Thank you for calling me to speak, Mr Hosie; it is a pleasure to serve under your chairmanship. I welcome the opportunity to contribute to the debate and I thank the hon. Member for St Albans (Daisy Cooper) for giving me that opportunity.

Quite simply, there should not be any further expansion of Luton airport—no ifs, no buts. It is in the wrong place to have a larger airport. As has been outlined by both the hon. Member for St Albans and my hon. Friend the Member for North East Bedfordshire (Richard Fuller), the airport has consistently shown disregard for local residents and their views. In particular, there is a conflict between Luton Borough Council’s largely financial interests and its need for Luton airport to grow and grow for financial reasons, and the interests of local residents in my constituency, and indeed those in many other surrounding constituencies in Hertfordshire and Bedfordshire.

This process should not go on any longer. I urge the Minister to outline how we can stop any further expansion. In addition, I would welcome an update on the flight path reorganisation work being done over the coming years, not just from Stansted but from all the different airports in the south-east, because that will significantly impact the lives of my residents.

The hon. Lady will know that we are committed to delivering economic development and levelling up the whole of the UK. That is why we are already investing in our rail and our roads, particularly in the north, which is why the Secretary of State is unable to be here today to answer this urgent question. We are committed to airport expansion, as we believe that it is a core part of our plan. I will make sure that we are hopefully able to continue to deliver on that.

The Minister will recognise that because of the court judgment there are huge amounts of uncertainty in places across the whole country in relation to their own airports and potential options for expansion. As somebody campaigning against the expansion of Luton airport, can I ask her to be very clear that any expansion of any regional airport in Luton or anywhere else must meet stringent environmental criteria on climate change, pollution and the rest? Will she make that point firmly at the Dispatch Box?

I hate to disappoint the hon. Lady in her first Transport questions, but a whole bunch of conversations need to take place first, including the working up of a detailed business plan. We are working with TfL on these matters—there is no blockage in the system—but these things do take time. I am afraid that I have to disappoint the hon. Lady and not give her a date at this point.

I have been working with Hertfordshire County Council on plans to improve accessibility to Hitchin station in my constituency. Will the Minister advise me on how best to work with Network Rail and the Department to progress this? We think it will cost £3 million to £4 million.

What action are the Government taking to address the conflict of interest, where the Labour-run Luton Borough Council frequently gives the airport permission to flout planning permissions that it has itself imposed?

I understand the sensitivity, particularly for local Members of Parliament and local communities who see that joint role. I reassure my hon. Friend that there are very clear statutory rules on how a local authority can and cannot act when it owns a piece of land that is subject to a planning application. I give him that reassurance that clear rules are in place.

I rise to discuss transport in Hertfordshire. I am an MP for Hitchin and Harpenden—the MP, not an MP; there is only one, at least at the moment. Transport affects us all—not just Hertfordshire, but all counties and everybody in the House—but it particularly affects my constituency, and today I want to draw the House’s and the Minister’s attention to two specific issues: first, the train system and commuters going in and out of London from the stations of both Hitchin and Harpenden—both main commuter stations into London; and secondly, the looming expansion of Luton airport and the constant disruption faced by many of my constituents and others across Hertfordshire, including the constituents of many of my colleagues.

I will start with trains. When thinking about our transport system in Hertfordshire, we must have a sense of balance. Better public transport is essential. I do not know anybody on either side of the House who would disagree. We recognise that people in Hertfordshire want better public transport. Yes, they want better roads as well, as it so happens, but they want better public transport. They also want to maintain their standard of life. They moved, often from big towns or cities, principally London, because they did not want to be there. Hertfordshire is a much more rural county than many people realise, and the green belt is very precious to many of my constituents. It is important to bear that in mind when thinking about what infrastructure improvements are needed.

In particular, on the subject of Luton airport, I spoke to the Minister earlier today. I know how much he understands and cares about these issues, despite being relatively new to his brief. It is important that infrastructure such as airports is used for the benefit of all and is mindful of the negative externalities and impacts on many people in Hertfordshire and in particular my constituency.

