My views on abortion are well known. Beyond that substantive question, and regardless of whatever position we hold personally, we must be respectful of one another’s views, whatever those views may be. It is clear that these regulations create a democratic deficit. Quite simply, the people of Northern Ireland have not been allowed to determine these issues for themselves, as they have the right to do. Without democratic legitimacy, and with a failure to ensure reasonable accountability and scrutiny for decisions which will result in significant financial commitments, this will breed even more contempt and mistrust in our institutions. There is so much to regret in these regulations, and, like my noble friend Lady O’Loan, I cannot support them. I will vote with her if she decides to divide your Lordships’ House.

My Lords, it is impossible to have a pick-and-mix constitution. I approach this entirely from a constitutional point of view. My views on abortion are similar to those expressed by the noble Lord, Lord Alton, in his very thoughtful and thorough speech, but I do not want to follow him along that road.

As a democrat and a constitutionalist, I accept that abortion is entirely legal within England. I accept that it is entirely legal within Wales and Scotland. I accept, although I deeply regret it, some of the legislative moves on the gender issue that are being made in Scotland. All those years ago in Parliament I opposed devolution for Scotland, but that is over and done with. We are where we are. Therefore, we accept that the United Kingdom is united with the United Kingdom Government on the great issues—foreign policy, defence, et cetera. However, if we accept that we have devolution, it cannot be pick-and-mix devolution. Therefore, it is wrong for us to dictate to the people of Northern Ireland, whose views, so far as we can assess them, as referred to by the noble Lord, Lord Alton, a moment or two ago, indicate that they do not want this. We may think that is benighted. Many of your Lordships may think that it is wrong and would be entirely justified in taking that view.

But we have devolution. It is very important indeed that Northern Ireland gets its act together. We would not be debating this today had there not been three years without a proper Assembly and Executive in Northern Ireland, and we are now in another period where we do not have a functioning Executive. As one who loves Northern Ireland and got to know it fairly well when I was chairman of the Northern Ireland Affairs Committee in another place, I deeply regret this. I would say to my many friends in Northern Ireland that they should, please, get their act together—but we in this United Kingdom Parliament should not take back powers that we have devolved. That is what we would be doing; indeed, it is what we have done already.

Let us not forget that Northern Ireland has a much longer history of devolution than any other part of the United Kingdom, going back 100 years. We have decided that Northern Ireland should have autonomy in certain areas; for example, it should be responsible for its education and its health. I greatly admire my noble friend the Minister; he has done a great deal for Northern Ireland and relations within the United Kingdom, and he is a man with whom I do not disagree lightly. However, in all conscience—fundamentally this is both a constitutional issue and an issue of conscience—I cannot accept what the Government are asking us to do today.

I suspect a significant number of your Lordships will take a different view—that, of course, again, I respect —but I come back to where I started. If you have devolution, and devolve certain things to the constituent parts of the United Kingdom, you cannot mix and match. You have to be consistent with your principles. I believe that the only way of being consistent with our principles in this is not to support what my noble friend advanced but to support the line taken by the noble Baroness, Lady O’Loan, in her amendment.

My Lords, I did not think I would sit and listen to more than about 10 minutes of this debate, as I expected to hear a very familiar argument about the morality and legality of abortion, on which my views were long ago established. I have always been in favour of legalising abortion. Indeed, I am quite liberal and tend to go the liberal end of a woman’s right to choose. However, I have found myself listening to a very challenging debate that is not on that subject at all; it is on the question of what should be within the scope of the powers that we have devolved to the constituent parts of the United Kingdom.

The speeches have been extremely eloquent, if I may say so humbly and without being patronising; there have been some very moving speeches. However, I am not sure that they altogether satisfy the case for opposing these regulations. We are debating what the exact scope should be of what we have devolved to the different nations of the United Kingdom.

