Public services are on the verge of collapse, the gap between rich and poor has widened, and we are slipping back into the Victorian era. Food bank use is at an all-time high, and workers have not had a decent pay rise in 15 years. But we are not here today to talk about those things—in fact, we are barely ever here to talk about them in any meaningful way. We are here to legislate on the dog-whistle, fantasist policies of the Conservative party, who are electioneering when they should be governing, not offering any real solutions to problems and attempting to divert attention from their own failings as a Government. They are wasting the time of this House and squandering the good will of the people of this country.

We keep going round and round on this matter. Our Supreme Court has ruled on it: it found Rwanda to be unsafe, a ruling that was based on evidence. Legislating the opposite is not going to rid us of the facts. This is not an exercise in parliamentary sovereignty, but an abuse of this Parliament’s functions. It undermines the rule of law and the constitutional separation of powers. Yes, we are lawmakers and we can make and change the law, but the law cannot be used to change the facts.

Another fact is that the treaty with Rwanda, coupled with the Bill, breaches many of our obligations under international law. If that were in doubt in any way, the Government have helpfully outlined that fact throughout the entire Bill. Clause 3, for example, disapplies key sections of the Human Rights Act. It directly prevents the courts from applying the Bill in a way that is compatible with convention rights, it prevents any consideration of previous rulings of the European Court of Human Rights that have found Rwanda to be unsafe, and it removes human rights obligations from public bodies, including courts. The Bill would place an obligation on every single decision maker who has found Rwanda unsafe to simply rule it as safe. It restricts the courts’ ability to protect people who are at risk of harm, and it restricts individual legal protections. Do the Government fully understand what that means? Do they see how far they have sunk? Are they so fanatical about this flawed policy that they would bar courts from considering the very reasons why Rwanda might be unsafe, stripping people of individual legal protections?

From the very outset, this Bill has been ridiculous. Conservative Members would do well to note that there is no more empire. International law is not whatever we say it is; it is comprised of agreements and treaties adopted by Members of this House, and to dismiss them as the rules of foreign courts is as irresponsible as it is untrue. We signed up to those solemn and binding rules, so the Bill risks our international reputation and makes us hypocrites. How dare we condemn other countries that do not uphold international law, and how dare we preach to them, when we would undermine the rule of law ourselves? This Government do not really care about that, though. They care more about the squabbles of the Conservative party than our standing as a country.

If this Government were serious about resolving the issues surrounding small boats, they would do more to target people traffickers, and they would provide safe and legal routes. People do not take those perilous journeys for fun: they are often fleeing some of the worst persecution. They are some of the most vulnerable people in the world, not the Conservative party’s scapegoats. As has already been said, those who seek asylum from countries such as Ukraine and Hong Kong do not have to come by unconventional means because the Government have given them the ability to come by other means. The Government need to stop misleading the public with their use of the word “illegal”, because seeking asylum in this country is not illegal; it is not against any of our laws, domestic or international.

It is the Government who have exacerbated the problems in the asylum system, not the vulnerable people who are seeking asylum. We know this because the vast majority of claims are justified. After lengthy delays, three quarters of applications are accepted. The longer these processes drag on, the longer refugees and asylum seekers are prevented from rebuilding their lives in this country, and from working and contributing to our economy.

This Government have already spent hundreds of millions of pounds on a policy that is as crap as it is unworkable. [Interruption.] There is nothing more telling than the fact that the Secretary of State has been unable to make a section 19 statement. He could not say that this Bill was compatible with the European convention on human rights. The Home Secretary means to take us all for fools. For the second time this year, he cannot say that his plans for removing asylum seekers to Rwanda will not break international law. The Rwandan Government have been very clear. They have said that they will not continue with this deal if it does not meet the highest standards of international law. This Bill does not do that. This Government are wasting our time. This is not going to work, and I am not even sure it was meant to.

I am sick and tired of being dragged to this House to approve legislation that does nothing to improve the lives of my constituents or uphold the values of our society. This Bill should simply not be allowed to go any further.

