May we have a debate on the success of our free schools policy? In my constituency, the I-Foundation has opened the first state-sponsored Hindu primary school and a secondary school. They are both so over-subscribed that capacity is having to be doubled in just two years. The I-Foundation is now launching a campaign to have five further Hindu free schools across the country, with a further five to follow. This demonstrates parental choice, both for a religious type of education and for the type of education that new organisations are providing.

My hon. Friend sets out a good argument both for free schools and for our taking the opportunity to celebrate the successes coming from them. That is happening around the country and often in this place we do not take enough opportunities to recognise what the successes in policies mean in practice for the populations we serve. It is not easy, as time is short in this House, but we will continue to look for where such opportunities might arise.

I share the right hon. Lady’s sense of shock and outrage at what happened, and I know that the whole House does, too. These events took place many years ago, but in a sense that makes the situation even worse; there has not been any recognition of what took place even though so much time has passed. The victims have had to live with the consequences without a satisfactory resolution, and it is therefore all the more important that we take action now.

My right hon. Friend the Home Secretary set out the action we will be taking, and we continue to consider how best to achieve a proper resolution. There are ongoing police investigations into the abuses in north Wales and, as my right hon. Friend said, judicial investigations into what happened in respect of the Waterhouse inquiry, but I will draw her attention to what the right hon. Lady has just said.

The Hindu festival of Diwali is next week. Will my right hon. Friend join me in wishing Hindus, Sikhs and Jains across the world, and in particular in this country, a very happy Diwali, and may we have a debate on the wonderful contribution the Ugandan Asians have made to this country, and the wisdom of the Conservative Government in admitting them in 1972, when no one else would?

Yes, I entirely share every sentiment my hon. Friend has expressed, including those about the tremendous contribution made by the Ugandan Asians. I know from my past responsibilities for the health service what a tremendous contribution they have made to medical services in this country, as well as, as we all know, the contribution they have made over many years in enterprise and business creation.

Festivals such as Diwali play an important role in helping us appreciate and celebrate the cultural diversity of this country. Diwali is a vibrant celebration of the victory of light over darkness, of good over evil, of knowledge over ignorance. It is a time for celebration and reflection about what we have achieved and our ambitions for the future, and I know that Members across the House will extend our best wishes to our constituents for the festival of Diwali.

As a relatively new business manager, I will of course be very glad to discuss these matters with colleagues, not least the House authorities and my hon. Friend the Member for Broxbourne (Mr Walker)—he is no longer in his place—who chairs the Procedure Committee. [Interruption.] I know, as does the hon. Lady, that there are circumstances in which it is proper to allow time for debate and not proper to assume that there will not be a substantive debate on an issue that will take all the time available, so it can sometimes be difficult to anticipate when business will finish sooner than it might otherwise do.

The improved economic figures are clearly welcome, but it is important that we improve our trade with developing nations. The Indian state of Gujarat has achieved record year-on-year growth, yet its First Minister, Narendra Modi, was denied access to the UK by the previous Government. May we have a statement from the Foreign and Commonwealth Office facilitating a state visit by Shri Narendra Modi to this country so that we can hear at first hand what wonders he has performed in Gujarat?

I will, of course, talk with colleagues in the Department for Business, Innovation and Skills about what opportunities there might be to look at Gujarat’s economic performance, but I remind my hon. Friend that, as he probably knows, over the past two years British exports of goods have increased to China by 72%, to India by 94% and to Russia by 109%. The Government are only too conscious of the importance of developing our trade with these leading emerging economies and will continue to give that real push.

It is a pleasure to follow my near namesake, the hon. Member for City of Durham (Roberta Blackman-Woods). I want to talk about three issues: the general position of policing and criminal activity in London; the excellent work being done by Harrow police; and the scandalous proposal to close the custody suite in Harrow.

