This is not a political move. This is not politicising the regulator at all. The regulations are simply designed to bring the regulator in line with other regulators.

The Minister may say that, but the regulations are effectively a tax on trade unions. Does he recognise that other bodies do not pay a similar tax? Broadcasters do not pay tax for Ofcom, and data processors do not pay tax for the Information Commissioner. Why does he feel that the regulations bring the trade unions in line with other sectors?

I am glad the hon. Lady has brought the focus to the regulations rather than the wider scope of the 2016 Act, which was discussed in Committee and during the passage of previous regulations. On finances, the work of the certification officer at the moment is funded through fines and other fees but the regulations will wrap them up in a levy, which will be proportionate and affordable, because we responded to the consultation and made some changes accordingly.

I would like to declare that I am a proud member of Unite the union and Unison. The regulations before us are punitive and cynical. They are an assault on the ability of working people to organise. That is what they are about. They are an attack on human rights. We must be clear that trade union rights are fundamental human rights. All of this is being done through secondary legislation. The Government’s increasing use of such legislation raises important questions about the quality of the law itself— its clarity, accessibility and democratic legitimacy.

Beyond this small Committee Room off one of the richly decorated corridors of Parliament, outside in the real world we know that there is a real sense of dissatisfaction—even despair—in workplaces across Britain. Despite working longer hours than those in all other EU countries, except Greece and Austria, millions cannot afford to make ends meet. With soaring in-work poverty, many workers are already facing the brutality of the cost of living squeeze.

On top of that, there is an extra poignancy to the disturbing nature of today’s regulations. I believe that it is particularly important to have in the forefront of our minds the enormous contributions that workers have made during the pandemic, despite the failures at all levels that have contributed to thousands of staff dying across all sections of various workforces. Now, the Government are trying to attack what is all too often their only means of challenging injustices. When thousands of workers were being pressured to return to their jobs even when they were still at risk of spreading covid-19, were being forced to work in unsafe conditions or were being fired and rehired on worse conditions, it was trade unions and trade unionists all over the country that stepped up. However, the Government’s refusal properly to engage with trade unions over and over again during the covid-19 crisis has resulted in an astonishing litany of failures, including but definitely not limited to inconsistent and unclear regulations, the failure to ensure that all workers have access to PPE, the failure to protect workers from unsafe working conditions and the failure properly to support workers to prevent them from being pressured into difficult situations or being forced to decide between economic welfare and their health, given the inadequacy of sick pay.

I could go on, but I will conclude by saying that trade unionism is one of the most fundamental responses to the injustices that workers invariably face. It is the best way to see one’s pay increase, to see a safer environment at work, to feel freer to express one’s opinion and to have one’s rights realised. I will always stand in solidarity with the trade union movement and oppose this Government’s cynical attacks on working people through these instruments.

I thank the right hon. Lady for giving way. She said that the Government have done so much more than any other in peacetime history. However, in 2019 the Government promised that after exiting the European Union they would come up with an employment Bill, but they have not yet done so. Does she agree that there were promises about what would happen once we had exited the European Union and that since then we have seen at least three EU directives—one on zero-hours contracts, another on minimum wage and another on platforming workers—while we fall behind? Yes, we have been in a pandemic, but we are not levelling up. In fact, we cannot keep up with what is happening across Europe on workers’ rights.

I thank the hon. Lady for her intervention. I share her frustration about not seeing an employment Bill, but given the restrictions that there have been on this place, in terms of debate and people being able to be here, I can sort of understand why. Also, there are the changes that we have seen in the economy, which, as I said, are a result of the pandemic and of leaving the EU.

I can give the Minister the benefit of the doubt as to why the Bill has been delayed, but I want to hear from him today that that delay will not be a moment longer than it has to be; the hon. Member for Slough is right that there are some really important issues that people want to be addressed in an employment Bill. However, before I get dragged down that rabbit-hole, I will gently get back to the topic that we are discussing today, which is, of course, the Taylor review—it is important in itself.

I want to make the context of this debate very clear. When we go back to the documents that the Government produced before the pandemic, it really is quite startling to see what is in them. We have the opening to the Good Work plan, putting forward the consultation on the single enforcement body. The introduction to that document, which of course became available only months or even weeks before we saw a significant lockdown of our economy, referred to the record levels of employment in the UK and wages

“growing at their fastest pace in almost a decade”.

It said that the UK labour market was thriving, which it was. However, we cannot ignore the impact of the pandemic, and we have to put that into the mix today as we consider this really important debate.

The way out of this pandemic is not just about vaccination and boosters, as important as they might be; it is also about getting our economy growing as it was prior to the pandemic, so that we can not only pay for the cost of the pandemic but get back on to the sort of track that the people of this country had become used to under this Government.

The skills of the Great British people are crucial to that economic growth. One of the great successes of this Government has been the ability to bounce back since the pandemic hit its height, but we need to be able to use the skills of the British people to get back once again to the levels of growth that I have referred to.

The Taylor review was all about tackling imperfections in the labour market, which is important not only in its own right but in terms of getting back to those levels of economic growth. Many of the sorts of imperfections that Taylor referred to in his review are, in many ways, being tackled already. I saw that for myself when I visited my local Jobcentre Plus office in Basingstoke. We are not known for high levels of unemployment in Basingstoke, but through the pandemic we saw our unemployment rate double, despite the very significant levels of furloughing that the Government had enabled.

