Written Question
Employers' Liability: Asbestos
Thursday 1st December 2016

Asked by: Nusrat Ghani (Conservative - Sussex Weald)

Question to the Department for Work and Pensions:

To ask the Secretary of State for Work and Pensions, what steps his Department is taking to support businesses which are threatened with legal action from previous employees affected by asbestos is but are unable to trace any relevant employers' liability insurance policy.

Answered by Penny Mordaunt

The Employers’ Liability (Compulsory Insurance) Act 1969 requires most employers to insure against liability for injury or disease to their employees arising out of employment.

The Department for Work and Pensions does not provide financial support to businesses that face an employers’ liability compulsory insurance claim. Employers are strongly advised to keep, as far as is possible, a complete record of their employers’ liability insurance.
Businesses that fail to hold the necessary insurance details risk having to meet the costs of such claims themselves.