On the general position in London, some 300,000 people were arrested last year for alleged crimes, of whom 100,000 were foreign nationals. Of the 100,000 foreign nationals arrested, 86,000 were convicted of a criminal offence. I am one of those who welcomes tourists who come to this country on holiday, spend their money here and enjoy our wonderful heritage. I also welcome those who come here as students and who learn about this country and go back to their own countries enriched by their experience of the United Kingdom. I welcome those who come here to work and pay their taxes, and the families that choose to live here and integrate into society, becoming part of our great British society overall. However, those who come as guests and then commit criminal offences, and who are responsible for a third of London’s crime, are a danger to everyone else who comes here to make this country their home.

That is a key concern. The worst aspect is that, as I understand it, of those 86,000 people convicted of criminal offences, none were deported. Worse still, none were barred from returning to the UK if they chose to leave of their own volition. That, of course, creates community tensions and concerns for all the law-abiding people who have come here either to live here or on a visit. This requires prompt and immediate Government action.

Let me turn to the issues in Harrow. I recently had the pleasure and honour to attend a commendation service for 22 policemen and women who were commended by the borough commander for courage and for work above and beyond the call of duty. These brave individuals do an excellent job in ensuring that Harrow is London’s second safest borough. They cannot be praised highly enough. I believe it is right and proper to pay tribute to all those brave men and women who lay their lives on the line almost daily so that we can go about our business in a carefree manner, as we would all wish.

Finally, the third issue I want to deal with is the scandalous proposal to close the custody suite in Harrow police station. Everyone knows that when people are arrested, they are often violent, they are sometimes intoxicated and they can give the police a very hard time. Such people need to be transported to a custody suite, and processed and looked after in the prison cells, if required, in the most expeditious manner possible. The last thing that is needed is to transport people arrested in Harrow to Wembley or even to Kilburn when they may be violent, intoxicated on drink or drugs and causing many problems for police officers.

Another key concern is that if this proposal were to go ahead, police officers would be dragged away from Harrow to go to Wembley, Kilburn or beyond to process these individuals, and criminal investigation department officers would have to attend at one of those police stations to interview them and make sure that they were safe and secure overnight, if necessary. That, to me, is dragging away police officers who should be patrolling Harrow streets and unnecessarily tying them up in work that they should not need to do. Equally, there is a concern that people who have been arrested and put in police cells need to be inspected by police inspectors on a regular basis to make sure that they are safe and secure, and thus in a position to be interviewed. What is being proposed suggests that there will be an attempt to move the CID officers from Harrow to Wembley or Kilburn in order to facilitate all this investigation work and the necessary work of policing.

I therefore ask responsible Ministers to step in and make sure that this proposal bites the dust very quickly so that we do not see a drag-down of police officers and a drag on police time and resources in Harrow, and so that we do not cease to be London’s second safest borough.

It is currently a proposal across London to close certain custody suites. I am obviously concentrating on my own constituency, but my hon. Friend should be clear that a similar proposal might well come forward for his own constituency, which will impact on his own borough of Bromley. We have to be careful about this across London.

I am particularly concerned because I know that when people are arrested in Harrow, at certain times of day it can take almost an hour to get to Wembley or Kilburn police station. Members can imagine a scenario involving violent criminals kicking off in the back of a police van that is dragging policemen or policewomen to another station where they will be tied up for several hours. Resources in Harrow will be severely stretched, and I suspect that there will be proposals for other custody suites to be closed throughout London, which I think would be wrong. We need to make it clear that custody suites should be in the most locally appropriate area, so that criminals can be processed in a humane and orderly fashion rather than transported for huge distances, tying up police resources unnecessarily.

I am sure that a Minister will respond to me in writing, but I hope that the Deputy Leader of the House will take the issue on board as well, so that we can be given an answer. I know that all three Harrow Members are very concerned about this, as are the Harrow public.

On the first question, we are determined that the Olympics will be a great success and that the issues that the hon. Lady referred to will be resolved in good time.