As the hon. Gentleman says, infrastructure and better funding for transport are important not just in his constituency but across the whole UK. Does he agree that decent infrastructure is necessary to every community and that, although issues such as potholes might not be high on the register for some, for those of us who want investment in our local communities, good infrastructure is the starting point, and that requires good planning and good funding, and these two must go hand in hand?

I agree with the hon. Gentleman. Good infrastructure matters. It is the difference between being a developed advanced country and not being one. The ability to get into work in a timely manner is critical to the economic and social wellbeing of a country, particularly in constituencies such as mine that rely on commuting. He talks about potholes and roads. I will come to this later. Roads are the essential lifeblood of pretty much every small business, of people taking their kids to school, visiting family, seeing friends or just conducting everyday business. These things may appear small, but they are critical.

That leads me to trains. Many in the House will have heard me talk many times about trains. I can see my hon. Friend the Member for Wells (James Heappey) in his place. He has heard me bang on about this many times.

Hitchin station in north Hertfordshire serves 3.2 million passengers a year—1.3 million more than nearby Letchworth. Everybody in the House will be aware of the debacle in the rail industry in May last year with the big timetable changes, which did not go well. Like many others, Hitchin suffered severely, although there were some improvements. People going from Hitchin into central London no longer have to change at King’s Cross St Pancras but can run all the way through the core of London to the south of London, which many constituents have told me is a significant improvement that has considerably improved their commute. That should be noted and welcomed.

That said, there are significant problems with the timetabling, particularly with overcrowding. This is a big problem, and not just because it is uncomfortable; it can often be a health problem, especially in the summer—and we are getting into warmer weather now. For anybody who has a disability or is pregnant or feeling ill, it can be a significant problem when commuting to and from work. The overcrowding is basically due to the fact that since the timetable changes there are fewer peak time trains from Hitchin and the trains stop more often going into London. This increases the overcrowding.

The Minister or any of the millions of people watching might think me just another MP whingeing about his local train service, because that is what local MPs do, and that is partly true, but unless the things that local MPs bring to this House, often after being begged by constituents, get heard, and unless constituents can see they are being heard and that their concerns are being acted on, there will be a crisis of trust not just in the local MP, but in the Government and Parliament as a whole, as a means to resolve the issues that people face. On these sorts of issues, I urge people—I know that the Minister, being a very good champion of his own constituency, understands and cares about this—to think about these things very deeply. Constituents email or write to their MPs, but they have better things to do; they do it because it matters and significantly impacts on their lives.

The Department for Transport does not run all the trains. It is not in charge of every driver of every route. The Transport Secretary does not determine every train timetable in and out of Hitchin or anywhere else. The Department sits atop a structure that includes Network Rail, which is responsible for the infrastructure and stations, principally, and for timetabling, and the operators —in our case, GTR—which are responsible for running services under franchise agreements with the Department. My contention is that GTR has not treated Hitchin as a major station. It has treated it as just another station in north Hertfordshire and not adequately appreciated the fact that it is the main station in that area, and this has had real consequences.

To best illustrate these consequences, rather than use my own words—we have heard enough of those already—I thought I would gather up some emails that I have received in only the last 72 hours about the train service from Hitchin. Constituent 1 told me—I will not name them because then they might appear on Google and it would all be terribly embarrassing, but I will quote them directly:



“I am still to gain an answer from GTR as to why the station of Letchworth has seen such vast improvements in service over the past 12 months whilst the Hitchin service remains relatively unimproved. Letchworth now has the same frequency of peak trains as Hitchin (despite the fact that Hitchin has almost double the annual usage) as well as gaining Direct services”

—to London—

“(which Hitchin commuters had previously lost). As a committed campaigner for a greener future yourself I can see no logic in the fact I can now drive to Letchworth station rather than walk to nearby Hitchin, and still get to London faster?”

Here is another example, from Mandy.

“Please can you explain to me why every time there is a school holiday”

GTR

“are totally unable to run anything approaching an acceptable service?”