I accept that we long for the devolved Administration to be set up in Northern Ireland, but we all know the reason why that is not happening at the moment. It is because of the forcing of the protocol upon the people of Northern Ireland, yet the heart of the Belfast agreement is that there has to be an acceptance and a willingness from all within the community of Northern Ireland, both the unionists and the nationalists, but the will of the unionist population has been totally swept aside. Therefore, we are ensuring that the will of the people—

It would appear that a majority of the people of Northern Ireland do not wish to see the protocol swept away—amended yes, but swept away most certainly not—and that is not a devolved issue. The noble Lord reprimanded my noble and learned friend Lord Clarke, and I must gently reprimand him to get his facts right.

The noble Lord, Lord Cormack, has missed the point of the Belfast agreement. There must be a majority of unionists and a majority of nationalists. I am pointing out to the noble Lord—and I am not going to be deflected from the real issue that is before us we are talking about abortion—but I have to say to him, that as far as the protocol is concerned, and I emphasise it again, not one unionist representative returned to the Northern Ireland Assembly is there to support, or give support, or give credence to the Northern Ireland protocol.

Indeed, the damage to the Belfast agreement is clearly seen because Regulation 2 spells it out for us:

“the Executive Committee of the Northern Ireland Assembly is to be disregarded when determining what a relevant person could do for the purposes of paragraph (1).”

I trust that everyone understands that under this regulation the opinion of the Northern Ireland Executive is to be totally ignored, totally disregarded. Such is the arrogance of those who bring forth these regulations. Indeed, the present difficulties in establishing a new Executive in Northern Ireland are due to many law-abiding people in Northern Ireland feeling that their concerns have been disregarded, undermined and ignored.

This statutory instrument simply adds to such alienation and does grave damage to the restoration of devolution. The Northern Ireland Act 1998 makes it clear that on matters that are significant and cross-cutting, the Executive must take the decision and it cannot be left to an individual Minister to decide. I know that the powers granted to the Northern Ireland Executive are not limitless and that the Secretary of State for Northern Ireland does have power to intervene and directly administer. However, that power is also limited and is there to ensure that decisions taken are compatible with international law, having regard to the protection of public order or the vital issue of national security.

These regulations change the very substance of the Belfast agreement and the Northern Ireland Act. These regulations permit the Secretary of State to have absolute power without scrutiny or accountability. When the Minister replies perhaps he can tell us where the power of the Minister of Health stops and the power of the Secretary of State begins. If the Secretary of State commands a civil servant in the Department of Health to do something and the Minister of Health gives a contrary command, whose decision does the civil servant obey? Does this not put civil servants in direct conflict with their Minister?

My Lords, should we not remember very carefully that there has never been a time since the war when it was more important to try to march in step with our friends and allies in the European Union? Will the Minister reflect on the fact that the late, great Harold Macmillan had a wonderful quote on his desk from WS Gilbert:

“Quiet, calm deliberation disentangles every knot”?

In which spirit I am sure my noble friend will welcome the tone and content of the Prime Minister’s article in the Belfast Telegraph this morning. As I have said, we are of course continuing to talk to and work with the EU, but, whatever else is going on, we cannot allow the problems in Northern Ireland to continue to fester and the institutions continue to be in abeyance. He and I both support the Belfast agreement. Without the institutions or the Assembly, strand 2 does not work; without the Assembly, strand 3 does not work; and without the institutions, the Belfast agreement looks pretty thin. We need to quickly get into a situation whereby the institutions can be restored, and that requires dealing with the protocol.

Briefly, in the gap, I want to add my support to the noble Lord, Lord Foster, thank him for the way he introduced the Bill and echo his congratulations to my honourable friend Sir David Amess in another place. I want to speak for two main reasons. First, I say to my noble friend on the Front Bench that this Bill may be simple in its aims but it is complex in its implications and I believe that the only realistic way of dealing with this is for the Government to pledge to take the Bill over and give it the time it needs for scrutiny in your Lordships’ House and in another place. I think that is essential.

