A great many constituents whose families found refuge here in the UK from the holocaust in Europe have reached out to me in the last few weeks to tell me about how they have been personally and directly affected by the ongoing attacks from Hamas in Israel. They would like me to commend my right hon. Friend for the work that he has been doing with our allies to bring peace and stability, and they pose this question: what further efforts can be made to ensure that, once the current threat from Hamas is addressed through Israel’s actions, the evidence is gathered and the perpetrators are identified so that the due process of international law can bring them to justice?

It is important that people act in accordance with international law, that those procedures are followed and, indeed, that Israel takes every precaution to avoid harming civilians. In the meantime, we will ensure that we get humanitarian support into the region. Those efforts are starting to bear fruit, but we must double our efforts.

Like the rest of the country, I have been moved by the heartbreaking tributes from their loved ones. This is an extraordinarily difficult time and every parent’s worst nightmare. The hearts of the whole country are with the families and all those who have lost their lives. The hon. Lady will, I am sure, understand that I cannot comment further at this stage, given that there is an ongoing situation, but the Home Secretary will be making a statement after Prime Minister’s questions.

My constituents in Ickenham and South Harefield benefit enormously from the work of the police based in the nearby Uxbridge police station, which remains open only because of the campaign by the Conservative-led council to stop the Mayor of London closing it down. Does my right hon. Friend agree that, as we invest in more police, those police need good local police stations to work from?

As the right hon. Lady will know, the Prime Minister’s ethics adviser is independent. It will be a matter for him to decide whether he wishes to take further action, in consultation with the Prime Minister. We see this time and again from the Labour party. They call on us to have an independent inquiry. As soon as we announce an independent inquiry, they ask us to pre-empt it. They ask us to have transparency, yet when it comes to transparency from the Labour party, they still have not provided details of the extensive meetings they had with a serving civil servant. It is in the public interest to declare that, and they have still failed to do so.

T5. I have heard from both my local authorities of the challenges that arise when the obligations placed on them by one Government Department may conflict with those from another Department. For example, the Illegal Migration Bill contains provisions regarding modern slavery and education, which may conflict with local authority legal duties under the Children Act 1989 and the Modern Slavery Act 2015. What proposals are there across Government to ensure that joined-up advice is provided, so that such conflicts do not result in difficulties for our public services?

My hon. Friend raises an important point. We have a number of structures in Government to ensure that Departments work effectively together. In relation to parliamentary legislation, there is the Parliamentary Business and Legislation Cabinet Committee, which is led by the Leader of the House. There is also the Economic and Domestic Affairs Secretariat, which ensures co-ordination between different Departments, and those are long-established practices.

We have enormous respect and gratitude for all our public sector workers, especially those in the NHS. That is why we have backed them with not just record funding, but record investment in more doctors and nurses, with 15,000 more doctors, 30,000 more nurses and more lifesaving equipment that will help them to do their jobs. We continue to want to engage constructively in dialogue with them.

Q11.   Ruislip, Northwood and Pinner has a great many car-dependent older and disabled constituents, many of whom are horrified to read that the Mayor of London may have manipulated the outcome of his own consultation in order to impose a unwanted £12.50 daily charge every time they go to a medical appointment or attend hospital. Does my right hon. Friend agree that any further roll-out of the ultra low emission zone should be paused until those matters have been fully investigated?

My hon. Friend rightly points out that transport in London is devolved to the Labour Mayor of London. It is disappointing that the Mayor, backed by the Leader of the Opposition, is choosing not to listen to the public and expanding the zone against the overwhelming views of residents and businesses. I urge the Mayor to reconsider properly and to respond to those serious concerns.

We have in fact safely settled more than 23,000 people from Afghanistan in this country. The hon. Member talks about safe and legal routes and actually, in the last year, we issued more humanitarian visas than in any other year since the second world war. That is the strength and depth of our compassion, and that is what we will always do, but we cannot have that compassion and generosity exploited by people who break the rules. There is nothing fair about that, and it does nothing to help the people we really need to target. That is what we will do.

I commend the Prime Minister on the approach that he has outlined today. Are there plans to examine the processes used by other states who are signatories to the European convention on human rights that enable them to be so much more robust in dealing with these issues within the law? Will he commit to working with those countries to develop safe and legal routes so that together we can ensure that that robust approach applies in the United Kingdom just as it does in those other countries?

