Introduce fines for local authorities that lose SEND tribunals

I suggest that local authorities should be charged £5,000 for each case they lose at SEND tribunals, regarding educational, health and care (EHC) plans, to encourage them to get it right.

In 2020/2021 tribunals only upheld the LA's decision in 3.5% of cases that it decided. Courts found in favour of appellants in 96.5% of cases that it decided.

Parents are fighting to get their LA to provide a proper education for their children. Too often LAs try and provide the cheapest possible education for children, which can involve placing them in the nearest mainstream even if the school says they can not meet the needs of the child.