The complexity issue was touched on by the noble Lord, Lord Redesdale, who talked about the majority of houses in this country being already built. He touched on a particular interest of mine: historic houses and buildings. I have the great privilege of living in a listed building in a cathedral close in Lincoln—we call it Minster Yard—where all the buildings are listed and where, at the centre, is one of the greatest buildings in the world: Lincoln Cathedral itself. Of course, all buildings, including all religious buildings, will have to be covered during the next 20 years. I know the Church of England has made a commitment—rather than giving any details on how it will carry it out—but we have to recognise that there is a particular challenge with historic buildings.

The noble Lord, Lord Redesdale, touched on this issue when he talked about wooden windows. My noble friend Lord Deben touched on it obliquely when he talked about the need for skilled workers. I declare an interest as the chairman of the William Morris Craft Fellowship Committee. We are going to need ever more proper apprentices who do a proper apprenticeship and who will be able to work on these buildings. The joy of our country lies very much in our historic towns and villages; not only in the houses but in the churches and cathedrals. We must honour the past, as well as prepare for the future in how we adopt and adapt to the needs of climate change. It is not a simple task.

Of course, the noble Lord, Lord Redesdale, is right to say that Historic England must be part of the team that deals with this. Imaginative solutions are needed. Artificial materials may, in some cases, be adequate, but in many cases they will not, so we will have to address such problems as how to preserve wood for longer. It is a complex issue and I beg my noble friend on the Front Bench to give a commitment to this House today that he will, at the very least, discuss with the Secretary of State the absolute imperative for the Government to take this on.

There are three elements to that. The first is that we need to decarbonise domestic heating, which is a real challenge. Most people still heat their homes by gas; I include myself. We need to make a choice between electricity or a potential hydrogen hybrid. The second element is that we must try to be more efficient in the way that we use our electricity. Finally, on the question of who will ultimately pay for this, I am afraid that there is no easy answer. Ultimately, it will be the people of Great Britain. We need to recognise that, to ensure that those affected by fuel poverty do not bear the brunt of the costs.

Can he also give us some idea of when a chairman will be designated? My noble friend would be an admirable candidate, as would my noble friend Lord Goldsmith.

We await the call. Who knows? My noble friend is right to ask when there will be a new COP chairman. I suspect that the Prime Minister will look at that as part of the wider re-examination of Government. Our relationships with the devolved Administrations are absolutely vital, as is our relationship with the great city of Glasgow itself. It is a great city in which to conduct this climate change conference.

The noble Baroness is absolutely right. There are lessons to be learned for this Government and for the parties in Northern Ireland; indeed, some of them are quite hard lessons. It is the people of Northern Ireland who often make the judgment, as they have done in elections gone by.

I am aware that this process is at a very delicate stage. It is almost like the stage when you see the first green shoots of your seeds coming through and you think that you have a harvest, but that is actually when you need to tend to them most carefully. We must all do that now to ensure that we reap the harvest of what we have achieved over the past few days. I am aware that each party will now be judged on how it tends the crop before we reach the harvest.

My Lords, I congratulate my noble friend warmly. Does he acknowledge that some important unfinished business has been taken forward in your Lordships’ House in the absence of the Executive? In particular, I refer to what I call the Hain initiative on providing proper compensation for those who suffered so much during the years of anguish and trouble. Can he assure the House that there will be no further impediment to implementing those measures?

My noble friend is right to raise this issue. He will recall, as I am sure other noble Lords will, that the legislation we took forward before Christmas was taken forward by this House and this Government. It was not dependent on the outcome of a new Executive. As a consequence, it will continue to the timetable that we set. I believe—again, I pay tribute to the noble Lord, Lord Hain, for his work on this—that the compensation for victims should be in place no later than May this year. That is something to be welcomed by all in the newly reformed Executive, I hope.

