My Lords, the noble Baroness, Lady Ludford, opened by pointing out that there has been no unqualified support for this Bill and, in fact, the vast majority of speakers have expressed their strong opposition to it. Looking at recent examples of protest, we have seen problematic actions such as protesters pouring milk out on to super- market floors during a cost of living crisis, leaving the mess for cleaners to sort out, but we have to balance that against the bravery of girls and women protesting in Iran for access to basic rights and fundamental change in their society.

I believe we need to see this debate in the round. Protest covers a range of behaviour. We need to get the balance right between the democratic right to protest and the ability of vital services to run, and we do not believe the Bill does that. We do not believe the Bill will be effective at what the Government claim to want to achieve. It includes powers that range from vague to extremely problematic.

On existing law, throwing a tin of soup at a publicly accessible work of art is already an offence—those demonstrators were charged with criminal damage—so how is the Bill relevant to that behaviour? In what way will it impact or deter it? The answer to managing protests surely cannot be to continuously introduce ever more draconian layers of laws on top of each other. Surely it is to use existing law well and to ensure proper training and support for police forces, which have to tackle genuinely problematic and illegal behaviour.

I ask the Government to provide, on the record, clear details of existing protest laws, what activity is already criminal and what existing powers the police have. It would be helpful for the Government to provide a complete list and make this available to the whole House. I was attracted by the view from the noble Earl, Lord Lytton, and the noble Baroness, Lady Ludford, that maybe the Government should move to some consolidation of all these existing powers.

The Government claim that one of the aims of the Bill is as a deterrent, but is there not a risk that the people who worry about it will be local campaign groups wanting to use their voice against, say, a local library closure or the cutting down of local woods? They are the people who may be deterred, but it will not deter, for example, the Just Stop Oil protesters. As we heard from the Minister, there were 650 arrests in October alone, but of course they are seeking to get arrested as part of their campaign. They are knowingly breaking the law. In what way will the provisions in the Bill change that behaviour?

Another concern is an overreach of powers. Key concerns are the suspicionless stop and search powers and the serious violence reduction orders. Suspicionless stop and search equates peaceful protest with powers currently used for terrorism and serious violent crime. It targets peaceful protesters and passers-by. If a protest is occurring in a town centre, the Bill gives the police the right to stop and search any member of the British public, without any grounds for doing so, as they walk through their local town centre. Hard cases make bad law. The Bill is not confined to the actions of a small number of protesters. It impacts on basic rights of the British people, and these are powers that should be taken out of the Bill.

Many of the powers in the Bill are vaguely drafted, with low thresholds. Again, hard cases are not an excuse to pass bad laws and hope that they will be well interpreted. This House will carefully scrutinise the language and the thresholds in the Bill and will expect powers to be clearly defined and necessary. We do not believe the Bill currently meets this test.

I turn to abortion buffer zones. In a free vote, the Commons voted on a cross-party basis to add Clause 9 to the Bill. As the noble Baroness, Lady Sugg, pointed out, this included a majority in the governing party. The aim is to prevent the kind of behaviour we have seen where both patients and staff have been subjected to harassment and intimidation when they access medical care or go to work. I pay tribute to colleagues on all sides who have worked on this issue for years. I understand that the Government are raising some concerns about the drafting of the clause. On the Labour Front Bench we look forward to working with the Minister on a cross-party basis to support Clause 9 and ensure that it delivers the protections intended.

I return to stop and search. There are various powers to stop and search a person where you have a reasonable suspicion that they are carrying prohibited items: offensive weapons, fireworks, drugs and other items. There are also specific stop and search powers related to terrorism. We have heard about the 1994 Act Section 60 stop and search without suspicion, which is related to terrorism. We have heard a number of noble Lords equating this power with the new powers sought in the Bill. The extension of stop and search in the Bill equates peaceful protest with measures currently used against violent crime and terrorism. We believe this is problematic, and we will oppose suspicionless stop and search as the Bill gets to later stages of its consideration by this House.

I was interested in what the noble Lord, Lord Hogan- Howe, said about making sure that people are properly informed when they are in an area where there is likely to be suspicionless stop and search. That was an interesting point that we may well seek to take forward. A number of noble Lords—the noble Lord, Lord Skidelsky, the noble Baroness, Lady Ludford, and my noble friend Lady Chakrabarti—pointed out the racial inequality likely to result from further stop and search powers. I thought that was a powerful point too.

