Question to the Home Office:

To ask the Secretary of State for the Home Department, if she will investigate the request for the European Arrest Warrant issued for the parents of Ashya King.

No Ministers or Home Office officials have any involvement in decisions about whether to issue Arrest Warrants, nor did they have any involvement in the decision to issue an Arrest Warrant for Ashya King’s parents. The decision to seek an Arrest Warrant is an operational matter for the Police and the prosecuting authorities, in this case the Crown Prosecution Service. Any decision about whether to issue a warrant is a matter for a judge. The Director of Public Prosecutions told the Home Affairs Committee in her evidence on this matter on 14 October 2014 that at the time, the Crown Prosecution Service "reviewed the case" and "upon further evidence, reviewed it again" which led to them contacting Spain to request that the Arrest Warrant be discharged, which it was.
