I am glad that the hon. Gentleman took the opportunity to say that. Having read the Hansard record of the first debate, I know how many people spoke in it and that the intentions behind the Bill were widely supported across the House.

When young people are in the space that encompasses both their education and their employment, it is important that there is clarity about what the responsibilities are. In the area of T-levels—an educational environment, but with very much a work focus—it is important that everyone understands and that independent learning providers realise that the expectations of them are exactly the same as they are for further education providers.

I think this is a wonderful Bill. For those of us who have been touched by and blessed with close family members who are on the autistic spectrum, the underlying challenges and social issues that young people face when they go through the school system are still there at 16 to 19. We have to safeguard the interests of children who are special and unique, but who have challenges in their lives. Training has to be adapted, whether with regard to a T-level or a more academic subject. Whatever training is provided, we need to ensure we have a system that safeguards those unique qualities to make sure that everybody can succeed. That is why I think this Bill is so worthwhile, and from the bottom of my heart I congratulate the hon. Member for City of Durham.

I could not agree more. It is important that children and young people with autism and the particular vulnerabilities that they face are not left out of our discussions. It is absolutely right that they need to be safeguarded. That is one reason that there is such support for the Bill.

While this is a technical change, it is of real importance, because specifying and putting front and centre that safeguarding duty is absolutely crucial. We all know that ignorance of the law is not a defence in law, but making sure that fewer employers are ignorant is one of our responsibilities in this place. I think this Bill will achieve that. I congratulate my hon. Friend the Member for City of Durham on introducing the Bill and I am glad that there seems to be such widespread support for it.

In practice, the terms of the clauses mean that all Government-funded providers of post-16 education must make arrangements to promote and safeguard the welfare of children, and to have regard to the same information on how to prevent and spot abuse, neglect or harm. That means that providers have policies and processes in place to ensure that harms can be identified and, if they occur, dealt with. In turn, that means that there is a clear and rigorous process established to investigate and address any issues raised by staff, students or parents, and that it is all up to date and can tackle any new or emerging harm.

If I may come back to the definition of welfare and safeguarding, one thing about the welfare of children in education is how their needs are protected by the education provider. An autistic child may need one-on-one support or a certain environment that enables them to learn and to address their challenges. May I confirm that the welfare of the child in the educational setting and the requirement that that puts on providers to seek the best way to ensure that such children can succeed are encompassed in the spirit, if not the wording, of the Bill?

My hon. Friend makes a very good point. The “Keeping Children Safe in Education” guidance sets out the type of consideration that providers need to show and goes into a great deal of information about special educational needs and disability. The Bill extends safeguarding duties that already apply to schools and colleges, including special schools and colleges of special educational needs, to new settings. The welfare and needs of the child are at the centre of that.

I am sure that all hon. Members wish to join me in thanking the providers of post-16 education up and down the country who work every day to protect our children. It is vital that parents and students have confidence that their education provider is doing all that they can, and should, to provide a safe, supportive learning environment that protects those students from harm. Providers must clearly understand what is expected of them, and having all the information in one place enables providers to get the help that they need quickly. That is why I strongly believe that the Bill will deliver consistency and simplicity to our diverse further education sector.

I thank all Members present today for their openness and constructive comments. I am confident from our discussions that we have the right foundations on which to progress the Bill. I am grateful to all Members present for taking the time to attend and contribute to this important debate. I pass on my gratitude in particular to the hon. Member for City of Durham for bringing this important issue to light and ensuring that the Bill will be enacted. I thank her very much for her support, and I commend the Bill to the Committee.

I thank the hon. Member for that intervention, and I concur. There is a school uniform manufacturer in my constituency called Buccaneer, which certainly provides good-quality and very competitive products for the school environment. Its frustration is the limited access that it has in the marketplace at the moment.

Compounding Lisa’s case was the fact that pupils had to buy pullovers and polos with their house colours embroidered on them. That limits the ability of families and friends to use hand-me-downs. Lisa found that many parents she knew, who were often unwilling to discuss the financial difficulties, were worried about how they would afford the school uniforms in the coming school year. That indignity, as I am sure Members across the Committee Room would agree, needs to end.

