My Lords, Amendment 34 is a minor and technical amendment to Clause 75. It will remove subsection (5) of the clause, which made provision for a consequential amendment relating to independent school standards. This subsection is now no longer necessary, due to the repeal in England of Section 157(2)(b) of the Education Act 2002 by paragraph 16 of Schedule 1 to the Education and Skills Act 2008. Therefore, it now makes sense to take this opportunity to remove this subsection. This will not affect the purpose, impact or effect of Clause 75; it is a simple housekeeping amendment. My Lords, I am grateful to the noble Lord for giving that explanation. We concur that this is a minor technical amendment. We rehearsed the wider issues about the practicalities and appropriateness of very young children being cared for on school premises and the wider issues around exemption from registering as an early years provider in Committee and I do not intend to rehearse those arguments again at this stage. We are content that the amendment should go forward.