The hon. Lady conveniently glossed over the rebellion among the Labour Members, 26 of whom defied their Whip, so it is clear that the Conservative party is not the only party that has differences on this issue. In my business statement, I announced the business for the first week back, which did not include further progress on the Bill, but on the substantive issue that she raised, it was clear from the vote on Second Reading that a huge majority of the House want to get on with it, with majorities within each of the three major parties voting for reform. She said that we could trust the Labour party, but I have to say that the Labour party was willing the end but not willing the means. Saying before the programme motion was even tabled that Labour Members would vote against it shows a lack of commitment to getting the Bill on to the statute book.

It was equally clear on Tuesday that there was no consensus on the timetable for the Bill, which is why we did not make progress with the programme motion. What we want to do—I say this in response to what the hon. Lady has just said—is to reflect and to allow time for meaningful discussion, including with the Opposition and with other hon. Members, to build a consensus on the best way forward. As I said on Tuesday, we do intend to table a timetable motion for the Bill in the autumn, but, as the House would expect, we want those discussions to take place first before I can give the House any further information.

As for marital relations, I think that relationships within the coalition are much better than relationships within the previous Labour Government. I get on much better with my deputy than the previous Prime Minister got on with Tony Blair. I just say to the hon. Lady, in conclusion, that two parties are working together to put right the mess left behind by the Labour party, which still refused to admit that it got anything wrong.

Under the coalition Government, 10,000 more people suffering from cancer have received treatment as a result of the cancer drugs fund that we introduced. That would not have been possible had we followed the Labour party’s proposals to cut the national health service. May we have a debate on the benefits that the coalition Government have brought to the health service and the further improvements we can bring to cancer research?

The Government believe, and indeed the House believes, that it is wrong that the Government should not be held to account from the middle to end of July until October, as was the practice in the previous Parliament. We believe that it is right that the House should sit in September, so that the Government can be held to account. Figures are in the public domain—I think from last year—showing the extra cost of sitting in September. My view is that it is very difficult to put a price on democracy, that it is right that we should be held to account throughout the year and that we can manage the maintenance of the House within the budget that is available.

Earlier this week, the Prime Minister made an excellent speech about the future strategy for benefits. The key issue that he made clear was that work will always pay but that benefits would be available for those who cannot work. Incredibly, the Labour party opposes a benefit cap and set up, when in government, a huge and complicated system of benefits. May we therefore have a debate on the future strategy for benefits, so that we can pin down, once and for all, where the Labour party stands? [Hon. Members: “Hear, hear.”]

I am very grateful to my hon. Friend. He will have heard my hon. Friends’ reaction to his proposal for a debate, and he may wish to ask the Backbench Business Committee for one. I applaud the speech that the Prime Minister made on Monday. The indications from one of the polls—I think I saw it in today’s paper—is that that speech struck a chord with the vast majority of the population. We have already made progress with universal credit, with housing benefit reform and reforms in respect of disability, but it is right to ask questions as to where we go next. I think that there is an appetite out there for further changes in the direction in which we have already embarked.

The problems experienced on 6 May 2010 did not illustrate a broken politics, as the Deputy Prime Minister suggested, but they do illustrate a need to change the law to make sure that this never happens again. I hope and believe that Members of all parties will recognise that and support new clause 4. Given its cross-party elements and cross-party support for its provisions, I hope that the Deputy Prime Minister and his Government will feel able to fulfil at least one of his promised to his constituents. I conclude on that note and look forward to hearing the Minister’s response.

I am grateful for the opportunity to contribute. I rise with some trepidation to debate “clause 4”, but it nevertheless has my wholehearted support. I want to provide a few anecdotes in support of the new clause. In my view, the issues it deals with are not confined to the last general election, as they have been going on for many years. On the basis of experience of fighting elections in my part of London over 38 years, I know that turnout will double between the opening of the poll and 6 o’clock in the evening and the period after that until the close of the poll.