The noble Lord is right that there are issues around more than just the component parts of the holiday because, as an entity, Thomas Cook is not just a single company. It has different named brands that sit underneath that name. The important thing for us here is that this will be through those who have booked a holiday with Thomas Cook, and have experienced severe injury and so forth as a consequence of that booking. In many instances, these are historic payments that will be halted because of the situation. They are not ongoing future payments, although some fit into that category. What is important here is that the manner in which Thomas Cook sought to address those questions will have been part of the initial settlement that Thomas Cook reached. The question we are then taking on is: how do we compensate and match a measure of the liability that was experienced? It will be done through the criteria that we set in primary legislation, which we will afford your Lordships an opportunity to examine in greater detail.

Is my noble friend aware that we will take great encouragement from the fact that he is involved in helping to solve this very difficult problem? We are all grateful to him for the way in which he led on the Northern Ireland Bill, which has just gone through the other place and is now the law of the land. He has shown commendable leadership and initiative. We have been glad to give him support and I hope that he will be reassured that we want to do the same for the expeditious legislation that will be necessary at the beginning of the new Parliament.

Regarding hyponatraemia, I will, as I have said before, commit to working to deliver against that—it is long overdue. As to the question of the commitment of my right honourable friend the Prime Minister, he is absolutely committed, but right now the person taking the lead on that is the Secretary of State for Northern Ireland. He has redoubled his efforts to bring the parties back to the table. That they have not done so remains a disappointment for him and for the people of Northern Ireland.

No doubt my noble friend knows that progress has been made when Prime Ministers—Sir John Major, Tony Blair and Gordon Brown—have become involved. Why does the Prime Minister not go to Northern Ireland and invite all Members of the Assembly, duly elected and still being paid, to Stormont to talk to him about these things?

My Lords, I shall certainly not disturb the unanimity, but may I say that it is heartening to note that the Secretary of State is following our proceedings? We hope that this will give added impetus to a very important Bill. It is a scandal that it has taken so long. It is very sad that it is over two years since the Hart report was published, and that Sir Anthony is no longer able to see what we are seeking to achieve on his behalf.

The biggest scandal of all is that this matter, which affects a number of extremely vulnerable people in Northern Ireland, has not been debated in full in the Assembly because the Assembly has not sat in the period since the publication of the report that is the foundation of this Bill. I pay unreserved compliments to my noble friend Lord Duncan, who has been indefatigable. Earlier this afternoon, he welcomed my suggestion that it would be very good if the Prime Minister went to Stormont and summoned all the Members of the Assembly there. As he has styled himself Minister for the union, let him tell them how keenly he feels for the union, and how important it is that they cast aside their differences and come together as an Assembly, with an Executive, to exercise the power that this Parliament has conferred on them. It is extremely important that this should happen; it is disgraceful that it has taken so long.

When my noble friend introduced the Bill, he made a very powerful, short speech, in which he said that he wanted to feel that he had the support of your Lordships in all parts of the House. I think he now knows that he has that support. I hope he and the Secretary of State will ensure that the Bill receives Royal Assent and becomes an Act of Parliament before any election day. There is a will for this to be done. There is unanimity in this House and in Northern Ireland, and it is crucial that we act.

My Lords, I begin by underlining the importance of what the noble Lord, Lord Empey, has just said to the House, and I ask my noble friend on the Front Bench: can he not discuss with the Secretary of State and the Prime Minister the location of a Health Minister—even if it means appointing an extra one to the department—who will remain in Northern Ireland to supervise the disturbing situation, which the noble Lord has described, until the Executive is restored?

As the noble Lord, Lord Empey, has said, we need to think outside the box and bear in mind what the noble Lord, Lord Alderdice, said about an election. I was one of those who supported deferring an election, and I believe that the noble Lord, Lord Alderdice, was also—he assents. But we cannot go on and on like this. I have urged my noble friend the Minister, of whom I am an admirer, many times. I know that he has done a great deal, but I urge that we must have an interlocutor. I will go further and try to be specific. Who are the two people from the UK Government who did most to bring about the Good Friday agreement? Sir John Major and Mr Blair. Should we not see whether they could play a role? Neither of them is a Member of either House, and they both maintain their commitment to the United Kingdom and to Northern Ireland. I suggested earlier this afternoon that the current Prime Minister should summon all Members of the Northern Ireland Assembly and talk to them in Stormont. Could this not be a follow-up? We must come up with ideas, and we have got to try to do something to break this logjam.

