The 1980 Limitations Act protects defendants when, for reasons of the passage of time, facts may prove difficult to establish. In cases involving pensions facts are often not difficult to establish. Victims may be left with no legal remedy when for valid reasons they do not notice an employers fraud or mistake until they are about to retire. This is often too late.