Chris writes:

“Hello Bim…Can I ask what can and will be done? The service provided…is abysmal and must be a serious consideration when people of our age are looking to relocate out of London. It must also affect the prosperity of the area as so many of us commute. The costs are enormous yet the service is poor at best.”

Mike says:

“Hi Bim,

The trains are worse than ever, it’s been a complete disgrace since the May timetable changes. Most seem to be around lack of staff? I don’t understand…

Are you able to find out if they’re lying to us? I just want to be able to get to work in the morning and home in the evening.”

I will not continue, but I have received those emails over the last 72 hours, and I have received hundreds more over the last 12 months. This is a real problem with which I believe GTR has manifestly failed to deal. What do we need? The answer is simple. In Hitchin, we need more peak-time trains leaving between 07:30 and 08:30, and more peak-time trains arriving between 18:00 and 18:45. I ask the Minister to deal with that specifically in his response.

Let me now turn to Harpenden, the equally loved station in my constituency. GTR has been pretty unwilling to accept that any changes are necessary, but in the case of Harpenden it has openly admitted that its actions last May caused severe difficulty. It has been quite candid about that, and has engaged with me several times on the subject of the station and the trains. That culminated in a meeting that I arranged in February this year with representatives from St Albans, Luton, Bedford and, obviously, Harpenden: commuter groups, local MPs, officials from GTR, and various people who decided to turn up. That was a big room.

The stated aim of the meeting was to deal with the problem at Harpenden, because everyone in the room recognised that there was a problem. Honest, open views were exchanged, and by the end of the meeting everyone had agreed that Harpenden needed at least two more peak-time services that would otherwise stop at Luton, because the number of commuters between Luton and London was infinitesimal compared with the number at Harpenden. That was agreed by everyone in the room—except the hon. Member for Luton South (Mr Shuker). The hon. Gentleman is not here and cannot defend himself, and I do not blame him for what he said. He felt that the issue affected his station, he did not want to be on record as having accepted that any station in his constituency had “lost” services to Harpenden, and he objected.

GTR manifestly failed in its duties. It is no way to run a process to accept that there is a problem—everyone is in a room with all the passenger loading data, the information and the evidence, and everyone agrees that in Harpenden services are needed from Luton rather than Bedford or St Albans—and then to hide behind an effective veto from a local MP. I do not believe that that is the way to run a service.

This afternoon I spoke separately to the Minister and to the rail Minister, my hon. Friend the Member for Harrogate and Knaresborough (Andrew Jones). Will the Minister commit himself, on behalf of the Department, to meeting me, various officials from the Department—if he wishes—and local commuter groups, along with GTR, to establish, finally, how we can broker some sort of agreement or solution to the problems faced at both Hitchin and Harpenden? That would be welcomed not just by me but, most important, by my constituents. Then, finally, we might achieve a resolution and an endgame to the problems that we face.

A connected, although separate, issue is the long-proposed rail freight site at the Radlett aerodrome, on the same line, which may not be advantageous to commuting services. Will the Minister confirm that the Government are no longer seeking to include that in their rail freight plans for the south-east?

I have dealt with the issue of trains. Let me now turn to the issue of Luton airport, which, surprisingly enough, is in Luton. It is in Bedfordshire, which is right next to my constituency. Constituents of mine live less than 200 yards from the runway. It is a rapidly growing airport: it handles more than 16.6 million passengers a year; and passenger numbers over the last 10 years have grown by over 80%.

If the House will indulge me, I will explain why I am particularly concerned about Luton airport beyond the fact that the disruption to my constituents from both noise and air pollution has grown significantly. Luton airport is owned by London Luton Airport Ltd on behalf of Luton Borough Council, which is also the planning authority hitherto responsible for approving increases in the allowed numbers of passengers. In December 2017, Luton Borough Council put forward a plan to expand Luton airport—a huge expansion, going up to 38 million passengers, which was later reduced to 32 million. I think, however, that everybody can appreciate that that is a significant increase from the current limit of 18 million passengers.

