I would personally be terribly disappointed if the noble Lord, Lord Tyler, were to take advantage of the fact that I was on my feet to go and have a cup of tea because I depend on his presence as a stimulus and discipline to myself. I might be tempted to speak more rashly and randomly if it were not for the invigilatory presence of the noble Lord in the Chamber.

In relation to the contribution of the noble Lord, Lord Tyler, does he know that just before we adjourned yesterday, Conservative Whips happened to find some papers that had been left in one of the gents toilets indicating a rota going on until six in the morning? There were then all sorts of phone calls and various messages went out to Conservative Members to come back quickly and to make sure that they were there. It turned out, somehow or other, that the paper was a hoax.

There are all sorts of possibilities. Happily, the Government’s business managers have ensured that we will not be excessively constrained for time as we debate these issues, so we can look forward to many noble Lords opposite helping us to understand, if they will, the case for what the Government are doing.

It is perplexing. Ministers have suggested that the size of the House of Commons has crept up—that phrase was used in previous debates. One hundred years ago, the House of Commons consisted of 670 Members of Parliament; it now consists of only 650, and a few years back, it was 659, as some of my noble friends have already mentioned. It is particularly interesting to see how the ratio of Members of Parliament to electors has deteriorated since 1950. There are now 25 more Members sitting in the House of Commons than in 1950, but in that period the size of the electorate has increased by no less than 10 million. The average electorate per constituency, which was 55,000 in 1950, is 70,000 now.

I do not know how Ministers can with a straight face tell the House of Commons and this House that the number of Members of Parliament has crept up and suggest that we are overrepresented. We are not democratically overrepresented in this country. Unlike the Federal Republic of Germany, we have no länder; unlike in United States of America, there are no states. Indeed, in all of our political lifetime, we have seen a weakening in local government in this country and a diminution in the number of local authorities. If, as the Liberal Democrats have proposed, there should be a large-scale redesign of patterns of representation at the different tiers of government in this country, you could make a serious case for reducing the size of the House of Commons. Unless and until that is done, you cannot.

The Government are setting about reducing the size of the House of Commons in a manner that will be to the party political interest of the dominant party in the coalition, the Conservatives, and, at the same time, increasing the size of the House of Lords in order to increase the majority on which they believe they can rely in this House, with no serious attempt to explain to us what the sound democratic principle can be in those processes. That is to let members of the Government open to the kind of criticism that we are more accustomed to hearing levelled at those who wield power in countries such as Kenya, Rwanda or even Zimbabwe. It will be very interesting as we begin to hear what international observers and professional and academic students of democracy in foundations and think tanks in this country and across the world have to say about the policies that we are experiencing at the hands of this Government.

It is absolutely right to ask two basic questions to try to establish a ground of principle on which to evaluate the Government’s propositions. We should ask: what are the requirements of a properly functioning House of Commons and how many people does it need serving in it to acquit itself of those responsibilities; and what are the properties of a Member of Parliament in his or her constituency? Until there has been a serious, rational and, as far as possible, objective analysis of both those issues, we should resist the suggestion that the number of Members of Parliament should be reduced. As we start to examine those issues, I think that we will find that, so far from there being a decent case for reducing the number of Members of Parliament, there is actually quite a strong case for increasing their number.

I do not want to speak for excessive length at this stage of the evening. We will have further opportunities to examine these matters as our discussion develops so, for the time being, I will not weary the House any longer.

Surely not. That could not possibly be the case on the other side of the Chamber. I shall get to my point. One evening last week, I spoke on this very important Bill for two periods of about two minutes each and then for a third time for about five or six minutes, making 10 minutes in total, so I do not think that I can be accused of filibustering and so on. I was involved as much as anybody and the only House of Commons attitude that I see in this House is a capacity of Governments of both kinds, Labour and Conservative—because it is an elected House and that is fair enough—to ram Bills through with strict timetables and so on. Here, the Government are trying to ram through an important constitutional change without any regard to the views that are put forward, and they are getting very annoyed because people want to make and answer points. If they do not answer them, they will be on record as never having answered. I genuinely do not believe that there is any filibustering going on here. If the noble Lord had been here more often, he would have heard the wide range of different views on this side of the Chamber on these very matters. Therefore, he should be a bit fairer about this.

I hope that my noble friend will not feel constrained in developing his points at whatever length he considers appropriate. After all, this Bill had no pre-legislative consultation, it was not consulted upon with the Welsh Assembly and the Scottish Parliament, which have a vital interest in the provisions of the Bill, and it was programmed in the House of Commons, so very important parts of it were not considered in Committee or on Report there. Therefore, I think that we have a responsibility to examine it closely and I am very glad that my noble friend is doing so.

My noble friend is absolutely right. I am not going to repeat all the points that have been made but shall leave it at that. However, I am certainly not going to allow attacks such as those to stay on the record without being refuted, despite the annoyance of the noble and learned Lord, Lord Wallace of Tankerness.

I am a believer in the United Kingdom and I think that the noble Lord is also. I am sure that he will be generous enough to acknowledge that the results of elections in which that has occurred have been beneficent for the country as a whole.