In my part of the world, many people travel long distances or have small shops that they keep open for quite extended hours. At the conclusion of their work, they travel back and join long queues to seek to exercise their right to vote. This is not confined to one or two polling stations, as it applies to many. This has been a problem for a long time.

The 2004 London mayoral election and the European elections were held on the same day, causing dramatic confusion in polling stations and leading to serious problems, with long queues forming—certainly in my neck of the woods. Some people were confused about what they were voting for, but the need to issue them with large numbers of ballot papers caused extensive delays.

In the London mayoral elections of 2008, the number of Londoners wanting to vote for Boris Johnson as Mayor and to kick out Ken Livingstone was so overwhelming that it led to huge queues in polling stations, particularly in areas where large turnouts were not expected, causing further problems. In the general election of 2010, because of the activities of both political parties—certainly in my constituency—people regularly had to queue for an hour to exercise their votes during the day.

The presiding officer has discretion over what constitutes a polling station. If it is a Portakabin, it is fairly straightforward, but if it is a school the question arises of where the polling station begins and ends—is it the school gates or the school hall? That causes further consternation.

The key point is this, however. When people are keen to go to the polling station to express their views by voting, it is vital for them to be able to get there and to queue for however long it takes for the ballot papers to be issued, and for however long it takes those ahead of them in the queue who have also sought to be there validly before the 10 pm watershed to register their own votes. I can think of nothing more frustrating for someone who has travelled a long distance back from work, has arrived at home, has said “Oh yes, I must go and register my vote”, has reached the polling station at 9.45 pm, and has joined the queue than to be denied his or her vote because the queue is so long, and to be told by the presiding officer “Very sorry; you arrived too late.” We can imagine the reactions of people who have travelled long distances or closed their shops quite late in the day in order to go and vote.

The problem has been raised with me many times in connection with polling stations in north-west London. I think it important for us to set in stone in the Bill that if someone has reached the polling station, validly, before 10 pm and is in the queue, that person’s vote will be recorded. I do not think it acceptable for presiding officers throughout the country to be able to interpret the position in different ways. If a presiding officer says “According to my watch it is 9.59 pm so I shall allow you to vote, although the time is actually 10.10 pm”, that is not a valid way of operating.

It cannot be right that elections could be won or lost on the basis of a presiding officer’s judgment of what the time is. That is clearly not what Parliament wants, or what the people want. What we want is absolute clarity, so that there is the minimum wriggle room for a presiding officer in the interpretation of the rules and the maximum capability for people to register their votes validly in the way that they wish.

Does my hon. Friend agree that presiding officers should be given a certain amount of flexibility when it comes to deciding exactly where their polling station is, and should have enough flexibility to be able to say “In the interests of democracy, I should make this decision”, or does he believe that the legislation should be so prescriptive that it lays down in black and white exactly what should happen? I tend to think that it would be quite good for the presiding officer to have a bit of wriggle room, and to have a say in what should happen when unforeseen circumstances occur.

I ask my hon. Friend to imagine this scenario. A person gets home late, arrives at the polling station, parks in the school car park and dashes through the doors of the school at 9.59 pm, but of course the polling station is in a hall further on. The person then gets lost because the signage is not good enough, or, worse still, is misdirected and goes to the wrong polling station, because there is often more than one in the same building. Whose fault is that? It is the person’s fault, because he or she is the voter.

Such questions are difficult, but what is clear is that the law should say that if the voter has arrived in the polling station, or in the queue at the polling station, his or her vote should be recorded. What should not happen is that a person arrives at the place where the ballot papers are issued, only to be told “I am sorry, but it is one minute past 10 and we have closed the polling station, so you are not allowed to vote”—although the person has been in the polling station and validly queuing for 15 or 20 minutes, or perhaps even half an hour. That is what needs to be clarified. There should be the minimum discretion in that respect, but the maximum discretion for the voter.