I am completely opposed to this proposal for expansion of Luton airport, but that is a subject for another day, because the processes of how it will be submitted are still being gone through and the Government have already accepted that the increase is so great that the application will go to the Planning Inspectorate at central Government rather than be decided by Luton Borough Council. I would make this point about Luton airport: it is not the right place for a major airport the size of Gatwick. Its location on a plateau means that topographically it is closed by fog and bad weather much more frequently than most airports in the south-east. The dense pattern of settlements around Hertfordshire and that part of the country—whether Hemel Hempstead, Harpenden, St Albans or large villages—means that significant numbers of towns and villages face growing amounts of noise and air pollution and traffic on rural roads, and particularly in my constituency.

Returning to Luton Borough Council’s role, to be frank, my constituents—and, I know, many constituents in Hertfordshire generally who are overflown by planes from Luton airport—do not trust the council on this issue, because there is a conflict of interests: Luton Borough Council owns Luton airport. I want to be very clear that I am not alleging any specific illegality or impropriety—I have no evidence of that—but, as all of us here know because we are politicians, the appearance of fairness is often as important as fairness itself and there is a significant trust deficit between my constituents, many people in Hertfordshire and Luton Borough Council and its role vis-à-vis the airport.

In December 2013, Luton Borough Council approved a proposed expansion of 9 million—from a limit of 9 million passengers to 18 million passengers. That proposal was in 2013, so only six years ago, but it was meant to take place over a 15-year period up until 2028, and the project was designed to be a balanced one that matched growth with mitigation measures for traffic, air pollution, noise pollution and the like. On the face of it that seems a broadly acceptable way of proceeding, or at least it seemed so at the time.

Since then I am afraid we have seen a lot of growth; in fact, as I have said, we are already getting up to the limit of 18 million passengers in 2019, despite the fact that we are only meant to get to that point by 2028. There has been lots of growth but no mitigation. In fact it has been worse than no mitigation; things have got worse—things have been going backwards. Noise for my constituents, which blights them every single day—and night, as I will come on to—is getting worse and worse and worse for those who are unlucky enough to live beneath a flight path.

Luton airport is now in breach of a key noise control planning condition known as the night noise contour. Broadly speaking, limits were set on how much night noise there should be and Luton airport has exceeded that limit. Here I come to the problem with Luton Borough Council: guess which body will be making the decision on whether Luton airport will be able to breach its agreed planning condition, which was expressly designed to limit noise that affects Hertfordshire? That body is Luton Borough Council.

People might think that, just because the council owns the airport, it would not necessarily approve any expansion, and that is of course true. I am sure that it will say that there are strict Chinese walls in its organisation, and perhaps there are. However, Luton Borough Council receives more than £20 million from Luton airport from dividends alone, and we can see the direct incentive to make the airport grow as fast as possible so that Luton gets the gain from the growth. I accept that there is significant economic gain for Luton; I do not deny that. However, the pain—in terms of increased traffic on small rural roads, increased noise and air pollution and significant disturbance—will come to my constituents and the people of Hertfordshire. Luton gets the gain and Hertfordshire gets the pain.

Does the Minister agree that planning conditions governing aviation noise and emissions are a key part of maintaining the balance between growth and environmental protection to which the Government’s aviation policy framework aspires? Does he condone the failure of Luton Borough Council to enforce a key planning condition despite the fact that the airport has breached the condition for the past two years and that a further breach of the same condition is predicted for this year? Will he, on behalf of his colleague, the aviation Minister in the other place, agree to the aviation Minister or another Minister from the Department sitting down with me and other local representatives and campaign groups from Hertfordshire to discuss whether the decision should be called in, in the light of the breach of the noise planning contour at Luton airport, such is the disturbance that this is imposing on my constituents?

We spoke about roads and potholes at the beginning of the debate, and I want to put on record that Hertfordshire County Council is doing its level best to improve the state of its roads. It has done well, and I call out Councillor David Williams, the leader of the county council, for working hard on this and making it a focus, but the council needs more money. I urge the Minister and the Department to keep in mind that we are not there yet. The money has increased, but there needs to be significantly more to improve the state of our rural roads in Hertfordshire and across the country.

