The Regulatory Reform (Fire Safety) Order 2005 applies to all non-domestic premises in England and Wales, including the communal areas of multi-occupied residential buildings. Local fire and rescue authorities are the enforcing authority for the majority of premises to which the Order applies and are required to have a risk based inspection programme and management strategy in place to ensure compliance in their area.

Article 25 of the Order sets out the instances where bodies other than fire and rescue authorities are the enforcing authority.