I listened carefully to my hon. Friend’s description of the incident that might occur. I should make it clear to the Committee that new clause 4 is not intended to help someone who runs into a polling station at one minute to 10. Each individual has a responsibility to leave enough time in which to find the polling station. The new clause is intended to help people who arrive at the polling station at 10 minutes to 10 thinking that they have plenty of time, but, as a result of some incident that then occurs—there may, for instance, be too many people or bad organisation—the ballot paper is not issued at 10 minutes to 10. I think my hon. Friend would agree that that is quite an important distinction.

I agree. The most important thing is that people who have arrived at the polling station well before the time deadline and have formed a queue and are waiting for their ballot papers to be issued should be allowed to register their vote.

We are not only talking about general elections. In 2014, for example, there will be European and local elections, probably on the same day. There are often multiple elections, and further problems can arise in such circumstances. In a general election, turnout tends to be high, of course, but these problems can occur even in local elections, when turnout is lower. We, as democrats, must seek to ensure that people are given the optimal opportunity to register their votes.

It is often not appreciated that we have huge numbers of differentials in elections, in that different people are entitled to vote in different elections. In the 2010 elections, in my constituency 10% of the voting population were from eastern Europe and were not eligible to vote in the general election but were eligible to vote in the local elections. That caused substantial confusion at certain polling stations, particularly later in the day. People were arguing about whether they should have a ballot paper. That can add to delays in issuing ballot papers to others, so people who have left sufficient time to cast their votes can find that they are not issued with ballot papers. That is fundamentally wrong. I want us to give a strong steer in law to returning officers about what they should do in such circumstances, and there should be the minimum of discretion for interpretation.

Sadly, in the 6 May 2010 elections my constituency was seriously affected by events that were similar to those that unfolded in other constituencies, and people were, understandably, very upset. I am a strong supporter of new clause 4, therefore. As there is cross-party support for it, I hope the Government will agree to add it to the Bill.

Three elections were taking place in Hackney South and Shoreditch on that day. Our elected mayor was up for re-election, and we had the local council elections and the general election. As a result there were three different ballot papers, each of a different type. One required electors to vote for three individuals, the general election was a first-past-the-post election with one vote to be cast, and there was a preferential system for the mayoral elections. That sometimes required some explaining. Hackney has learned lessons from that experience, which I shall discuss later.

The hon. Member for Manchester, Withington (Mr Leech) suggested that general elections should always be held as stand-alone elections. I disagree. Although we are all democrats and are fond, especially in this House, of people voting, we have seen in respect of the timing of the European elections, which are usually held a month after the May elections, that it can be difficult to persuade people that it is in their interests to come out and vote twice in quick succession. There is also a huge additional cost attached to holding elections at separate times when they could be doubled up. There is therefore much sense in holding elections at the same time.

Of the six polling stations that were affected in the borough of Hackney five were in my constituency: the Ann Tayler children’s centre, which experienced some of the worst problems, the Trinity centre, St John the Baptist primary school in Hoxton, the Comet day nursery, and Our Lady and St Joseph Roman Catholic primary school in De Beauvoir. Those polling stations did not have a huge number of electors, however. My hon. Friend the Member for Penistone and Stocksbridge (Angela Smith) suggested some polling stations were over-optimistic and covered a larger number of electors than they could cope with, but that was not the case in Hackney. In my constituency, in each instance the total number was less than 2,500, which falls well within the tolerance levels.

In some polling stations there had been queues at other times of the day, but by about 9 o’clock—and certainly by 9.15 or 9.30—there were serious issues. One extra staff member was deployed at the Ann Tayler centre at 9 pm, where there were particular problems, but, a whole hour before the close of polling, that was not enough to deal with the scale of the difficulty or the queues. That is why I will discuss what Hackney council has done more generally to try to solve this problem.