On the roads we have cars, and we also have buses. Buses are the lifeblood of rural areas for elderly people or those who cannot afford a car. They cannot get anywhere without an adequate bus service, but in many parts of my constituency the local bus services have worsened and are inadequate. The village of Redbourn is an example, and I call out Councillor Victoria Mead for her absolutely fantastic campaigning to improve the bus service from Redbourn. Various villages to the south of Hitchin also have failing bus services that need support and improvement, and I urge the Minister to take a look at this issue in rural areas. How can we help our local bus services? I will work with him on anything that he and the Department wish to do.

I am a realist; I know that there is no magic wand. These issues are structural—whether they involve trains or Luton airport—and they take time. They are complex and difficult, and as I have said, the Government are not the only actor involved. However, I am asking the Government—in addition to answering the precise questions that I have mentioned—to lean in a bit more heavily on the side of the people and against the interests of GTR, which is not taking my constituents’ concerns adequately into account, and against the unbridled, unfettered growth of Luton airport by Luton Borough Council, which is pursuing this reckless growth and profit without taking Hertfordshire residents into consideration. Let us work together to ensure that we improve the lives of the Hertfordshire residents that I and many other colleagues are here to represent.

One thing that is often lost in debates like this is the practical impact of such issues on passengers. I urge the Minister, the Secretary of State and all Members to remember that, yes, this is about getting investment, improving stations and timetables and increasing capacity, but fundamentally the whole point of the system is to make life better for our constituents, particularly those who rely on trains to get to work. Many Members have talked about the difficulties of recent weeks, and the House does not need to hear any more from me about my disappointment in relation to my constituency or those of other right hon. and hon. Members.

My hon. Friend, my right hon. and learned Friend the Member for North East Hertfordshire (Sir Oliver Heald) and I have been working hard with Ministers and with Govia—we are in touch daily—because tens of thousands of our constituents have been massively affected every single day. We are trying to fix things so that our constituents can get to work. Although there are issues with the timetable in our area, things will be dramatically better when it works. The number of seats will be doubled, there will be 50% more trains from my constituency, and a whole variety of new destinations will be provided. When the new timetable is in place, there will be positives, but there are issues now, and they are what we are working daily to resolve.

I thank my hon. Friend. One point worth making—one that backs up his intervention—is that a real frustration as a Member of Parliament is knowing the intended improvements over the medium term, but constituents quite rightly not believing that the improvements will happen when the implementation does not work as hoped. It is therefore incumbent on GTR and Network Rail to do their best to get a grip not just on the medium and long terms, but on the emergency timetable.

I want to draw the attention of the House and the Minister to a private Member’s Bill that I will shortly introduce relating to enhanced compensation for passengers. I recognise that the Secretary of State has set out a compensation scheme specifically for the disturbances over past weeks, but the compensation in the Bill will be governed by the Government’s new rail ombudsman on an ongoing basis, providing automatic compensation for all passengers throughout the country. In addition, it will provide enhanced, more generous compensation for passengers throughout the country. Critically, it will ensure not just that passengers get a percentage of a single ticket for a train that is cancelled or delayed, but that we move towards a system with service levels and a contract between the operator and the passenger. Then, if that service level is not maintained, the passenger will receive compensation. I would like the Minister and the Secretary of State to consider that direction.

I thank the hon. Gentleman for flagging up his Bill and welcome what he describes. Will he confirm whether the compensation for the current timetable problems should be based on the new timetable that was expected to be introduced, not the reduced timetable, and therefore be much larger? Does he agree that there is a strong case for making train companies and Network Rail liable for consequential losses associated with train delays, not just the ticket cost?

On the right hon. Gentleman’s first point, that would depend on when the Bill could make progress and whether it would take effect in time. It is difficult to understand how the proposed compensation regime would interact with the special compensation regime relating to the implementation of the new timetable. However, on the right hon. Gentleman’s broader point about consequential loss, he will appreciate that that is hard to prove. I remember from my days as a corporate lawyer that consequential loss in contracts is one of the toughest things to prove. I am not saying that he is incorrect, but it would merit further consultation and I am happy to sit down and discuss the matter with him. If we can come to an agreement, hopefully the Liberal Democrats will support my private Member’s Bill.