The current guidance encourages schools to keep compulsory branded items to a minimum, but the issue of excess branding has dominated my inbox since I announced my intention to introduce this Bill. I have come to strongly believe that no more than two branded items are necessary for a school to establish a sense of identity, and I would like to see that included in the guidance. Other elements could, for example, be sewn on or provided as badges. I look forward to the Minister’s response on that issue, as I know that it is not straightforward.

Another key element of the guidance will be how it deals with the issue of single suppliers and the tendering process. The current Department for Education guidance stipulates that exclusive single-supplier contracts should be avoided unless regular, transparent tendering competitions are run whereby more than one supplier can compete for the contract and governing bodies can secure the best value for parents and carers. In too many cases—Members will be familiar with this—that simply is not happening. That is shutting good, competitive manufacturers such as—I will mention it again—Buccaneer in my constituency out of the marketplace. That is limiting choice and increasing costs.

One parent from Bristol emailed me to say that although several suppliers sell a brand of trousers that his son’s primary school requires, the school stated just this summer that the trousers can be purchased only from one particular supplier and must now be embroidered by that supplier to prove where they were purchased. That comes alongside the need for a branded polo shirt and sweatshirt, which, again, can be purchased only from a single supplier. I do not see how this arrangement can stand up to competition laws. Indeed, the Competition and Markets Authority has contacted me regarding the Bill, having long been concerned about the practices of many schools.

Several avenues have been suggested by the Department for Education. One is to do away with single-supplier arrangements completely to ensure competition. Another option, based on the current guidance, is to ensure that regular, transparent tendering processes take place. That part of the statutory guidance should be looked at very carefully. Despite the clear guidance from the Department for Education and the warnings from the CMA, some schools continue with utterly opaque practices that do not ensure value for money or easy availability of uniform for parents. Without clear directions, these practices will simply continue.

Finally, one aspect of the guidance that I know the Minister believes in very strongly is around sustainability. We should encourage people to reuse uniforms and suppliers to make lasting, sustainable clothing. However, I do not want that approach to become an alternative to making sure that school uniforms are affordable first hand to pupils. I have been contacted by many volunteers across the country who run excellent uniform banks in their local areas. I respect their work hugely, but they themselves will say that parents should not have to rely on charity to afford school uniforms, and they strongly support the measures outlined in the Bill. None the less, schools should be required to provide parents with regularly updated information about second-hand suppliers, school swap shops and clothing banks, as well as information on locally available grants. I would like to see that requirement included in the statutory guidance.

I look forward to hearing the Minister’s reply and other Members’ contributions, and to working with everyone here and the Department over the coming months.

I agree with every word that the hon. Member for Weaver Vale said. However, I am afraid that the lawyer in me is coming out with respect to some parts of what has been said.

One is affordability. From what I understand, although the guidance will be provided by the Government, affordability will still be decided by the governing body. If, for example, a parent or whoever it may be believes that the governing body is not acting in line with Government guidance regarding affordability, in that the uniform is still too expensive for many parents, I would be interested to hear how they could challenge the decision of the governing body.

I welcome the hon. Member’s comments regarding affordability, but how do we define it? How does a governing body define it? Is it in respect of the mean income of the parents in the school? Is it in respect of the lowest income of parents in the school? A lot of my constituents and a lot of his constituents are on state benefits, so affordability for them is very different from what it is for parents on higher incomes.

However, those are just questions. I congratulate the hon. Member on the Bill, which is excellent, and I was glad, like my hon. Friend the Member for Aylesbury, to be there on Second Reading.

Diolch, Ms Nokes. It is an honour to serve under your chairship. It is also an honour to be on this Bill Committee, and I pay tribute to the fantastic work that my hon. Friend the Member for Weaver Vale has done on an issue that he has advocated for passionately for a long time.

The cost of school uniforms is a huge issue for many families across the UK, and it is vital that the UK Government are committed to producing statutory guidance for families in England, which will allow them greater choice about where they can buy their children’s uniform.

Members may wonder why I, as a Welsh MP, would want to be involved in a Bill Committee on a topic that is so clearly devolved to our fantastic Welsh Labour Government. As you will know, Ms Nokes, I am nothing if not persistent in my ambition to shamelessly support the work of the Welsh Labour Government at any opportunity. Members may have heard the tried and tested phrase, “Where Wales leads, England follows.” The Welsh Government published statutory guidance to make school uniforms more affordable, accessible and gender-neutral more than a year ago, which is a prime example of that very accurate phrase in action.

