Motorways: Fly-tipping

Question to the Department for Transport:

To ask the Secretary of State for Transport, what his Department's policy is on the removal of fly-tipping from motorway embankments.

The Highways Agency complies with the Environmental Protection Act 1990. This is supplemented by the Code of Practice on Litter and Refuse (2006). Paragraph 5.4 defines refuse, including fly tipped waste.

The Agency’s mandatory technical requirements adhere to the Code of Practice which applies a grading for refuse, and specifies standards of cleanliness and response times.

Any required restoration measures take place within the required timescales, in accordance with the Code of Practice. It specifies 14 days for slip road carriageways, their hard shoulders, verges and embankments. It specifies 28 days (or as soon as is reasonably practicable) for main line carriageways, their central reserves, hard shoulders, verges and embankments.