In January, which is quite near, we will have had Northern Ireland without an Executive or a functioning Assembly for three years. That is why we are having these regular debates. What progress have we made? The answer is precious little. My noble friend has come to the Dispatch Box and said that talks are going on. They have been intermittent, but they have also been unproductive. If Northern Ireland is going to continue to have a devolved Administration, it must have an Administration and an Assembly that meets. I do not wish to see a return to direct rule, but we are now in the worst of all worlds because we have Civil Service rule without direct answerability either in the UK as a whole or in Northern Ireland. This is not in any way criticising individuals who are seeking to do their jobs. Politicians in Northern Ireland have got to realise that unless they can come together, direct rule is inevitable. We do not want it, so can we not try to get an interlocutor or interlocutors to go to Stormont and remain there—a locked room has a great deal to recommend it—until we have some agreement?

It goes without saying that I have mentioned the names of two former Prime Ministers without consulting them, and they may be horrified when they read about it tomorrow, if they do, but they are two men who have done an enormous amount for our United Kingdom and for Northern Ireland in particular. I think they will both be deeply distressed if what they achieved between them comes to an end, so give them a chance at perhaps ensuring that it survives. If not, let us have somebody else and let us set an absolute time limit—31 January seems to be a favoured date at the moment—and let us try to make some real progress.

My noble friend has tried extremely hard. His heart is absolutely in the right place. I paid tribute to him earlier this afternoon in the context of another debate, and I pay tribute to him again, but will he please undertake after this debate to have an immediate meeting with the Secretary of State to discuss what has been said in your Lordships’ House, where we believe passionately in the union and in Northern Ireland remaining part of it?

My Lords, these reports every fortnight give us an opportunity to touch on some of the bigger issues facing Northern Ireland. I will try to take on some of the specific issues raised today.

I will begin with the noble Baroness, Lady Lister. She raised very important points. We must speak very clearly on this. I have been told by my officials that the absence of Northern Ireland Ministers does not prevent a senior officer of a Northern Ireland department exercising a function of the department during the period of forming an Executive if the officer is satisfied that it is in the public interest to do so. If it is in the public interest to exercise that during the period, we must make sure that there is no diminution of that during that period. I will confirm that in writing to the noble Baroness.

A question was asked about whether these reports will continue. To be honest, I am not sure about that myself in terms of what is happening in the other place, but if we do indeed enter into purdah there will be no Parliament here to debate the reports, so the reporting function would be in abeyance. However, I would instruct my officials that we will continue to draft such reports so that they might be available for a continuing or incoming Government, regardless of what happens next. It is important that this information is still actively gathered together.

The noble Lord, Lord Alderdice, asked about the founding of a university in Derry/Londonderry. The answer, in truth, is that it rests with the institution itself to put forward the case. To date, none has done so. If the university is indeed in such a position it should do just that and put together its case to initiate the proceedings, because nothing can happen until that has been completed. It is a matter of devolved authority but, none the less, the first step will necessarily be taking forward the examination of the business case for the initiation of the establishment of a university. If he were able to facilitate, I would be very happy to sit with the institution and discuss this further. I know that my right honourable friend the Secretary of State for Northern Ireland has already sat and discussed with it. I am not privy to that conversation but, if it was not on that point, I am very happy to initiate and have that very clear discussion with that institution if we can.

I will touch on the larger question that rests here today on the formation of an Executive. I am always drawn to the remarks of the noble and right reverend Lord, Lord Eames, on these matters. As some noble Lords will be aware, I am also a fan of poetry from Ireland:

The ceremony of innocence is drowned”.

Those noble Lords who know their Yeats will know the bit I missed out. I had to check the exact words, because I always remember the part I read out. The rest of it says:

“Mere anarchy is loosed upon the world,


The blood-dimmed tide is loosed”.