Governing bodies of schools in Wales are now expected to consider ways of keeping down the cost of uniforms. The Welsh Government’s pupil deprivation grant, plus additional school uniform guidance, are designed to help reduce the burden on families so that children can focus on fulfilling their potential at school. The guidelines include stipulating the basic items and colours, but not styles, which allows parents to buy items of uniform from more than one outlet. The Department for Education must afford parents in England the same flexibility, and affordability must be a top priority when setting uniform policy.

I welcome the Bill. The hon. Member for Weaver Vale (Mike Amesbury) and I met two or three weeks ago in a television studio where we were on a programme together. Much like my hon. Friend the Member for Thirsk and Malton (Kevin Hollinrake) , the hon. Gentleman is such a nice man that I think he could persuade me of most things, but he was certainly an articulate advocate for this very important issue when we discussed it in the green room at the television studio, and he has been so again today. I am very proud to come here today, as I said I would, and support him and the Bill.

I will not repeat all the reasons why uniform is a good thing. We have heard lots of reasons so far. I am stood here today because a constituent came to me and said, “James, we have an issue. My daughter, who is unemployed through no fault of her own, has two children at high school in your seat. She is facing a cost of over £300 in respect of the clothing and sporting equipment for her children to go to school.” It was not a case of affordability or an issue for debate: my constituent’s daughter simply did not have the money to provide the uniform that the school in my constituency required her children to have to go to school in the first place. I made inquiries with the school. It is a good school, but it did not have any procedures in place to assist with the costs. I went to my local authority, which also did not have any procedures in place to assist with the cost. It seemed to me that that was a completely unacceptable situation. It is not a question of one person or 5,000. The interests of the one are just as important as the interests of the 5,000 who are affected by something.

The Bill is welcome. I think at its heart is a very simple message. It would give a clear signal to school governing bodies that uniforms must be affordable: how on earth can anyone argue with that? Local authorities are not private businesses, they are state organisations, and they need to provide the best means by which our children can thrive and succeed. Discrimination should not happen as a result of what they have to wear, their background or their parents’ income.

am a chair of governors at a nursery school, so we do not have some of the problems we have heard about today, but it is in extremely deprived area of my seat. We have a wide catchment area, but many parents at my school could not afford the prices that are being charged for uniforms, and I do not want them to be penalised for that.

This is a simple but excellent Bill that will help and assist in a positive way. But there are other things we should take away from this debate. We should not simply stop here, and as MPs we should work with our local authorities and encourage our schools. Some schools in my area are fantastic and help their pupils through various payment plans and other ways of affording uniform, but we should try to work with our local authorities to ensure that all of them have some financial support in place for constituents, like mine, who are not in a position to send their children to school because they cannot afford the uniform.

I agree. T-levels are an extremely important part of our education system. They will be rolled out a lot more in the coming years. In fact, I was about to cover T-levels in the next part of my speech; the hon. Member read my mind.

As New College Durham will be one of the first colleges to provide T-levels from September, this is of vital importance to my constituents—I am sure it is to the hon. Member’s constituents, too, and to those all over the country. However, the legal safeguarding duty that protects T-level students will vary, depending on the provider that the student chooses. As MPs, we have a duty to ensure that safeguarding laws apply to all children equally. That is not currently the case. I ask hon. Members for their support to help me to fix this loophole in the law.

My Bill would correct the existing inconsistencies in safeguarding arrangements by extending the legal duty to cover all publicly funded providers of post-16 education. This will directly impose legal safeguarding on 16-to-19 academies, and make the Secretary of State for Education directly accountable for ensuring that all funding agreements with specialist post-16 institutions and independent providers include proper safeguarding duties. The Secretary of State will also be directly responsible for ensuring that funding agreements with apprenticeship and T-level providers include safeguarding duties. This is especially important, because there will be 113 new T-level providers over the next two years, but this expansion can only happen safely if the right safeguarding duties are in place.

These issues are not party political. Across England, the Bill will place safeguarding duties on an estimated 30 16-to-19 academies, 100 specialist post-16 providers and 1,000 independent providers. The Bill will help to ensure that all young people have the same safeguards and protections under the law.