I turn to tunnelling. These powers are new in the Bill, in that they were not considered by the House in the PCSC Bill, and we will want to look at them carefully. I understand the points made by the noble Lord, Lord Blair, about the difficulty of tunnelling.

Further, the Labour team in the House of Commons raised the issue of injunctions, as the Government may be seeking injunctions and politicising making them on certain individuals. It was interesting that the noble Lord, Lord Sandhurst, raised this as a possible problem. It seems to me undesirable for politicians to get involved in this sort of decision-making, which should rightly rest with the police.

We believe the Government have a responsibility to protect our historic rights to peaceful protest and to safeguard our national infrastructure, including our NHS, from dangerous and seriously disruptive protests. This Bill fails on both counts. It is too widely drawn and targets peaceful protesters and passers-by. It also fails to include the sensible measures that councils, the police, businesses and the NHS need to prevent dangerous and seriously disruptive protests. The Labour Party is clear that in a democracy freedom of speech, freedom of assembly and the historic rights to protest run alongside the rights of people to go about their daily lives. It is in this spirit that we look forward to scrutinising the Bill.

Well, I have read the Manifesto report to which the noble Baroness refers—all 48 pages of it. I am afraid that I did not necessarily agree with all the conclusions, some of which required—shall we say?—a bout of syllogistic gymnastics to arrive at. I did look at some of the named councils’ websites and found limited public outrage—maybe I was looking in the wrong place. However, I do think that no one should be terrorised in the way described by the noble Baroness.

My Lords, Members of the House of Commons voted in a free vote last week to provide nationwide protection for medical premises providing abortion from disruptive and harassing protests and behaviour. Rather than requiring each locality to apply for an individual public space protection order, will the Minister work with Members across the House to ensure that the provision is supported as the Public Order Bill makes its way through this House?

My Lords, I too welcome the Minister to his new position. I know that he is also a local councillor at Gedling Borough Council, so he will be well used to the cut and thrust of debate across the Chamber.

We are sympathetic to the concerns raised by the noble Lord, Lord Hay. We too believe that the Government seem unnecessarily inflexible on this matter. I shall also speak relatively briefly on some of the points raised today and in the Northern Ireland Affairs Committee. That cross-party committee, chaired of course by the Conservative Party, recommended, first, that the naturalisation fee charged to Irish applicants who wish to naturalise as British citizens be abolished altogether. Secondly, it recommended that the requirement for Irish citizens to pass a “Life in the UK” test be waived. Thirdly, it recommended that attendance at the citizenship ceremony should be optional.

Could the Minister explain to the House why each of those recommendations in turn is not being accepted by the Government, and why the Government have not taken the generality of the recommendations forward? On the question of the fee, which is £1,300, how much is the actual administrative cost to the Home Office and how much is a fee on top of that? What is the actual administrative cost of processing the applications? On the “Life in the UK” test, is there a point at which the Minister considers that it may not be necessary—after 20, 30 or 40 years? Surely, at some point that test would not be necessary. How many people do the Government estimate will be impacted? We have heard from the noble Lord, Lord Rogan, that it may be 40,000, a figure the noble Baroness, Lady Suttie, also referred to. Could the Minister confirm the figure?

Finally, in the Westminster Hall debate earlier this month, on 18 October, Steve Baker, the House of Commons Minister, who I understand is still in his place —I certainly welcome that—said that he would reflect on the issues raised. What does that reflection look like in practice? What further discussions have been had by Northern Ireland Ministers, and with which stakeholders, since the issue was raised in Parliament?

For some people this is a minor matter, but for the people concerned it is extremely important. An expression of good will could have ramifications on other, far more important matters, if I can put it like that, such as the Northern Ireland Protocol Bill that we were talking about last night. There is an opportunity here for a gesture of good will, and I hope that the Government will take up that opportunity.

I thank the Minister for repeating the Statement. I join him in paying tribute to the 7,300 victims and survivors who gave testimony to the inquiry, and who have shown great bravery and strength in telling their stories; but there will be many thousands of other victims who did not feel able to come forward. I hope they too will feel that this report is a substantial and serious attempt to understand the extent of institutional failure to protect children over many decades.