A point that is often made to me is that many commuters do not have a good enough choice. On some lines, the operator is the only game in town, and where that happens, it is incumbent on the operator to do a significantly better job at getting on top of problems when they arise. My right hon. Friend the Member for Sevenoaks (Sir Michael Fallon) made the point that the Secretary of State may need additional powers at times of crisis to direct what needs to happen at certain stations, and the House should consider that. I welcome the fact that the Secretary of State has said to me, both privately and in this House, that he is committed to improving the situation at Hitchin and Harpenden stations once we have got past the current difficulties—[Interruption.] I can see the Rail Minister nodding in approval, which is always good. My constituents—I was nervous about this before I came to speak this afternoon—are not particularly interested in rhetoric; they are interested in making sure these changes are introduced in the right way to provide real practical improvements to them and their lives. That is what I, as the local Member of Parliament and with the Government, will hopefully be providing.

I seem to remember that when I took over there were real problems with Southern metro services at other stations in the hon. Gentleman’s constituency. Those problems have now been improved and sorted, and those services are running very well—not across the whole Southern network, but across the Southern metro network. We now need to sort this problem out.

I have spoken to the Secretary of State over many weeks and months about the train issues in my constituency of Hitchin and Harpenden. I know the inquiry he has announced will look into culpability on this matter, but how much more evidence do we need that the senior management of Network Rail and GTR are incompetent, incapable and inept? How long can they go on?

Trying to encourage, recruit and retain people to work in the fishing, port and shipping sector is a priority for the Department. We know how difficult it is to attract people who are not already in contact with fishing, ports and ships. We are doing what we can to try to encourage people to think of shipping, fishing and working in ports as jobs going forward. We have set up a number of initiatives, especially this year, through the Year of Engineering, to try to get young people interested in being employed in fishing, ports and shipping, and we will share that information with any Department that wishes to see it.

The new Thameslink timetable started on Sunday. It brings more frequent and better connected journeys for passengers across London and the south-east. As part of this, rail passengers at Hitchin and Harpenden now have a more regular train service throughout the day than they did previously. The Government, along with the rail industry, are monitoring performance of the new timetable, as well as passenger feedback.

On Monday, the first day of the timetable for commuters, 24% of Hitchin’s services were cancelled and more than 50% were delayed. Please will the Minister reassure me and my constituents that the Department will do everything it can to force Govia Thameslink to improve its performance drastically or be stripped of its franchise?

The biggest challenge in getting to Old Trafford on a match day are all the roadworks on the M60, which are due to our investment in the motorway network, and all the roadworks around Old Trafford, which are down to the support we are providing to Manchester to invest in the extension of the Metrolink.

The hon. Gentleman will be aware that Network Rail and Manchester City Council are in detailed discussions about Piccadilly, and we are close to moving forward with desperately needed improvements to the two platforms, and I want that to start soon. As for the airport, we need a really good hub station at the airport, and we are now working through how best to take the Transport for the North proposals for Northern Powerhouse Rail and create a deliverable programme. The first bit of that starts next year with the upgrade of the TransPennine route.

Does the Secretary of State agree that working with private sector partners on the west coast main line has delivered huge improvements to reliability and customer service? Will he reassure my constituents that any operational changes that have been outlined or envisaged today will not have a negative impact on their service?

That is my goal. The thing is that I am very much in favour of the public sector and the private sector working together in partnership, and I have talked about that in other parts of the rail network. The difficulty is that the Opposition do not seem to want the “private” bit at all—everything has to be public. Both sectors bring strengths to the party, and the working partnership that exists today between Network Rail and Virgin Trains on the west coast main line has delivered significant performance and customer satisfaction improvements over the past few years.

I beg to move,

That this House has considered Luton airport expansion.

It is a great pleasure to serve under your chairmanship, Mr Gray, and to speak in my first Westminster Hall debate on a subject of great interest to my constituents and of importance to the whole region. I thank the Minister for being here to respond to the debate. I wish him all the luck in the world in whatever may transpire in No. 10 later on.