That is what it means if we get this wrong; the bit I left out is the problem. It is easy to talk about the other bits; it is the bit in the middle that causes us the problem. This is where it becomes very difficult, because I am running out of words to say that no stone shall be left unturned. I am out of clichés about what is going on in Northern Ireland and I want to stop using them.

It is critical that the parties in Northern Ireland come together. If they do not, then in the new year there will need to be an election. I do not know what the result will be. I have no crystal ball. My fear is that it will lead us to where we are now, and thereafter we will take that journey down the path down towards direct rule, spoken of by the noble Lord, Lord Empey. As the noble Lord, Lord Murphy, has said on more than one occasion, once we enter direct rule, we do not get out of it. I think that the truth is that the people of Northern Ireland are crying out for change, whether it be in health, education or welfare. They are crying out and no one is hearing them. It is a silent cry for change to come.

I cannot make the parties do more than they are doing. The question has been asked: what is the Prime Minister doing? The Prime Minister met the parties in July. However, there is no point in equivocating around the truth that we sit in the fog of Brexit. I make no excuses for that, and I make no explanations around that. That is where we are: becalmed in the fog of Brexit, waiting for the winds of change to pick up and take our vessel towards that promised land which will be change in Northern Ireland. Yet here we wait. We listen to the remarks of the noble Lord, Lord Empey, about the situation with health in Northern Ireland, and are reminded of exactly what it means to get this wrong. We cannot be becalmed and wait for this to pass. That is the shocking and sad thing about it.

I take a slight issue with the points raised by the noble Lord, Lord Murphy. There is a structure to the talks. We have brought in independent facilitators—although not an overarching, high-profile one—to bring the parties to that point from which we believe that the next step can be taken. If I could quantify it in a meaningful way, I would say that we are 95% there but, like jumping over a chasm, 95% does not get you to the other side. It is that magic 5% that needs to be met, and it rests in the areas with which I am sure noble Lords are very familiar: rights, culture and language, issues which can unite us. The poetry of language can bring us together, yet it can divide us strongly as well. This is the part that remains undone—that remains to be stitched together. If we can find that compromise and way forward on the language matter—it seems in some respects so close, and would be so joyous to get right for all of Northern Ireland—the issues that have been stacking up could be addressed one by one. The greatest danger for an incoming Executive just now is too much to do and too little time. What shall the priorities for Northern Ireland be? How shall we try to establish whether it should be welfare, education or whatever else? Some of these issues have been left waiting to be taken forward not just since the downfall of the last Executive, but for decades preceding it.

I could go on in this regard, but I will not. I do not think that would be useful at this time. I wish I could say that when I come back here, those parties will have found a way forward. However, I do not think that I am going to be doing that in a fortnight’s time, I am sad to say. There may be other reasons why I do not return here in two weeks’ time; I am afraid that I do not know about that either. However, I believe that these reports are invaluable. They have provided us with a platform on which to have this serious debate. I hope that they are heard and listened to in Northern Ireland. I hope that the parties recognise them for what they are: a cry for something to be done, for change to come, for something to be resolved and for the Northern—

I do not get to meet the Prime Minister as often as I would like to, I am afraid, but I am very happy, on the next occasion when we do meet, to raise this matter. I do not believe that one can claim to be the Minister for the Union without ensuring that one is doing all that one can to hold that union together. I will make that point very strongly when I next have an audience with the Prime Minister. I suspect that will not be for a little while but, none the less, when I have that opportunity, I will.

I commend these reports. I believe that they serve a purpose and will continue to do so. I hope that there will come a point when we can look back on them as having provided the foundation for the necessary restoration of a sustainable Executive.

As I was listening to the noble Lord, Lord Liddle, I could not help but remember a speech that I heard at my first State Opening of Parliament way back in 1970. The Address was moved by the then John Nott, later Sir John Nott, and he made a remark that has always stuck in my mind: he said that the real poor of the 20th century are those without hope. You can repeat that statement and advance the century, because it is still those who have no hope—who do not feel that they have a future—who are the real poor. I very much hope that the various promises made in this document, unsubstantiated in some ways as it is, can be carried forward and expanded.