This report, seven years in the making, is of immense importance. It offers practical solutions and a solid, rational oversight of a crime that is alternately ignored or sucked into conspiracy theories, which we see through organisations such as QAnon. The report shows the true banality of evil, and it is all the more powerful for that; I pay tribute to Professor Jay for producing it.

This is a report about one of the worst imaginable crimes—about the sexual abuse and exploitation of children and the institutional cover-ups when the abuse came to light. These institutions were there to protect children but instead they acted to protect their own institutional reputations.

The report raises concerns about current child protection arrangements. First, it refers to the explosion in online-facilitated child sexual abuse, including the grooming and rape of children and babies. The Home Secretary did not mention this in his Statement, but can the Minister confirm that the online harms Bill will complete its passage through the Commons next week and be accelerated straight to the House of Lords? Can the Minister also confirm that the National Crime Agency will not have to make the 20% staff cuts which it has been asked to draw up in the recent past?

Secondly, the report says that

“significant reductions in funding of public services”

after 2010 is one of the key factors that has had

“a deleterious impact on responses to child sexual abuse.”

Does the Minister accept the damage done by the scale of the cuts in child protection? What can he say about protecting our existing arrangements in the forthcoming spending review?

Thirdly, the report is clear that organisations still do not take child protection seriously enough. What is the Home Office’s position on a mandatory duty to report child sexual abuse? The Labour Party has been calling for it since 2014, and it is worth noting that former Prime Minister Theresa May, who initiated this report, supported this key recommendation of the report.

Fourthly, the report is clear about the failings in the criminal justice system. The charge rate on child sexual abuse has dropped from 32% in 2015 to 12% last year. There are many other examples of failures in the criminal justice system too, but surely child sexual abuse should be the top priority.

Fifthly, the Home Office has responsibility for unaccompanied asylum-seeking children, yet the independent inspectorate found just last week that they were being placed into unsuitable hotels where the staff did not even have DBS checks, and hundreds of children have gone missing. What action have the Government taken since the Minister saw those reports over the weekend?

This report is clear about the systemic failures, past and present. We in the Labour Party have been part of the problem. My right honourable friend Yvette Cooper apologised on behalf of the Labour Party for its part in that failure. Too often, there has been a deference to power, which has overridden a duty of care.

I spoke about the banality of evil. Noble Lords will know that I sit as a magistrate in London. Magistrates would not normally deal with these types of offences but several times in my experience as a magistrate in family courts, youth courts and adult courts, I have had witnesses and defendants make very serious child sex-related accusations when we were dealing with far lesser charges in the court process. We as a court system need to be alert to people reaching out for help when they are in the court system. We owe it to the thousands of survivors who have spoken out.

I have two final points to make. The first and very important point is that this is not a historical problem; it is happening today. My question to the Minister is: what is being done to ensure that children know where and how to report abuse? Secondly, I repeat a point made by many Members in the other place: can the Minister give an undertaking that there will be regular reports to Parliament on how the Government are implementing the recommendations in the report?

My Lords, I thank the Minister for repeating the Statement. This seven-year Independent Inquiry into Child Sexual Abuse sheds light on extraordinary and appalling institutional failings. I want to thank the right honourable Theresa May MP for establishing this inquiry in the first place, as well as Professor Alexis Jay, the chair, and her panel, and, most of all, the survivors and victims who selflessly came forward because they wanted to prevent what had happened to them happening to anyone else.

This is a catalogue of failure to protect children, failure to listen to children and failure to believe children. There must be a change of culture, both in society and in those institutions which put their reputations before protecting children. We on these Benches are also truly sorry. All Governments have failed these survivors and victims, along with the police, health and social services, and local authorities. We have all let down the victims and survivors of child sexual abuse.

The physical and emotional damage these children have suffered has led to a lifetime of suffering. The Home Secretary said that the perpetrators will be “caught and punished” and that “all available levers” in his power, including the police and criminal justice system will be used to bring offenders to justice. Can I ask the Minister how that will be brought about when there is a lack of police resources, the police are already overstretched and the Crown Prosecution Service does not have enough lawyers? The proportion of criminal cases overall resulting in prosecution is falling and there are serious backlogs in the courts. Will the Government increase the resources to the criminal justice system, for example, those available to the police and Crown Prosecution Service? Will the Government ask those institutions to prioritise child sexual abuse cases?