First, let me establish some facts. Luton airport is a rapidly growing airport that currently handles more than 15 million passengers a year. Its passenger numbers have increased by 70% in the past seven years alone. It is owned by London Luton Airport Ltd on behalf of Luton Borough Council, which is also the planning authority responsible for approving any increases in allowed passenger numbers. Luton Borough Council set the limit at 18 million passengers in 2014. In mid-December last year, Luton Borough Council, as owners of the airport, set out a highly ambitious plan to more than double Luton airport’s passenger traffic by 2050, bringing it to roughly 38 million passengers. To give some context, that represents an ambition for Luton airport to manage as many passengers as Gatwick airport did as recently as a couple of years ago, when it was, as it is now, the second busiest airport in the UK.

My constituency, Hitchin and Harpenden, lies in rural Hertfordshire but abuts Luton to the west. The flight path of Luton airport for inbound and outbound planes runs directly over thousands of my constituents—particularly in Harpenden, Wheathampstead, Sandridge and Jersey Farm—causing a great deal of noise and air pollution over the area. In addition, although Luton sits on the M1 motorway, a great deal of the traffic that naturally accompanies an airport handling more than 40,000 passengers a day currently runs through the very rural roads of my constituency to the north and east of the airport. That is near such villages as Breachwood Green, Mangrove Green, Lilley, Hexton and Pirton. Much of that area is in the Chiltern hills and is designated as an area of outstanding natural beauty.

I congratulate my hon. Friend on securing this debate. I am sure he is aware that the flights blight not only the lives of his constituents, particularly in rural areas, but the rural parts of my constituency, particularly the Markyate and Flamstead area. The people who live there are the experts on the issue because they have planes flying over them all the time. They were given categorical promises that as the growth took place, noise mitigation would also take place, and that has not happened. Would that not be a good reason to curb the speed of the increase in flights until the airport has done what it promised to do in the first place?

I thank my right hon. Friend for that intervention. To add to his point, which I agree with entirely, it is my case that the proposed expansion of Luton airport to the level of 38 million passengers is first unsustainable and unsuitable for the local area that includes not just my constituency but his and that of my hon. Friend the Member for St Albans (Mrs Main), and secondly—this is a particularly serious point—could undermine trust in government for tens of thousands of Hertfordshire residents because Luton Borough Council owns the airport, receives income from it and yet also acts as the planning authority.

If it is not entirely clear from my comments so far, I am not against airports or Luton airport. I understand the need for and the necessity of a thriving aviation sector, and I recognise—I am sure the Minister will talk about this—the jobs and economic growth that Luton airport brings to the United Kingdom and to Luton. My case, which is supported by the vast majority of my constituents in Hertfordshire, is that the proposed expansion to more than double Luton’s passenger numbers is unsuitable for the local area and unsustainable in the context of the constraints that exist in rural Hertfordshire in particular.

Luton is just not the right place for an airport with a proposed size of 38 million passengers. Topographically, its location on a plateau means that it is closed by fog and bad weather much more frequently than the other airports in the south-east. It has a very constrained footprint compared with Gatwick and Stansted, and the dense polycentric pattern of the surrounding settlements, such as Hemel Hempstead, Harpenden and others, means that many towns and villages are affected by noise and pollution. It is right next door to extremely rural Hertfordshire countryside which has, as we would expect, many small narrow lanes. They are often used as rat runs through to Luton airport. Many of them can take only one car at a time and are already seeing vast increases in traffic as passenger numbers rise year on year. In addition, unlike Heathrow, Gatwick and Stansted, Luton does not have a direct rail link to the terminal, although I recognise there are plans for that.

Furthermore, Luton already has the greatest concentration of air traffic movement in its airspace in the UK, and it is one of the most congested airspaces in Europe. Noise complaints from Hertfordshire residents are already extremely high with the existing traffic of more than 15 million passengers. To give some context, those complaints have increased twenty-two-fold in two years. Night flights also hugely blight the lives of many of my constituents. Over the past two years, the number of flights between the hours of 11 pm and 7 am has gone up 25%, from 12,867 to 16,031.

