We want the Government to make it a legal requirement for there to be a clinical assessment of an individual's mental capacity, and notification of a person's family, before ordinary power of attorney or lasting power of attorney (LPA) can be put in place or used.

We believe that under the current system it is too easy for power of attorney to be granted and used, and there are not adequate safeguards for checking a person's mental capacity, or ensuring family are notified when arrangements for power of attorney are made or used.
