. They helped to secure the release of Nazanin on furlough and continue to push for a full and permanent release, most recently on 9 November. As I said earlier, escalation in the form of diplomatic protection on 7 March 2019 represented a formal recognition that her treatment breaches Iran’s obligations under international law and raises the status of this case to the highest possible level.

My Lords, as Russian forces continue to build up on the Ukrainian border, Associated Press reported that Russia and Belarus are further deepening their integration, stopping short of a full merger. Obviously Lukashenko now relies on Russia for support far more than he did before because of the international community’s opposition to his crackdown on the opposition within the country; 10 days ago we discussed the sanctions. I welcome what the Minister has said about discussions with NATO but, as the noble and gallant Lord, Lord Houghton, said, we really need a co-ordinated approach here. Can the Minister tell us why the Government are still delaying the full implementation of the Russia report?

My Lords, on the noble Lord’s last point—the Russia report—we have already taken key steps and actions. I have previously documented the steps that we have taken. There is a cross-government approach to the response to that, and a reply was issued immediately after the report came out. In the interests of time, I will write to the noble Lord about the specific actions that we have undertaken.