I believe in giving credit where it is due, so I must thank the Government and the Department for Transport for their recent efforts on noise mitigation, as shown by their commitment to an independent noise regulator to be called the independent commission on civil aviation noise. Once established, I hope that body will help provide much more objective independent guidance on how aircraft noise should be assessed and managed and how that should be used to inform airspace decisions.

The Government’s consultation document states that

“it is clear that tensions are likely to arise when airport operations change in a way which affects how local communities experience noise impacts. We want to ensure that there is not a breakdown of trust between airports and their communities.”

I submit that the extremely rapid rise in complaints about aircraft noise in Hertfordshire shows that as things stand, trust between Luton airport and residents of rural areas in Hertfordshire is in danger of breaking down. I believe it will break down completely if colossal expansion plans are rammed through without appropriate consultation with Hertfordshire residents.

I would go further than my hon. Friend. He, his predecessor, my hon. Friend the Member for St Albans (Mrs Main) and I have been campaigning on the issue for many years. I can only speak for my constituents, but I am afraid the trust has gone already. Promises have been made so many times in the past, and they have never been fulfilled. Instead of trying to work with the communities, the airport makes noise about doing tests and this and that, but when it comes to the crunch, it never fulfils its promises. This is another classic example where there is growth before the mitigation is put in.

I thank my right hon. Friend for that. Perhaps it is because I am new—perhaps I am optimistic and generous—but I do agree with him that trust is crucial. Trust between the citizen and Government, both local and national, is one of the most fundamental underpinnings of our or any democracy. Many of my constituents have lost trust in recent borough council management of the expansion of Luton airport over recent years, as my right hon. Friend describes, and one reason for that is the highly unusual situation whereby Luton Borough Council owns Luton airport and at the same time is the planning authority currently responsible for approving its expansion. I must make it clear for the record that I am not accusing Luton Borough Council of any legal or procedural impropriety. However, there is a significant conflict of interest.

In 2015 the highly esteemed National Audit Office—esteemed not only by the Government and the House; as a member of the Public Accounts Committee I work with its civil servants frequently and they are incredibly capable people—published a report on managing conflicts of interest in the public sector. The report states:

“A failure to recognise a conflict of interest can give the impression that the organisation...is not acting in the public interest and can damage...confidence in government.”

Luton Borough Council’s ownership of Luton airport, which generated a net profit of roughly £47 million in the last financial year, coupled with the huge increase in flight noise for many thousands of my constituents and across Hertfordshire, as I have already demonstrated, as well as with the huge increase in passenger numbers, leaves many of my constituents feeling that Luton Borough Council has one real interest: growing passenger numbers and therefore revenue for its airport. That interest has been pursued without any real consideration for the significant negative impacts on the people of Hertfordshire that I have outlined here today. As one of my constituents put it to me, Bedfordshire gets the gain, and Hertfordshire gets the pain.

So, what shall be done? I propose that the Minister responds to the following points in his response. First, bearing in mind the huge growth proposed at the airport, will the Government confirm that the plans for any future expansion must be approved as a nationally significant infrastructure project submission to the Planning Inspectorate, with the decision therefore no longer being made by Luton Borough Council? Secondly, will the Government act not to allow any further expansion of passenger numbers beyond 18 million without the imposition of much greater conditions around noise concerns, flight route changes, and a much tougher limit on night flights, so that Luton is finally treated like other London airports? Thirdly, will the Government call on Luton Borough Council to provide detailed plans for the necessary infrastructural improvements, particularly on local roads, that will be necessary in Hertfordshire even based on existing passenger numbers, as well as in Bedfordshire, and explain how they propose to fund it?

Finally, will the Government call on Luton Borough Council and Luton airport to work much harder to gain the trust and partnership of Hertfordshire residents, as mentioned earlier by my right hon. Friend the Member for Hemel Hempstead (Sir Mike Penning), not only for any expansion of passenger numbers in future, and actively keep future growth in step with mitigation measures and constrain that future growth if necessary?