My hon. Friend asks an excellent question and the answer is yes: that is what we have done over the past few weeks and what we will continue to do, and our Albania deal builds on exactly that learning. But where we can learn from other countries about how to do this faster and better, with a higher rejection rate, that is exactly what we want to achieve. With his support, I know we can do it.

It is a pleasure, as always, to serve under your chairmanship, Mr Evans, as we discuss the Bill this afternoon.

I wish to say at the outset that I am speaking very much in support of the Government’s position on the Bill. It seems to me that we are dealing with a very complex, sensitive and fluid situation. I recognise that we have heard from everybody, from the former Labour Prime Minister, Tony Blair, right through to business organisations on the ground, all of whom recognise that there is no clear right or wrong to this situation at the moment, that we need to take forward this debate in a constructive way, and that we need to reach solutions that continue to support stability and the economic development of Northern Ireland as part of the United Kingdom.

My attention was particularly drawn i to amendment 51, because of the points that it illustrates about referring disputed matters to the UK-EU Joint Committee, which is envisaged as part of the withdrawal agreement. That highlights that there remains a number of avenues still to explore, and it is with a sense of optimism that I look at those avenues. It is clear that the political situation that we face today, with the departure of one Prime Minister and a new Prime Minister to be elected, creates an opportunity for a reset in the relationships and the negotiations that are taking place with the European Union on this issue. It was clear from the Dispatch Box when we first debated the Bill that it remained the Government’s preferred outcome that negotiations would result in changes that would address fully the issues of concern to all communities across Northern Ireland and, indeed, to those in my own constituency, whose businesses are involved in trade with the UK single market and the European single market. They are watching closely at what the outcomes of this will be because of the implications for other parts of our international trade in future.

The success that we have seen in Northern Ireland—in particular its ability to attract inward investment to drive that economic growth, to be the other region of the United Kingdom, outside of London, that is really bouncing back strongly—demonstrates the strength that there is in that economy and that community, and that it deserves the support and attention of this House to a greater degree perhaps than it has enjoyed in the past. The reality is that the protocol that we are discussing today is clearly our Prime Minister’s protocol, and we now have an opportunity to revisit those negotiations and find a new way forward.

I wish to address the point that was made strongly by the right hon. Member for Lagan Valley (Sir Jeffrey M. Donaldson) in his eloquent contribution around the issue of a democratic deficit. There was one thing that piqued my attention. I have served as a member of the Committee of the Regions, alongside cross-party members from Northern Ireland, such as Jonathan Bell, Arnold Hatch, Stewart Dickson—all of whom were part of a process that was set up, as an EU member state, whereby the elected politicians from different parts of the European Union undertook a supervisory and oversight role on the operations of the European Union and the single market.

I spent a good part of my life in the Centre Borschette in Brussels—the conference centre in which the European Union undertook its negotiations and discussions about the development of the single market. I was there to talk about education. I was sharing that building with people who were there to deal with anything from veterinary products, to agriculture and to any other conceivable economic area of interest. It is clear that, now that we have left the European Union, we need to make sure that we are putting in place an equivalent degree of oversight so that everybody involved in the community has the opportunity to play an appropriate part in the development of these markets. It is clear from the eloquent contributions that we have heard from a number of Members on the Benches opposite that there remains a very live concern in Northern Ireland about whether the arrangements currently in place allow for that to happen.

Even with the results of the recent election, where I recognise that the majority of people in Northern Ireland voted for parties that were in favour of the protocol, it is clear that the essence of the peace and stability that supports that economic development is that everybody has the opportunity to be part of that discussion. We know that that has not always been done as fully as it should have been in the past, and as we debate the Bill in this Committee we have the opportunity to demonstrate our commitment to ensuring that that does happen in future.

It is also important to recognise, when we look at the important progress that Northern Ireland is making in its economic development and in bouncing back from the covid pandemic, that the European Union is making a reasonable point about the need to ensure that we carry out the relevant checks on goods and products that are traded in and out of that single market—a point that we have an equivalence for in our own United Kingdom single market. There is a lot of history to that. The United Kingdom has historically been notorious, as a member of the single market, for not carrying out the checks on goods and services that we were committed to carrying out as part of that single market.