It is right that we should say sorry to the victims and survivors, but we should also not forget those falsely accused whose lives and reputations were seriously damaged as the police lurched from not doing enough to the opposite extreme. Those making false allegations damaged genuine victims as well as those they wrongly accused. Every victim must be protected, cared for and believed while the police engage in an objective search for the truth.

I shall mention three specific issues. First, will the Government introduce an effective statutory duty to report child sexual abuse?

Secondly, when it comes to unaccompanied asylum-seeking children, as has already been said, they are being placed in inappropriate accommodation in hotels where those looking after them have not been DBS checked. More than 100 have gone missing. In going missing, they are vulnerable to sexual abuse. In the Home Secretary’s Statement, he said that

“there is no worse dereliction of duty than failing to protect a child”,

but the Home Office has not been protecting these children by allowing them to go missing. What are the Government doing to ensure that this is stopped?

Thirdly, on prosecutions, the Home Secretary talked about the number of convictions for possession of indecent images of children increasing by 39%. But what about the number of children being rescued from abuse and the children in those indecent images? What about the prosecutions of those producing the images, not just those in possession of them?

There were 2 million pages of evidence and 107 recommendations. It will take time to fully process and action all those recommendations. That must not be lost in the current political turmoil. Child sexual exploitation is endemic and increasing. As the report says:

“this is not just a national crisis, but a global one.”

Urgent action is needed to reverse the increasing numbers of children being abused. Can the Minister confirm that the Government will regularly update the House and not wait until all the recommendations have been addressed?

I thank the noble Lord for his two questions. First, he mentioned the risk of suicide. It is worth pointing out that the health and welfare of those in immigration detention is of the utmost importance. We have a dedicated welfare team on site at each immigration removal centre which is responsible for identifying vulnerable individuals and providing assistance to support an individual’s needs. I remind noble Lords that decisions will be taken on a case-by-case basis and nobody will be relocated if it is unsafe or inappropriate for them. With regard to the terms governing this, which was his second question, he will not be surprised to hear me answer that this is slightly above my pay grade, but I will happily take it back to the department.

My Lords, in a Written Answer on 13 October, a Home Office Minister revealed that, as well as the £120 million down payment on this policy, there was

“a £20m upfront payment to the Government of Rwanda to support initial set up costs.”

Is the Minister able to give clarity to the House on the full cost per person of this scheme and to say whether there will be further up-front payments?

I could not agree more with my noble friend and I am grateful for the opportunity to pay tribute to the vast majority of our police men and women in the Met and indeed across the whole country. They do a very difficult and often thankless job in often very difficult conditions, and they do it to a very high standard. I thank my noble friend for the opportunity to say that, and I thank those officers. I am sure that they are equally upset by this report’s findings.

My Lords, it may well be that the problems identified in the Casey report go beyond the Metropolitan Police. On this side of the House, we believe that the Home Secretary needs to personally take action. Will she now require all police forces to produce data and analysis of their misconduct systems in the same level of detail as in the Casey report, so that we can know what is happening in every police force in England and Wales?

The noble Lord makes some sensible suggestions and I refer back to the review that I referenced in my Answer to the original Question. I will quote the Statement made by the Minister of State for Crime, Policing and Fire:

“The Government will work closely with key policing stakeholders to examine evidence of the effectiveness of the system to remove those who are not fit to serve the public. As well as examining the overall effectiveness of dismissal arrangements”,


he expects the review to consider

“the impact of the introduction of Legally Qualified Chairs to decide misconduct cases; whether decisions made by Misconduct Panels are consistent across all 43 forces in England and Wales; and whether forces are making effective use of their powers to dismiss officers on probation. This focused review will be launched shortly and will be conducted swiftly.”—[Official Report, Commons, 18/10/22; col. 22WS.]

On the back of the point from the noble Lord, Lord Harris, that is precisely the sort of capability we are looking to achieve. We are also building 292 masts in some of the most rural and remote parts of Britain, known as the extended area service or EAS. I am confident. I pay tribute to the noble Lord, Lord Harris, because when he pointed it out to me all those years ago, it was a huge concern. It remains a huge concern, but we are very much determined to deliver it.