The amendment of my noble friend Lady Hayter is an ingenious way to introduce another version of a threshold, which is that there would have to be a majority in each constituent part of the United Kingdom. I would like there to be a threshold, but I do not think that this is the right way to introduce it.

I, too, am grateful to my noble friend Lady Hayter for moving the amendment, because it raises as a serious issue—I hope that it is treated by the House accordingly—the cohesiveness of the United Kingdom. Speaking as a former Member of Parliament representing a Scottish constituency, I would not claim any great authority but I was representative for the area that I came from and embody in this place a particular opinion about Scotland’s place in the United Kingdom, which we value a lot. To move to a semi-federal system where one nation imposed its will on another on a constitutional matter would raise issues and give manna from heaven to the nationalists and separatists who would divide up the United Kingdom.

Naturally, there have been a lot of contributions about referenda and thresholds. The noble Lord, Lord Tebbit, mentioned the 1975 referendum and how he voted one way and then changed his mind some years later. He voted yes in 1975, he tells us, and says that he has changed his mind since. I voted no in 1975 and I am still not yet totally convinced that I was wrong, so there is a twist in that as well.

I support my noble friend Lord Grocott. This referendum is to be about the choice of a parliamentary voting system, so it is bizarre not to declare the results on the basis of parliamentary constituencies. If it were a referendum about how local government is organised, one might see some sense in the stipulations—districts, counties, London boroughs and so forth—that are set out in Clause 7(2). However, those units are irrelevant to the question at issue in this referendum, so my noble friend’s case is self-evidently sensible.

I also join my noble friend in his mild but firm stricture on the intervention of the Electoral Commission. The proper responsibility of Parliament is to ensure that the system put forward in this Bill is well designed. The expedience for the Government of ensuring that the referendum takes place on 5 May must be a secondary consideration. I would have hoped that the Electoral Commission would also want to make it its priority that the system that it is there to oversee and to administer is appropriately designed. I am disappointed that it has not done so in this case.

My Lords, I rise briefly to indicate my support for my noble friend Lord Grocott’s amendment. As a former Member of Parliament for a Scottish constituency, I can bring a perspective as to how this will be viewed. As my noble friends have said, this proposed referendum is on a voting system for Westminster. It seems incongruous and, quite frankly, plain daft that the results will not be declared on a constituency basis. These days, when people are looking for more transparency and accountability from MPs, it is absolutely right that, if it is an embarrassment to the MP if the constituency goes a different way from the way he or she campaigned, that should be known. So be it—that is the way it is.

As a unionist, I take exception to the fact that Scottish Parliament seats seem to be given primacy over Westminster seats when it comes to a voting system for the Westminster sovereign UK Parliament. It is wrong in principle and sends out the wrong messages. It will give further incentives and justification for those in nationalist politics in Scotland to continue that drive to say that somehow we in Scotland are different from our friends, neighbours, relatives and colleagues in England, Wales and Northern Ireland. No, we are not. We are all part of a British state. As well as being proud of our individual countries, we are British citizens. There is nothing wrong with that at all.

These proposals are an indication that the Bill has been rushed. Time and again we have come up against things which it would seem common sense to do but which are not done. The fact that these things have not been done is not part of any great malicious master plan, in my view. It is the result of a rush to judgment and to get this Bill through. There is a whole host of things in this Bill that should have been more carefully thought out. There are plenty of experienced people on the other side who I am sure, if they had had their time, would have framed the Bill more accurately and thoroughly.

I totally accept that people have different opinions in Scotland but for my part and, I am quite convinced, for the majority in the constituency of Rutherglen and Hamilton West the Westminster Parliament is—I say this without any disrespect to the Scottish Parliament—the prime Parliament. I can imagine hearing the howls of anguish—“Trust the perfidious English!”—if the Westminster Parliament organised a referendum for the voting system for the Scottish Parliament that did not give due respect to the Scottish Parliament, the forum for which it was proposing a change in the voting system. What is good for the goose et cetera.

The noble Lord, Lord McNally, has paid tribute to my noble and learned friend Lord Falconer for lowering the temperature a wee bit. It is certainly not in my nature to up the temperature. It might be stretching credibility to say that I feel intimidated but I certainly feel on occasion a bit reluctant to come forward to speak. Time and again I hear not only the accusations from the Front Bench on the other side but also the sneers and ridicule from other parts of the Chamber when somebody rises to make a point. This is the third time that I have spoken this evening. The other two times I spoke for two or three minutes. That is hardly filibustering, dragging things out or not co-operating. It is making sure that the Bill is scrutinised and that we can come forward and point to things that we believe are wrong. There are differences of opinion—a whole host of them. There is no concerted effort from this side of the House as far as I can see. I am certainly not part of it.

I will not repeat my noble friend Lord Grocott’s quotation from the Electoral Commission. However, it quite took my breath away that the Electoral Commission—a so-called independent organisation—in effect tells Members of this House not to put forward or vote for any change because that would prevent the Government from having the referendum on 5 May. It is breathtaking and quite disgraceful. I hope that we do not get any more of that sort of comment or, quite frankly, blackmail from the Electoral Commission. I support my noble friend.