I congratulate the hon. Lady on her excellent Bill, which I am sure my colleagues fully support. I am passionate about ensuring equality of opportunity after the age of 16, as well as before. Children with special educational needs or on the autistic spectrum do not stop having safeguarding issues at the age of 16. Does she agree that these proposals are excellent for equalising opportunity and ensuring that support is in place for further education, so that everybody has the chance to succeed?

I totally agree, and that is one of the reasons that this Bill is so important. There are likely to be more children and young people—some who are the most vulnerable in our society—who do not go down the academic route, but pursue the new T-levels in some of our colleges. The hon. Member has made a really important point, and it is why we really need to pass the Bill.

My Bill will ensure that all young people have the same safeguards and protections under the law, regardless of which education or training provider they choose. I believe that safeguarding responsibilities are too important not to be protected by the law, and I hope that the House will join me in safeguarding our young people and giving parents the peace of mind that they deserve.

T10. In my constituency of Bury North, we need to strengthen specialist mainstream provision for primary-age children with autistic spectrum conditions and children with social, emotional and mental health needs. Will the Secretary of State or the relevant Minister agree to meet me and representatives of Bury Metropolitan Borough Council to discuss how we can fund two new bases to provide much-needed support for some of the most vulnerable pupils in my town?

I thank my hon. Friend for his concern for children with autism and social, emotional and mental health needs. We do understand that there can be challenges for these children in achieving their potential in education, although the vast majority of them go to mainstream schools. Specialist bases within the schools can be a help. We have invested £365 million through the special provision capital fund. I am very happy to meet him to discuss the situation in Bury.

Thank you very much, Madam Deputy Speaker. My seat of Bury North is made up of the townships of Ramsbottom, Bury and Tottington, and we are blessed with brilliant teachers, teaching assistants and other professionals who support all our children through their educational journeys. But we must do everything to ensure that children from the most disadvantaged backgrounds and those with special educational needs have the best chance to thrive and succeed throughout their lives.

In my maiden speech, I will highlight my own experiences of outstanding educational practice by nurseries, schools and further education providers in my constituency. It has been an honour to serve for the past six years as chair of governors at Bury North’s only state nursery school, Hoyle Nursery School. We are situated in one of the most deprived wards in the borough of Bury, and most pupils come from deprived and disadvantaged backgrounds. They have limited life experience and on entry to the school most children are significantly below the expected developmental level for their age group. However, in the past four years, we have had two outstanding ratings from Ofsted, which is a tribute to the leadership of Val Kay—it is an honour to mention her name in this place; sadly, she passed away earlier this year—and the current headteacher, Rachel. I will quote from the most recent inspection report:

“Children get off to a flying start at this outstanding school. Staff…want the very best for each of the children. They believe that there is no limit to what children are capable of achieving.”

What better statement on education could one have?

A bespoke curriculum is put in place to ensure pupils are on track and ready for the next stage of their learning. We have a specialist special educational needs unit and fully inclusive educational provision to ensure there are no barriers to progress, no matter what issues the children have. I was going to say that no matter what their background, children make good progress at Hoyle Nursery School, but they do not; they make amazing progress, including the much-cherished pupils with special educational needs.

I am also a governor at Springside Primary School, which is another fantastic school in my constituency. Like many schools, Springside has had its issues, but following our recent Ofsted inspection we have moved from “requires improvement” to “good”. It is a good school, delivering good education to children in my area. That has been achieved by concentrating on an inclusive curriculum, supporting the developmental goals of all children and providing a bespoke curriculum for SEN pupils to thrive and succeed. I am proud to be associated with the school.

I will also highlight Bury College in my constituency. Last Friday, together with the Minister for the Northern Powerhouse and Local Growth, my right hon. Friend the Member for Rossendale and Darwen (Jake Berry), and my hon. Friend the Member for Bury South (Christian Wakeford), I went to the college to support the proposed new £6.74 million health, innovation, science, maths, engineering and technology centre. The proposal is supported by £2.25 million from the Government growth deal fund and will provide a high-quality educational facility, delivering training and skills to equip young people in my constituency and the wider area to succeed in their working lives, specifically in careers in the NHS. It is a fantastic project and I thank the Minister for his input into it. I want to take every opportunity to praise those who are doing everything possible to improve the lives of the people of Bury North, including the Minister, who said:

“I think it’s an extraordinary story of ambition by the college and its leaders but also a partnership between the college and Government investing in the future of young people across this region.”