I am delighted to say that as a result of the work of Jobcentre Plus, and the tenacity of the entrepreneurs who live in my constituency, those unemployment levels have halved. The work of organisations such as the M3 Job Club is helping to ensure that people in longer-term unemployment also have opportunities.

It is a pleasure to serve under your chairship, Mrs Cummins. I congratulate my hon. Friend the Member for Slough (Mr Dhesi) on securing this important debate.

The covid-19 crisis has highlighted the brutal reality of insecure work in the UK and has exposed the systemic failures of the law around worker protections. Far from simply providing flexible jobs with autonomy, the truth is that gig economy employers increasingly trap workers into a dangerous and precarious existence.

Increases in working poverty during the last decade blight our society and reflect the fact that insecure work damages people, their families and their communities. The rise in workplace precarity, zero hours contracts, bogus self employment and contracting out puts workers at risk, and is a threat to our existing health and safety laws and to achieving equal rights at work. In particular, casework in my constituency has emphasised that black, Asian and minority ethnic workers and women workers continue to face a disproportionate burden, working in insecure jobs with fewer rights at work and ongoing pay gaps. However, care workers, drivers and shop workers played a crucial role in keeping society going during the pandemic, and continue to do so.

The principle that everyone has equal rights at work that are guaranteed by law is of fundamental importance to any just society, but, more than that, a thriving and truly democratic economy cannot be created without the full involvement and empowerment of its workforce. The UK Supreme Court’s dismissal of Uber’s appeal against the landmark employment tribunal ruling that its drivers should be classed as workers, with access to the minimum wage and paid holidays, was a significant step forward, and I hope the Minister will address the importance of that ruling in his remarks. However, it is disappointing that Taylor’s proposals maintain the present multiple categories for defining workers, with different rights attaching to each, though renaming some of them. I hope the Minister will also address this point, with which I will close: would it not be better to create a single status of worker for all but the genuinely self-employed, as captured by Lord Hendy’s Status of Workers Bill?

My hon. Friend is right. We heard another accusation, in relation to whether or not those on this side of the House are uncaring when it comes to workers’ rights. What it boils down to is this: would an employee facing a rogue employer using a bully-boy tactic rather have a solution that protects their rights, or would they rather have a jabbing-finger Opposition politician who relies on an unstable future for such workers for his or her political future?

Ethnic minority workers have faced hire and rehire tactics at a disproportionate rate—nearly twice the rate of white workers. They have also disproportionately borne the brunt of the pandemic. Does the Minister not believe that the message he is giving today does not show the urgency needed to address the fact that they are literally dying in the pandemic without adequate protections?

The hon. Lady raises very important points about the situation facing ethnic minority employees, but that is why we are acting. It is why we sought quantitative evidence from ACAS. It is why we charged ACAS to come up with guidance in the first instance. There are plenty of other things we can look at, but as well as giving employers certainty in knowing how they should approach the situation, the guidance allows employment tribunal judges to make sure they are consistent with their judgments, too.

We receive lots of correspondence—I get a lot, not least from Members of this House sharing their constituents’ concerns—and I can see how deeply distressing it is for those who face changes to their pay, working hours, sick pay or other benefits. That may happen after years of service to their employer or to those new to the world of work. Losing one’s job through redundancy and dismissal is clearly something everybody wants to avoid. I speak to businesses every day and I know the vast majority of employers want to do the right thing by their employees. For most employers, decisions to change terms and conditions are not taken lightly, nor is the choice to let members of their workforce go. Good employers know that investing in their workforce and not treating them badly is the best way to increase productivity.

Before the pandemic, a decade of austerity left far too many trapped in low-paid, insecure work, consistently failed by the social security system. The brutality of this failing economic regime has been further exposed throughout the coronavirus pandemic, with at least 3 million people being left without economic support. The post-covid economic recovery needs to be built upon equitable distribution of income and wealth and new jobs. But beyond the rhetoric of levelling up, a redistributive economic vision that can deliver the future that people across the UK deserve was wholly missing from the Budget.

Despite finally listening to trade unions and campaigners with regard to the furlough scheme, there was not nearly enough to secure a recovery that puts people in a better position than when they entered the pandemic, never mind laying the foundations for the economy to meet the challenges of the future, including tackling climate change and mass unemployment. Yes, the main rate of corporation tax will increase from the present 19% to 25%, but not until 2023. At the same time, the rich and big business are being treated to mouth-watering tax giveaways and reliefs, despite unclear evidence about whether that will actually create the investment needed.

Beyond the limited extensions of job and business support schemes, there is very little about providing support for public services and public investment and a lasting boost to welfare for those hit hardest by the crisis. Not only was this Budget a missed opportunity for a care-led green recovery that creates decent, well-paid, unionised jobs and addresses our care crisis. It will create widespread inequality and precarity. It actually laid out significant cuts to public spending.

The lockdowns and an inadequate social security system have caused widespread financial hardship, unemployment and debt, and yet the Budget fell far short in tackling poverty, low pay and the deepening divisions in our society. It risks plunging more people into poverty and forcing them to queue outside food banks. The £20-per-week top-up of universal credit, which was introduced at the start of the pandemic, will be temporarily retained and will help some 6.5 million families, but only until September. At the same time, there is no increase in the statutory sick pay of £95.85 per week. Despite the ongoing performed gratitude towards those working on the frontline, the Government did not end the wage freeze for public sector workers. That is an absolute insult.

In the long run, we need an inclusive, intersectional recovery to rebuild our economy and recover from the pandemic and entrenched inequality. I am sick of looking around me and seeing the hard work and creativity of my local people often go unrewarded.