Indeed, the United Kingdom was significantly fined for having failed to carry out those checks. I know that there are businesses in my constituency trading in goods and services that have seen their ability to do so undercut when the integrity of that single market has been damaged by our failure to carry out those checks. That failure means that we have, for example, counterfeit car parts being brought into the United Kingdom and traded—not only putting people’s lives and wellbeing at risk, but damaging the economic prospects of those businesses.

As we take those negotiations forward in a constructive spirit, while we are rightly determined to protect the integrity of the UK, it is absolutely right that we also recognise that the United Kingdom has not always been as good at this as we should have been. The constructive partnership with the European Union means that we must recognise that and show our commitment to ensuring that those checks and standards will be carried out in future in a way that we have not always done in the past. It may well be that the joint committee referred to in amendment 51 will play some role in ensuring that, as negotiations progress and those matters are taken to a lower level, there will be an opportunity to drive forward to reach agreements.

I will finish where I started. The opportunity of a change of leadership is that it creates some scope for a reset in the relationship that has been clearly described at the Dispatch Box as the Government’s preferred route for achieving a better outcome. I entirely support the Government in that objective. We have already heard intimations from some of our partners across the European Union that, regardless of what they think about the merits of any individual, that reset is the chance for a fresh start.

I hope the outcome will be that we reach that negotiation without any of the powers that have been referred to at the Dispatch Box and that are causing concern ever having to come into play, exactly as we saw with the United Kingdom Internal Market Act 2020. The priority for this Committee, for Members and for my constituents whose trading interests are strongly affected by this Bill is that we ensure that we respect the complexity of the politics of Northern Ireland, to which we have often paid far too little attention in this House. We must support all our colleagues in achieving a deal that they can live with, one that will continue to support the stability and economic development of both the Republic of Ireland, our ally, and Northern Ireland, which is part of the United Kingdom.

This afternoon’s amendments focus on the disapplication of the protocol and the extravagant powers that the Government hope to grant themselves. Our amendments, consistent with our amendments tabled on other days—I think we are on day 712 of this Bill—seek to balance and, where necessary, curtail those powers, to ensure that Ministers have due regard for the views and the needs of all the people in Northern Ireland and their elected representatives.

Through amendment 49, we also propose to formalise the safeguarding of the Good Friday agreement. It is referenced just once in this Bill, where I believe it is being used as an amulet to defend against repudiation of an international treaty. We are told repeatedly, although it does not reflect the understanding of the agreement that many of us have, that this Bill is about protection of the Good Friday agreement, so it is difficult to see why codifying that is being so forcefully rejected. As a lifelong and committed follower of John Hume, I am always very pleased when his ideas get a new airing and a new audience. However, it is frustrating when the concepts and ideas he spent his life developing and persuading Northern Ireland to adopt—many people took a lot longer than others to finally adopt those views, while we all seemed to happily operate in this framework—are misrepresented and distorted, as they have been at some stages of this debate. John Hume argued and finally persuaded, through the Good Friday agreement, which has enormous consent in Northern Ireland and is sovereign in Northern Ireland, that consent should rest on the will of the majority of people in Northern Ireland. Crucially, he framed that within the architecture and the institutions of the three-stranded approach in the agreement, which explicitly saw Ireland’s and the UK’s joint membership of the EU as underpinning that, and underpinning the relationships east-west and north-south, regardless of Northern Ireland’s constitutional settlement.

The reason that some DWP offices will not be needed is that unemployment did not rise in the way that was anticipated. We have the lowest level of unemployment in this country since 1974, and the highest number of people in payroll work, and it is only right that the estate of DWP meets the requirements of the DWP. We get huge efficiencies by implementing technology better. That has become clear in many Government activities. Labour party members always want to keep people on the payroll and then they do not want them to go into work: they either want to be on the picket lines helping them to strike, or they want to have them working at home.

T7. The two local authorities that serve my constituents—Hillingdon and Harrow—have shared with me how they quantify the savings from efficiency programmes, which helps to mitigate my constituents’ council tax and also to reinvest in frontline services. Can my right hon. Friend share with me what approach central Government are taking to demonstrate how savings from efficiency are helping to keep taxes down and focus money on the frontline?