I am very glad that the hon. Member has given way. I was not present when he referred to my speech, but I want to ask him if he really understands what the issues are. The Government, as he rightly said, already have the ability to reduce people’s citizenship, so why do they want to make it even easier, and why do they want to remove all checks and balances? This is where the concern arises. After what has happened to the Windrush generation, and after what has happened to the young people who—

I rise to speak in favour of the motion and to speak for those vulnerable people who have endured and are suffering the situation that we, as a major occupying force, have left behind. During the past few weeks, we have all been inundated with cases from constituents desperately seeking whatever help they can find for family members in Afghanistan. My office has been no exception.

Like other hon. Members, I would like to take the opportunity to thank my staff, and staff across the House, who have gone above and beyond the call of duty. Anyone who knows anything about this House knows that we are nothing without our staff; the past few weeks have been a testament to that. From British nationals trapped in Kabul to young children seeking to be reunited with their parents, siblings or grandparents, to former UK-contracted personnel stuck in hiding in fear for their lives, our offices have been presented with some of the most harrowing cases. Listening to them and reading them have profoundly affected people.

While those who are carrying out Operation Pitting on the ground are to be commended, it is worth noting that the Government received intelligence about the worsening situation in Afghanistan in July. We knew for a year that the withdrawal was happening. Glaring mistakes with neglected case inboxes and sensitive documents are a reminder that this could all have been prevented and that all blame is to be laid right at the Government’s door. We may never know the true effect of all the mismanagement, but the suggestion that 9,000 eligible Afghans entitled to settle in the UK have been left behind does nothing to ease the worried minds of my constituents.

I was appalled to read the Home Office letter. My hon. Friend the Member for Brent North (Barry Gardiner) has quoted from it, but it is worth quoting again: it says that

“we cannot provide to MPs assessments or updates on those individuals who remain in Afghanistan and whose cases they have raised.”

What exactly are we supposed to do with that? For weeks, our offices have done exactly as instructed when raising cases. We have endured the different email addresses, the briefings with few answers, the helpline numbers published wrong or with a digit missing, and all the failures in between. We did absolutely everything that we were asked to do by the Government—and now, nothing. To say that that is not good enough is a complete understatement. That is no way to run a Government, no way to treat colleagues, no way to treat our hard-working staff and certainly no way to treat vulnerable people who have been left in Afghanistan.

To add further insult to injury, the Government with their damaging legislative agenda seem hellbent on punishing people seeking refuge from war, violence and persecution. The hostile environment has meant that in the past decade the UK has deported more than 15,000 Afghan asylum seekers on the basis that Afghanistan was a safe place, yet we are meant to clap our hands for the Government saying they will repatriate 20,000 here over the next few years. There will inevitably be a rise in Afghan refugees, and the Nationality and Borders Bill, that disgraceful piece of legislation, will do nothing to alleviate it. I do not understand why the Government have not—

This month we marked the 73rd birthday of the NHS, and instead of celebrating it and giving it the homage that it deserves—the NHS, one of the very best things about our country—the Government have introduced a Bill that looks set to ramp up their long-standing attempts to continue to privatise it. I was proud to add my name to the reasoned amendment in the name of my hon. Friend the Member for Coventry South (Zarah Sultana) because we do not need private healthcare companies to sit on boards deciding how NHS funding is spent, further outsourcing of contracts without proper scrutiny, transparency and accountability, or the introduction of a model of healthcare that incentivises cuts and the closure of services.

Forcing NHS staff to implement yet another top-down Conservative reorganisation would take people away from the task of tackling growing treatment lists and coping with rapidly rising covid cases. We need to fill our 84,000 vacancies, and we need a 15% pay rise across the board for our NHS staff. It is hard to see how ordering a reorganisation such as this while ignoring calls for increased funding and a plan for social care could be anything other than disastrous.

This corporate takeover Bill—which is exactly what it is—will put private companies at the heart of the NHS and pave the way to sell off our confidential health data to multinational corporations. Nobody wants that. It will normalise the corrupt contracting that we have seen during the pandemic. The money that we spend on our healthcare should go to the services that we need, not to the pockets of Conservative party donors or corporate shareholders. Over the path of the pandemic, we have seen what this outsourcing and privatisation has meant in practice. Contract after contract awarded without competitive process. People being failed. Failing contracts. Delivery failed on again and again. Now the Government want to open up new ways for that to happen, just as they have done throughout the pandemic.

