The first decision I took was that the threshold had been passed. I was concerned about interference with the accurate presentation of news and the freedom of the press. The evidence I saw enabled me to say that the threshold had been passed, and to ask Ofcom and the Competition and Markets Authority to look at the matter more broadly. They did that and they took some time to give me a very detailed report, which I further considered. In my letter sent in March, I set out the evidence from that report and my decision that I was minded to send the matter to phase 2 investigation. The letter in which I set out the evidence on which I relied has been published, I believe.

As a former journalist and a former member of the Society of Editors in Scotland, I welcome the Secretary of State’s statement because press freedom is vital in a democracy, as she says. The insidious influence of foreign states has to be protected against, not just in newspapers but, as we have heard, online and in television and radio. Does she agree that the matter is not settled with this step? We have to be continually aware of the danger of foreign interference and the insidious growth of that influence in our media by all means. Will the Government take that on board and continue to monitor the situation on a regular basis?

Of course, the Government always keep matters under review. I can reassure the hon. Member that we have a robust system to deal with interference with press freedom. We had that in the Enterprise Act; my powers as Secretary of State under that Act in relation to interference with the accurate presentation of news and the freedom of the press were clear and robust. I took various decisions at each stage to ensure those matters were fully investigated. The hon. Member can also take reassurance from the fact that the legislation that will be coming back to the House this afternoon will put beyond that doubt, and set out that a foreign state cannot interfere with our newspapers. Every hon. Member who has expressed a view across the Chamber is of the view, which I share, that a foreign state should not be able to control, influence or own a British newspaper.

I am pleased that work has been going on in the hon. Lady’s constituency on these important matters. Of course, through Arts Council funding and through Department for Culture, Media and Sport funding, we support institutions across the country that support the history of, and what is going on in, their local communities, as well as arts across the country.

This is the 900th anniversary of the founding of Edinburgh city and St Giles’ cathedral. Celebrations are planned to mark it, so will the Minister tell us whether the Department is going to be working with the devolved Administration and supporting the local council in celebrating that anniversary? As my right hon. Friend will know, IR35 was brought in to ensure that people doing the same job paid the same tax. I understand that he would like to discuss some issues with me, and I look forward to doing that this afternoon.

TaxWatch UK has just published research showing that on a like-for-like basis, the tax gap—or the money lost every year through unpaid tax—has gone up for two years in a row. That is before we include in the figures the estimated amount lost to error and fraud through the HMRC-administered covid-19 support schemes. The tax gap resulting from fraud is now 45% and stands at £14.4 billion. When will the Government do something about that? They could perhaps create a fraud Minister with the remit of tackling this growing problem, which takes money from other parts of the economy.

The Government are taking a number of steps to tackle fraud, including coronavirus fraud, which the hon. Member mentions. The taxpayer protection taskforce was set up to do specifically that. I will have a cross-governmental meeting this afternoon to understand how we can we work across Departments to tackle fraud.

As the hon. Gentleman will know, a consultation is ongoing, and the Government will be responding to it in due course. I am sure that he will read the report of our response with some interest.

The Institute for Fiscal Studies—which, I am sure, understands the policy—has been critical of it, saying that the windfall tax is too generous and that

“It is hard to see why the government should provide such huge tax subsidies and thereby incentivise even economically unviable projects.”

Why are the Government providing incentives for projects of that sort rather than raising the money that would help out desperate families, and help them to feed their children?

I appreciate it is very important to get a view from the ground as well as to understand what is said by officials. As the Secretary of State has already identified, we are confident in our supplies of PPE, except in relation to coveralls, of which we have a flight coming in from China this week. I do regularly speak to a large number of people in relation to a vast number of issues—from the unions to prison group directors and those who work in the sector—to try to ensure that we get an overall picture of what is happening on the ground.

There is grave concern about the potential transmission of covid-19 among both prisoners and prison staff. Organisations such as the Prison Governors Association, the Howard League and the Prison Reform Trust are all urging the Government to go further and faster in reducing the prison population. Will the Government consider urgently ending overcrowding by releasing prisoners who are on short-term sentences and suspending any new short sentences to slow the spread of covid-19?

As the Secretary of State has outlined we have a many-pronged approach to ensuring that we reduce the headroom in the estate. We are, as the Secretary of State mentioned, following Public Health England advice, which is that we have to reduce the headroom, and we are on track to do that by a variety of means, including release, natural reduction in the population and additional accommodation on our prison estate. That is not all we are looking at, though. The hon. Member mentioned short sentences; we have done a considerable amount of work to ensure that people do not come into prisons unnecessarily. We are looking at people on remand and trying to ensure that those who are on remand and have served their sentence have their court hearing quickly. It is about ensuring that we have good mechanisms in respect of bail and good offers in relation to non-custodial orders. We have a variety of work strands and are looking at all such issues carefully.

We have heard that this incident has caused a great deal of disruption for the judicial system, and the Minister has apologised to staff, but will she also take into account the very many individuals who are awaiting court sentencing and appearances? They have undergone unbelievable stress and gone through a great deal of personal sacrifice and disruption because of this incident, so will she apologise to them and ensure that future investment in the Ministry of Justice ensures that this does not happen again?

The hon. Lady makes an important point. It is of course users who are at the heart of the justice system. Professionals work in the justice system, but they and the system work for justice for individuals. This morning I was at a court that was functioning—I was sitting at a hearing—and of course there is that continuous reminder that we are there to serve people who want to get justice done.

T9. Is the Minister aware of the looming crisis in criminal duty solicitors due to the increasing age profile? Data from the Law Society shows that in five to 10 years there could be insufficient numbers of criminal duty solicitors in many areas. Will the Government take action to address and protect this vital public service?

I am aware of the recent document produced by the Law Society. Of course, it is important that we have professionals at every level, that we have a diverse profession and that we encourage young people to join what is an excellent profession.