This is an important issue. My hon. Friend will know that we have increased the entitlement to free education and care for three and four-year-olds to 15 hours a week and extended it to disadvantaged two-year-olds. He will also know that under universal credit—I am delighted to see my right hon. Friend the Secretary of State for Work and Pensions here—there will be greater support for child care when we remove the so-called 16-hour rule and enable those working less than 16 hours a week to access child care.

In a few weeks’ time, London will play host to the Olympics and Paralympics, which we will all celebrate. During the games, it will be the 40th anniversary of the Olympics’ darkest hour when, in 1972, 11 members of the Israeli team were brutally murdered. So far, the Olympic movement has failed to honour their memory or provide closure for their families. Will my right hon. Friend allow a statement to be made to the House on this matter? There is widespread support across the House for a one-minute silence to be held during the games to commemorate those who were murdered.

My hon. Friend raises an important matter in reminding us of the tragedy that took place 40 years ago. I would like to raise his suggestion with my right hon. Friend the Secretary of State for Culture, Olympics, Media and Sport and, possibly, with Lord Coe, who is in charge of the arrangements. Any commemoration involving a period of silence in the House would be a matter for Mr Speaker, who I am sure will read the record of what my hon. Friend has just said.

My hon. Friend raises an important issue. As he will know, we set out our drugs strategy in December 2010, and we are in the process of updating it. We will shortly publish a report on the achievements in the first year of the strategy, and it might be possible to “pin” a debate once the report becomes available. I am grateful to my hon. Friend for having spoken at the symposium this morning.

I am sure my right hon. Friend is aware that last week voter turnout in London was 7% above the national average, and I am sure the whole House will wish to congratulate Mayor Boris Johnson on his re-election and Ken Livingstone on his retirement from front-line politics. Will my right hon. Friend find time for a debate on devolving much more power to the Mayor of London so that Londoners can fully see and feel the benefit of having Boris Johnson as our Mayor?

Without wanting to put too much pressure on my coalition colleagues who sit on the Front Bench with me, I do, of course, congratulate Boris on his re-election, which was achieved with the support of my party and many of my hon. Friends on the Back Benches who worked tirelessly to get him re-elected. We have recently devolved more powers to the Mayor: powers under the Homes and Communities Agency have been transferred to the Greater London Authority; we have abolished the London Development Agency and transferred its activities to the GLA; and we have enabled the Mayor of London to establish a mayoral development corporation to oversee the long-term development of the Olympic park. I hope my hon. Friend will therefore see that we are in the process of devolving more powers to the Mayor of London.

I would be surprised if that had disappeared. I would expect it to be reinvested in the NHS, but I am sure that I can generate a letter from my right hon. Friend the Secretary of State for Health to explain the accounting procedures to which the hon. Lady has just referred and to give her the reassurance that the money that Parliament has voted to the NHS will indeed be applied to the NHS.

During the Easter recess, the Government released £600 million for new primary places across England and Wales. I looked with great interest to see who had got the money— £382 million has gone to London; I know that £30 million has gone to the London borough of Brent, which is extremely welcome—and I looked for the allocation to the London borough of Harrow, only to find that it was zero. I then made a series of phone calls to find out who was responsible, only to discover that the incompetent Harrow council had failed to supply the data, and therefore received no money. Despite many efforts, we still do not have an answer on how much money will be available to provide much-needed primary places in Harrow. Will the Leader of the House offer the House an opportunity of a statement so that we can clear up this matter once and for all?

I cannot offer a statement, but I commend my hon. Friend’s energy in seeking to ensure that the children in his constituency get a square deal at school. There is an issue between the London borough of Harrow and the Department for Education about the school capacity data that Harrow provided to the Department in 2011. That issue is under investigation, and I shall ask my right hon. Friend the Secretary of State for Education to write to my hon. Friend to bring him up to date. I want to assure other colleagues that that will not affect allocations to other local authorities.