As the Member for Bury North, I will do all I can to continue to support all schools and educational providers in my constituency to deliver an outstanding educational journey, providing all Bury youngsters with the life skills and qualifications they need to thrive during their working lives. I should also say that we have many fantastic private sector nursery providers who are delivering outstanding educational provision.

My predecessor, James Frith, served on the Select Committee on Education in the last Parliament and was a vocal advocate for improvements to the education system. I have known James for many years and we both served as councillors together in Bury. I wish to pay tribute to his formidable campaigning skills and thank him for the courteous way he behaved towards me in the general election campaign. He is a good man; I wish him and his family well for the future.

It would be remiss of any Bury MP not to talk about the disgraceful circumstances that have led to Bury football club losing its football league status this season. Some 135 years of history and tradition have been ignored by the football authorities. The Football Association and the English Football League should prioritise the fans of clubs, who are the lifeblood of their existence. Thousands of people in my constituency continue to see Bury football club and its Gigg Lane home as central to our town’s identity. The club’s current predicament has impacted on local businesses and the wider economy, but more than that it has increased social isolation for those I have met and spoken to who have long supported their hometown club—some for 70 years—and now no longer see the friends they have made over a lifetime.

I pay tribute to everyone in Bury and elsewhere who is fighting to ensure that football returns to Gigg Lane, and I hope all Members in this House support the campaign. I will work together with others to ensure that the interests of football fans are properly defended by the football authorities and that football fans are not penalised due to the unscrupulous actions of owners. Let me quote my hon. Friend the Member for Folkestone and Hythe (Damian Collins), in his role as Chairman of the Digital, Culture, Media and Sport Committee. Talking about Bury football club, he said:

“From the evidence we have received, we believe that the EFL’s failure to enforce its own rules and regulations both prior to and following”

the current chairman’s

“takeover of the club contributed to the problems that ultimately led to Bury’s expulsion.”

What an indictment that is.

Like all other Members, many other issues impact on my constituency. Due to the time, I shall comment on only three: first, I will continue to campaign to protect the green belt in my constituency; secondly, I will work with stakeholders to improve bus services, specifically the much-needed direct link between Ramsbottom in the north of my constituency and Manchester city centre; and thirdly, I will speak up for my Kashmiri constituents, who are concerned about human rights abuses in Kashmir.

It is the honour of my life to be given the opportunity to represent the residents of Bury North. I am delighted that Bury has elected two Conservative Members of Parliament for the first time since 1992. Although my hon. Friend the Member for Bury South is not here, I am sure we will make a formidable team, speaking on behalf of our borough. I have been a councillor in my constituency for more than seven years and a partner in a small business based in Bury, where I have worked for the past 12 years. I spent nine of those years as a criminal defence legal aid solicitor, representing the most vulnerable before Bury magistrates court.

We have touched on those from disadvantaged backgrounds and those with special educational needs, but I wish very briefly to mention Mathew. I began representing Mathew in court when he was 12 years of age. He was a young man from a terrible background, but he had more talent in his finger than I have in my body. At 12 years of age, he gave the best mitigation in a court room that I have ever heard. For seven years, I tried to keep him out of prison and, ultimately, I did not succeed. It is one of the great indictments of our society that, if Mathew had been born to a middle-class couple, he would be stood where I am now. We must do everything to make sure that Mathews do not fall through the net.

In conclusion, I pay tribute to my wife Joanne for her support and selflessness, which has allowed me to be here, and to everyone else who has supported me. For many years, I have played cricket, spectacularly badly, for Brooksbottom cricket club in my constituency. I urge the parliamentary cricket team to come to Brooksbottom to test the wicket out—

Yes. I have loved cricket since being a young boy, but have not had the talent to match my aspiration. Over all the years I have played for Brooksbottom, I have not yet scored 50—after 10 years. I will continue to strive. The joy of being part of a team, working to a common goal and never giving up may be an apt description of my cricket, but I hope it is also a characteristic of my representation of my constituency.

I have one final secret that I would like to let you in on, Madam Deputy Speaker. In Bury North we have the finest football coach in this country. He is called Danny Grundy and he is the manager of Walshaw Wildcats under 8s. Above all else, I look forward to watching them on Saturday in the top-of-the-table clash with Shawside.