Let us consider what happened with Track and Trace, which was a complete disaster in the hands of Serco. The system has been so ineffective that, recently, MPs concluded that it had ”no clear impact”—a £37 billion system with no clear impact. After a decade of cuts, it was our NHS and its staff and volunteers who led the vaccination roll-out. That was a success, but it was their success, not the Government’s success. That is a lesson that we can learn about exactly what happens when we give the NHS the funding it needs, but the Bill does nothing to do that. We do not need more overpaid consultants involved the NHS; we need to value the staff we already have, and put in the investment that made the vaccination programme a massive success. We must be clear—

I will not be voting for this Bill. I do not believe it should even be permitted to proceed through this House, and I tabled a reasoned amendment to that effect. The Bill certainly should not proceed at this time, when we are in the midst of a global pandemic.

The Government’s approach is fatally flawed. In plain language, it puts the cart before the horse and post-Brexit immigration legislation before the legal, economic and trade relationship with the EU is in any way settled. Our relationship with the EU will remain our most important external economic relationship for years to come, and it is important to get that right. Our immigration system should fit into that, not the other way around. Worse still, the Bill is supplemented by a whole slew of Henry VIII powers.

My constituents did not elect me to this House to hand away the right to speak up for them and represent them on these issues. What does our democracy even mean if any Government are given the opportunity to make laws that so fundamentally affect people’s lives and the economy with little scrutiny and behind closed doors? That is essentially a constitutional power grab. No Government should be given a blank cheque that they can redeem any time they are in trouble or are tempted to whip up anti-migrant sentiment as a distraction. Who would trust this Government with these powers? Immigration policy brought in by this Government has been bad enough as it is.

This will be the second time in the past 10 years that a Conservative Government have retrospectively changed the rights of migrants after they have entered this country, lived here, settled here, had children here, opened businesses here and paid taxes here. The Government did it in 2014 to the Windrush generation, and we saw just how many suffered, but as they are pressing ahead with the Bill, it seems that no lessons were learned. The Government’s commitments on EU nationals’ rights are meaningless if not underpinned by primary legislation and if they are not granted automatic settled status. The Bill does neither.

We cannot continue to allow Governments to keep passing legislation like this. It leaves migrants and their children asking at what point their rights in this country—their home—are truly secure. Instead of giving reassurances and creating a migration system that is fair, respects human rights and benefits our economy, this Government have opted simply to subject EU nationals to the same failed and inhumane hostile environment policies that they have had for people from outside the EU.

Children born here and who have lived here their whole life are asked to pay more than £1,000 to be British. Families are split apart because of the arbitrary minimum income threshold. Data sharing with the Home Office makes the most vulnerable scared to use services. The Government continue with no recourse to public funds, even though the courts have ruled it unlawful and the coronavirus has proved it inhumane. They detain people for months on end, even the victims of torture and trafficking—longer than any other country in Europe —only to eventually release nearly 70% of them, allowing private companies to profit from their misery. This Bill and the Government’s points-based system end none of those things.

In fact, the Bill does not even help our work shortages. The Institute for Public Policy Research has shown that under the income threshold, 69% of EU nationals would not be eligible. To all those who call such workers “low skilled”, I say that those earning below the salary threshold are not low skilled at all. There is no such thing as low-skilled work; just low-paid work. All work is skilled when it is done well. Persisting down this line is a slap in the face to those many key workers who are low paid and who have been our backbone throughout this pandemic. How callous is it to bring forward the Bill without being sensitive to those matters?

We need a fair immigration policy that does not retrospectively strip people of their rights—an immigration policy that meets this country’s needs and ultimately ends the hostile environment. The Government are not in any way attempting to do that. History proved right those brave few who voted against the Immigration Act 2014, and I urge all Members to vote down this disgraceful piece of legislation today.