I really want to talk about something else, because this is an extraordinarily artificial debate. The noble Lord, Lord Davies of Stamford, hit the nail on the head in his opening remarks. Here we are, back from a brief September session that was, it turns out, illegally brought to a close. I am very glad that, like the Leader of the Opposition, I boycotted what turns out to have been not the Prorogation ceremony. We are now in the middle of a constitutional crisis, the like of which this country has not seen for a very long time indeed. I am not sure I would go back to 1789, with the noble Lord, Lord Davies—

The noble Lord actually said 1789, but we will not bandy this across the Chamber. One could say that 1911-12 was a great constitutional crisis. However one looks at it, and whatever one’s views of the decision that was unanimously reached yesterday, I do not think that anybody can deny that this is a great constitutional crisis. I pay tribute to the Justices of the Supreme Court. I think that they did indeed act without fear or favour; they were not taking sides on the Brexit issue. They were ruling—and I say this with some feeling of embarrassment and shame—on the conduct of a Conservative Prime Minister who should not have played fast and loose with Parliament and who should not have sent us packing on 9 September, having himself even said that he might keep us here until 12 September. I believe that the matters we have been discussing today, in an unsatisfactory form, through Statements and now this debate, illustrate the fact that there is indeed an agenda that would have kept us more than busy for most of the five weeks. Now we still do not know what is going to happen. I imagine that there will be a short and perfectly proper Prorogation in a couple of weeks, followed by a state opening and a Queen’s Speech on 14 October. However, we do not even know for certain whether that is going to happen. We have an extraordinary situation: a Government who are in a significant minority and discussing financial plans and promises that they do not know whether they will be able to discharge.

No one wishes the Prime Minister greater success in reaching a deal than I do. As I made public on many occasions, I would have accepted the deal that Prime Minister May achieved, all those months ago. I very much hope that we can have a deal and that we can be out on 31 October, much as I will greatly regret that, because this long saga has to be brought to a close. The fact is that Parliament has now decreed—rightly, in my view; I strongly supported the Benn Act, as it is now called—that we should not leave without a deal. What I have been concerned about this afternoon, in answers to two Statements delivered by my noble friend Lord Callanan, is that he has not come absolutely clean, by saying what will happen if, on 31 October, the deal has not been concluded. I hope that the Leader of the House will be able to do so in a few moments’ time. Parliament has decreed that it should be concluded before we come out. Having had one constitutional crisis because of the way in which the generally accepted rules of Prorogation were neglected, we do not want another crisis because an Act passed in Parliament through both Houses is ignored. I hope that, tonight or before we rise tomorrow—though we are of course back next week—we will have a clear and unequivocal statement. I would appeal to the Prime Minister, though I do not suppose that he will necessarily read—

The only reason that I said that is that the Leader is not here. Therefore, she is not able to answer the question. It would be very helpful, if there were questions, for us to be able to hear her response. That was my only point.

The Leader is perfectly able to read Hansard tomorrow. She is not here at the moment, but the fact is that we need answers to certain questions.

I very much hope that we will have a deal. But I appeal to the Prime Minister. If he wants to enact this spending review—and I hope that he can, with some embellishments and improvements—I hope that he will recognise that with a little bit of compromise, and if he would relax his absolute insistence on a particular date and time of day, there is a chance that we could move forward. I also appeal to him to bring back into the Conservative fold 21 of its finest members who were so peremptorily dismissed a couple of weeks ago. That would be a very real contribution.

The spending review, yes, with some embellishments such as money for the police and education of course and, as my noble friend Lord Horam said, for apprenticeships; all of these things are crucial, as are other points made by the noble Lord, Lord Liddle. But none of that can come to pass unless and until we have a stable Government and a stable relationship with our European friends and neighbours.