My Lords, in preparation for this Question I googled the emergency services network and saw that the director role was advertised in April, with a closing date in May. First, is the new director currently in place? Secondly, while this is clearly an ambitious programme with a lot of scope for overruns, in terms of both delay and cost, does the Minister agree with me that the reliability and interoperability of the emergency services network should be the new director’s number one concern?

I totally agree with the noble Lord’s latter point, because unless that is the case it will completely undermine what the emergency services are trying to do. I assume the new director is in place. I will double-check, but I think the answer is yes.

I do not disagree with the noble Baroness, but I reiterate that the legally qualified chair can, in the interests of justice, take longer than 100 days to convene the misconduct hearing. I do not want anything I say at this Dispatch Box in any way to undermine a misconduct hearing, which is why I am so cautious about the matter.

My Lords, I was going to ask the same question as the noble Lord, Lord Howell. Why should Mr Veale not stand aside? I thought the Minister said in her response that she agreed with the proposition put by the noble Lord, Lord Howell. Does she think Mr Veale should stand aside while this investigation is under way?

I think noble Lords will all support the upholding of the rule of law, that justice is served and that anyone is innocent until proven guilty. The misconduct hearing will see that course of justice resolved.

This Government and Home Secretary care more about maintaining a dogmatic and unjustified policy that immigration and border services must be self-funding than the best interests of children. While welcoming the waiver for looked-after children, we strongly support this regret Motion.

My Lords, I too thank my noble friend for moving this regret Motion. She has done so comprehensively. Many of the questions she asked are more detailed than the ones I have written down here. I look forward to the Minister’s answers. I also pay tribute to the “terriers united” club and its aspirant members—I nominate the noble Earl, Lord Dundee, as he tried to speak in this debate but unfortunately was unable to.

An interesting aspect of this debate is the other debates we are having in this House about our relationship with international treaties. The changes we are talking about have been brought about by our court system, which considered the policy in detail and found that it did not meet our obligations in the best interests of the child—namely, Article 3 of the UN Convention on the Rights of the Child, which has been in force for about 20 years.

In this instance, the Secretary of State has been guided into action by the courts to protect the rights of British children—and they are British children. They are entitled to British citizenship. We are talking about a registration, not an application. Of course we welcome the exemption for children who are being looked after by local authorities. This is a key change which has been campaigned for over many years. This and the introduction of the fee waiver in certain discretionary cases are significant changes and improvements.

I will be interested in what the Minister says about how many children who are entitled to British citizenship register that citizenship each year. What is the scale of this issue? Also, we have heard questions about the decision to continue charging the majority of children extremely high fees, but how will the waiver operate in practice? What is the expected timeframe for an application for the waiver to be considered? The published guidance sheds no light on this. It simply says:

“No specific service standards apply to the assessment of whether the applicant qualifies for a fee waiver. However, caseworkers must make reasonable efforts to decide such requests promptly”.


This leads me to the question of what training caseworkers will have. We have heard about the complexity of the guidance. The noble Lord, Lord Russell, asked whether there might be any specialist training. My noble friend Lady Lister asked whether the complexity of this process might be reviewed.

I want to dwell for a second on the point made by the noble Lord, Lord Paddick, about young people who find themselves in the court system—whether, if they get a sentence of 12 months or more, they could be deported, and whether that could be exacerbated if they have not registered for British citizenship. I occasionally see this situation in youth courts. I do not know how the cases are resolved but it is not that unusual to have young people in court who have citizenship issues and modern slavery issues as well as the offences which the court is dealing with. They have extremely complex lives, and they are often accompanied by a number of professional advisers to try to resolve their issues. I will be interested in what the Minister says about the possibility of deporting young people who have an entitlement to British citizenship but have not registered, if they receive a court sentence of 12 months or more.

I conclude on the central question, which has been asked by all noble Lords who have spoken in this debate: whether the Home Office will commit to publishing its assessment of children’s best interests and how this policy fulfils our obligations under international law.

