Require consideration of family as part of the Mental Capacity Act 2005

This petition asks the Government to add a sixth principle to the Mental Capacity Act 2005 so that the family and familial relationships must be considered in the taking of an act, or making of a decision, under this Act.

Allowing for close family relationships is the purpose of the new principle. It could help allow families to stay in contact with management in care homes and independent living homes, even though their relative is suffering from mental health issues and may not recognise them or want to be in contact with them. It should also help ensure that family members who demonstrate genuine care are able to check up on their loves ones.
