Question to the Home Office:
To ask the Secretary of State for the Home Department, whether firearm licence holders are permitted to keep their firearm licence in the event of a pending decision by the CPS to prosecute that licence holder.
Responsibility for applying and enforcing firearms law is the responsibility of the police.
Firearm certificate holders are subject to continuous review and the Firearms Act 1968 gives the police the power to remove a person’s firearms and to revoke a firearm or shotgun certificate if they are not satisfied that the holder can be permitted to possess firearms without danger to the public safety or to the peace.
Whether a certificate holder is permitted to retain their firearms and certificate will depend upon the nature of any offence committed and any sentence imposed by the courts. Section 21 of the Firearms Act 1968 sets out the restrictions on the possession of firearms by persons convicted of crimes in England, Wales and Scotland.