My Lords, I thank all noble Lords who have spoken in this debate, particularly the noble Baroness, Lady Lister of Burtersett, whose club of the terriers is growing. There is now a waiting list for applications. I do not know what the criteria is for joining but I wish her well. I can only admire her persistence. She speaks powerfully on this matter, and the Government recognise the continued strength of feeling on it.

As noble Lords have heard, the Government laid legislation on 26 May introducing changes intended to improve access to British citizenship for children who may face issues in paying the application fee, which since 2018 has, as she said, been set at £1,012. These changes include the introduction of a discretionary fee waiver on the basis of affordability, as well as a fee exception for children who are looked after by a local authority. The regulations also maintained the fee at the existing level, to support the continued funding of the borders and migration system. I will come to the numbers on that shortly.

I am glad that the noble Baroness welcomed the changes introduced by the regulations, which, as my honourable friend the Parliamentary Under-Secretary of State for Safe and Legal Migration outlined in his Statement of 26 May, the Government believe represent a positive step in better supporting children to obtain citizenship. I am also pleased that these changes are already beginning to have an impact, with the department having now received hundreds of waiver applications since the provision came into effect on 16 June and with the first waiver grants having already been made. The noble Lord, Lord Ponsonby, asked how many applications there had been in previous years. I will have to get back to him on that, but I think it is a pleasing outcome.

In engaging on these changes, we have initially focused on reaching out to local authorities to increase awareness of the fee exception for children in care through several channels, including the local government bulletin, the Government Communication Service’s local network and the Local Government Association. We are also engaging directly with local authorities through established channels, as we did for the EU settlement scheme. More broadly, we are reaching out to organisations that work with children through the department’s established stakeholder networks to raise awareness and answer questions on the new provisions. We continue to explore further opportunities for engagement, so I am grateful for the points made.

Engagement will be informed by ongoing monitoring of the take-up of the waiver, which is very important, and the fee exception against forecast, including the rate of applications and grants. We will look at whether there are gaps in the spread of applications across local authority areas, to see where further direct engagement on the fee exception in particular would be beneficial. There are currently no specific plans to report to Parliament on these points, but we are open to providing further updates and will consider the best mechanism for doing this.

The noble Baroness raised concerns about the detail of the policy and supporting process. The paper application form has been developed to align with the online form to ensure consistency in the evidence required from individuals across different application routes. Where possible, we encourage applicants to apply online as it offers a more intuitive and customer-friendly experience, but the paper option is there for those who need it. I take the point made by the noble Lord, Lord Russell of Liverpool, about making it shorter and we are open to feedback.

Caseworking guidance has been developed to support a robust assessment of an individual’s financial circumstances. This ensures that waivers are granted only to those who genuinely need them, thus helping to protect the department’s finances and ensure that publicly funded resources are allocated effectively. It also aligns with the guidance published for other affordability-based waivers offered by the department, ensuring consistency in the test applied across different customer groups. Where it is clear that applicants face issues of affordability—for example, where the individual might face destitution—I assure noble Lords that there will not be an onerous focus on the evidence required.

Regarding the specific question raised about asylum support allowance, it is important to note that this is included as a guide for caseworkers in assessing essential living costs. It is only one part of an assessment to consider whether paying the fee would result in a child’s need not being met.

On the very important question of training, caseworkers undergo specialist training before considering cases, and complex cases can be escalated to caseworking conferences or to senior caseworkers to ensure that consistent and fair decisions are made.

We are, as I said, open to feedback on the guidance and application process, and to considering where appropriate improvements could be made. I hope that the initial figures around the take-up of the waiver will provide some reassurance that it is reaching its intended beneficiaries.

My Lords, I congratulate the Minister on her 1,000th contribution to this House; it is nice that it is on a non-contentious issue. As she says, there is considerable local support for this change in name. The question asked by the noble Lord, Lord Paddick, about the cost implications of this change in name was interesting, and I would be interested to hear the answer, but we are happy to support this statutory instrument.

My Lords, I am pleased that my 1,000th contribution is on a totally uncontroversial issue.

There will be no significant cost to the Government as a result of the instrument. The PCC has provided assurances that, similarly, there will be no significant costs incurred locally to the detriment of the police force. To ensure that that is the case, the change will be phased over a number of years when items need replacing, to ensure that there is no unnecessary additional cost and no major rebranding exercise. I happily commend the regulations to the House.