Again, this is a very important point to raise. Central Government—the Cabinet Office’s Crown Commercial Service—is saving into the billions of pounds across Government, which is money that is then available for Departments. That saves those Department’s budgets and ensures more efficient procurement. We are also cracking down on fraud. I am looking forward to the launch of the public sector fraud authority, which hopes to be able to save £180 million in the first year of its operation.

I thank the hon. Lady for the opportunity to say that it was not the result of litigation that addressed the problems with the Worboys case. If she wants to look after victims in such cases, the Labour party should join us in supporting not just the Bill of Rights but our parole reforms, which will make sure that dangerous offenders are not released and that we protect the public.

Q13.   My constituent Joel Lindop has suffered the abduction of his young children to Poland. His is one of many families in the UK who go through a similar experience every year. Despite repeated judgments in his favour in the courts in Poland, he has been unable to persuade the Polish authorities to fulfil their obligations under international law and return those children to their family. Will my right hon. Friend intercede so that my constituent, and the many other families who face this challenge, can ensure that their children are returned safely and in a timely fashion in the future?

I cannot imagine how appalling that situation must be for any parent to find themselves in. My hon. Friend will know that we are committed to the 1980 Hague convention on child abduction, which provides a mechanism. He is right that that has to be driven through the courts. That is not something that we can directly interfere in, but I will speak to the Foreign Office and see whether there is anything further that Ministers can properly do to support my hon. Friend’s constituent.

May I give the hon. Member some reassurance? First, the Human Rights Act is a protected enactment and a precise example of UK-wide application. I have met the Justice Minister of Ukraine, and I will tell the hon. Member what he said. He said “Thank you” from the bottom of his heart for everything that this country has done on sanctions, for our support for Ukraine’s military and for the role that we are playing, alongside the Attorney General, in supporting the International Criminal Court prosecution and investigations on the ground in Ukraine to hold the commission of war crimes in Ukraine and hold those responsible to account.

My constituent Mr Lindop, who is trying to recover his kidnapped children from Poland, will be one of many who will be pleased to hear the Government’s continued determination to uphold these international standards.

When I visited the European Court of Human Rights last week, I heard from the UK judge, who was interviewed for his post by Members of this House, that the UK continues to have the lowest number of cases per capita referred to the Court and the lowest number of cases per capita to go against it of any country that is a member of the convention, and that our commitment to upholding the rule of law provides enormous moral authority for our international leadership role. With that in mind, will my right hon. Friend confirm once again that, with this new Bill of Rights, the UK will continue to uphold the highest possible standards of human rights and continue to be an example to other member states?

I thank my hon. Friend for the way in which he expressed and articulated his point. He is absolutely right. People talk about the UK’s record and, of course, we have one of the highest levels of compliance with the ECHR compared with many of our European friends and partners. However, rarely but on occasion, there will be moments of mission creep where the goalposts shift. Prisoner voting was an example where we said, “Actually, that is not something that Parliament would accept.” I was the Justice Minister in 2015 who went to the Committee of Ministers and said, “We believe in staying in the European convention, but we feel that the ruling is wrong on principle. We are not going to give prisoners the vote.” We will maintain our high standards of compliance, but when it comes down to it, the final word must stay with this House on critical issues of national importance.

COP26 was one of the first such conferences to have a significant private sector presence, as well as key corporate commitments to tackling climate change. For example, more than 7,000 international companies have signed up to the Race to Zero campaign, committing them to reach net zero by 2050 at the latest.

My hon. Friend raises an important point, and her beautiful constituency is well worth a visit. She makes a vital point about rooftop solar, and she will know from the energy security strategy that our plan for rooftop solar is to radically simplify planning processes, with a consultation on relevant permitted development rights, to help support the deployment of rooftop solar on commercial premises. We will also consider the best way to make use of public sector roofs.

Local energy companies are often well placed to support small and medium-sized enterprises with the transition to net zero. Local authorities, with their insight into local opportunities for things such as solar, are best placed to help with that. What assessment has the COP26 President made of the opportunities that that model may afford?

My hon. Friend is right to highlight the role of local energy companies in helping the transition to net zero through the provision of renewable energy. Close to my constituency we have Reading Hydro, a community-financed, built and operated hydro plant that supplies renewable electricity to local businesses. The Minister for Energy, Clean Growth and Climate Change and I would be happy to meet him to discuss this matter further.
